3 AGENDA ITEM 4B CITY OF FERNDALE PROCLAMATION HONORING BUFFALO WILD WINGS COMMITMENT AND CONTRIBUTIONS TO THE CITY OF FERNDALE Mayor David Coulter, on behalf of the Ferndale City Council, extends the City s heartfelt appreciation to Buffalo Wild Wings for their generosity in serving the Ferndale Community. Since 2008 Buffalo Wild Wings, under the guidance of Manager Dean Miles, has donated dinner for Ferndale s election inspectors and officials on Election Day. Over the course of eleven elections BW3 has provided more than 600 dinners for our dedicated election team. Buffalo Wild Wings and Dean Miles are a credit to this community, and it is with sincere and deep gratitude that we recognize them for selflessly serving Ferndale. ADOPTED UNANIMOUSLY I, J. 4 Draft FERNDALE CITY COUNCIL MEETING Monday, February 11, 2013 AGENDA ITEM 6A A Regular Meeting of the Ferndale City Council was held Monday, February 11, 2013 at City Hall, 300 East Nine Mile Road, Ferndale. Mayor Coulter called the meeting to order at 7:30 p.m. 1. PLEDGE OF ALLEGIANCE 2. ROLL CALL Present: Council Member Lennon, Council Member Galloway, Council Member Piana, Mayor Coulter, and Council Member Martin. Absent: None. 3. APPROVAL OF AGENDA Moved by Council Member Martin, supported by Council Member Piana to approve the agenda as amended to add two presentations: 4C. County Commissioner Zack and 4D. Update on installation of multi-space parking meters; and two items to the Regular Agenda: 7D. Sale of State Fairgrounds Property and 7E. Appointment of Council Member as alternate representative to SEMCOG General Assembly. AYES: Council Member Lennon, Council Member Galloway, Council Member Piana, Mayor Coulter, and Council Member Martin. NAYS: None. MOTION CARRIED 4. PRESENTATION A. Ferndale Public Schools Ferndale School Board Member Raylon Leaks-May provided an update on the Board's strategic planning process. B. Credit Union One 75th Anniversary Proclamation Mayor Coulter presented a proclamation honoring Credit Union One's 75th anniversary. C. County Commissioner Helene Zack Commissioner Zack provided an update on the Commission's programs and initiatives. D. Status Report on Installation of Multi-space Parking Meters City Manager Lynch addressed the frustrations and concerns expressed by residents during the two weeks of the rolling implementation. Downtown Development Authority Executive Director Sheppard-Decius addressed the three major issues: 1) Park Mobile, the smart phone app for on-street meters was off-line, but will be back on-line for all lots by the end of the week. In addition signage is being installed with Park Mobile zone numbers in all lots; 2) Some pay stations have inadequate light for the keypads. DPW is investigating solutions and hopes to begin fixing the lighting issues next week; and 3) Long lines at pay stations. Transaction times should decrease as Park Mobile comes on-line

5 allowing visitors to utilize that pay option via their smart phones and as visitors become more familiar with the operation of the pay stations. Data from the weekend showed 5000 transactions per day, indicating the need for additional pay stations. Ms. Sheppard-Decius encouraged system users to notify the City via Park Mobile or the City website of any problems they are experiencing. Feedback is being monitored. Ms. Lynch reported the ambassadors who are present to help users of the system will remain in place for at least two more weeks. Ms. Sheppard-Decius explained the grace period on enforcement will continue until after Council reviews data at their next meeting. 5. CALL TO AUDIENCE Kat Bruner-James, Chairperson of Citizens for a Fair Ferndale, announced nominations are being accepted for this year's Good Neighbor Awards. Chris Johnston voiced concerns about the new parking meter system and the increased rates. Chris Hughes, DDA Communications and Marketing Manager, promoted upcoming activities in Ferndale's downtown. 