14 ORDINANCE NO. AN ORDINANCE OF THE CITY OF LLANO, TEXAS AMENDING ZONING ORDINANCE NO. 735, SECTION 8B-1AND ESTABLISHING SPECIFIC USE PERMIT NO. ALLOWING A BEAUTY SALON IN A SINGLE-2 (SF-2) DISTRICT, PROPERTY AS DESCRIBED HEREIN; WITH STIPULATIONS DESCRIBED HEREIN; AMENDING THE OFFICIAL ZONING MAP; AND PROVIDING FOR A PENALTY, SAVINGS, SEVERABILITY CLAUSE; AND AN EFFECTIVE DATE. WHEREAS, at its meeting held on the 19 TH OF July 2018, the Planning/Zoning Commission did consider and make recommendations on a certain request for a Specific Use Permit to place a Beauty Salon in a Single Family 2 (SF-2) District. Physical address is Legal description is south addition, Block 15 N Pt of LT AC. WHEREAS, the City Council, after determining all legal requirements of notice and hearing have been met, has further determined the following amendment to the zoning laws would provide for and would be in the best interest of the health, safety, morals, and general welfare: NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LLANO, TEXAS. SECTION I. That Specific Use Permit No. is hereby established for the premises located at 1101 Hickory, Llano, Texas, and more specifically described on the attached Exhibit A, providing for the following use: Beauty Salon SECTION II. That development shall be in accordance with all special conditions, restrictions, and regulations. None SECTION III. That the official Zoning Map of the City of Llano shall be amended to reflect the provisions of this ordinance and in accordance with Section 20.2 of Ordinance No. 735 of the City of Llano, Texas. SECTION IV. That any person, firm or corporation violating a provision of this ordinance, upon conviction, is guilty of an offense punishable as provided in the City of Llano Ordinance No. 735, as amended, by a fine not to exceed one thousand dollars ($1,000); and each day or portion thereof during which the violation is committed, continued or permitted shall be a separate offense.

15 SECTION V. That if any section, sub-section, paragraph, clause, phrase, or provision of this ordinance shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of this ordinance as a whole or any part or provisions hereof, other than the part so decided to be invalid or unconstitutional. SECTION VI. That Ordinance No. 735, otherwise known as the Zoning Ordinance of the City of Llano, as amended, shall remain in full force and effect. SECTION VII. The Zoning Ordinance No. 735, as the same has been heretofore amended, is hereby further amended so as to rezone properties L I & F BLK 139 LT 1 & PT OF LTS 2-4 and L I &F BLK 139 LTS to the city of Llano from single family -2 (SF-2) to commercial to the City of Llano, Llano County, Texas. Section II. It is directed that the official zoning map of the City of Llano be changed to reflect the zoning classification established by this Ordinance. Section III. All provisions of the ordinances of the City of Llano in conflict with the provisions of this Ordinance are hereby repealed, and all other provisions of the ordinances of the City of Llano, not in conflict with the provisions of this Ordinance, shall remain in full force and effect. Section IV. The repeal of any ordinance or part of ordinances effectuated by the enactment of this Ordinance shall not be construed as abandoning any action now pending under or by virtue of such ordinance or as discontinuing, abating, modifying or altering any penalty accruing or to accrue, or as affecting any rights of the municipality under any section or provisions of any ordinance at the time of passage of this Ordinance. Section V. Any person, firm or corporation violating any of the provisions or terms of this Ordinance shall be subject to the same penalty as provided for in Ordinance No. 735, as amended, of the City of Llano, and upon conviction, shall be punished by a fine not to exceed the sum of One Thousand Dollars ($1,000.00) for each offense, and each and every day such violation shall continue shall be deemed to constitute a separate offense. Section VI. It is the intention of the City Council that this Ordinance, and every provision thereof, shall be considered severable and the invalidity of any section, clause or provision or part or portion of any section, clause, or provision of this Ordinance shall not affect the validity of any other portion of this Ordinance. Section VII. This Ordinance shall become effective immediately upon its passage and publication as required by law. 28 xc Agenda Item Report July 19, 2018 Agenda Item D-4 Contact Toni Milam, x 107 tmilam@cityofllano.com AGENDA TITLE: Discuss and consider action on making a recommendation to the City Council on the approval of an Ordinance amending the Code of Ordinances, Chapter 110, Article 1, Section and Article II, Section BACKGROUND/HISTORY Prior to former Mayor Mike Reagor leaving office, he had requested a review of the zoning ordinance, Chapter 110 be done by the City Attorney s office to determine provisions in the zoning ordinance and to check for provisions that were more stringent than state law requires. After a review of the current zoning ordinance, Chapter 110, Article 1, Section and Article II, section , the City Attorney advised there were provisions in the zoning ordinance that exceeded the requirements with those set out in the Chapter 211 of the Texas Local Government Code. By aligning the City s requirements with those set out in state law it would give the City more flexibility. The State does require notification be sent to property owners, however, at 200 feet rather than 300 feet. City Council passed the previous ordinance whereby only eliminating the requirement of sending notification letters by registered/return receipt, but could send by regular USPS. 2. FINDINGS/CURRENT ACTIVITY Under the attached proposed