Shelli Adams and the Education Committee are putting together a really fun and informative program so be sure to mark September 29 & 30 on your calendar and get your registration in early. More information on the conference is available in this newsletter and on the KACM website. Don t forget to be thinking about the Silent Auction that is always a part of our fall conference. If you like to join in the lively competition of bidding against your friends on a fabulous treasure, make sure you bring an auction item to add to the fun! Proceeds from the auction go to the Polly Mains Scholarship Fund. Our legislature has recently passed some changes affecting municipal courts. Several are effective July 1 which doesn t allow much time for contemplation and implementation! Gail Garrett has been working really hard at getting the updates together for this edition of the Docket. July is the month when the National Association for Court Management (NACM) holds their annual conference. Their conference Pushing the Boundaries is being held in Las Vegas and focuses on working together to strengthen and support the administration of justice. Attending a NACM conference is a real opportunity in being exposed to the justice system on a more global basis and offers a wonderful chance to network with court personnel from across the country. If your city considers sending you, be sure to take advantage of the training opportunity. (continued, page 2)

DOCKET PAGE 2 (president s corner, continued) The tornado in Joplin affected several of our KACM members even though their cities may be located across the state line from Missouri. Their community may not have experienced property destruction from the tornado but they did suffer losses in other respects. Members have mentioned having friends that happened to be in Joplin that evening who were lost or injured. Some of our Kansas communities have employees living in Joplin who lost their homes or vehicles. Please know that KACM extends its heartfelt condolences to those directly affected by this disaster and its appreciation to everyone who is doing what they can to help. Brilliant.. Robert Norton Kennedy, 51, was arrested in Horry County, S.C., in May and charged with assault and battery, despite the humble tattoo on his forehead referencing a Bible verse and reading, "Please forgive me if I say or do anything stupid." The Fifth Amendment to the U.S. Constitution forbids double jeopardy for the same offense, and this applies whether the first trial ends in acquittal, conviction, or a mistrial. If a mistrial occurs due to a manifest necessity or if a defendant appeals a conviction, however, the rule against double jeopardy does not apply. DOCKET PAGE 3 Legislative Update Gail Garrett, Chair If confusion is the first step to knowledge, I must be a genius. --Larry Leissner There might very well be a genius epidemic among Kansas court personnel come July 1, when the new DUI law goes into effect. I will go into more detail later in this report, but I want to get the easy stuff out of the way first. HB 2044 (effective ; amends KSA , 1604, 1605; repeals , 1606) This bill changes the leaving the scene of an accident laws. It requires a person involved in an accident to immediately stop at the scene, or as close as possible and then immediately return to the scene, of the accident. Failure to do so is a class C misdemeanor if the resulting property damage is less than $1000; if over $1000, it s a class A misdemeanor. Drivers are still required to furnish information at the scene, but now they are also required to make an effort to determine if anyone involved is either injured or killed and to render reasonable assistance to the injured party. If no police officer is present and there appears to be damage over $1000, injury, or death, then anyone over the age of 18 who was either a driver or an occupant of a vehicle involved in the accident is required to notify the police by the quickest available means of communication. H Sub for SB 55 (effective ; amends KSA , a) This bill makes it clear that a municipal judge may order house arrest for a convicted person. It also provides that a municipal court must make expunged records available to the KBI for purposes of completing a person s criminal history record, or to determine a whether a person is eligible to possess a firearm. HB 2192 (effective ; amends KSA ; ; & 2504) This bill includes the Dead Red provision, which allows for a motorcycle or bicycle rider facing a steady red light, after first coming to a complete stop, to proceed through the red light after a reasonable period of time if it appears that the light is malfunctioning or its sensor has failed to detect the cycle s presence at the light. It raises the maximum speed limit on separated multilane highways that are specifically designated by KDOT from 70mph to 75mph. Finally, it clarifies that the fines set out last year for seatbelt violations are THE fines. Apparently, it really ticked off the Legislature that many cities enacted their own ordinances and fines for