GALE Minutes November 16, 2017 Call to Order Chair Arkoosh called the meeting to order. Roll Call and Pledge of Allegiance Chair Arkoosh, Vice Chair Lawrence, and Commissioner Gale were present. First Deputy Treasurer William Caldwell led the Pledge of Allegiance. Commissioners Comments Vice Chair Lawrence thanked everyone who helped make the November 7 Election Day a success. Chair Arkoosh noted the presence of Controller Karen Sanchez and Recorder of Deeds Jeanne Sorg. Approval of Minutes Vice Chair Lawrence made a motion to approve the minutes of the November 2, 2017 meeting of the Montgomery County Board of Commissioners. Commissioner Gale seconded the motion. Chair Arkoosh brought the motion to a vote and it was adopted unanimously. Announcements, Commendations and Reports National Hunger and Homelessness Awareness Week Emma Hertz Ms. Hertz presented on the challenges of food scarcity and homelessness. Chair Arkoosh thanked Ms. Hertz for her presentation and commented on the challenges for homeless children. Chair Arkoosh also commented on her attendance on the launch of the Your Way Home Program: EPIC (Eviction Prevention and Intervention Coalition). Vice Chair Lawrence thanked Ms. Hertz and commented on his participation in the week long Food Stamp Challenge and the difficulties that people face with food insecurities. Vice Chair Lawrence encouraged people to donate to their food pantries all year round. Commissioner Gale thanked Ms. Hertz and commented on the difficulty of going thorough food insecurity and homelessness during the holidays. 2 Consideration of the Proposed 2018 Budget Vice Chair Lawrence made a motion that the proposed budget for Montgomery County for the Fiscal Year 2018 shall be posted to the County s website, and a printed copy shall be available for inspection and review by the public. Commissioner Gale seconded the motion. Commissioner Gale commented on the 2.6 million in negative appropriations in 2017 and inquired if that number would be 2.8 million in Mr. Dortone answered in the affirmative. Chair Arkoosh made a comment regarding the Compensation Study. Chair Arkoosh also thanked Mr. Dortone, Mr. Tom Bonner and the Montgomery County Senior Staff for their hard work on the 2018 budget. Chair Arkoosh noted that Public Hearings on the proposed County Budget for 2018 would be held on Thursday, November 30, 2017 at 10:00 am and 5:30 p.m. There were no further board comments. Resolutions Authorization of a District Court Lease for the King of Prussia District Court John Savoth Vice Chair Lawrence made a motion that the proper County Officials, in accordance with the authority conferred by law, and subject to the approval of the County Solicitor, hereby authorize entering into a lease agreement with the King of Prussia Volunteer Fire Company, owners of the property located at 170 Allendale Road in King of Prussia, for the purpose of housing District Court at that location, beginning July 1, 2018, at rents in accordance with the schedule attached in the resolution. Commissioner Gale seconded the motion. Chair Arkoosh inquired if the siren noise had been taken into consideration. Mr. Savoth responded that there is mild disruption but nothing that interferes with the courts. There were no further board comments. There was no public comment. Prohibition on New Video Gaming Terminal Locations in Montgomery County Josh Stein