6. CONSENT AGENDA A. Approval of the minutes of the Regular and Special Meetings held January 28, 2013, and Special Meeting held February 4, 2013, as submitted by City Clerk B. Approval to confirm the re-appointments of Peggy Snow and Anna Garratt to the Ferndale Beautification Commission for terms ending December 31, 2015, as submitted by City Clerk C. Consideration to purchase patrol vehicles Moved by Council Member Piana, supported by Council Member Galloway to approve the purchase of three Dodge Chargers, in the amount of $23,893.43/each, and two Ford Explorers in the amount of $26,615/each, total amount $124,910.29, from Motor Pool account # AYES: Council Member Lennon, Council Member Galloway, Council Member Piana, Mayor Coulter, and Council Member Martin. NAYS: None. MOTION CARRIED 7D. State Fairgrounds Property Sale The Michigan Land Bank Authority released an RFP for the sale of the state fairground property in May of 2102, and are currently finalizing who they will negotiate with for the sale of the property. The sale and redevelopment of the property will have a significant impact on the City of Ferndale. Therefore the City, while supporting the sale and redevelopment of the property, wishes to insure that the final approved site plan recognizes the placemaking efforts of the State, the transit oriented development principles adopted for the Woodward corridor, that transit is a core consideration of the development and that the City's infrastructure concerns be taken into consideration as well. Moved by Council Member Piana, supported by Council Member Martin to approve forwarding a request to the Michigan Land Bank Fast Track Authority to incorporate the concepts identified in the attached letter (Attachment A) into the purchase agreement for the sale of the State Fairgrounds property. Also, that the Authority ensures that the purchaser of the property demonstrates the financial ability to successfully develop the subject site and that the purchaser is committed to stakeholder input throughout the development process and that the purchaser takes into consideration the current stress on the City of Ferndale's electrical infrastructure. Approval to redirect a $500 grant received from the Ferndale Community Foundation to All About Animals Rescue for its Trap, Neuter and Release Program, as submitted by Community and Economic Development Director Moved by Council Member Martin, supported by Council Member Piana to approve the redirection of the $500 grant received from the Ferndale Community Foundation to All About Animals Rescue to assist with their continued Trap, Neuter and Release Program. CALL TO COUNCIL Chief Collins commended Ferndale and Madison Heights police officers on apprehending armed robbery suspects. CDS Director Delacourt announced the City has been successful in obtaining a grant for reconfiguring the Livernois corridor, and indicated concept plans and cost estimates will be submitted for Council's review shortly. Project and Grant Coordinator Gacioch provided an update on the final draft of the Capital Improvement Plan (CIP), noting it will be presented to the Plan Commission this week. City Manager Lynch reminded Council and staff of the February 25th meeting to conclude goal setting, from 5:30 until 7:30 p.m. She also noted that the agenda for the March 25th Regular Council Meeting will deal exclusively with budget issues; reminded the public that City Hall is closed on Monday, February 18th for President's Day; and announced staff will be meeting tomorrow with architects on the Police/Court project. Dan Martin reported on his recent meeting with the PTA; thanked Department of Public Works Director Cureton and his crew for an excellent job on snow removal; and thanked Peggy Snow for continuing to serve on the Beautification Commission. Council Member Lennon commended the DPW crew on snow removal; asked about the recycling pilot program in Rochester Hills and Huntington Woods; and asked that conditions in the alley behind Hambos be addressed. 9 Council Member Piana reported on the upcoming monthly meeting of the Dales Neighborhood group. Mayor Coulter had Mr. Cureton explain the process of obtaining a permit at the DPW office for residents without a driveway so that their cars are not ticketed during snow emergencies; and commended Peggy Snow for her dedication and contributions to the City. 9. 