Nine Mile Rd., Ferndale MI A Special Meeting of the Ferndale City Council was held Monday, December 15, 2014 at City Hall, 300 E. Nine Mile Rd., Ferndale. Mayor Coulter called the meeting to order at 6:00 p.m. 2. ROLL CALL Present: Council Members Lennon, Martin, Pawlica, Piana, Mayor Coulter Absent: None 3. APPROVAL OF AGENDA Moved by Council Member Pawlica, seconded by Council Member Piana, to approve the agenda as submitted. AYES: All NAYS: None MOTION CARRIED 4. CALL TO AUDIENCE There were no members of the audience wishing to speak. 5. CLOSED SESSION Moved by Council Member Martin, seconded by Council Member Pawlica, to adjourn to closed session for the purpose of consulting with our attorney regarding trial or settlement strategy in connection with specific pending litigation in Wolf vs. Ferndale, pursuant to MCL , Sec. 8(e). FYE2014 Audit Report Representatives from Abraham & Gaffney, P.C. presented the FYE 2014 audit report, noting the General Fund is in a strong position. 5. 19 Agenda Item 6A(3) FERNDALE CITY COUNCIL MEETING Monday, December 15, 2014 A Meeting of the Ferndale City Council was held Monday, December 15, 2014 at City Hall, 300 East Nine Mile Road, Ferndale, Michigan. Mayor Coulter called the meeting to order at 07:00 p.m. 1. PLEDGE OF ALLEGIANCE 2. ROLL CALL Present:Mayor Coulter, Council Member Piana, Council Member Pawlica, Council Member Martin, and Council Member Lennon. Absent: None. 3. APPROVAL OF AGENDA Moved by Council Member Martin, supported by Council Member Pawlica to approve the agenda as submitted. AYES: Mayor Coulter, Council Member Piana, Council Member Pawlica, Council Member Martin, and Council Member Lennon. NAYS: None. MOTION CARRIED Mayor Coulter presented City Clerk Brown with a Resolution of Appreciation thanking her for her years of service to the City. 4. PRESENTATION A. Ferndale Public Schools Amy Butters, Ferndale School Board, reported on activities and accomplishments in the District. B. Ferndale Arts and Cultural Commission The Arts and Cultural Commission reported on the reinstituted Ferndale Arts and Cultural Commission. C. Jack & Annette Aronson Boys & Girls Club of Oakland County Representatives of the Ferndale location of the Boys and Girls Club provided an update on the successes of the venture.

20 D. Downtown Development Authority DDA Executive Director Sheppard-Decius reported on the success of the Holiday Ice Festival and promoted upcoming holiday events in Ferndale's downtown. 5. CALL TO AUDIENCE Jeanne Davis, Seniors President, reported they raised $470 for soldiers with their bake sale during the Holiday Ice Festival, and reported on the success of the Historical Home Tour. Kristi Faulkner, Ferndale Association of Invested Residents, announced a food and clothing drive and asked for donations of winter coats, non-perishable food, socks, and underwear to be dropped off at Renaissance Vineyard Church and noted the church is hosting a warming center January Paul Kisch reported on the status of his ongoing enforcement issue with the City. Robert Meacham presented a few arguments in favor of the location of his proposed tattoo parlor. 6. CONSENT AGENDA A. Approval of the minutes of the Regular and Special Meetings held November 24, 2014, as submitted by City Clerk B. Approval to reappoint Doug Wehner to the Brownfield Redevelopment Authority for a term ending December 31, 2017 and Kate Baker and and Kevin Vettraino to the Planning Commission for terms ending December 31, 2017, as submitted by Community and Economic Development Director C. Approval of the $10,509 quote from Commerce Controls for the purchase and installation of software upgrades to the OIT computer at the Hilton Road pumping station, to be charged to the Water/Sewer Fund, Repair & Maintenance, account no , as submitted by Director of Public Works D. Approval of the $243,000 bid by M. K. Painting, of Wyandotte, for maintenance and miscellaneous improvements to the three-million gallon water storage tank, to be charged to the Water/Sewer Fund, Capital, account no , as submitted by Director of Public Works E. Approval to authorize the Mayor to sign the amendment to the engagement letter with Plante Moran for the services of Finance Director/Treasurer for an additional $25,000 from approximately January 1, 2015 to June 30, 2015 for the specific purpose of transition from New World Systems to BS & A financial software, to be charged to account no , as submitted by City Manager