3 Vice Chair Lawrence made a motion that the Montgomery County Board of Commissioners, subject to the authority conferred by law, hereby resolve that the placement of video game terminals within the borders of Montgomery County shall be prohibited. Be it further resolved, the proper County Officials are hereby authorized to draft and send a letter to the Pennsylvania Gaming Control Board indicating the County s desire to prohibit the placement of Video Gaming Terminals within the borders of Montgomery County, per the requirements of the recently amended Pennsylvania Race Horse Development and Gaming Act. Commissioner Gale seconded the motion. Chair Arkoosh asked Mr. Stein to clarify the significance of the Board s timing on voting on this resolution. Mr. Stein clarified that the bill requires that if a County wishes to prohibit the expansion under this new bill, that it needs to be done within 60 days of the enactment of the law. Chair Arkoosh also inquired about mini casinos licenses. Mr. Stein responded that mini casinos are not permitted in County s with a category 3 license, like Montgomery County. Vice Chair Lawrence asked Mr. Stein to define truck stop. Mr. Stein responded that a truck stop must be equipped with diesel islands used for fueling commercial motor vehicles, sells an average of 50,000 gallons of diesel or biodiesel fuel each month for the previous 12 months, has at least 20 parking spaces dedicated for commercial motor vehicles, has a convenience store, has a parcel of land situated on no less than 3 acres, and not on any land owned by the PA turnpike. There were no further board comments. There was no public comment. Chair Arkoosh brought the motion to a vote and it was adopted unanimously. Approval of Contract Award Selection by PennDOT for Phase 3 Construction of the Lafayette Street Extension Matt Edmond Vice Chair Lawrence made a motion that the Commissioners of Montgomery County concur in the Pennsylvania Department of Transportation s determination of contract award for Phase Three (Section MGN) of the Lafayette Street Extension Project, and, subject to review by the County Solicitor, hereby authorize the Board Chair and Chief Clerk/Chief Operating Officer to execute the appropriate documents to enter into the contract with Allan Myers, LP of Worcester, Pennsylvania, in the amount of NINETEEN MILLION FIVE HUNDRED FIFTEEN THOUSAND FIVE HUNDRED FIFTEEN DOLLARS AND ZERO CENTS ($19,515,515.00). Commissioner Gale seconded the motion.

4 Vice Chair Lawrence inquired about the timeline and how long it would take until completion. Mr. Edmond responded that it would be 30 months until completion. Chair Arkoosh inquired about whether Phase 3 will be able to start in January or if it was weather dependent. Mr. Edmond responded that the work will start in January although it may move a little slower because of the weather. Ms. Pauline Braccio inquired about the bidding process. Mr. Edmond explained the bidding process. There were no further board comments. There were no further public comments. Chair Arkoosh brought the motion to a vote and it was adopted unanimously. Advertisement of a Bid On motion of Vice Chair Lawrence, seconded by Commissioner Gale, the following request for an advertisement of a Bid was authorized unanimously, subject to the approval of the County Solicitor: A. Advertisement of an RFP and a Bid Montgomery County 1. RFP on behalf of Assets & Infrastructure for design-build services to place or construct a new Parks Ranger Station 2. Bid on behalf of Assets & Infrastructure for the replacement of the Geryville Pike Culvert 304 end wall There was board comment. There was no public comment. Awards of Contract Vice Chair Lawrence made a motion to approve the preceding awards of contracts, as described by the Chief Operating Officer Lauren Lambrugo, and to authorize the proper County Officials to execute the same, subject to the approval of the County Solicitor. Commissioner Gale seconded the motion. Ms. Pauline Braccio made a public comment regarding contract award #2 and #3. There was no board comment. There were no further public comments. 5 General Public Comment Ms. Pauline Braccio, of Towamencin Township, made a public comment. Ms. Jennifer Mazlow, of Citizens for Better Elections, made a public comment. Commissioners Comments Upcoming Meeting Dates The next meeting of the Montgomery County Board of Commissioners will be at 10am on Thursday, December 14, Adjournment On motion of Vice Chair Lawrence, seconded by Commissioner Gale, the November 16, 2017 meeting of the Montgomery County Board of Commissioners was adjourned. Salary Board Controller Sanchez made a motion to approve the November 16, 2017 Salary Board presentation as given by the Director of Human Resources, Donna Pardieu and to authorize the proper County Officials to execute the same. Vice Chair Lawrence seconded the motion. There was no board comment. There was no public comment. Chair Arkoosh brought the motion to a vote and salary board was adopted unanimously. Adjournment On motion of Controller Sanchez, seconded by Vice Chair Lawrence, the November 16, 2017 meeting of the Montgomery County Salary Board was adjourned.

7 MONTGOMERY COUNTY COMMISSIONERS November 16, C. 404 On motion of Vice Chair Lawrence, seconded by Commissioner Gale, it was adopted that the proposed budget for Montgomery County for the Fiscal Year 2018 shall be posted to the County s website, and a printed copy shall be available for inspection and review by the public.

