GALE Minutes February 1, 2018 Call to Order Chair Arkoosh called the meeting to order. Roll Call and Pledge of Allegiance Chair Arkoosh, Vice Chair Lawrence, and Commissioner Gale were present. Ms. Doris Starks Smith led the Pledge of Allegiance. Commissioners Comments Approval of Minutes Vice Chair Lawrence made a motion to approve the minutes of the January 18, 2018 meeting of the Montgomery County Board of Commissioners. Commissioner Gale seconded the motion. Chair Arkoosh brought the motion to a vote and it was adopted unanimously. Announcements, Commendations and Reports Montco 2040 Plan Implementation Update Jody Holton Ms. Holton made a presentation on the MontCo 2040 Plan in the form of a PowerPoint Presentation. The Presentation is attached in the appendix of this document. Chair Arkoosh thanked Ms. Holton for her work and the work of the Planning Department for making the 2040 Plan a living document. Chair Arkoosh also commented that the growth in the County is growing the Commissioners hoped it would grow. Vice Chair Lawrence thanked Ms. Holton for her work and inquired about the new category within the Implementation grants. Jody Holton responded that there is the Downtown Revitalization category, the Walk and Bike MontCo category, and Adaptive and Resiliency category. Commissioner Gale thanked Ms. Holton and inquired about applications submitted by municipalities for the MontCo 2040 grant. Ms. Holton responded that the applications usually come in later February but that a lot of municipalities have reached out with questions regarding the grant. 2 Mr. Smith detailed an instance wherein members of Roads and Bridges were working in one of the large vehicle and equipment storage barns at the new Roads & Bridges facility in Worcester when suddenly an electrical fire ignited. Jerry Griffith and Mike Courtney were in the barn when this occurred and acted immediately; taking several steps that resulted in a quick resolution to what could have been a major catastrophe. Jerry and Mike called the Emergency Operations center, then gathered fire extinguishers and began to extinguish the fire. The fire was extinguished and the Worcester Fire Department verified the building s safety. Because of Jerry and Mike s actions, no people were injured, no equipment was damaged, and the building still stands with only minor damage. Mr. Smith asked to formally recognize Jerry Griffith, Mike Courtney and their Foreman Andy Lattanze for their unwavering dedication to the County and its constituents. Resolutions Authorization of a Municipal Planning Assistance Contract for the Pottstown Metro Area Regional Planning Commission Jody Holton Commissioner Gale made a motion that the proper County Officials, in accordance with the authority conferred by law, subject to the approval of the County Solicitor, are hereby authorized to approve the contract for municipal planning assistance with the Pottstown Metro Area Regional Planning Commission, as outlined in the resolution. Vice Chair Lawrence seconded the motion There was no board comment. There was no public comment. Chair Arkoosh brought the motion to a vote and it was adopted unanimously. Grant of Easements to the North Penn Water Authority Josh Stein Vice Chair Lawrence made a motion that the proper County Officials, in accordance with the authority conferred by law, subject to the approval of the County Solicitor, are hereby authorized to execute the necessary documents to grant certain temporary construction and permanent utility easements to the North Penn Water Authority, for the purposes of constructing and maintaining a new water transmission main line across County property, as specified in the resolution. Commissioner Gale seconded the motion.

3 Chair Arkoosh inquired if this grant was at any cost to the County. Mr. Stein replied that there was no cost to County. There were no further board comments. There was no public comment. Emergency Medical Services Advisory Council Appointments Commissioner Gale made a motion that Timothy Hinchcliff and Brian Kuklinski be appointed as Montgomery County Ambulance Association representatives to the Montgomery County Emergency Medical Services Advisory Council. Each appointee will serve a two-year term that is to expire on February 1, 2020 and to serve at the pleasure of the County Commissioners and in accordance with the current duly-adopted By-Laws. Vice Chair Lawrence seconded the motion. There was no board comment. There was no public comment. Chair Arkoosh brought the motion to a vote and it was adopted unanimously. Montgomery County Community College Board Appointments Vice Chair Lawrence made a motion to appoint Varsovia Fernandez and Napolean Nelson to the Montgomery County Community College Board of Trustees for terms to begin immediately and to expire on March 20, 2021 and to serve at the pleasure of the County Commissioners and in accordance with the current duly-adopted By-Laws. Commissioner Gale seconded the motion. There was no board comment. There was no public comment. Chair Arkoosh brought the motion to a vote and it was adopted unanimously. Advertisement of RFPs On motion of Vice Chair Lawrence, seconded by Commissioner Gale, the following request for advertisement of RFPs and a Bid was authorized unanimously, subject to the approval of the County Solicitor: A. Advertisement of RFPs and a Bid Montgomery County 1. RFP on behalf of Aging and Adult Services for the Senior Community Centers (SCC) in the Harleysville and Lansdale areas only 2. RFP on behalf of Assets & Infrastructure for Engineering for County Bridge 275, Waverly Road in Cheltenham Township 3. Bid on behalf of Assets & Infrastructure for the Rehabilitation of County Bridge 243, Old Reading Pike over Yeagers Creek in West Pottsgrove Township