Approval of the Special Event Permit for the 2015 "Arts at City Hall" from January 15, 2015 to November 30, 2015 as detailed in Director of Special Event s summary, as submitted by Director of Special Events G. Approval of the Special Event Permit for the BBQ Rib Burnout VIII on Saturday, January 31, 2015 from 12:00 PM to 6:00 PM as detailed in Special Event Director s summary to reflect the consensus of the Special Events Committee, as submitted by Director of Special Events H. Approval of the Software as a Service Agreement with Seamless Docs for a one time project cost not to exceed $8,500 from account number , and ongoing annual costs of $4,950 will be proportionately distributed amongst account numbers and , as submitted by Chief Innovation Officer I. Approval to fill Police Lieutenant position, as submitted by Director of Human Resources J. Approval to pay Invoice No from W. W. Williams for $3, for the repair of E11-4, as submitted by Fire Chief K. Approval of the bills and payrolls as submitted by the City Manager s Office subject to review by the Council Finance Committee Council Member Lennon left Council Chambers. Moved by Council Member Piana, supported by Council Member Martin to approve the Consent Agenda as submitted. AYES: Mayor Coulter, Council Member Piana, Council Member Pawlica, and Council Member Martin. NAYS: None. MOTION CARRIED Council Member Lennon returned to Council Chambers. 7. REGULAR AGENDA A. Consideration to appoint Provisional District Library Board Members Moved by Council Member Piana, supported by Council Member Pawlica confirm the appointments of Judeen Bartos, Frank Castronova, Patrick Dengate, Tiffani Gagne, Adrienne Gilmore, Monique Herzig and Kevin Yezbick to the Provisional Library Board for the Ferndale Area District Library.

22 AYES: Council Member Lennon, Council Member Martin, Council Member Pawlica, Council Member Piana, and Mayor Coulter. NAYS: None. MOTION CARRIED B. Consideration of recommendation to appoint City Clerk Moved by Council Member Martin, supported by Council Member Pawlica promote and appoint Marne McGrath as the City Clerk for the City of Ferndale, effective January 1, AYES: Council Member Lennon, Council Member Martin, Council Member Pawlica, Council Member Piana, and Mayor Coulter. NAYS: None. MOTION CARRIED Moved by Council Member Martin, supported by Council Member Piana to approve the City of Ferndale adopt a recruitment policy in relation to vacant department head positions that the recruitment process would include a search of both internal and external candidates. AYES: Council Member Lennon, Council Member Martin, Council Member Pawlica, Council Member Piana, and Mayor Coulter. NAYS: None. MOTION CARRIED C. Consideration of Special Event Permit for a Menorah display at the Kulick Community Center Pat Cissell proposed to restore nativity scene in public space. Gay Tischler spoke in favor of the special event permit. Hannah Finman spoke in favor. City Attorney Christ spoke to First Amendment issues, and defended his position that the Supreme Court does not allow for a government to display secular items that could be construed to advocate a particular religion. He noted it has been determined that a menorah has been found to be a non-secular symbol. He referenced the threefold Lemon test, which is a Supreme Court case that generally is used as a guideline in similar situations. The main points to consider are 1) is there a secular purpose, 2) does it have a principal effect of advancing religion, and 3) does it foster an excessive entanglement between government and religion. Mr. Christ noted this is a private citizen seeking to express his views as permitted under the First Amendment. He indicated that although the Kulick Center can be construed as a public forum for purposes of speech, it is not the heart, or center, of government which lessens the suggestion

23 by a reasonable observer, which is the test, would construe this to be an endorsement by the city. Moved by Council Member Martin, supported by Council Member Piana to approve the Special Event Permit for the "Menorah Display" effective December 16, 2014 to December 26, 2014, with a Lighting Ceremony on December 23, 2014 as detailed in Special Event Summary and according to the following terms and conditions: Per Section 4 of the Special Events Policy, the following fees are as agreed: *Application Permit Fee: $35; * Recreation Rental Fee: $50; *Total Fees: $ Per Sections 9 of the Special Events Policy, Applicant shall provide the City, no later than Tuesday, December 16, 2014 by 9:00 a.m. with a certificate of liability insurance naming the City as "additional insured" with insurance coverage remaining active December 16, 2014 to December 26, 2014; and 2) Applicant shall pay of all necessary city permits based on the approval of City Council; and 3) Per Section 13 of the Special Events Policy, Applicant agrees to bear sole responsibility for maintaining a clean site including trash clean-up during the duration of the display; and 4) AYES: Mayor Coulter, Council Member Piana, Council Member Pawlica, Council Member Martin, and Council Member Lennon. NAYS: None. MOTION CARRIED Council was in agreement that in 2015 a city policy needs to be created to address the display of religious symbols. D. Consideration of Third Amendment to the Fire Protection Agreement with Royal Oak Township Moved by Council Member Pawlica, supported by Council Member Martin to approve Third Amendment to the Fire Protection Agreement between the City of Ferndale and the Township of Royal Oak AYES: Council Member Lennon, Council Member Martin, Council Member Pawlica, Council Member Piana, and Mayor Coulter. NAYS: None. MOTION CARRIED 8. CALL TO COUNCIL Police Chief Collins, Community & Economic Development Director Delacourt and Special Event Director Lary all thanked City Clerk Brown for her service and wished her well in her future endeavors. Fire Chief Sullivan reported on recent industrial facility fire.