8 MONTGOMERY COUNTY COMMISSIONERS November 16, C. 405 On the motion of Vice Chair Lawrence, seconded by Commissioner Gale, it was unanimously adopted that: 1. The County of Montgomery (the County ) currently leases temporary court facilities for District Court , where Magisterial District Judge William Maruszczak presides, following the expiration of the previous long-term lease at another location. 2. The leased space, located at 200 W. Main St., Norristown, Pennsylvania, was intended to be temporary while Court Administration determined a suitable new space for the District Court. 3. Court Administration has identified space at 170 Allendale Road in King of Prussia, a three-story fire house currently owned/occupied by the King of Prussia Volunteer Fire Company (the Lessor ), whose first-floor social hall is available and is proposed for conversion to a new District Court with associated office and support spaces. 4. The Lessor of the building has offered a fifteen (15) year lease to begin July 1, 2018, at a monthly rent of $5,710.00, with fit-out costs included in the monthly rental. 5. The President Judge of the Montgomery County Court of Common Pleas and Court Administration have approved the proposal to relocate District Court to 170 Allendale Road in King of Prussia, with a proposed move-in date of July 1, 2018, entering into a fifteen (15) year lease with the Lessor. NOW, THEREFORE, BE IT RESOLVED that the proper County Officials, in accordance with the authority conferred by law, and subject to the approval of the County Solicitor, hereby authorize entering into a lease agreement with the King of Prussia Volunteer Fire Company, owners of the property located at 170 Allendale Road in King of Prussia, for the purpose of housing District Court at that location, beginning July 1, 2018, at rents in accordance with the schedule on the attached Exhibit A. 10 MONTGOMERY COUNTY COMMISSIONERS November 16, C. 406 On motion of Vice Chair Lawrence, seconded by Commissioner Gale, it was unanimously adopted that: 1. On October 30, 2017 Governor Wolf signed into law House Bill 271 which amends the Pennsylvania Race Horse Development and Gaming Act ( Act ), 4 Pa.C.S et seq., and authorizes a number of gambling expansion opportunities throughout the Commonwealth. 2. One such opportunity is found in the allowance of Video Gaming Terminals ( VGTs ) at certain truck stops, as defined by the Act, across Pennsylvania. 3. Section 4506 of the Act provides for a Host County Option that permits a county in which a Category 1, Category 2, or Category 3 Slot Machine License is located to prohibit the placement of VGTs within the host county. 3. Montgomery County ( County ) is the location of Valley Forge Casino, a holder of a Category 3 Slot Machine License. 4. Pursuant to the power granted under Section 4506, the County now desires to prohibit the placement of VGTs within the borders of the County. NOW THEREFORE BE IT RESOLVED that the Montgomery County Board of Commissioners, subject to the authority conferred by law, hereby resolve that the placement of video game terminals within the borders of Montgomery County shall be prohibited. BE IT FURTHER RESOLVED, the proper County Officials are hereby authorized to draft and send a letter to the Pennsylvania Gaming Control Board indicating the County s desire to prohibit the placement of Video Gaming Terminals within the borders of Montgomery County, per the requirements of the recently amended Pennsylvania Race Horse Development and Gaming Act

