5 C I T Y O F F E R N D A L E R E S O L U T I O N 2013 At a Regular meeting of the City Council of the City of Ferndale, Oakland County, Michigan, held in the Council Chambers at 300 E. Nine Mile Road, Ferndale, Michigan on the 28 th day of May, 2013, Mayor David Coulter, on behalf of the Ferndale City Council, extends the City s condolences to the family of Lawrence Connolly. Lawrence Connolly, a long-time Ferndale resident, passed away on April 25, Mr. Connolly, at the age of 22, was the sole witness to the murder of Oak Park Patrol Officer Henry Wolf in After his testimony helped convict the murderer of Officer Wolf, Mr. Connolly endured years of torment and intimidation from the imprisoned felon. Lawrence Connolly will be missed by many but especially by his son and four siblings. Lawrence Connolly was a credit to his family and to his community, and it is with deep sorrow that we mourn his loss. ADOPTED UNANIMOUSLY I, J. Mayor Coulter called the meeting to order at 7:30 p.m. 1. PLEDGE OF ALLEGIANCE 2. ROLL CALL Present: Council Member Lennon, Council Member Galloway, Council Member Piana, Mayor Coulter, and Council Member Martin. Absent: None. 3. APPROVAL OF AGENDA Moved by Council Member Martin, supported by Council Member Piana to approve the agenda as submitted. AYES: Council Member Lennon, Council Member Galloway, Council Member Piana, Mayor Coulter, and Council Member Martin. NAYS: None. MOTION CARRIED 4. PRESENTATION A. Poppy Week Proclamation Mayor Coulter proclaimed May 13-18, 2013 as Poppy Week in the City of Ferndale, a period of fundraising for the rehabilitation and comfort of disabled veterans of all wars. Frank Flores explained the American Legion and VFW Veterans will be selling paper poppies, the "Flower of Remembrance", during the week. B. Blues Festival Awards and Proceeds Craig Covey and Monica Mills presented several awards for volunteers of the 2013 Annual Ferndale Blues Festival. 5. CALL TO AUDIENCE Frank Flores, representing the American Legion, invited the public to contribute to the SSG Matthew Leach Memorial Fund. Sherry Wells reported on recycling activities as part of the Clean the Ferndale Up program; encouraged recycling via donations of CDs, coffee cans, milk jugs and baby food jars to the Ferndale Recreation Department for their summer camp program; and promoted the Ferndale Seniors Group's presentation "Recycling Made Easier" on May 11 and the Trunk & Treasure Sale on June 8. Ann Heler, FernCare Free Clinic, promoted the annual Ferncare Garage Sale on June 8, and thanked everyone who made the annual fundraising dinner a success.

8 Cristina Sheppard-Decius, Ferndale Downtown Development Authority Executive Director, provided information on the West Nine Mile Road project, including road closures and no parking zones. DPW Director Cureton added information on traffic signal timing and water main replacement. Ms. Sheppard-Decius promoted the Third Thursday Wheels & Wine event on May 16. Sherry Wells promoted the Annual Bike Rodeo, hosted by the Ferndale Recreation Department and the Ferndale Police Department. Greg Pawlica, Ferndale Community Foundation, announced the grant application process is underway; and promoted the Ferndale Pride event on June 1. Representatives of Michigan's Fallen appealed for volunteers to carry signs during Ferndale's Memorial Day Parade honoring Michigan service personnel killed in action in Iraq or Afghanistan. Chief of Police Collins thanked participants of the recent fundraising event at Ferndale High School, and issued an invitation to the Ferndale Police Memorial Flagraising Service on May CONSENT AGENDA A. NAYS: None. MOTION CARRIED 8. CALL TO COUNCIL Fire Chief Sullivan reported on the Department's attendance at the funeral service for Wayne- Westland Firefighter Brian Woehlke. City Clerk Brown announced the deadline to submit nominating petitions in order to be a candidate on the ballot for the Ferndale Public Library Board of Directors is May 14 at 4:00 p.m. City Manager Lynch asked Council to send her any comments or questions they might have on the West Nine Mile Road project communications plan she distributed and indicated staff would present an update on the project at every Council meeting as a Presentation. Dan Christ provided an update on legal challenges to the Michigan Legislature's action to preclude government entities from utilizing project labor agreements. Council Member Martin thanked the participants of the Clean the Ferndale Up project, and noted the deadline for submitting grant applications to the Ferndale Community Foundation is May 31. Council Member Lennon asked for a report from staff on the dilapidated buildings on West Marshall. Council Member Piana extended thanks to the organizers and participants of the Clean the Ferndale Up event, and promoted the Ferndale Pride and Rainbow Run events on June 1. 