24 Recreation Director Manchik applauded the Boys & Girls Club and the success of the joint venture. DPW Director Cureton reported on upcoming completion of E. Nine Mile Road project; noted the community interest in replacing the traffic signal at Marshall & Livernois and announced the project is anticipated to be completed by the end of January. CINO Gacioch spoke about his upcoming tenure as Interim City Manager. City Clerk Brown invited everyone to join her for her going away party. City Manager Lynch announced that she will be on FMLA leave until March 23. City Attorney Christ noted he looks forward to assisting council with the display of religious symbols policy and thanked City Clerk Brown for her service. Council Member Martin added his well wishes to City Clerk Brown and wished everyone a happy holiday season. Council Member Lennon thanked Brown City Clerk for updating the clerk's office and wished everyone happy holidays. Council Member Pawlica noted the City Hall clock tower now works and thanked DPW for fixing it, announced the success of the historic home tour, indicated his disappointment at the demolition of the first church in Ferndale, and noted that has prompted him into researching the possible formation of a Historic Commission. He asked for Council's permission to continue his research and bring ideas back to Council. He expressed how much he will miss City Clerk Brown and wished her all the best. Council Member Piana congratulated City Manager Lynch on the impending birth of her daughter, noted that City Clerk Brown will be an asset to her next employer, and encouraged residents to contact legislators, particularly about the transportation bill, during the lame duck session in Lansing. Mayor Coulter expressed his thanks to City Clerk Brown, wished City Manager Lynch well during her FMLA leave, announced a rally on Thursday at 7 p.m. to express displeasure at the religious freedom act being considered by legislators during the lame duck session and wished happy holidays to all. 9. CLOSED SESSION - to consider material exempt from discussion or disclosure by state or federal statute, pursuant to MCL (h). The appropriate representative of each group was contacted in order to confirm meeting days and times. The Open Meetings Act requires that public notice of all regular meetings be posted within ten days after the first meeting of the public body in the calendar or fiscal year. Collins, Chief of Police Elimination of the Part-Time Dispatcher Program SUMMARY & BACKGROUND: The six person part-time Dispatcher program for the Police Department that was initiated last year has been a failure due to problems related to recruiting, training, scheduling and mostly, retention. Several of the new part-time employees found fulltime employment shortly after their hire and left our employment. We are currently budgeted for four full-time Dispatchers, one for each of the four Platoons, Days/Nights A and Days/Nights B. I propose a new program to include two additional full-time Dispatchers and call them Swing A and Swing B. A detailed explanation is included in the attached memo. This scheduling will assist us to comply with State mandates in which only trained dispatch personnel answer 911 calls for service. Therefore, after concurring with City Manager Lynch and HR Director Walewski, I recommend the Part-Time Dispatcher program be discontinued and Council approve the proposed schedule for two additional full-time "Swing" Dispatchers for Platoons A and B. COLLINS Chief November 21, 2014 April, As we have discussed in the past few weeks, the Part Time Dispatcher program we initiated last year has been a failure. For the most part this was a good idea on paper, but in application, we came across several unintended consequences. These problems are related to recruiting, training, scheduling and most of all retention. Although we recognized the problems with recruiting, training and scheduling early on, and made several adjustments to overcome them, we found that retaining part time dispatchers was problematic. Several of our new part time employees found full time employment (both in the dispatch field and elsewhere) and left our employment. We have had only one of the recruits actually complete the training program, and never actually worked as a part time dispatcher due to the fact that she was offered and accepted a full time position after the resignation of a full time dispatcher a few months ago. Therefore, after conferring with the H.R. director, I feel that the Part Time Dispatcher program should be discontinued. In its place, I would propose a new program in which we employ six {6) full time dispatchers and no part time dispatchers. This new program was suggested by one of the FPOA Union Board members, Officer John Heath. In concept it would entail the following: We would retain the four full time dispatch positions we are currently budgeted for, each assigned to one of the four platoons (Days A, Days B, Nights A and Nights B). These four dispatchers would work their normal platoon shift of 7 am to 7 pm (Days) and 7 pm to 7 am {Nights). We would add two additional dispatchers who would also work 12 hour shifts from 11 am to 11 pm. We would call these two dispatchers Swing A and Swing B. Swing A would work 11 am to 11 pm only when

