Update KACM Blackboard THE PRESIDENT S CORNER By Bettina Jamerson Happy Fall! What a great conference we had in Wichita. Thank you so much Education Committee and all the KACM members that helped make it a memorable conference. The hotel was very nice and conveniently located for restaurants, shops and the Melodrama. We had some great speakers. Who knew you could get exercise out of laughter, what a hoot! The Newton Detectives were very informative sharing their knowledge of drugs and their effects. What unimaginable physical changes those meth users underwent and in such a short period of time. It s always great to have Marcy and her assistants come and answer our DMV questions, especially this year with the electronic filing. We learned some self defense tactics in How to Survive an Attack and even had some laughs doing it. Mark Gideon shared his tips on simplifying our lives with humor and interactive activities. He was wonderful and I d love to have him back. I spoke with Mark after his presentation. He s from my hometown of Springfield, MO. We got to talking and came to realize the brother he spoke of in his presentation, papa, he was my Liberty and Law teacher my senior year in high school. What a small world. We had some new vendors this year which was nice to have, Schwaab Marking & Identity Products, Cardinal Tracking, Inc. and Kansas Correctional Industries. We had longer breaks this conference to allow our members more time to visit with the vendors. Plus giving you time to peruse the Silent Auction and Promotions table. We had new products this year at our Promotions table; a new logo and some business casual shirts that you could wear to your office. Thank you Promotions Committee! Candy Westhoff (Girard) did a great job with the Silent Auction bringing in $ for the Polly Mains Scholarship Fund. With Carla Rains (Wellington) help on the 50/50 pot we raised another $ for the scholarship fund. Good job ladies! And speaking of Carla Rains, she was awarded the Outstanding Court Clerk Award. The food was great and we shared a lot of laughs during the Melodrama. We even had participation from our membership, Rona Downing (Atchison). She was asked by the cast to participate and she made us proud; that s some great acting skills Rona! I want to thank those members that have signed up to serve on committees. We re excited about all of you who have decided to volunteer for the first time. And I appreciate those die-hard members that have been serving for some time or have decided to serve again after a brief hiatus. I do want to mention that we are in dire need of a chair for the Membership Committee. If you have any questions about the position and what it entails I m sure Rod Edmondson (Baxter Springs) would be happy to answer them. I hope you ve marked your calendars for the Spring Conference in Hutchinson, April 3 & 4, And in the meantime, enjoy your holidays and make every day a great day! Bettina Jamerson DUI, Whodunit?? In Abbotsford, Wis., in August, Harvey Miller, 43, and Edwin Marzinske, 55, were both ticketed for DUI while driving the same car. Miller has no legs but was steering; Marzinske was operating the foot pedals. Hence, both men argued to police that neither of them was, by himself, "operating" the car. [Wisconsin Rapids Daily Tribune, ] 2007 Conference THANK YOU THANKS TO EVERYONE Who made the 2007 conference such a success! It could not have been done without each of you and also everyone who came to the conference. As you can tell from the evaluations; the location, speakers, and activities were enjoyed by many. On the evaluations is a list of things that would like to be seen in the future. Some of those I need input on from whom ever wrote them. Would the one who wrote about the gangs, please call me. ( ) The one who wanted more input from DMV on wants, needs, and requirements, please call. The one who wanted a link to the website on vehicle inspections, please call. Thanks! Each year the Education Committee tries to meet the needs of the clerks. For your information, in the Spring, the speaker will talk about building relationships in the work place, DMV will be there again, and a talk on appeals and what is legal and ethical will be discussed. So we re trying to meet your needs and wants. ~ REMEMBER ~ Spring Conference is April 3 & 4, 2008 at the Grand Prairie Hotel in Hutchinson. Only those who have not had 2 years of training can attend the April 3 training of new clerks. April 4 th will be the conference for everyone. Fall Conference is September 18 & 19, 2008 at the Courtyard by Marriott in Junction City. This is a non-smoking hotel with a noon check out! The cost is $89/night plus taxes. Hotel reservations must be made by August 18, 2008 and early bird conference reservations are due on the same date.