10 February 7, 2013 ATTACHMENT A Ms. Homan Executive Director Michigan Land Bank Fast track Authority 3022 W. Grand Boulevard, Suite Detroit, Michigan Re: Transfer of Michigan State Fairgrounds. On behalf of the City Council of Ferndale, we are writing this letter regarding the proposed negotiation and sale of the Michigan State Fairgrounds. We believe the sale and redevelopment of this property will have a significant impact on the City of Ferndale and the region as a whole. The City supports the sale and redevelopment of the property and is only interested in assuring that the sale and development of the property is done in a manner consistent with the current development situation of the area. The City is a member of both the Woodward Avenue Action Association and the 8 Mile Boulevard Association, and would like to support the suggestions made by both organizations, including: 1. That there is a meeting with the consulting team working on both the Woodward Transit Alternative Analysis and Complete Streets Master Plan to discuss the recommendations currently underway and to ensure that these efforts are consistent with any future proposed site plan. 2. That any sale of the property takes into consideration the recently passed Regional Transit Authority, and more specifically the ongoing efforts to develop a viable Transit Oriented Development Plan for the entire Woodward Corridor and Southeast Michigan Region. We believe this site can play a vital role in the Governor s efforts. 3. That design charrettes be incorporated into a final sale agreement ensuring that Detroit, Ferndale, the 8 Mile Boulevard Association, the Woodward Avenue Action Association, and all stakeholders have an opportunity for input. The City of Ferndale does not object to the sale of the State Fairgrounds, in fact, the City looks forward to the positive impact the appropriate redevelopment will have on the City and the area as a whole. However, we do think it is important that whoever purchases the site and is ultimately responsible for its redevelopment understands Michigan s commitment to ensuring quality development that contributes to the state s vision of a regional transit system and the associated positive economic impact. Ferndale is excited about the positive impact the redevelopment of this property can have on our City and to the surrounding area, if done in the appropriate manner. We encourage the Land Bank to ensure these considerations are taken into account throughout the negotiation process regardless of the preferred developer selected. We look forward to participating in the process as it moves forward. Lary, Director of Special Events Memorial Day Parade and Observance SUMMARY & BACKGROUND: The Ferndale Memorial Association is requesting the City s cooperation in hosting the annual observance of Memorial Day and the planning of the Memorial Day Parade on Monday, May 27, The attached Agreement between the City and the Association is the similar to the one that has been in effect and s igned for the past several years. It stipulates the City will provide all necessary police, traffic control; barricading and emergency medical response. Ferndale's Memorial Day Parade is the State of Michigan s oldest continuously running parade. 14 AGREEMENT WITH THE CITY OF FERNDALE (CITY) AND FERNDALE MEMORIAL ASSOCIATION, A MICHIGAN NON-PROFIT ORGANIZATION The Michigan Constitution, the Ferndale City Charter, various opinions of the Michigan Attorney General and series of appellate decisions of the Michigan Courts have defined those circumstances to render or receive services on behalf or by the City in furtherance of the City's interest and for the public benefit; and The Ferndale Memorial Association is a non-profit organization whose identification number, issued pursuant to Section 501 (c)(3) of the U.S. Internal Revenue Code or any other enabling provision is ; and NOW THEREFORE, the parties have agreed as follows: The Ferndale Memorial Association has agreed to sponsor, promote, cooperate and engage in activities to bring about the Annual City of Ferndale Memorial Day Parade, May 27, 2013; and The Ferndale Memorial Association agrees to use its best efforts to organize a successful Annual Ferndale Memorial Day Parade on behalf of the City on Monday, May 27, 2013; and The Ferndale Memorial Association shall receive from the City all necessary police, traffic control, barricading and emergency medical response, as has been customary; and Any public funding provided will be used only and exclusively in furtherance of a public purpose, described as the "Annual Ferndale Memorial Day Parade" as conducted in 2012, considered by the City Council to be a proper observance of Memorial Day in 2013, and constitutes a public purpose under 1905 P.A.110, as amended, and is consistent with the Charter powers and municipal objectives of the City of Ferndale; and The manner and nature of the public funding, if any, will be exclusively determined by the City and is described specifically in this Agreement; and Any public funding in cash or in-kind called for by this Agreement shall be spent or expended exclusively in the carrying out of responsibilities of the Ferndale Memorial Association under terms of this Agreement. 