seat belt violations, so the Legislature made it really clear in the new law that cities and counties will not vary from what is set out in the statute. It s $5 (no court costs) through , and $10 (no court costs) starting Persons aged are still fined $60 (no court costs). SB 97 (effective ; amends KSA ) Increases the judicial branch surcharge currently added to driver s license reinstatements from $17.50 to $ And now, the big ugly H Sub for SB 6 (effective , amends KSA and a bunch of other statutes) I had the privilege of attending a luncheon hosted by KACM President Barb Inselman on June 15, featuring a presentation on the new DUI law by Karen Wittman, Assistant Attorney General and member of the former Kansas DUI Commission. As you know, this commission was created 2 years ago and charged with the task of

4 VOLUME 64 THE K.A.C.M. DOCKET PAGE 4 overhauling the state DUI laws. They did a heck of a job and crafted an unbelievably comprehensive bill (SB7) that would have made a huge impact on drunk drivers in our state. Unfortunately, that huge impact came with a huge price tag. For some reason, the Legislature decided that some reform was better than no reform at all, so they nitpicked SB 7, pulled out the provisions with the least fiscal impact, and then wove them into a big old mess in H Sub for SB 6. In researching this bill, I have been told the following: (from an extremely knowledgeable experienced DUI prosecutor) I don t have the slightest idea what the Legislature expects us to do with this law. (from a statement made to prosecutors at a conference) You all might want to just quit prosecuting DUI s in municipal courts and send them all up to District Court. There is no way to adequately summarize all the stuff that this law covers, but I will do my best. A person who holds some type of professional license (law, medicine, pharmacy, etc.) cannot lose that license solely because of a 1 st DUI or diversion. The KBI has 1 year to establish regulations for preliminary saliva tests. All minimum DUI fine amounts are increased by $250, and that money will be used to bankroll the new Community Corrections Supervision (CCS) fund. This fund is to be used for grants to cover the cost of new DUI offender supervision programs. (Interesting note: per the statute, only district courts are required to submit $250 of every DUI fine imposed; there is no requirement that municipal courts do the same) The 2-hour time limit between driving a vehicle and taking an Intox test is extended to 3 hours. The sentencing provisions for commercial DUI under KSA 8-2,144 are changed to more closely mirror those of KSA The collection of urine samples for testing can now be supervised by a person licensed to practice medicine (male or female), a registered nurse (male or female), or a law enforcement officer (must be same sex as person being tested). ADSAPs are eliminated. Now, pre-sentencing (or pre-diversion) alcohol/drug evaluations must be performed by providers as defined in the statute. SRS has to come up with a standardized format for the evaluations and has to compile a list of authorized providers ; courts MUST use a provider from that list. The defendant has to pay for the evaluation, not to exceed $150, at the time of the service and they can t be sentenced unless and until that evaluation is completed. Chemical test refusals/failures and related penalties: o Refusals, and Failures when BAC is.15 or higher #1: suspend DL 1 year, then ignition interlock restriction 1 year #2: suspend DL 1 year, then ignition interlock restriction 2 years #3: suspend DL 1 year, then ignition interlock restriction 3 years #4: suspend DL 1 year, then ignition interlock restriction 4 years #5 or more: suspend DL 1 year, then ignition interlock restriction 10 years o Failures when BAC is.08 to.14 #1: suspend DL 30 days, then ignition interlock for either 180 days or 1 year, depending on certain conditions #2: suspend DL 1 year, then ignition interlock restriction 1 year #3: suspend DL 1 year, then ignition interlock restriction 2 years #4: suspend DL 1 year, then ignition interlock restriction 3 years #5 or more: suspend DL 1 year, then ignition interlock restriction 10 years People who ve had the 10 year interlock imposed can petition to have it removed after 5 years People who ve had a 1 year suspension imposed on them can, after 45 days of suspension, apply to have the suspension replaced by an interlock period during which they are restricted to driving to & from