3 VOLUME 50 THE K.A.C.M. DOCKET PAGE 3 DUI No Moped License: SB 35 prohibits a person with a DL suspended because of a DUI from obtaining a moped license. Collection Costs Can be Assessed to the Defendant: SB 31 was amended late in the session to include a provision allowing municipal courts to use collections services to collect fines, fees and restitution (which we always felt wecould do anyway), but more importantly, it allows that court to assess the cost of collection back to the defendant. It also allows any beneficiary under an order of restitution to make use of the court collection program to collect restitution. In addition, whenever there is an order of restitution, amounts collected by the collection agency must first go to collection expenses and then to restitution before any court debt is collected. (quoted from The Verdict, Summer 2007). Seat Belt Fine Change: Remember that SB 8 (which amends K.S.A and is reflected in STO 182.1) sets a new fine amount for seatbelt violations as of January 1, Previously, officers were required to give warning tickets for persons age without proper seatbelts; beginning in 2008 a $60 fine applies. As a side note, the fine for persons over 18 years of age in a front seat remains at $30. Don t forget that these fines amounts include court costs. Passenger Can Challenge Consitutionality Of Traffic Stop: In Brendlin v. California US (June 18, 2007), the United States Supreme Court held that when police make a traffic stop, a passenger, like the driver, is seized for Fourth Amendment purposes and may challenge the stop's constitutionality. Request For Counsel Must Be Made After Completion Of Breath Test To Be Effective: In State v. Tedder Kan.App. (July 20, 2007): Request for counsel must be made after completion of the breath test before there can be a violation of the defendant's statutory right to speak with attorney. Legislative Update Implied Consent Notice Provisions Are Mandatory, Not Directory: State v. Kogler Kan.App. asked Court to suppress breath test results. Defendant arrested for DUI. When taken to station for breath test, he was read outdated implied consent advisory (using the five year lookback rather than current consent based on convictions over lifetime). Defendant agreed to take test. Even though, in this circumstance, defendant was not harmed, Court found notice provisions were mandatory and had to be substantially complied with, whether effect harmful or not. STO/UPOC Amendments Only for cities using the Standard Traffic Ordinances / Uniform Public Offense Code. STO 30 - DUI Felony Jurisdiction: During the 2007 term, the Legislature passed a law authorizing municipal courts to handle third and subsequent DUI offenses, which are felonylevel offenses. However, the League of Municipalities declined to include the change into STO Section 30 which would be necessary to act on that authorization. Without that change, cities prosecuting under the STO will continue to have jurisdiction over only first and second DUI s. The League is of the opinion that including a felony-level offense would raise significant legal (perhaps constitutional) problems and potential expense issues. Thus they advise against it. STO Headphones/Television-Devices with Driver: The Legislature repealed the State prohibitions against driver use of certain headphones, and against the presence in a vehicle of a television-type receiver so situated as to be in the view of the driver. However, in the STO the League has eliminated only the provision as to television-type receivers and has left in the headphone prohibition, which would then have status as just a purely local regulation, and would not require reporting to the state. Legislative Update (continued from page 3 ) UPOC 11.2,3 - Promoting Obscenity; Promoting Obscenity to Minors: These provisions have not previously been part of the UPOC, in part due to constitutional problems in the related State statutes. Those constitutional problems are now believed to be corrected. Some cities have concluded that obscenity prosecutions are complicated at best, and involve issues (such as community standards as to what is or is not obscene ) which perhaps are best left to juries to decide. Any conviction on such a charge in a municipal court would likely be appealed to the District Court for a jury trial, and then the City would have to bear the costs of prosecution. Therefore, some cities have not adopted this provision of the UPOC. Theft?? Louisiana prosecutors want the death penalty in the first trial for accused serial killer Sean Gillis, but to get that for an individual murder, state law requires an "aggravating circumstance" beyond the murder, such as kidnapping or robbery. At an August hearing, a prosecutor said Gillis had actually "robbed" his first victim, in that he had absconded with one of her arms and part of a leg. Gillis' lawyer argued that that was not "robbery," in that those parts were merely "left over" from the homicide. [Town Talk (Alexandria, La.)-AP, ]

Additions to Agenda None MINUTES AND TREASURER REPORT The minutes from the Board Meeting of July 20, 2007 were presented as printed in the K.A.C.M. newsletter and available in registration packets. Barb Nelson (Ottawa) motioned that minutes be approved as written; Jeanette Ward (Hiawatha) seconded. Motion carried. The Treasurer s Report was presented by Treasurer, Kristi Orbin (Shawnee). The report provided in the registration packets reflected an account balance of $17, Expenses from this fall s conference that have not yet been paid include guest rooms for speakers and K.A.C.M. President, scholarship recipients, hospitality suite, conference meals, food and drinks for hospitality suite. Expenses for the Melodrama have already been paid. Evelyn Thomas (Topeka) motioned to accept the Treasurer s Report; Sherri Adams (Pittsburg) seconded. Motion carried. CORRESPONDENCE A thank you card was received from Connie Sams (Ottawa) for the flowers sent for her knee surgery. COMMITTEE REPORTS Ambassador Debra Metzger (Lyons) No report. A new chairperson is needed for this committee. Courtesy Barb Nelson (Ottawa) Connie Sams (Ottawa) will be having replacement surgery on her other knee. This committee is looking for a person from each region to assist with making contacts. Education Jeannine Hoheisel (Hesston) There are 115 court clerks registered for the fall conference; 110 persons signed up to attend the Melodrama.