19 Agenda Item 6C CITY OF FERNDALE REQUEST FOR COUNCIL ACTION FROM: Timothy D. Collins, Chief of Police SUBJECT: Change North Curb on Fox Street to No Parking SUMMARY & BACKGROUND: May, 2012, a resident submitted a request to eliminate parking on the North side of Fox Street, between Kensington and Shasta. The majority of the residents of Fox Street who responded to our survey were in agreement with the proposed no parking order. Temporary No Parking signs were posted for a six-month trial period. Residents did not report any problems or complaints. I recommend that Council approve Traffic Control Order # , to permanently change the North curb of Fox Street, between Kensington and Shasta, to no parking. Cherilynn Brown, City Clerk Appointment of Representative and Alternate to SOCRRA Board of Trustees SUMMARY & BACKGROUND: Article VII of the Articles of Incorporation of SOCRRA provides that each municipal partner shall annually appoint a representative and an alternate to the Board of Trustees. These representatives will serve during the next fiscal year. SOCRRA has requested that City Council make these appointments for the fiscal year beginning July 1, Historically, with the exception of FYE2013, the DPW Director has served as the representative. 29 Agenda Item 6F CITY OF FERNDALE REQUEST FOR COUNCIL ACTION FROM: SUBJECT: Loyd Cureton, Director of Public Works Purchase of Solar Powered Pay Here Signs and Lights SUMMARY & BACKGROUND: Because of safety concerns at night by users of the City s parking pay stations, we have been working with two different suppliers to design and build a solar powered Pay Here sign and light. Each company successfully delivered a working prototype that met our specifications. After careful consideration, we are recommending the Pay Here sign and light produced by Little Buildings, Inc., 161 Shafer Dr., Romeo, Michigan at a cost of $2,065 each. Changes made to the final design included lowering the battery, a smaller three-inch tube and larger 8-1/2 polycarbonate sign. We would like to purchase ten signs and lights for a total cost of $20,970, which includes a $320 charge for shipping; delivery would take five to six weeks. 33 CITY OF FERNDALE REQUEST FOR CITY COUNCIL ACTION May 28, :30 p.m. FROM: Jenny Longthorne, Human Resources Director SUBJECT: Request to Fill the Recreation Supervisor Position SUMMARY & BACKGROUND: In 2012, when Jill Manchik was promoted into the Recreation Director position, the City decided at that time not to backfill her position, which was the Recreation Supervisor role. The primary responsibilities of this position are to handle the programming aspect of the recreation department. The intent was to evaluate her department s staffing levels and needs as a new Director given the various shared service opportunities and financial constraints. In the interim, a part-time employee has performed some of these programming duties. However, due to scheduling issues and the increased demand in programming, the department has determined that there is a need to fill the fulltime Recreation Supervisor position. This full-time position was approved for the FY 13/14 budget. We are asking for approval to begin this process utilizing the attached job description (no changes are being proposed) and the salary range as listed below (consistent with the collective bargaining agreement): Start 1 year 2 year $16.989/hr. $17.838/hr. $18.730/hr. The recruitment process will be administered in accordance with the current Collective Bargaining Agreement between the City of Ferndale and AFSCME Local 998 Clerical and Technical Employees as well as the Civil Service Rules. 34 RECREATION SUPERVISOR Classification Code: 965 Department: Recreation Department Union: AFSCME - Local 998 GENERAL STATEMENT OF DUTIES: Plans, promotes, organizes, coordinates, and supervises a community recreation program, including sports, cultural arts, physical activities, special events, classes, playgrounds, and summer programs for various age groups. SUPERVISION RECEIVED: Works under the general supervision of the Recreation Director. SUPERVISION EXERCISED: Supervises sports officials, recreation specialists, part-time recreation staff, instructors, seasonal employees, and volunteers, as assigned. ESSENTIAL DUTIES AND RESPONSIBILITIES Manages and supervises assigned operations to achieve goals within available resources; Plans and organizes workloads and staff assignments; Trains, motivates and evaluates assigned staff and volunteers; Reviews progress and directs changes as needed. Assists in providing leadership and direction in the development of short and long range plans. Selects, organizes, and supervises sports leagues, special events, classes, workshops, and activities as assigned. 36 DESIRED MINIMUM QUALIFICATIONS Education and Experience: A) Graduation from a four-year college or university with a degree in recreation, physical education, or a closely related field. B) One year recreation experience including community center programming; or C) An equivalent combination of education and experience. Necessary Knowledge, Skills and Abilities: A) Considerable knowledge of recreation philosophy, planning and administration. B) Considerable knowledge of the equipment, facilities, operations, and techniques used in a comprehensive community recreation program. C) Ability to plan and supervise the work of paid staff and volunteers. D) Ability to develop, coordinate, and direct varied activities involved in a community recreation program. E) Skill in First Aid and CPR. Lynch, City Manager Residential Parking Zone Extension SUMMARY & BACKGROUND: It has been a year since we met to discuss continued concerns and frustrations regarding parking congestion in W. Troy and Saratoga Neighborhoods. The City