1 Beaverton 0 R E G 0 N City of Beaverton CITY COUNCIL MINUTES BEAVERTON CITY COUNCIL REGULAR MEETING DECEMBER 4, 2018 CALL TO ORDER ROLL CALL The Regular Meeting of the was called to order by Council President Lacey Beaty in Beaverton City Hall, City Council Chamber, SW Millikan Way, Beaverton, Oregon, on Tuesday, December 4, 2018, at 6:30 p.m. Present were Councilors Cate Arnold, Lacey Beaty, Betty Bode (via telephone until 8:00 p.m.), Mark Fagin; and Marc San Soucie. Mayor Denny Doyle was excused. Also present were City Attorney Bill Kirby, Community Development Director Cheryl Twete, Mayor's Office Director Abigail Elder, Public Works Director David Donaldson, Assistant Finance Director Dave Waffle, Vision Advisory Committee (VAC) Staff Liaison Victor Sin, Development Division Manager Cadence Petros, and City Recorder Catherine Jansen. Council President Beaty read a letter of thanks to Councilor Bode, as it was her last meeting as an elected official for the City of Beaverton since her term expires on December 31, She reviewed Councilor Bede's 25-year history of service to Beaverton, including 16 years as a City Councilor and nine years as a volunteer on various City boards, prior to being elected to Council. On behalf of the City Council and the City, she thanked Councilor Bode for her service. Councilor Bode shared her joy in serving the City and working with the many Councilors she worked with over the years. She thanked the citizens for electing her through four elections. PROCLAMATION Council President Beaty announced December 10, 2018, was proclaimed Human Rights Day by Mayor Doyle and Councilor Arnold read the proclamation. Commander Kelly Jones, Washington County Sheriffs office, received the proclamation. He said he was a member of the Human Rights Council of Washington County for the past three years. The Human Rights Council of Washington County will be hosting an annual celebration of Dr. Martin Luther King, Jr., on January 19, 2019, at the Glenn and Viola Walters Cultural Center in Hillsboro. He thanked them for the proclamation. Vice Chair Cameron Monfared, Human Rights Advisory Commission (HRAC), and Marilyn McDonald, HRAC member, thanked the City Council for the proclamation. Starting December 9, 2018, there will be a Human Rights display at the Beaverton Library. Mr. Monfared noted Ms. McDonald's last HRAC meeting would be in December and he thanked her for all her years of service on HRAC and for being the guiding member.
2 Page No. 2 PRESENTATIONS Visioning Advisory Committee Annual Report Vision Advisory Committee (VAC) staff liaison Victor Sin, and Chair Meng Chen, VAC, gave the annual report for the VAC (in the record). Councilor San Soucie, Council liaison to the VAC, thanked them for the annual report. He said the VAC members were dedicated and doing great work. He said his first major vote as a Councilor in December of 2008 was to authorize the creation of both the visioning program and the VAC. Councilor Fagin thanked them for their work. He said the VAC was the first board he served on for the City and he was the first chair. The outreach phase was a lot of work and the VAC does well. Without the community vision there was no mechanism for people to tell the Council or the City what they would like for the community. He said one reason he became interested in running for Council was to make sure the community vision continued. Councilor Arnold said one of the VAC's successes was that the visioning produced a living active vision for the community. The VAC makes sure partners are stepping up to fulfil important pieces that the City wants to work on. This was a vibrant, successful committee. Councilor Beaty thanked them for the important work they do District 4 Metro Update by Metro Councilor Kathryn Harrington Metro Councilor Kathryn Harrington updated the Council, for the last time, on Metro activities (in the record). She said she has appreciated the Council sharing their time with her during Council meetings. She encouraged the Council to invite the next Metro 4 Councilor, Juan Carlos Gonzalez, to provide updates for Metro. She thanked the Council for their role in supporting the Metro bond, Measure 102, and Measure Councilor Arnold confirmed Metro was working with the jurisdictions throughout the region and industry partners to figure out a solution for plastic waste long term. Councilor Fagin thanked Councilor Harrington for taking the time to report to all the cities throughout the region for the past 12 years. He said she brings information that people do not normally get without going to the Metro website. He thanked her for her service and all she has done for the community, and he looks forward to working with her in her new role as Washington County Chair starting in January Councilor Beaty thanked her for her time investment in the City State Legislative Review Gwenn Baldwin, Baldwin Consulting LLC, reviewed the upcoming 2019 State Legislative Long Session. On January 14 all the bills are introduced and read; on January 22 the legislature comes back to begin work on the bills. The Session ends on June 30, unless it has to be extended. Big policy issues up for review were: 1) Revenue reform for education; 2) Tax reform for income and corporate taxes; 3) PERS reform - a significant portion of revenue for education would be taken by increases in PERS costs; 4) Carbon reduction, and cap and trade; 5) Housing supplies and tenant protection; and 6) Medicaid-filling the funding