She thanks those who helped for this conference. This committee is looking for a new chairperson and additional committee members. Legislative Greg Nickel (Newton) Sheila Hopkins (Prairie Village) reported that she will serve as chairperson since Greg is now doing the newsletter.. Membership Rod Edmondson (Baxter Springs) Rod thanked Shelly Allenbach (Moundridge), Amy Hankins (Gardner), and Hillary Pappan (Winfield) for their help with conference materials. There are currently 307 K.A.C.M. members; 35 new members since the last conference. Rod has been chair of this committee for 5 years and is looking for a new chairperson due to his having other City responsibilities. Newsletter Greg Nickel (Newton) No report. Promotion/Sales Amy Spitler (Hutchison) There are several new items for sale this year. The committee could use new members with creative ideas for merchandise. Scholarship Candy Westhoff (Girard) Two clerks are attending the conference on scholarships; Pam Martin (Galena) and Paula Fleming (Gossel). Manual Toni Rogers (Haysville) Manual updates were distributed spring The committee will meet next year; please notify the committee or Toni of any mistakes or other updates that need to be made. Past Presidents Committee - Sherri Adams (Pittsburg) No report. Historian Candy Westhoff (Girard) The committee will be taking pictures during the conference. OLD BUSINESS Three names are presented for lifetime memberships: Sherri Stevens (LaCrosse) retired June 30, 2007; court clerk since 1987 Karen Kuffler (Parsons) retired August 1, 2007; court clerk since 1996 Phyllis Gillihan (Olathe) retired September, 2005 Linda Engel (Oakley) motioned that these names be accepted for lifetime memberships; Toni Rogers (Haysville) seconded. Motion carried. NEW BUSINESS It was mentioned that Debbie Pickell (Gardner) will be retiring in January 2008 after 20 years as a court clerk and 30 years with the City of Gardner. Sherri Adams (Pittsburg) presented the annual Outstanding Court Clerk Award to Carla Rains (Wellington). Sherri Adams (Pittsburg) presented the Slate of Officers and asked for any additions from the membership. Board of Director s meeting was held Friday, September 21, 2007 at the Old Town Courtyard by Marriott in Old Town in Wichita, Kansas. President, Bettina Jamerson (Prairie Village) called the meeting to order. CORRESPONDENCE No report. COMMITTEE REPORTS Ambassador Debra Metzger (Lyons) No report from chair person. Debra Metzger will stay on as chairperson; an additional ambassador is needed for regions 1 and 6. There was a suggestion to have a mixer at the next conference with a format that would give members an opportunity to meet other clerks in their region. Courtesy Barb Nelson (Ottawa) No report. Education Jeannine Hoheisel (Hesston) Jeannine extended a thank you to members of the committee for all their help with the fall conference; committee did an excellent job and feedback from membership indicates the conference was a huge success; members enjoyed the speakers and had a good time at the melodrama. Historian Candy Westhoff (Girard) There will be some great pictures from the fall conference, especially from the melodrama. Hospitality Traci Dockery (Basehor) signed up as committee chairperson. Legislative Greg Nickel (Newton) Greg reports that he will be stepping down as the chairperson and Sheila Hopkins (Prairie Village) will serve as chair; Greg will assist the committee. Manual Toni Rogers (Haysville) The regional meetings are going well. Toni s region recently met in Bel Aire and took a tour of its City Hall; Toni indicated the tour was interesting and educational. Membership Rod Edmondson (Baxter Springs) was not present but has notified the Board he must step down as chairperson by January Newsletter Greg Nickel (Newton) Articles for the next newsletter should be submitted by mid-october; it d be nice to have some personal articles submitted Past President s Sherri Adams (Pittsburg) No report. Promotion/Sales Amy Spitler (Hutchison) The committee had $1,400 in sales at the fall conference; $99 of sales were from old stock; $55 to $56 went to the scholarship fund ($1 per item sold). Committee will try to have a variety of items but won t stock a lot of any one item. Members appeared to like the new logo; stock for the spring conference will be in spring colors. Scholarship Candy Westhoff (Girard) The 50/50 raffle brought in $124 for the scholarship fund; silent auction sales brought in $272.