recognized these issues and recommended implementing a pilot program that consisted of increased enforcement along with the creation of a Restricted Parking Zone (RPZ). In December of 2012 we followed up with the same residents to gain feedback through surveys and a town hall. We found that many of them expressed the same continued concerns. The common themes suggested that the current level of enforcement was not adequate to meet the needs of the program and did not go late enough into the evening. Considering the feedback received, staff is recommending extending the RPZ as a pilot through December 31, City staff will focus on addressing how we manage enforcement as well as request to increase the hours of enforcement from 11:00am-11:00pm to 11:00am-1:00am. There will be no need for residents to secure new parking permits; they may continue to utilize the current permit they received in April The cost of the permit will remain free through December 31, While we recognize that this does not reconcile all the issues within this neighborhood, we continue to see the potential value this program may provide to ease some frustrations and concerns. Staff is committed to monitoring this pilot program as well as working through other issues as identified. After making these adjustments to the program, we anticipating meeting with the residents again to determine the success of this program. 41 CITY OF FERNDALE ORDINANCE NO AN ORDINANCE TO AMEND CHAPTER 18, TRAFFIC AND MOTOR VEHICLE CODE, TO ADD ARTICLE XI, RESIDENTIAL PARKING ZONES, TO PROVIDE FOR THE CREATION OF RESIDENTIAL PERMIT ZONES TO THE CITY OF FERNDALE CODE OF ORDINANCES. THE CITY OF FERNDALE ORDAINS: Part I. The City of Ferndale Code of Ordinances, Chapter 18, Traffic and Motor Vehicle Code, is amended to add Article XI, Residential Parking Zones, as follows: Article XI. RESIDENTIAL PARKING ZONES. Sec Purpose and Intent The City of Ferndale is enacting this ordinance in order to: (a) Reduce hazardous traffic conditions resulting from nonresidents competing with residents to park vehicles on streets in certain residential parking zones. (b) Protect the residents from unreasonable burdens in gaining access to their residences. (c) Promote efficiency in maintaining streets in those residential parking zones in a clean and safe condition. (d) Preserve residential property values in residential parking zones. Sec Legislative Findings. The City Council finds that the continued vitality of the City depends on the preservation of safe, healthy, and attractive neighborhoods and residential zones. The City Council further finds that one factor that threatens the safety, health, viability and attractiveness of the City s neighborhoods is the excessive and burdensome practice of nonresidents parking their motor vehicles for extended periods of time in onstreet parking spaces in certain residential neighborhoods. The number of nonresident motor vehicles attempting to park on streets in certain residential zones often exceeds the number of available parking spaces. A parking system for designated residential zones during certain times that limits nonresident motor vehicles will help to reduce the burden to those residents who have been unable to find onstreet parking in their residential zone and, accordingly, will promote the general welfare of the City. 1

42 Sec Definitions The following words, terms and phrases, when used in this Article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning: Lease means that a person pays rent or other remuneration for the use of a parcel or lot of real property as the person s principal residence. Motor vehicle means an automobile, truck, motorcycle, or other motor-driven or self-propelled form of transportation, but shall not include recreational vehicles. Nonresident motor vehicle means a motor vehicle parking on the street in a residential parking zone which is not registered with the City of Ferndale as a resident vehicle. Owns means that a person has at least a one-quarter ownership interest in a parcel or lot of real property with a residence within a residential zone. Resident vehicle means a motor vehicle parked in a residential zone which is registered with the City of Ferndale and has been issued a residential parking permit. Residential parking zone means a particular public street or highway block within a residential zoned district where curbside parking on the public street (onstreet parking) is limited at certain times, unless the vehicle properly displays a residential parking permit authorized by this ordinance. Sec Designation of Residential Parking Zones. In order for the City Council to determine whether a residential parking zone shall be established, or shall continue to be so designated the City Council shall conduct, upon City Manager s initiative, City Council s initative or upon a petition signed by a majority of sixty-five (65%) percent of the residents on the block street of a proposed or existing residential parking zone, a public hearing prior to such designation and prior to the withdrawal of such designation. The public hearing shall be held after notice has been published once in a newspaper of general circulation in the City. The notice shall clearly state the purpose, time and location of the public hearing and the boundaries of the proposed residential parking zone. In addition to the published notice, a similar notification may be prominently posted in the proposed or existing residential parking zone, or may be mailed to every residence in the proposed or existing residential parking zone. During such public hearing any interested person shall be entitled to appear to be heard, and to submit a written statement for the record. Sec Designation Criteria. (a) In determining whether nonresident motor vehicles sufficiently impact a residential parking zone, or portion of a residential parking district, the City Council shall consider factors including, but not limited to, the following: 2

