Absent: Mayor John Monaco. PRE-MEETING - COUNCIL CONFERENCE ROOM - 12:00 P.M. AGENDA REVIEW STAFF PRESENTATIONS 1 Receive proposed budget presentations for the Finance, Information Technology, Housing and Community Services, Library and Community Development Departments. EXECUTIVE SESSION - EXECUTIVE CONFERENCE ROOM - 12:12 P.M. The City Council met in Executive Session pursuant to Section of the Texas Government Code to consider pending and contemplated litigation subjects or settlement offers ; whereupon, the City Council proceeded to meet in the Executive Conference Room. After the closed meeting ended at 12:31 p.m., the City Council reconvened in Open Session. No executive action was necessary. REGULAR CITY COUNCIL MEETING - CITY COUNCIL CHAMBER - 3:02 P.M. 2 SPECIAL ANNOUNCEMENTS (1) Mr. Porter congratulated Mrs. Ransome, 212 Norwich Lane, as the recipient of Keep Mesquite Beautiful, Inc., Yard of the Month award. (2) Ms. Roberts invited everyone to take advantage of the free summer events being offered such as Movies in the Park at City Lake Park, Music in the Park at Westlake Park and JazzBreaks on the Plaza at the Mesquite Arts Center. (3) Mr. Noschese expressed appreciation to the Municipal Court staff, Judge Stephen Crane and Assistant City Attorneys Paula Anderson and Cindy Steiner for the efficient work they perform for the citizens of Mesquite. (4) Mayor Pro Tem Pickett presented Manager of Solid Waste Charles Goodson with the Texas Public Works Association (TPWA) Solid Waste Manager of the Year Award. Mr. Goodson s public service towards citizens and his innovation were some of the attributes noted by TPWA in their selection of him for this prestigious award. CITIZENS FORUM Toni Mills, 3742 Gus Thomasson Road, representing the Texas Coalition for Compassionate Care, spoke in support of House Bill 594 regarding the affirmative defense for medical cannabis for patients. CONSENT AGENDA Approval of the Consent Agenda Mr. Noschese moved to remove Item No. 10 from the Consent Agenda to be considered separately. Motion was seconded by Mr. Porter and approved unanimously. Ms. Roberts moved to approve Item Nos. 2-9 and 11 on the Consent Agenda, as follows. Motion was seconded by Mr. Forsythe and approved unanimously. 2 Minutes of the regular City Council meeting held June 3, A joint ordinance of the, and the City of Balch Springs, Texas, ratifying and adopting an agreement between the cities, adjusting their common boundary line, the City of Mesquite releasing a certain parcel of land to the City of Balch Springs and the City of Balch Springs receiving that parcel of land from the City of Mesquite. (Staff recommends all bids be rejected and rebid at a later date.) 11 Authorize the Chief of Police to execute a Memorandum of Understanding with Dallas County among participating local governments for law enforcement juvenile data sharing via the TechShare.Juvenile Program. CONSENT AGENDA ITEM CONSIDERED SEPARATELY 10 Bid No Construction of DeBusk Park Pavilion. (Authorize the City Manager to execute a contract with Concord Commercial Services, Inc., in the amount of $168, ) Jay Thomas, 5061 Harrier Drive, representing Medtronix Solutions USA, LLC, stated that Medtronix was the low bidder for Bid No , Construction of DeBusk Park Pavilion, and was told by City staff they would not be awarded the bid due to their equipment and subcontractor s equipment not being satisfactory to perform the work, the work references submitted are not for projects of similar size, scope or cost of work and Concord Commercial Services, Inc., scored better due to numerous work references for projects of similar cost. He stated that Medtronix has completed work for municipalities in the past. They are cost effective, leverage technology and utilize supply chain management. He stated that their subcontractor has the necessary equipment and is in the process of being registered as an approved vendor with the City of Mesquite. Mr. Thomas requested that Medtronix prevail as the low bidder. Cliff Keheley, Director of Parks and Recreation, stated that the project was bid under the best value bid process which analyzes bids on a number of areas including the cost of project, experience of the contractor and timeliness of the project. The contractor did not provide enough information to ensure they had completed projects of similar scope and scale. A list of subcontractors, which could have been used as a reference to complete the analysis, had not been included in their bid packet. The product provided in Medtronix s bid packet was not approved by the architect prior to bid submittal as required in the bid process. Based on the information provided at the time of the best value process, Staff determined that another contractor would provide a better value or better quality project to the City. Mr. Sarfraz Taj, representing Medtronix Solutions USA, LLC, stated that during the bid process he provided the subcontractor information for a City of Garland project. Councilmembers encouraged Mr. Thomas and Mr. Taj to bid on future projects with the City. Mr. Noshese moved to award Bid No , Construction of DeBusk Park Page 4

5 Pavilion, to Concord Commercial Services, Inc., in the amount of $168, and authorize the City Manager to execute the contract. Motion was seconded by Mr. Tarpley and approved unanimously. END OF CONSENT AGENDA PUBLIC HEARING 12 Conduct a public hearing and consider an ordinance for Application No , submitted by Adam Atalla, for a zoning change from Service Station to Commercial with a Conditional Use Permit for the sale of used tires on property located at 1711 West Scyene Road. (No opposition to the proposed amendment has been received. The Planning and Zoning Commission recommends approval of the application with certain stipulations.) Mr. Noschese moved to postpone consideration of Application No , until the July 1, 2013, City Council meeting. Motion was seconded by Mr. Porter and approved unanimously. APPOINTMENTS TO BOARDS AND COMMISSIONS 13 Consider appointment of a Mayor Pro Tem and Deputy Mayor Pro Tem for one-year terms. Mr. Noschese moved to appoint Shirley Roberts as Mayor Pro Tem and Al Forsythe as Deputy Mayor Pro Tem for one-year terms. Motion was seconded by Mr. Porter and approved unanimously.