NEW BUSINESS Bettina Jamerson (Prairie Village) requested to purchase a fire box to keep the association seal, original by-laws, Articles of Incorporation and other significant papers protected. Jeannine Hoheisel (Hesston) motioned for KACM to purchase of fire box; Candy Westhoff (Girard) seconded. Motion carried. Jeannine Hoheisel (Hesston) asked if a strict deadline could be set for conference registration or a late fee assessed. There were several embers who signed up at the last minute for the fall conference and it s difficult to add meals, etc. after registration has been closed. Barb Inselman (Lenexa) suggested that the conference committee consider having an early bird registration fee with a higher registration fee after a specific date. This might get members to register more promptly at the lower registration fee with the higher registration fee defraying some of the additional costs for late sign ups. It was suggested that legislative updates be put on the website. Greg Nickel (Newton) asked if this would be duplications since they are already in the newsletter. Candy Westhoff (Girard) stated it would not be difficult to put legislative updates on the website and that a chronological list of updates could be set up so old updates could be referenced. Grey Nickel (Newton) inquired as to whether two persons could share a registration fee if one person attends the conference the first day and another person attends the second day. It was determined that any sharing of registration fees would be determined by the committee planning the conference. Amy Spitler (Hutchinson) asked about having totes as a giveaway for the next fall conference. Other suggestions from the Board were day planners or leather portfolios. Bettina Jamerson (Prairie Village) received a notice from the IRS regarding the 2008 annual electronic notice filing. Toni Rogers (Haysville) stated that paperwork is filed annually with the IRS for organizations with less than $25,000 gross receipts which is done by the Treasurer each year. Some of the new clerks have asked for a question and answer session at the fall conferences to review some of the training done in the spring. Some clerks are so new when they attend the spring training but find they have questions a few months later about the manual and would like to take them up at the fall conference. The conference committee can look at having some small group sessions that would allow for question and answer time. An issue regarding assistance for the DMV was requested by Sherri Adams (Pittsburg) to be presented at the Board meeting. Apparently Sherri has spoken with the DMV and they would be open to KACM members assisting the DMV on Saturdays to help them get caught up. Members would need to contact the DMV and work out any volunteer time directly with the DMV. Janeice Rawles (Edgerton) stated that several clerks have mentioned to her that it is difficult for them to attend the spring training when they have to upfront the expense and wait for reimbursement from OJA. Janeice thinks this will become a larger issue due to the economy and financial hardship of some clerks. Janeice wondered if KACM might approach OJA to see if they would pay expenses directly for court clerk training so clerks would not have to wait for reimbursement. Candy Westhoff (Girard) will see if an on-line form could be put on the KACM website for clerks to responds so the association could determine just how many clerks might have a financial hardship. The education committee will tally the results and present to the Board at a later date. Janeice Rawles (Edgerton) will draft a form for the website. Candy Westhoff (Girard) was asked by Carla Rains (Wellington) to bring up the matter of having an association directory with pictures of court clerks. The last directory was done in Candy mentioned that pictures could be taken at the spring and fall conferences to get as many clerks photographed as possible. Candy also mentioned that it would be good to have pictures and names of Board members and committee heads on the website.. Barb Inselman (Lenexa) asked about the history regarding the association looking into a court clerk certification program. Jeannine Hoheisel (Hesston) suggested that Tootie McAdow (Halstead) be contacted for information since she investigated certification programs in other states. Amy Spitler (Hutchinson) motioned to adjourn. Theresa Durler (Dodge City) seconded. Motion carried; meeting adjourned.

Auto Accident Janiece Rawles son was injured in an automobile accident. He is a very lucky 17 year old. He is doing much better now and has already gone back to school. Janiece would also like to thank everyone for the good wishes, words and prayers. What a great association that we have, and I am proud to be a part of it.