revision (as prepared by the City Attorney s office) to the current zoning ordinance, Chapter 110, Article 1, Section and Article II, Section , the City would not be required to send notification letters to property owners within 300 feet, but rather only 200 feet within distance of the property and still meet the state requirements. It would also eliminate the current ordinance requirements of requiring signage be placed at the property, advising of a public hearing, meeting the state requirements. Upon conviction, the violator shall be fined a sum not to exceed two thousand and no/100 dollars ($2,000.00) every day that such violation or non-compliance exists. The City of Llano may also institute any appropriate action or proceedings in any court having jurisdiction to prevent, restrain, correct, or abate, or to prevent any illegal act, conduct, business, or use of any land by any person, firm, or corporation. The definition of any violation of the terms of this chapter as a misdemeanor shall not preclude the City of Llano from invoking any civil remedies allowed by law or equity in such cases, but shall be cumulative of and in addition to the penalties prescribed herein for such violations. II. Chapter 110; Zoning, Article II, Administration, Section of the Code of Ordinances of the City of Llano, Texas is amended to read as follows: Sec Public hearing and notice. (a) Prior to making its report to the city council, the planning and zoning commission shall hold at least one public hearing on each application. (b) Before the fifteenth (15 th ) day before the date of the public hearing, notice of the time and place of the hearing must be published in the official newspaper of the City or a newspaper of general circulation in the City. (c) Before the tenth (10 th ) day before the date of the public hearing, written notice of each public hearing before the planning and zoning commission on a proposed change in a zoning classification shall be sent to each owner, as indicated by the most recently approved municipal tax roll, of real property within two hundred (200) feet of the property on which the change in classification is proposed. The notice may be served by its deposit in the City, properly addressed with postage paid, in the United States mail. The provisions of this Ordinance shall be cumulative of all other ordinances or parts of ordinances governing or regulating the same subject matter as that covered herein; provided, however, that all prior ordinances or parts of ordinances inconsistent or in conflict with any of the provisions of this Ordinance are hereby expressly repealed to the extent that such inconsistency is apparent. IV. If any section, subsection, sentence, clause, or phrase of this Ordinance is, for any reason, held to be unconstitutional or invalid, such holding shall not affect the validity of the remaining portions of the Ordinance. It is the intention of the City Council that this Ordinance, and every provision thereof, shall be considered severable and the invalidity of any section, clause or provision or part or portion of any section, clause, or provision of this Ordinance shall not affect the validity of any other portion of this Ordinance. AN ORDINANCE AMENDING ZONING ORDINANCE NO. 735 OF THE CITY OF LLANO, AS HERETOFORE AMENDED, SO AS TO REZONE FROM NORTHERN BUSINESS DISTRICT (NBD) TO COMMERCIAL (COM) IN THE L I &F BLK 138 LTS CHANGE TO BE MADE ACCORDINGLY TO THE OFFICIAL ZONING MAP OF THE CITY; AND PROVIDING A PENALTY CLAUSE, A SEVERABILITY CLAUSE AND AN EFFECTIVE DATE. WHEREAS, the City Secretary of Llano, Texas, directed that notices of a hearing be issued, as required by the Zoning Ordinance of the City of Llano and laws of the State of Texas, at a meeting of the Planning & Zoning Commission, to be held on the 19 TH day of July 2018, for the purpose of considering a change in the Zoning Ordinance; and, WHEREAS, the City accordingly caused to be issued and published the notices required by its Zoning Ordinance and laws of the State of Texas applicable thereto, the same having been published in a paper of general circulation in the City of Llano, Texas, at least twenty (20) days prior to the time set for such hearing; and, WHEREAS, the Planning & Zoning Commission, pursuant to such notice, held its public hearing and heard all persons wishing to be heard both for and against the aforesaid change in the Zoning Ordinance, on the 19 TH day of July 2018; and, WHEREAS, the Planning & Zoning Commission, on the 19 TH day of July 2018, recommended the requested change in the Zoning Ordinance; and, WHEREAS, the City Secretary of Llano, Texas, directed that notices of a hearing be issued, as required by the Zoning Ordinance of the City of Llano and laws of the State of Texas, at a meeting of the City Council, to be held on the 6 TH day of August 2018, for the purpose of considering a change in the Zoning Ordinance; and, WHEREAS, the City accordingly caused to be issued and published the notices required by its Zoning Ordinance and laws of the State of Texas applicable thereto, the same having been published in a paper of general circulation in the City of Llano, Texas, at least twenty (20) days prior to the time set for such hearing; and, WHEREAS, the City Council, pursuant to such notice, held its public hearing and heard all persons wishing to be heard both for and against the aforesaid change in the Zoning Ordinance, on the 6th day of August 2018; and, WHEREAS, the City Council is of the opinion and finds that such change would not be detrimental to the public health, safety, or general welfare, and will promote the best and most orderly development of the properties affected thereby, and to be affected thereby, in the City of Llano, and as well, the owners and occupants thereof, and the City generally; and,