47 (Day and Night) Platoon A was scheduled, and Swing B would work only when (Day and Night) Platoon B was working (also 11 am to 11 pm). The effect would be that we would have a second dispatcher every day f rom 11 am to 11 pm, which is our busiest time for Calls. We could explore an adjustment of this time 10 to 10 or 12 to 12, but 11 to 11 seems to be a good place to start the conversation. It was further suggested that we pool all of the A's together and all ofthe B's together for time off and vacation selection. We would also restrict the selection of time off to one person per pool at any one time. In other words, when selecting a vacation, Days A, Nights A and Swing A would select as a group, one at a time with no overlapping of days. This would allow us to move the Swing dispatcher to Days when the day dispatcher is on vacation, and move the swing dispatcher to nights when the night dispatcher is on vacation. When the swing dispatcher is on vacation, no one will have to move at all, because only one of the three dispatchers can be on vacation at the same time. This would be the same for the B's as well. This configuration will assist us to comply with State mandates in which only trained dispatch personnel answer 911 ca lls for service. We would also move toward the concept of replacing missing desk pe rsonnel with only desk personnel in an effort to keep un-trained patrol officers off the desk unless absolutely necessary. This may cause some additional overtime for dispatchers that we currently do not have, however to achieve compliance with the State, it will be necessary in any event. The cost ofthis program is actually less expensive than the cu rrent budgeted allocations for full and part time dispatchers. Current full time dispatchers range in costs (with benefits) from a high of $68,733 to a low of $49,931, and I took the total of the four most recent full time dispatchers and averaged them: $68,733 + $57,455 + $49,981 + $49,931 = $226,100 I 4 = $56,525. I will use $56,525 for my estimations. We are currently budgeted for six part time dispatchers who work 24 hours per week for 52 weeks a year. This would equal a total of 7488 part time dispatcher hours per year. Using the hourly rate of a dispatcher (at top pay) of $19.34 and hour, the cost of 6 part time dispatchers without any benefits would be $144,818. Using the above figures, it is estimated that if our Full and Part time dispatcher plan was implemented it would cost approximately $370,910 ($56,525 x 4 = $226,092 + $144,818 = $370,910). The proposed six full time dispatcher programs would be estimated at $56,525 x 6, or $339,150.

48 This represents a potential cost savings of $31,760 to the budget. This new program would not provide two dispatchers 24/7 like the current Full and Part time solution, however I do not believe we will ever achieve our goal of 4 full timers and 6 part timers in todays market. We would of course have to get buy-in from the union, however the union suggested this Idea so that issue will be lessened I believe. The upgrade is necessary and as outlined, the cost would be an agency responsibility. The original cost for each participating agency was estimated at about $8,000 per device. 52 CITY OF FERNDALE RESOLUTION ADOPTING POVERTY EXEMPTION GUIDELINES & RESIDENT LETTERS OF PROTEST At a Regular meeting of the City Council of the City of Ferndale, Oakland County, Michigan, held in the Council Chambers at 300 E. Nine Mile, Ferndale MI on the 12th day of January, 2015, The following resolution was moved by Council Member and seconded by Council Member : Public Act 390 of 1994, which amended Section 7u of Act No. 206 of the Public Acts of 1893, as amended by Act No. 313 of the Public Acts of 1993, being sections 211.7u of the Michigan Compiled Laws, requires that the governing body of the local assessing unit determine and make available to the public the policy and guidelines used by the Board of Review in granting reductions in property assessments due to limited income and assets, referred to as Poverty Exemptions. THEREFORE, BE IT RESOLVED that in order to be eligible for poverty exemption in the City of Ferndale, a person shall do all of the following on an annual basis: 1. Be an owner of and occupy as a principal residence the property for which an exemption is requested. 2. File a claim with the Board of Review on a form provided by the local municipal office. 3. Submit the most recent year s copies of the following: a. Federal and State of Michigan Income Tax Returns. b. BE IT FURTHER RESOLVED that a poverty exemption shall not be granted to an applicant with cash on deposit in excess of the proposed tax obligation for the ensuing year, unless the applicant can show evidence that the cash is subject to a legitimate cost of living expense. BE IT FURTHER RESOLVED that meeting the income level guidelines does not guarantee 100% exemption, at their discretion, the Board may approve full or partial exemption if deemed appropriate. Those applicants granted partial exemptions will be required to pay a property tax equal to 3.5% (three and one-half percent) of their annual gross income.