15 Agenda Item 6D. CITY OF FERNDALE REQUEST FOR COUNCIL ACTION FROM: Kevin P. Sullivan, Fire Chief SUBJECT: Approval for Capt. Theut and Lt. Makowski s invoices for EMU s School of Fire Staff & Command SUMMARY & BACKGROUND: We are sending all Ferndale Fire Officers to school at Eastern Michigan University s Center for Regional and National Security, School of Fire Staff & Command. The officers listed will be round two of the process for us. We will continue for the next two years, to complete the training of our full staff (2 Capt.s, 2 Lt.s, 2 Sgt.s) and then look at training Senior Firefighters in the Fill in Officer (FIO) program as part of our legacy planning for the future. The current cost of the program is $3000 per candidate and the program is ten forty hour weeks, concluding in October. The attendance for two officers in the program was budgeted in our Training and Education Account. We are only sending two at a time in order to keep staffing at a manageable level. Cherilynn Tallman, City Clerk SUBJECT: Amended Liquor License Resolution for Redevelopment License for 241 West Nine Mile Road, LLC, d/b/a Ferndale Public House, 241 W. Nine Mile Road, Ferndale, MI SUMMARY & BACKGROUND: On December 17, 2012 Council adopted a R esolution recommending to the MLCC that a Redevelopment Liquor License be approved for 241 West Nine Mile Road, LLC, d/b/a Ferndale Public House ( Ferndale Public House ). The MLCC has notified the applicant that the City s Resolution needs to clearly indicate the recommendation is for a new Class C issued under MCL (1)(b). Therefore I am requesting that Council amend the Resolution accordingly. 29 February 18, 2013 Ms. April Lynch City Manager City of Ferndale 300 East Nine Mile Road Ferndale, MI RE: Recommendation for Architectural / Engineering Services for Court and Police Projects Dear Ms. Lynch: This letter transmits an update from Plante Moran CRESA (PMC) as it relates to the assignment to assist and advise the City of Ferndale (CF) in its selection of the Architect/Engineering firm for the CF Court and Police expansion and renovation projects (Projects). This update represents the mutual efforts of City, Court, and Police Administration and staff, and legal counsel to present a framework in order to identify, evaluate, and select the architect/engineer for this project. PMC was engaged by CF and it was indicated that two firms would be interviewed to allow each firm to present information relating to relevant court and police experience, quality assurance, proposed inhouse and consultant professional services firms, and insurance coverage. This framework is to provide an order of importance of the presenting firm s experience to allow CF to make an informed decision regarding hiring of an Architect/Engineering firm for the Projects in addition to the proposed professional fees. The two firms interviewed on February 12, 2013 were French Associates of Rochester, Michigan and Redstone Architects of Bloomfield Hills, Michigan. These firms were the previously identified by the City of Ferndale as two of the highest ranking firms based on court and police project experience during the Request for Proposals in the Design-Build process undertaken by the CF in The interviews took place in the Council Chambers at City Hall and were attended by the eight (8) member Court and Police Project Committee. The format of the interviews included each firm presenting an overview to the firm, the proposed team and consultants, relevant court and police projects, adherence to the draft AIA contract, and an opportunity to allow the City, Court, and Police attendees to ask questions of each firm. Based on the interviews and financial considerations, the eight (8) member committee (Committee) unanimously selected French Associates for the Projects. The selection was based on French Associate experience having completed over 20 major court and police projects in the past 10 years throughout Southeast Michigan, most recently working with the municipalities of Livonia and Oak Park.