3 Page No. 3 gap. Other issues include: Paid family leave; unanimous jury decisions; and gun control. The City will not know its level of participation until the bills are available. The City's areas of interest include City finance and operations; Land Use and Housing; and Infrastructure and Economic Development. She thanked the City Council for the privilege of working on behalf of the City and the residents of Beaverton. She extended her best wishes to Councilor Bode and said she would be missed. Councilor Bode said it was important to look at the housing stock and services for those in need of housing at the state and city level. Another important topic was the continued funding of the infrastructure and transportation. She said it had been a pleasure working with Ms. Baldwin, who was an outstanding individual representing Beaverton. Councilor San Soucie thanked Ms. Baldwin for the update. He said another area of interest was the municipal water supply and asked that she keep that on her radar for City staff and Council to participate and testify as needed. Councilor Beaty asked that Beaverton's voice be heard on tenant rights and responsibilities that may differ from Portland's needs. She wanted to be kept informed of times a Councilor could come testify for this topic Annual Report on Federal Legislative Agenda Joel Rubin, Partner CFM Strategic Communications, Inc., and Michael Skipper, CFM Federal Affairs Associate, reviewed the City's 2018 Federal agenda covering grant and lobbying efforts, and previewed what was ahead for 2019 (in the record). The City was successful in securing two of the three applications, totaling $900,000. There was much work behind the scenes to get these grants. This work involved showing the City of Beaverton was a good steward of federal resources by delivering on the project, having community support, and active engagement from the congressional representatives, and state representatives, like DEQ. In addition to the grant support, CFM also worked on policy and other issues, such as: All-American City Submission (finalist); Low-Income Housing Tax Credit; NMFS Reasonable and Prudent Alt (RPA); Community Development Block Grants; HOME Partnership (Housing); BYRNE Justice Assistance Grants; and FY 2018 Funding for BUILD, Rail, Economic Development, Brownfields and Mental Health. City projects for 2019 included: Quiet Zone Project (Railroad Crossings within Beaverton); Patricia Reser Center for the Arts (PRCA); Water Efficiency and Irrigation Project; Water Resiliency Project; Digital Health Collaborative Equipment; and PRCA Art Installation Project. Councilors San Soucie and Arnold thanked Mr. Rubin and Skipper for their comprehensive work on behalf of Beaverton. Councilor Fagin thanked them for the update and asked for them to be aware of opportunities for Beaverton, as projects evolve at the federal level and federal funds become available. Councilor Beaty thanked them for doing a fantastic job on securing grants and funds for the City, adding Council appreciated the updates, in person and in s. She would like the City to look at more transportation options and new technology for ride share opportunities, and encouraged them to look for these opportunities at the federal level.
4 Page No. 4 VISITOR COMMENT PERIOD Ellie Younger, Young Climate Action Coordinator for imatter, and Isabel Lemus Kristensen, Beaverton, spoke on a climate action plan. They shared a resolution on a climate action plan with the City Council and asked for Council support. They submitted copies of the resolution to the City Recorder and were asked to their request to Council. It was also suggested they contact the State Legislature because this issue would be discussed in this coming session. Bryce Mclaughlin, Beaverton, referred to Agenda Bill 18263, Ordinance No. 4748, regarding community involvement in signature gathering for the initiative process. He asked that the time period to gather signatures be left at two years and not reduced to six months. COUNCIL ITEMS STAFF ITEMS There were none. Public Works Director David Donaldson thanked the Beaverton community for participating in the leaf drive; it was a record year. They collected 4,250 pounds of food to donate to the food bank. (4:0) ACTION ITEMS Resolution No. 4549: Adopt Resolution to Provide Limited System Development Charge Relief to Proposed Affordable Housing Projects Development Division Manager Cadence Petros gave a staff report covering the two Agenda Bills and on affordable housing (in the record). Agenda Bill was for adoption of a resolution providing limited System Development Charge (SOC) relief for regulated affordable housing projects. Agenda Bill covered the third update to the Five-Year Action Plan which indicated the City's priorities for housing. Councilor San Soucie said the Five-Year Action Plan was a good document that provides information on what Beaverton was trying to do on its own and with partners in the area on housing at all cost levels. He thanked staff for the Plan. On page 14 and 15, he said it was helpful to note the City authorizes the hiring of additional bicycle officers for the police department, who are the first contact with people camping around the city. On page 29, the budget, he said the total figure could go up if other opportunities are identified or partner opportunities arise. Regarding the Metro GO bond of $652.8 million (page 21), he wanted to see the anticipated amount Beaverton would receive directly. Councilor Beaty thanked staff for the work on the SOC portion. This was formal invitation for the City's partners to join the effort to extend the bond proceeds dollar amount. Councilor Fagin thanked staff for the wording in the SOC resolution; it was non-threatening and showed the importance of making affordable housing work in the area. The Five-Year Action Plan was a wonderful document.