5 VOLUME 64 THE K.A.C.M. DOCKET PAGE 5 work, school, treatment or the interlock provider (but, curiously, they re not allowed to drive to court or their probation office hmmm). People who have already been sentenced and are currently under a suspension period can pay $100 to have this new law apply retroactively to them and get their licenses back sooner (albeit restricted). If someone who must have an interlock device is convicted of tampering/circumventing that device, they will have an additional 90 days tacked on to the required interlock period. If they are convicted of it a 2 nd time, then the original interlock period starts all over again. A person given a DC-27 who then requests an administrative hearing regarding their driving privileges will now have to pay a $50 fee for that hearing, and it will be held by telephone unless an in-person hearing is specifically requested. DUI Sentencing: o #1: Class B misdemeanor; jail minimum 48 hrs. / maximum 6 mos.; fines minimum $750 / maximum $1000; house arrest authorized o after 48 hrs. of jail time. #2: Class A misdemeanor; jail minimum 90 days / maximum 1 year; fines minimum $1,250 / maximum $1,750; must serve at least 5 days jail (can substitute with 48 hrs. jail time followed by 10 days in work-release or in monitored house arrest) o #3: Class A misdemeanor (unless the person has a prior DUI conviction within the preceding 10 years that makes it a felony); jail minimum 90 days / maximum 1 year; fines minimum $1,750 / maximum $2,500; must serve at least 90 days jail (again, can substitute with 48 hrs. jail time followed by work release or monitored house arrest) At sentencing, court is to perform risk assessment to determine whether offender gets supervised by Community Corrections or Court Services after serving jail time. Must serve one year under supervision; court can t reduce this. Must take part in multidisciplinary team for substance abuse treatment, mental health counseling, etc. For purposes of determining whether a conviction is a first, second, third, etc., we can only consider convictions which occurred after July 1, If you have someone with 17 DUI s between 1986 and 1999, then gets DUI #18 a couple of months from now, it s really not #18 it s #1. DUI convictions are now apparently eligible for expungement after 10 years. Whew, that was exhausting. Cities need to get prepared for the new law by the time July 1 rolls around; if your city typically waits on the Standard Traffic Ordinance book to come out, you will end up with a bunch of DUI s between July 1 and the date your city enacts the STO that you won t be able to prosecute. I know several prosecutors who are rushing to get ordinances passed in their cities ASAP so that they can continue to prosecute DUI s without interruption. Also, remember that the Kansas Criminal Code is being re-codified as of July 1, so some statute numbers you might be used to will be changing. It affects mostly code sections in KSA Chapter 21, and some of the most common ones with which we interact are summarized in the chart that follows (thanks, Greg!) It will be important to make sure that these changes are incorporated in your court management software programs, and on your KADR s and fingerprint cards. DOCKET PAGE 7 KBI News DV Tag Law: HB 2517 establishes a requirement that all Domestic Violence cases be tagged in a way that allows them to be tracked as cases involving the special circumstances of domestic violence. This has the potential to be very useful for prosecutors as they review an offender s history, who will now be able to see which convictions involve DV elements; for example, a disorderly conduct conviction that was originally been filed as a DV case might have some bearing on how a pending DV prosecution is handled. New KADR forms have a DV column to mark Y (yes) or N (no) and a new program box called DV Assessment to check as applicable. (shown below) The unbarcoded (unnumbered) KADR forms were also updated; however, will no longer be mailed. An unbarcoded form will be available as a download on the KCJIS web portal. The download will be available in June. The juvenile forms will not be updated at this time. The domestic violence law only pertains to adult offenders. The KBI rapsheet will also have a new designation to inform the reader of domestic violence cases. The designation will appear directly under the arrest agency case number and/or the court case number. It will state, Domestic Violence Case. The designation will appear for the case if at least one offense is domestic violence related. The designation will not rely on the case being domestic related from start to finish. The case can begin as a domestic violence case then in court be determined as not domestic. In that instance the arrest will have the designation, but the court will not. The reverse is also possible. (KCJIS Newsletter, May 2011) OpenFox Periodic Disconnects: There was a problem reported regarding users being disconnected from OpenFox Messenger even though the server is never disconnected from the switch. After troubleshooting the issue it was discovered the NIC card on the PC has an option Allow the computer to turn off this device to save power and it was selected. Having this option selected turns the network card off on the PC once the NIC card is shut off a message is sent to the switch indicating the mnemonic is no longer actively connected and should be disconnected. We encourage the agencies having problems with periodic disconnects to check their PC s network card settings. To verify the settings on your network card Click on Start à Control panel à Systemà Select