43 (1) The extent that legal onstreet parking spaces are occupied by motor vehicles during the period proposed for parking restrictions. (2) The extent that motor vehicles parking in the area during the period proposed for parking restrictions are nonresident motor vehicles. (3) The extent that residents cannot obtain adequate curbside parking adjacent to or near their residences because of widespread use of available curbside parking spaces or onstreet spaces by nonresident motor vehicles. (4) The effect on the safety of the residents from intensive nonresident motor vehicle parking. (5) The extent of air and noise pollution, hazardous conditions, and deterioration of the residential environment as a result of traffic congestion and insufficient parking in the area. (6) The extent that the designation of a residential parking zone would be likely to reduce traffic and parking congestion and any other problems referred to above. (7) The extent and need for parking by the general public in the particular residential parking zone. (8) The desire of the residents in the proposed, or existing, residential parking zone for the institution of a residential parking zone system and the willingness of those residents to bear the costs incidental to the issuance of parking permits authorized by this ordinance. (b) Following the public hearing, the City Council may vote, as applicable: (1) Whether to designate the area under consideration as a residential parking zone and, if so, what restrictions shall apply for motor vehicles that are nonresident vehicles. (2) Limit, by resolution, the number of permits issued to any residence or resident if such limitation would further the goals of the residential parking zone. (3) Establish, by resolution, the residential parking permit fee. (4) Whether to withdraw the designation of an existing residential parking zone. Sec Posting of Residential Parking Zone. Following the City Council s affirmative vote to designate a residential parking zone, parking signs shall be erected in the designated area. The signs shall indicate prominently that curbside parking on public streets in the designated area is limited and specify the limitation applicable unless the vehicle properly displays a parking permit authorized by this ordinance. 3

44 Sec Notice to Residents of Designation of Residential Parking Zone. Following the City Council s affirmative vote to designate a residential parking zone, the City Manager or the City Manager s designee shall mail to every residence within the designated residential parking zone the following documents: (a) A Notice of Designation that shall inform the residents in the designated area of: (1) The existence and exact location of the residential parking zone. (2) The parking restrictions applicable to all vehicles in curbside parking spaces along public streets in the designated residential zones that do not properly display a residential parking permit authorized by this ordinance. (3) The procedures to obtain a residential parking permit. (b) An Application for Residential Parking Permit on which the applicant is to provide the following information for each vehicle(s) to receive a residential parking permit: (1) The name and residential address of the owner of the vehicle(s). (2) The make, model, license plate number and registration number of the vehicle(s). (3) The signature of the applicant for the residential parking permit. (4) Fee, if any, established by City Council. Sec Issuance of Residential Parking Permits. (a) Upon submission of a completed and validated residential parking permit application, and fulfillment of all applicable provisions of this ordinance controlling issuance, renewal, or transfer of residential parking permits, the applicant shall receive a residential parking permit for the vehicle(s) described in the application. The residential parking permit shall be securely affixed to the inside bottom left corner of the front windshield of the vehicle(s) and shall display the following information: (1) The designation of the residential parking zone. (2) The expiration date of the residential parking permit. (b) No residential parking permit shall be issued to a vehicle whose owner and principal operator does not reside within the designated residential parking zone. (c) The applicant for, and holder of, the residential parking permit shall be the owner or principal operator of the vehicle receiving the parking permit. 4