Dan Christ, City Attorney indicated that our ordinance as it relates to alcohol in public places needed to be reviewed and altered if we wish to continue these events. Attached are ordinance adjustments that focus on cleaning up language to address special events and the allowabilty of alcohol in the Library during their fundraising events. These changes still do NOT allow for alcohol in the Kulick Center or in the parks. It only addresses special events and the Library. The City of Ferndale Code of Ordinances, Chapter 3, Alcoholic Beverages, Article I, In General, Section 3-4 Consumption or possession of alcoholic beverages on public highways, streets and public places, is amended as follows: Section 3-4. Consumption or possession of alcoholic beverages on public highways, streets and public places. (a) It shall be unlawful for any person within the city to consume any alcoholic beverages on a public highway or street, park or other public place, including any store or establishment doing business with the public not licensed to sell alcoholic beverages for consumption on the premises as provided in article 2 of this chapter, nor shall anyone who owns, operates, or controls any such public establishment or store permit the consumption of such alcoholic beverages therein; nor shall any person possess any alcoholic liquor or alcoholic beverage in a container which is uncapped, open, or upon which the seal is broken, while upon the public street, park or other public land, or within any municipal building, unless such consumption or possession occurs during a city-approved block party, city-approved special event or where a non-profit applicant, properly registered with the state in active status, has been issued a liquor license by the Michigan Liquor Control Commission and within the confines of the area approved by the city for the block party, cityapproved special event or non-profit applicant s event other than by a person in a moving vehicle. This section shall not apply to park or other public land subject to a written lease agreement, with a term of not less than five years and a capital investment to the leased property of not less than $25,000.00, between a nonprofit corporation and the city as approved by the city council in which the lease permits alcoholic beverages to be sold, possessed and consumed on the indoors of the leased property and only provided that the nonprofit corporation has been issued a liquor license by the Michigan Liquor Control Commission and shall also not apply to a public building that is subject to a written lease agreement between the city and

63 a governmental entity or authority; or a resolution of council to a non-profit applicant, properly registered with the state in active status, regarding the use of a public building under the control of council, provided the governmental entity, authority or non-profit applicant has been issued a liquor license by the Michigan Liquor Control Commission or is otherwise in compliance with the Michigan Liquor Control Commission rules and regulations. The council reserves the right to limit areas and/or times of consumption of such alcoholic beverages where permitted under this section by council resolution. (b) Any person who possesses or has under his control an open container which is partially filled with any alcoholic beverage on a public highway or street or in a vehicle which is moving, standing or parked on a public highway or street shall be presumed to have consumed such beverage in violation of this section. Part II. Savings Clause. All proceedings pending and all rights and liabilities existing, acquired or incurred at the time this ordinance takes effect are saved and may be consummated according to the law enforced when they are commenced. Part III. Severability. The various parts, sections and clauses of this ordinance are declared to be severable. If any part, sentence, paragraph, section or clause is adjudged unconstitutional or invalid by a court of competent jurisdiction, the remainder of the ordinance shall not be affected. Part IV. Repeal. All regulatory provisions contained in other city ordinances which are inconsistent with the provisions of this ordinance, are repealed. Part V. Effective Date; Publication. City Attorney Christ has drafted the attached ordinance to establish a policy and procedure for the review of new licenses or transfer applications of the location of licenses. The proposed ordinance provides consistency of process for all licenses, whereas the current council policy resolution addresses only intra-county transfers and redevelopment licenses. Through the proposed ordinance the City sets standards of compliance that can be compelled through the annual renewal process. 67 ORDINANCE NO CITY OF FERNDALE OAKLAND COUNTY, MICHIGAN THE CITY OF FERNDALE ORDAINS: Part I. The City of Ferndale Code of Ordinances, Chapter 3, Alcoholic Beverages, Article II, Vendors for Consumption on Premises, Section 3-17, is amended as follows: Sec Approval or transfer of License for consumption on premisesrequires payment of property taxes. All personal property taxes and real property taxes and other obligations due and payable to the city shall be paid which relate to any premises for which a license approval is sought or to which or from which a liquor license is sought to be transferred before the city council shall approve the issue or transfer of such license under this article. (a) Purpose. The purpose of this division is to establish a policy and procedure for the review of new licenses or transfer applications of the location of licenses for sales of intoxicating liquor for consumption on the premises in the city. (b) New or transfer of location - Standards. Any and all new licenses and transfers of location of a license for consumption of intoxicating liquor on premises within the city require the approval of the city council. Applications for a new license or a transfer shall be in writing and filed with the city clerk. An application for a new license or the transfer of a location of a license for consumption of intoxicating liquor on the premises shall be considered by the city council based on the following standards: (i) An applicant will be given consideration only if it proposes to provide and continues to provide for the service of meals to be consumed on the premises in the amount provided prior to the transfer application or if such application provides for service of meals which shall be established to be at least fifty (50%) percent of the establishment s revenue. (ii) The location proposed and methods of operation must not detrimentally and unreasonably impact nearby property owners, businesses and residents. (iii) All applicable health and safety codes, building codes and ordinances, including zoning, must be met.