Hardware à Device Manager à Click on Network Adaptersà Right Click on your Network card and Select Properties à Click on Power Management Tabà Verify none of the options are checked. Detailed instructions with screen shots are posted on the KCJIS web portal under the Help Desk link and then look under the CPI heading. Work Group: The KBI has been concerned with the completeness and accuracy of its criminal history record information (CHRI) contained within the central repository for some time. They recently met with OJA and digressed from the original topic long enough to decide that they really need to consider long term solutions as well as short term. The ultimate goal would be to have timely, accurate, and complete reporting with workflows that minimize labor and systems that provide the best access to CHRI for the stakeholders. It is believed that the best approach may be to form a small working group to assess the problem and determine a solution or solutions. The working

8 VOLUME 64 THE K.A.C.M. DOCKET PAGE 8 group would then take the problems and solutions to KCJIS. The KBI would then seek, as a united front, a funded resolution. Amy Spitler (Hutchinson) was selected as the KACM representative for this group. The two meetings were in May and June, Stay tuned for future developments and if you have thoughts about the issue, feel free to contact Leslie Moore at Leslie.Moore@kbi.state.ks.us. Here are some highlights from the meeting minutes: Purpose of Work Group: to identify problems with criminal history records, such as reporting issues, content, availability, etc. We would also like the working group to come up with ideas on how to overcome these issues. Reporting problems Missing fingerprint cards: Many times the individual is never fingerprinted by anyone. The arresting agency thinks the originating jurisdiction will print the person and vice versa. Missing palm print cards. Bad fingerprints: Bad fingerprints are just as bad as missing fingerprints. The FBI only allows each state to have.5% of all fingerprints submitted to be bad fingerprints. Kansas well exceeds our limit each month. Lisa Parrish explained that she has been providing training on this for several years, but the problem is not getting better. Missing/incomplete court dispositions Missing appeal documentation: the comment section of the KDR often reports that the person had filed an appeal, but the appeal is not being reported. The record should contain the original conviction, the appeal and the rehearing/resentencing if it pertains. Correcting inaccuracies: There is a form on the KCJIS web portal called a FPC Change Request Form. City/municipal violations. Some reports come in using these statutes instead of the correct state statute. This is causing many problems, including City/municipal violations do not reflect the actual crime (not reported to the federal record unless the correct statute is used.) People reading a criminal history record do not know what crime was committed It was suggested that the city/municipal violation statutes be moved from 00-xxxx to 99-xxxx so they do not appear at the top of the pick lists. Another suggestion was to remove the city/municipal violations from the livescan version the statute file to force those agencies to find the correct statute. These suggestions will need to be taken to the statute file committee for review. DMV Update Customer Service Hours: Please be advised the Driver Control Bureau has changed our customer service hours for telephone service to the public on our main line: (785) Our telephones are open from 9:00 a.m. to 3:00 p.m., Monday through Friday. Our office for walk-in customers continues to be open from 8:00 a.m. to 4:45 p.m., Monday through Friday. Theft of Motor Fuel: This is a suspendable violation, but the suspension code is not configured. The code TF1 used for reporting convictions will not work, so any DL reinstatements for this violation will have to be done by paper. Prison Guard Skillz?? Erie County (N.Y.) jail officials suspended guards Lawrence Mule, a 26- year veteran, and James Conlin, a 29-year veteran, after they scuffled at the County Correctional Facility on April 21, reportedly over a bag of chips. An inmate had to break up the fight. (newsoftheweird.com)

Any Assistant Court Clerk/Assistant Court Administrator or any person serving in a management position in any Municipal Court in the State of Kansas shall be eligible for regular membership in the corporation. The Kansas Association of Court Management also offers new clerk orientation at the Spring Conference (those new clerks who have been appointed within the last two years). The orientation is a basic course geared toward new clerks. This scholarship is being offered to Court Clerks who have never been able to attend a KACM conference before. He was a member of St. Joseph Catholic Church, Oakley Fourth Degree Knights of Columbus and Veterans of Foreign Wars, and he served on the St. Joseph Church committee, St. Joseph School Building Committee and National Farmer's Organization New Job!