An applicant s homestead and principal vehicle shall be excluded from consideration as an asset. All other property, including from all other persons residing in the household, shall be included as an asset. TIA s evaluation of intersections and roads was important in the formation and finalization of the following major road projects: West Nine Mile Resurfacing (Pinecrest to Livernois) and Streetscape (Pinecrest to Livernois) Project Livernois Complete Streets Project (8 Mile to 9 Mile) East Nine Mile Resurfacing / Complete Streets Project Hilton Road Complete Streets / Road Diet Project TIA s evaluations and recommendations for the intersection of Livernois and Marshall were critical after the traffic signal was destroyed in an accident. In 2015, the Pinecrest road project and traffic signal evaluations are just two of the projects that we will be utilizing TIA s consulting services. TIA also assists the Police Department with traffic-safety studies, traffic counts, speed evaluations, traffic-flow and crash analysis, all necessary for safety and orderly traffic flow. Federal Surface Transportation Funds shall be applied to the eligible items of Part A of the project, hot mix asphalt cold milling and resurfacing work along Hilton Road from Woodward Heights to Ten Mile Road, including drainage improvement, pavement repair, concrete curb and gutter, concrete sidewalk, sidewalk ramp, pedestrian signal work, and all together with necessary related work, up to the lesser of: (1) $402,331, or (2) an amount such that 81.85% is not exceeded at the time of the award of the construction contract. Sullivan, Fire Chief SUBJECT: International Ambulance, Rescue 11-2 (R11-2) SUMMARY & BACKGROUND: Crews recently had heavy black smoke exhaust and poor performance from R11-2. DPW Mechanics determined it was a diesel engine problem which would be best dealt with by the International dealer. The unit was sent to Tri-County International Trucks, Inc. in Warren. The mechanics there determined it was a fuel injector issue most likely the problem. I gave them a verbal go ahead to make repairs and confirmed via , as this type of repair is costly. Several other items were repaired as the mechanics came across them, being a Rescue in the Fire Service International is more critical of the repairs they perform. The current invoice I am requesting approval for is $5, This is a local single source vendor, the repair was emergent as R11-2 is our front line Ambulance. With budget constraints we held off on the scheduled replacement of Rescue 11-2 as it has been a very dependable unit, with no major repair or maintenance issues. Nine Mile (Canine to Five) Summary: The applicant is requesting a conditional rezoning from C-2 (General Commercial) to M-1 (Limited Industrial) to allow pet care, boarding and day care facilities at the subject site. The site is currently zoned C-2, the proposed use is not permitted in the district. The applicant is proposing a conditional rezoning to only allow the specific pet care/boarding use. Conditions have been offered by the applicant prohibiting all other uses allowed in the M-1 district. The applicant currently operates a pet care facility on Hilton Road. The business continues to expand and can no longer be supported by the existing site and building. The applicant has worked with Staff for the last year attempting to find an existing facility in the M-1 district for the expanded operation. To date we have not been able to identify an available property within the M-1 district. Although the subject site is currently zoned C-2 the location, building size, and site are consistent with traditional industrial zoned properties. The applicant is offering conditions in an attempt to mitigate the requested use and to prevent the negative impacts associated with other industrial uses. In addition to the restrictions related to use, the applicant proposes conditions restricting hour s pets would be able to utilize the outdoor play area and a stipulation that if the pet care use ceases operation that the property automatically returns to C-2 zoning. The applicant has also provided a condition that if complaints regarding noise are received that they will work with Staff to identify and implement an agreed upon response, (please review the attached statement of conditions submitted by the applicant for the full conditions). The applicant has submitted a detailed application for review, it addresses each of the required criteria necessary for review of a rezoning request. If approved a conditional rezoning agreement will be required to be reviewed and approved by the City Attorney and recorded with the property. That the rezoning is consistent with the goals, policies and future land use map of the City of Ferndale Master Plan. 2. That the proposed rezoning, subject to the offered conditions, is compatible with the site's physical, geological, hydrological and other environmental features. 3. That with the conditional rezoning, the site remains compatible with all the potential uses allowed in the proposed zoning district with surrounding uses and zoning in terms of land suitability, impacts on the environment, density, nature of use, traffic impacts, aesthetics, infrastructure and potential influence on property values. 4. That the capacity of city infrastructure and services is sufficient to accommodate the uses permitted in the requested district without compromising the health, safety and welfare of the city. 5. There is apparent demand for the types of uses permitted by the conditional rezoning in the city in relation to the amount of land in the city currently zoned to accommodate the demand. 6. Due to the unique size of the building and parcel the Conditional Rezoning to C-2 is more appropriate than another district or than amending the list of permitted or special land uses within a district. 1. Unless otherwise approved by the City, the use of the Property shall be restricted to a pet care facility and any other uses allowed in the C-2 zoning district. 2. In the event the pet care facility ceases operations at the Property for more than six (6) months, then the Conditional Rezoning Agreement shall become null and void and the zoning of the Property shall automatically revert back to C-2.