45 (d) No vehicle shall be issued a residential parking permit unless it displays valid state license plates, except where state law does not require the vehicle to display license plates. (e) Any landlord leasing residential property located in a designated residential parking permit zone shall provide notice of this ordinance along with a residential parking permit application to its tenants. Sec Use of Parking Permits. (a) A parking permit shall not guarantee or reserve a parking space within a designated residential parking zone. A parking permit shall not authorize the standing or parking of any vehicle in such places and during such times when the stopping, standing or parking of vehicles is prohibited or set aside for specified types of vehicles, and shall not excuse the observance of any traffic regulation. (b) Whenever the holder of a residential parking permit, or the vehicle for which the parking permit was issued, no longer fulfills one or more of the applicable provisions of this ordinance controlling issuance, renewal or transfer of parking permits, the holder shall surrender the parking permit to the City Manager or City Manager s designee. (c) Until its expiration, surrender or revocation, a parking permit shall remain valid for such time as the holder continues to reside within the designated residential parking zone. (d) A parking permit shall be valid only in the residential parking zone for which it is issued. (e) It shall be a violation of this ordinance for the holder of a parking permit to fail to surrender the permit when so directed by an authorized person. (f) It shall be a violation of this ordinance for any person to represent in any fashion that a vehicle is entitled to a parking permit authorized by this ordinance when it is not so entitled. The display of a parking permit on a vehicle not entitled to such a parking permit shall constitute a violation of this ordinance. Sec Exemptions. (a) Whenever metered parking is in effect in any portion of a residential parking zone, the parking spaces controlled by meters shall be excepted from the provisions of this ordinance only so long as the control by the meters is in effect. (b) The provisions of this ordinance shall not supersede the provisions of the City Code and state laws relating to parking by disabled persons. (c) The following vehicles are specifically exempted from the parking restrictions imposed by this ordinance: 5

46 (1) A motor vehicle owned by or operated under contract to a public utility when used in the construction, operation, removal or repair of utility facilitates or engaged in authorized work in the residential parking zone. (2) A motor vehicle identified as owned by or operated by a federal, state, or local governmental agency and being used in the course of official government business. (3) An authorized emergency vehicle as defined by state law. Sec Withdrawal of Designation of Residential Parking Permits. Following the City Council s affirmative vote to withdraw the designation of an existing residential parking zone, the City Manager or the City Manager s designee shall provide notice to the residences within the existing residential parking zone of the City Council s withdrawal of the designation and its effective date. Sec Regulations and Forms. The City Manager or the City Manager s designee is authorized to establish such written regulations and forms necessary to implement and enforce the provisions of this ordinance. Sec Penalty. Any person violating any provisions of this ordinance shall be responsible for a civil infraction punishable by a fine of not more than $ Each day during which the violation continues shall constitute an additional, separate and distinct violation. Sec Revocation of Permit. In addition to the penalties provided above for violation of this ordinance, the City Manager or the City Manager s designee may revoke the residential parking permit of any person found to be in violation of this ordinance, and, upon written notification, the person shall surrender such permit to the City Manager or the City Manager s designee. Failure to surrender a revoked residential parking permit when requested to do so shall constitute a separate violation of this ordinance. Sec Sunset. All sections of this ordinance shall expire on December 31, 2013, unless City Council resolves by ordinance amendment to repeal this provision. Part II. Savings Clause. All proceedings pending and all rights and liabilities existing, acquired or incurred at the time this ordinance takes effect are saved and may be consummated according to the law enforced when they are commenced. 6

47 Part III. Severability. The various parts, sections and clauses of this ordinance are declared to be severable. If any part, sentence, paragraph, section or clause is adjudged unconstitutional or invalid by a court of competent jurisdiction, the remainder of this ordinance shall not be affected. Part IV. Repeal. All regulatory provisions contained in other city ordinances, which are inconsistent with the provisions of this ordinance, are repealed. Part V. Effective Date; Publication. This ordinance shall become effective upon publication of a notice in a newspaper circulated in the city, stating the date of the enactment and the effective date of the ordinance, a brief notice as to the subject matter of this ordinance, and such other facts as the city clerk shall deem pertinent and that a copy of the ordinance is available for public use and inspection at the office of the city clerk.