11 MONTGOMERY COUNTY COMMISSIONERS November 16, C. 407 On the motion of Vice Chair Lawrence, seconded by Commissioner Gale, it was unanimously adopted that: 1. Montgomery County (the County ) is the lead entity in implementing the Lafayette Street Extension Project (the Project ). 2. The County prepared a construction bidding package for Phase Three of the Project Section MGN which is the reconstruction and widening of Lafayette Street between Barbadoes Street and Ford Street in Norristown, and the relocation of the Schuylkill River Trail. 3. The Pennsylvania Department of Transportation (PennDOT) administers and oversees the bidding process in conformance to state and federal laws, and will assist in providing oversight during construction of the Project. 4. PennDOT received six (6) bids from various construction firms and has reviewed and certified the bid proposal from Allan Myers, LP of Worcester, Pennsylvania as the lowest bidder, and has formally recommended that the County award the construction contract to Allan Myers, LP in the amount of $19,515, NOW THEREFORE BE IT RESOLVED that the Commissioners of Montgomery County concur in the Pennsylvania Department of Transportation s determination of contract award for Phase Three (Section MGN) of the Lafayette Street Extension Project, and, subject to review by the County Solicitor, hereby authorize the Board Chair and Chief Clerk/Chief Operating Officer to execute the appropriate documents to enter into the contract with Allan Myers, LP of Worcester, Pennsylvania, in the amount of NINETEEN MILLION FIVE HUNDRED FIFTEEN THOUSAND FIVE HUNDRED FIFTEEN DOLLARS AND ZERO CENTS ($19,515,515.00).

13 17-C. 409 On the motion of Vice Chair Lawrence, seconded by Commissioner Gale, it was unanimously adopted that: 1. Pursuant to the Housing and Community Development Act of 1974, P. L , as amended, the County of Montgomery (the County ), subsequent to designation as an Urban County/Participating Jurisdiction, is eligible to receive entitlement funds for the undertaking of the Community Development Block Grant Program (CDBG). 2. Pursuant to the requirements of this legislation, in order to obtain such funds, the County is required to plan, document, and implement activities consistent with the program regulations, and specifications to develop a Five-Year Consolidated Plan and Annual Action Plan. 3. Funds related to activities approved in previous Annual Action Plans, which either cannot be fulfilled, or are no longer in keeping with the County s Five- Year Consolidated Plan may be reallocated. 4. The Montgomery County Office of Housing and Community Development recommends to the Commissioners reallocation of $5, of Community Block Grant funds for a housing rehabilitation program carried out by Genesis Housing Corporation in the Borough of Pottstown to benefit low and moderate income homeowners. NOW, THEREFORE BE IT RESOLVED that the proper County Officials, in accordance with the authority conferred by law, subject to the approval of the County Solicitor, hereby authorize Montgomery County to approve changes to the 2013 Annual Action Plan to provide reallocation of Community Development Block Grant funds to Genesis Housing Corporation in the amount of FIVE THOUSAND DOLLARS ($5,000.00).

14 17-C. 410 On the motion of Vice Chari Lawrence, seconded by Commissioner Gale, it was unanimously adopted that: 1. Per Commissioners Resolution 17-C.287 dated August 17, 2017, the County awarded a contract for the Reconstruction of County Bridge #224, Rittenhouse Road over Skippack Creek in Towamencin Township, to Loftus Construction Inc. of Cinnaminson, NJ for a total cost of $532, The Department of Assets & Infrastructure requests an additional $107, for additional scope required to complete the project. NOW, THEREFORE BE IT RESOLVED that the contract awarded to Loftus Construction Inc. of Cinnaminson, NJ, for the Reconstruction of County Bridge #224, Rittenhouse Road over Skippack Creek in Towamencin Township, be amended for a new total lump sum price of $639,

15 17-C. 411 On the motion of Vice Chair Lawrence, seconded by Commissioner Gale, it was unanimously adopted that: 1. The Behavioral Health/Developmental Disabilities Department previously solicited Request for Proposal (RFP 14-50), Forensic Consultant, for a period of one (1) year commencing on date of contract execution with an option to be extended for three (3) additional one (1) year terms. 2. The Behavioral Health/Developmental Disabilities Department recommends extending the contract with Patricia Griffin of Wyndmoor, PA for the third and final one (1) year term. THEREFORE IT IS HEREBY RESOLVED that the proper County Officials, in accordance with the authority conferred by law, subject to the approval of the County Solicitor, are hereby authorized to extend the contract with Patricia Griffin of Wyndmoor, PA for Forensic Consulting, for a total amount of $25,080.00, for a term of one (1) year.