No more than 3 dogs at any one time shall be allowed outside of the building on the Property during the hours of 8:00pm to 6:30am Monday through Friday, and during the hours of 8:00pm to 7:00am on Saturday and Sunday, provided that such pets are allowed only within the fenced outdoor yard and are supervised by an employee. 4. In the event the City receives multiple noise complaints from surrounding property owners relative to the operation of the fenced outdoor yard at the Property, the Applicant agrees to cooperate with the City and use commercially reasonable efforts to mitigate such noise issues. 5. In addition to the restrictions related to use conditions offered include a restriction on hours pets would be able to utilize the outdoor play area and a stipulation that if the pet care use ceases operation that the property automatically returns to C-2 zoning. The applicant has also provided a condition indicating that if complaints regarding noise are received that they will work with Staff to identify and implement an

The applicant has submitted a detailed application for review. The application addresses each of the required criteria necessary for review of a rezoning request. Also, the application includes a statement of conditions offered by the applicant. If approved a conditional rezoning agreement will be required to be reviewed and approved by the City Attorney and recorded with the property. General Requirements for Rezoning & Conditional Rezoning (Section & 325) Sec Rezoning criteria. The planning commission shall and the city council may consider the following criteria in making its findings, recommendations and decision: 1. Consistency with the goals, policies and future land use map of the City of Ferndale Master Plan, including any subarea or corridor studies. If conditions have changed since the current master plan was adopted, the consistency with recent development trends in the area. 2. Compatibility of the site's physical, geological, hydrological and other environmental features with the potential uses allowed in the proposed zoning district. 3. The compatibility of all the potential uses allowed in the proposed zoning district with surrounding uses and zoning in terms of land suitability, impacts on the environment, density, nature of use, traffic impacts, aesthetics, infrastructure and potential influence on property values. 4. The capacity of city infrastructure and services sufficient to accommodate the uses permitted in the requested district without compromising the health, safety and welfare of the city. 5. The apparent demand for the types of uses permitted in the requested zoning district in the city in relation to the amount of land in the city currently zoned to accommodate the demand. 6. Where a rezoning is reasonable given the above criteria, a determination shall be made that the requested zoning district is more appropriate than another district or than amending the list of permitted or special land uses within a district. Sec Conditional rezoning. A. An applicant requesting a rezoning may voluntarily offer a conditional rezoning. An election to submit a conditional rezoning agreement shall be pursuant to the Zoning Act and this section. 1. The conditional rezoning shall be in writing, executed by the applicant and the city and recorded with the Oakland County Register of Deeds. All costs associated with the review and approval of the conditional rezoning agreement shall be the responsibility of the applicant.