68 (iv) Applicants will be required to submit a detailed plan of proposed operation as part of their application for a new license or a transfer, which shall include a site plan for the proposed location, a plan identifying any proposed change in exterior and interior design, lay-out of any proposed change to ancillary facilities and a general operational statement outlining the proposed manner in which the establishment will be operated, including a schedule of the hours of operation, crowd control plans, use of the facility, parking provisions and the estimated cost of any proposed improvements. (v) Full identification and history of the proposed licensed holder or the licensed holder as it pertains to the license proposed to be transferred including any complaints filed with the liquor control commission, any adverse actions taken by any municipality or the liquor control commission and a positive recommendation from the city department directors who have conducted an investigation from the referral from the city manager identified in section (c)(ii). (c) Procedure. (i) Each applicant for a new license or a transfer of the location of a license for consumption of intoxicating liquor on the premises within the city must make an application to the city clerk. This application is in addition to any application required by the liquor control commission. (ii) Upon receipt of an application for a new license or a transfer, the city manager will refer it to the police chief, building official, fire chief, community and economic director, the county department of health and such other city officers or employees as the manager determines, who shall cause a investigation of the applicant to be made, including an analysis of the proposed location for the new license or for the transfer of the license for consumption of intoxicating liquor on the premises. (iii) The applicant will be required to reimburse the city for the cost of its investigation, based on a fee schedule to be adopted by resolution of city council prior to the city undertaking its review. The city shall schedule a public hearing prior to city council considering any new license or approval of an application for transfers of locations for a liquor license within the city. The public hearing shall be scheduled within sixty (60) days of city s receipt of the completed application and notice shall be provided to the applicant and the public by the city clerk. (iv) The applicant may be required to appear before the city council to address any questions or concerns raised regarding the requested transfer or the proposed plan of operation for the proposed new location. (v) If the city council is satisfied that the new license or the transfer of the location of the license for consumption of intoxicating liquor on the premises will constitute a positive asset to the community and meets the standards of this 2

69 section, it may adopt a resolution approving a new license and may adopt a resolution approving the transfer of the license, subject to any conditions stated in the resolution. Once the city council approves the new license or the transfer of the location of the license, a copy of the resolution shall be provided to the applicant. The applicant shall comply with all representations made to the city council as part of the request for transfer of location. If, following transfer of the location a license for consumption of intoxicating liquor on the premises or issue a new license it is determined that the project was not completed as presented or in compliance with the representations made to the city council, the city council may consider such matters in objecting to the renewal of the license for the following year or commence an action to revoke the license with the liquor control commission. (d) Duty of continuing compliance. Successful applicants for a new license or transfer of the location of a license for consumption of intoxicating liquor on the premises shall continue to comply with all city and state codes and the standards set forth in this section, including the submitted plan of operation and any verbal representations made to the city council in obtaining written approval of the license or requested transfer. A licensee's failure to comply with all codes or the written plan of operation or its verbal representations to city council may result in the objection by the city council to renew of its license or in action to revoke the license with the liquor control commission. Part II. Savings Clause. All proceedings pending and all rights and liabilities existing, acquired or incurred at the time this ordinance takes effect are saved and may be consummated according to the law enforced when they are commenced. A license holder s premises and the business must be in full conformity and compliance with all building, zoning, licensing health, fire, safety and other regulations of the City, and all applicable State agencies. Inspections of your premise may be conducted by the Police Department, Fire Department, the Heating, Building, Plumbing, Refrigeration, Air Conditioning, and Electrical Inspectors, Engineering, the City Assessor/Treasurer Department, and the Oakland County Health Department. All charges or bills for water or sewer services, any delinquent payment of any real or personal property tax assessed or levied against the property or other properties owned by the applicant within Ferndale must be paid in full prior to the date Council considers the application. The applicant or licensee must not be in default in any payment, debt or obligation of any kind, owing to or benefiting the City of Ferndale, at the time Council considers the application.