16 17-C. 412 On the motion of Vice Chair Lawrence, seconded by Commissioner Gale, it was unanimously adopted that: 1. An RFP for household hazardous waste collection throughout the County of Montgomery issued by the City of Philadelphia on behalf of Bucks, Chester, Delaware and Montgomery Counties. 2. The City of Philadelphia awarded a contract to Clean Harbors Environmental Services, Inc. of Norwell, MA for a term of one (1) year with the option to extend the contract for three (3) additional one (1) year terms. 3. The Planning Commission recommends exercising the first additional one (1) year contract renewal for the 2018 calendar year. THEREFORE IT IS HEREBY RESOLVED that the contract of Clean Harbors Environmental Services, Inc. of Norwell, MA to provide a regional household hazardous waste collection program throughout the County be awarded for a one (1) year term for a total contract amount of $300,

17 17-C. 413 On the motion of Vice Chair Lawrence, seconded by Commissioner Gale, it was unanimously adopted that: 1. The Information and Technology Solutions Department requires proprietary software maintenance to support the County s Geographic Information System ( GIS ). 2. ESRI, Inc. of Redland, CA has agreed to extend the contract to provide proprietary software maintenance to support the County s GIS System for a one (1) year period beginning December 31, 2017 through December 30, The total cost to provide proprietary software maintenance to support the County s GIS System for a one (1) year period beginning December 31, 2017 through December 30, 2018 is $34, NOW THEREFORE BE IT RESOLVED, that a contract be authorized with ESRI, Inc. of Redland, CA, to provide proprietary software maintenance to support the County s GIS System, for a total cost of $34,380.00, beginning December 31, 2017 through December 30, 2018.

18 17-C. 414 On the motion of Vice Chair Lawrence, seconded by Commissioner Gale, it was unanimously adopted that: 1. The Commonwealth of Pennsylvania has entered into State Contract # with DS Services of America Inc., dba Crystal Springs of Atlanta, GA, to provide bottled water and dispensers to State Agencies and Political Subdivisions under Act 31, 1971 at State Contract prices. 2. The Department of Assets and Infrastructure has requested to use State Contract # , for bottled water and dispensers. 3. The estimated total cost for bottled water and dispensers for a contract period beginning December 1, 2017 through November 30, 2018 is $63, NOW THEREFORE BE IT RESOLVED, that a contract be authorized with DS Services of America Inc., dba Crystal Springs of Atlanta, GA for an estimated total cost of $63,000.00, for a contract period beginning December 1, 2017 through November 30, 2018, all in strict accordance with Act 31, 1971, which precludes the need for advertised bidding.

19 17-C. 415 On the motion of Vice Chair Lawrence, seconded by Commissioner Gale, it was unanimously adopted that: 1. The County wishes to extend the current contracts for the Operation of the County's Your Way Home Housing Resource Centers. 2. Pottstown Cluster of Religious Communities is currently on contract to provide this service for the Pottstown area. 3. Carson Valley Children s Aid is currently on contract to provide this service for the Norristown area. 4. Keystone Opportunity Center is currently on contract to provide this service for the North Penn/Indian Valley areas. 5. These are the third of three (3) allowable, annual extensions. 6. The contract extension will cost $1,677, (Pottstown Cluster of Religious Communities - $532,449.00; Carson Valley Children s Aid - $965,790.00; Keystone Opportunity Center - $179,350.00) for the period 1/1/ /31/2018. NOW, THEREFORE, BE IT RESOLVED the County Commissioners hereby authorizes an extension to the Contracts with Pottstown Cluster of Religious Communities of Pottstown, PA, Carson Valley Children s Aid of Flourtown, PA, and Keystone Opportunity Center of Souderton, PA as indicated above.

20 17-C. 416 On motion of Vice Chair Lawrence, seconded by Commissioner Gale, it was unanimously adopted that: 1. The Montgomery County Department of Behavioral Health/Developmental Disabilities (hereinafter BH/DD ) provides services for BH/DD clients of Montgomery County. 2. BH/DD has determined the scope and extent of such services and the providers listed below have submitted an individual budget, accepted and approved by the Assistant Director, Health and Human Strategic Support to provide these services for the contract period specified below. 3.