The conditional rezoning may include limitations on: the uses permitted on the property in question; density or intensity of use; and location, size, height or other measure for buildings, structures, improvements, setbacks, landscaping, buffers, design, architecture and other features. 3. The conditional rezoning shall not authorize uses or developments of greater intensity or density than those permitted in the proposed zoning district; nor may a conditional rezoning agreement permit variations from height, area, setback or similar dimensional requirements that are less restrictive than the proposed zoning district. 4. The conditional rezoning may include conditions related to the use and development of the property that are necessary to: a. Serve the property with improvements, including but not limited to, the extension, widening or realignment of streets; construction or extension of utilities or other infrastructure improvements serving the site; or the construction of recreational facilities. b. Minimize the impact of the development on surrounding properties and the city overall. c. Preserve natural features and open space beyond what is normally required. B. In addition to any limitations on use or development of the site, preservation of site features or improvements described above, the conditional rezoning agreement shall also include the following: 1. A legal description of the land to which the agreement pertains. 2. An acknowledgement that the conditional rezoning agreement was proposed voluntarily by the applicant. 3. A statement that the property shall not be developed or used in any manner that is not consistent with the conditional rezoning agreement. 4. A statement that the approval of the rezoning and the conditional rezoning agreement shall be binding upon and inure to the benefit of the property owner and the city and also their respective heirs, successors, assigns, receivers or transferees. Where the applicant for rezoning is acting on behalf of the landowner through some form of purchase agreement or other mechanism, then the landowner must also consent and sign the agreement. 5. A statement that, if a rezoning with a conditional rezoning agreement becomes void in accordance with this section, that no further development shall take place and no permits shall be issued. 6. A statement that no part of the conditional rezoning agreement shall permit any activity, use or condition that would otherwise violate any requirement or standard that is otherwise applicable in the new zoning district. 7. Any other provisions as are agreed upon by the city and applicant. C. Process.

The conditional rezoning agreement shall be reviewed concurrently with the petition for rezoning following the process in section , Procedure. 2. The conditional rezoning agreement may be submitted prior to planning commission making its recommendation to the city council. The conditional rezoning agreement shall be reviewed by the city attorney, at the expense of the applicant, to determine that the conditional rezoning agreement conforms to the requirements of this section and the Zoning Act and shall confirm that the conditional rezoning agreement is in a form acceptable for recording with the Oakland County Register of Deeds. 3. Following the public hearing for a proposed zoning amendment, the planning commission shall make a recommendation to the city council based upon the criteria listed in section , Criteria for amendment of the official zoning map (rezoning). In addition, the planning commission shall consider whether the proposed conditional rezoning agreement: a. Is consistent with the intent of this chapter. b. Bears a reasonable and rational connection or benefit to the property being proposed for rezoning. c. Is necessary to ensure that the property develops in such a way that protects the surrounding neighborhood and minimizes any potential impacts to adjacent properties. d. Is necessary to allow the rezoning to be approved, in that the property could not or would not be rezoned without the proposed conditional rezoning agreement. e. Is in the public interest and is consistent with the recommendations of the master plan. 4. If a conditional rezoning agreement has been offered by the applicant and recommended for approval by the planning commission, the city council may approve the conditional rezoning agreement as a condition to the rezoning if it meets all requirements above. The conditional rezoning agreement shall be incorporated by attachment or otherwise as an inseparable part of the Ordinance adopted by the city council to accomplish the requested rezoning. 5. If the conditional rezoning is approved, the zoning classification of the rezoned property shall consist of the district to which the property has been rezoned and a reference to the conditional rezoning agreement. The zoning map shall specify the new district plus an asterisk to indicate that the property is subject to a conditional rezoning agreement (i.e., "R- 1*"). The city clerk shall maintain a listing of all properties subject to conditional rezoning agreements and shall provide copies of the agreements upon request. 6. The approved conditional rezoning agreement shall be recorded with the Oakland County Register of Deeds. 7. Any uses proposed as part of a conditional rezoning agreement that would otherwise require approval of a special land use or site plan approval shall be subject to the applicable review and approval requirements of Article XI, Site Plan Review and Article XII, Special Land Use.