(4:0) Adoption of Fiscal Year Housing Five-Year Action Plan Councilor San Soucie MOVED, SECONDED by Councilor Fagin to Adopt the Fiscal Year Housing Five-Year Action Plan as presented in Agenda Bill Councilors Arnold, Beaty, Fagin, and San Soucie voting AYE, the MOTION CARRIED. (4:0) ORDINANCES First Reading Ordinance No : An Ordinance Amending Beaverton Code Chapter 7.10 Relating to Secondhand Dealers Ordinance No. 4750: An Ordinance Relating to the Acquisition of Property Amending Beaverton City Code Chapter Ordinance No. 4751: An Ordinance Amending Ordinance No. 2050, the Zoning Map, ZMA , The Vineyard at Cooper Mountain PUD, Zoning Map Amendment (Map: 1S131, Tax Lots: 1600, 1605, and a portion of 1900) Councilor San Soucie MOVED, SECONDED by Councilor Fagin that the Ordinances embodied in Agenda Bills 18286, and be read for the first time by title only at this meeting and for the second time by title only at the next regular meeting of the Council. Councilors Arnold, Beaty, Fagin, and San Soucie voting AYE, the MOTION CARRIED. (4:0) City Attorney Bill Kirby read Ordinance Nos. 4749, 4750, and 4751 by title only for their first reading. Councilor San Soucie said Ordinance No states Beaverton Code Chapter 7.08 and it should be The City Attorney said this would be corrected for the second reading (scrivener's error). Second Reading and Consideration of Adoption Ordinance No : An Ordinance Relating to the Engineering Design Manual and Repealing Ordinance Nos. 4060, 4303, 4417, 4155, and 4157 City Attorney Kirby read Ordinance No by title only for its second reading. (4:0) Ordinance No. 4748: An Ordinance Amending the Beaverton Election Code, Beaverton Code Chapter (*After discussion, action on adoption of this ordinance was deferred to January 8, 2019.) City Attorney Kirby read Ordinance No by title only for its second reading. Councilor San Soucie MOVED, SECONDED by Councilor Fagin that Ordinance No now pass. Councilor Arnold said past citizen initiatives have caused problems, disruption and were costly because they were poorly written. On the other hand it was important for the citizens to have the opportunity to participate. She said two years was too long for signature gathering and would rather have signature gathering for nine months to one year. Councilor San Soucie said he was comfortable with six months. He said initiatives or petitions are submitted by individuals or a group and once they are submitted there can be no changes or modifications. It becomes a yes-or-no process that was difficult to change. The legislative process allows for discussion, public hearings, and modifications before something goes into action. Councilor Fagin said after hearing the testimonies at the public hearing, Council decided four months was too short, but six months was workable. Councilor Beaty said she would not support the ordinance because six months was too short to collect signatures. She said multiple realms to address laws in the community were needed. A year would be more appropriate for signature collecting for an initiative petition. Councilor Arnold said in the 1980s two Beaverton initiatives happened that could be or were destructive: 1) switched to a strong mayor form of government which could potentially have problems, and 2) all citizens needed to vote for urban renewal development and if a person did not vote it was considered a no vote. The City Attorney was asked if this motion resulted in a tie vote and the Mayor was not here to break the vote, what would happen. Mr. Kirby said it would fail due to lack of a majority and to make a change the process would have to start over. Motion to Adopt Withdrawn: Councilor San Soucie withdrew the motion that the ordinance pass, and the seconder, Councilor Fagin, agreed. *Councilor San Soucie MOVED, SECONDED by Councilor Beaty to defer Ordinance No to a date certain of January 8, 2019, the next City Council meeting. Councilors Arnold, Beaty, Fagin, and San Soucie voting AYE, the MOTION CARRIED. (4:0) COUNCIL NEW BUSINESS/COUNCIL AND MAYOR DISCUSSION There was no new business or further discussion before the Council.
8 Page No. 8 EXECUTIVE SESSION Council President Beaty announced the Council was adjourning into Executive Session in accordance with ORS (2)(e) to conduct deliberations with persons designated by the governing body to negotiate real property transactions, and in accordance with ORS (2)(h) to consult with counsel concerning the legal rights and duties of a public body with regard to current litigation or litigation likely to be filed. Pursuant to ORS (4) it is Council's requirement that the items discussed not be disclosed by media representatives or others.