The rezoning and conditional rezoning agreement shall expire, unless extended by the city council for good cause, two years after adoption if substantial construction on the approved development of the property pursuant to building and other required permits issued by the city has not commenced or is not proceeding diligently to completion. 2. In the event that substantial construction on the approved development has not commenced within the aforementioned two years, the conditional rezoning agreement shall be void and of no effect. 3. Should the conditional rezoning agreement become void, all development on the property shall cease and no further development shall be permitted. Until action satisfactory to the city is taken to bring the property into compliance with the conditional rezoning agreement, the city may withhold or, following notice to the applicant and being given an opportunity to be heard, revoke permits and certificates. This shall be in addition to or in lieu of any other lawful action to achieve compliance, including rezoning. 4. Notwithstanding the above, if the property owner applies in writing for an extension of the conditional rezoning agreement at least 30 days prior to the expiration date, the city council may grant an extension of up to one (1) year if it determines that the owner has made diligent effort towards completing the conditions of the agreement. E. Reversion of zoning. If the conditional rezoning agreement becomes void as outlined above, then the land shall automatically revert back to its original zoning classification. The community development department will advise the land owner and/or developer, by registered letter, of the reversion of zoning. The city shall take affirmative action to rezone the property. F. Continuation. Provided that all development and/or use of the property in question is in compliance with the conditional rezoning agreement, a use or development authorized there under may continue indefinitely, provided that all terms of the conditional rezoning agreement continue to be met. G. Amendment. The conditional rezoning agreement may be amended by the city council with the property owner's consent in the same manner as was prescribed for the original rezoning and conditional rezoning agreement. H. Violation of agreement. Failure to comply with the conditional rezoning agreement at any time after approval will constitute a breach of the agreement and also a violation of this Ordinance. Further use of the property may be subject to legal remedies available to the city. I. Subsequent rezoning of land. Nothing in the conditional rezoning agreement, nor any statement or other provision, shall prohibit the city from later rezoning all or any portion of the property that is the subject of the conditional rezoning agreement to another zoning classification. Any rezoning shall be conducted in compliance with this chapter and the Zoning Act. J. Failure to offer conditions. The city shall not require an owner to offer conditions as a requirement for rezoning. The lack of an offer of conditions shall not affect the owner's rights under this chapter.

The city is not required or obligated to accept any or all conditions offered by a developer on a rezoning application. In no way is an offer of a conditional rezoning agreement the basis for requiring the city to approve a rezoning application. Site Plan Review Considerations The applicant is not proposing significant changes to the site at this time. The only change is the proposed addition of the outdoor play area on the east side of the building. The site plan indicates the area will be screened with an 8 foot high wooden fence and gates. The applicant is not proposing to reduce the total number of parking spaces available on site. If approved the applicant shall submit a final site plan to Staff for review and approval addressing any issues or improvements identified by the Planning Commission. Consistency with the Master Land Use Plan The City s Master Land Use Plan (MLUP) identifies the corridor for future use as general retail, service and office type uses. The proposed use is consistent with the plan in that it is a retail/service type of business. Although the use is not allowed in a C-2 district it is similar to uses normally associated with the district. Also, the building and parcel are of a size and location that is traditionally consistent with industrial buildings and parcels in the city, making it unique for redevelopment with general retail type uses. The conditions offered by the applicant offer additional assurances that any use of the property will conform to the intent of the MLUP. No traditionally industrial type uses will be allowed under the agreement. Potential Motion Motion by, supported by, that the Planning Commission recommends City Council APPROVE the Conditional Rezoning request for 1221 E. Nine Mile Road, (Canine to Five), Sidwell numbers , with the following findings and conditions after a Public Hearing was held as set and published for this date and place: Findings 1. That the rezoning is consistent with the goals, policies and future land use map of the City of Ferndale Master Plan. 2. That the proposed rezoning, subject to the offered conditions, is compatible with the site's physical, geological, hydrological and other environmental features. 3. That with the conditional rezoning, the site remains compatible with all the potential uses allowed in the proposed zoning district with surrounding uses and zoning in terms of land suitability, impacts on the environment, density, nature of use, traffic impacts, aesthetics, infrastructure and potential influence on property values.

Due to the unique size of the building and parcel the Conditional Rezoning to C-2 is more Conditions appropriate than another district or than amending the list of permitted or special land uses within a district. 1. Unless otherwise approved by the City, the use of the Property shall be restricted to a pet care facility and any other uses allowed in the C-2 zoning district. 2. In the event the pet care facility ceases operations at the Property for more than six (6) months, then the Conditional Rezoning Agreement shall become null and void and the zoning of the Property shall automatically revert back to C No more than 3 dogs at any one time shall be allowed outside of the building on the Property during the hours of 8:00pm to 6:30am Monday through Friday, and during the hours of 8:00pm to 7:00am on Saturday and Sunday, provided that such pets are allowed only within the fenced outdoor yard and are supervised by an employee. 4. In the event the City receives multiple noise complaints from surrounding property owners relative to the operation of the fenced outdoor yard at the Property, the Applicant agrees to cooperate with the City and use commercially reasonable efforts to mitigate such noise issues. 5. That the applicant and the City will enter into a conditional rezoning agreement approved by the City Attorney and recorded with the property. 6. That the Applicant will submit a final site plan to for final review and approval by City Staff.