4 There were no further board comments. There was no public comment. Chair Arkoosh brought the motion to a vote and it was adopted unanimously. Awards of Contract Vice Chair Lawrence made a motion to approve the preceding awards of contracts, as well as the contract for the Southeast PA Regional Taskforce, as described by the Chief Operating Officer Lee Soltysiak, and to authorize the proper County Officials to execute the same, subject to the approval of the County Solicitor. Commissioner Gale seconded the motion. Chair Arkoosh commented on her excitement for the contract award for the One Montgomery Plaza Reskin Project. Chair Arkoosh also asked for the patience of the employees in One Montgomery Plaza, as this project will be disruptive but ultimately, will revitalize the building. Commissioner Gale made the following comments regarding the contract award for the One Montgomery Plaza Reskin Project. Madam Chair, I have a comment as well related to the same contract award, number 10 on the agenda; the One Montgomery Plaza Reskin Project. I would say for at least 10 years, probably longer, we ve had scaffolding around the building. We ve known this, not only this administration but previous administrations, that the building needed to be repaired. What concerns me is the lack of responses we ve received from providers. As our Chief Operator mentioned, 507 providers were sent with General Contracting, we received only 4 responses. And more concerning than that, with HVAC, 507 providers with 1 responding. Plumbing and Fire Protection providers with 1 responding. Electrical Contracting 500 providers with 1 responding. So due to the fact that this has been an ongoing process, we ve had engineering done, we ve design work done, to cast a net to over 500 providers and receive 1 response, is quite alarming. That s less than.2% of a response rate. So, before I would ever vote to award over $23 million to this project to undergo construction, I d like to know what the factors are limiting the bid responses because there has to be a reason why. Either the contractors are not interested in the project and that would be a reason why, or we re not doing a good procurement policy and procedure to capture more bids that would create more competition and give us a better idea of what these cost rates should be coming in at. So I strongly encourage the Board to revisit this, to cast another net, to re-advertise the RFP and hope that we get more than one response for this important work that s being done to the building. So I m willing to make that motion but I strongly believe we should re-advertise this RFP. So my motion would be to re-advertise the RFP related to the services of One Montgomery Plaza Reskin Project. Chair Arkoosh: Is there a second to that motion? I don t hear a second so that motion failed then.

5 Commissioner Gale: Ok so then I would like to do a roll call vote on contract award #10 and then group the other 9 together. Chair Arkoosh: Ok, we can certainly do that. Ok so let s do the first 9. [to Solicitor Shelley Smith] We have to do another motion, right? That just includes the first 9? Vice Chair Lawrence made a motion to approve the preceding awards of contract numbered 1-9, as described by the Chief Operating Officer Lee Soltysiak, and to authorize the proper County Officials to execute the same, subject to the approval of the County Solicitor. Commissioner Gale seconded the motion. There was no board comment. There were no further public comments. Chair Arkoosh brought the motion to a vote and it was adopted unanimously. Vice Chair Lawrence made a motion to approve the preceding award of contract, noted as #10 on our agenda, as described by the Chief Operating Officer Lee Soltysiak, and to authorize the proper County Officials to execute the same, subject to the approval of the County Solicitor. Chair Arkoosh seconded the motion. Chair Arkoosh: I would like to make one comment which is that this project has been underway for the last several years. The Commissioners have been briefed on this project multiple times. We have each had an opportunity to provide our comments and our thoughts about the project. The advertisement for this award was put out a couple of months ago, I believe? Six to eight weeks ago? There have been multiple times for Commissioners to weigh in and share their thoughts on this project. Commissioner Gale: I would like to add additional comments. You are correct this has been a very long ongoing project. We voted in November of 2017 to advertise the RFP, I believe applicants started in January of this year and I found out yesterday who was receiving the contract awards. And I found out yesterday that only one responded and 4 responded for general contracting, 1 for the other 3 items. So, this has been ongoing but not all the Commissioners were included in that full process so I d like to point that out as well. Chief Operating Officer Lee Soltysiak: Madam Chair, would you like some additional background information for all three Commissioners on the response rate? Chair Arkoosh: Sure. COO Lee Soltysiak: I ll ask Tom Bonner to speak to this issue in particular because when it, when we received the bids, obviously having received 1 bid in

6 a number of categories was noted by Purchasing and Tom and his team as well. We asked for further explanation and Tom can elaborate. Capital Projects Program Director Tom Bonner: Certainly. So, just with respect to the response rates, as has been spoke about we have the benefit in this project and will have going forward for all the other County Campus projects that we discussed, an extensive team and review and preparation procedure that goes into that bolsters our county resources here in the department of purchasing in the solicitors office and here in the Commissioner s office. Along with our consultant team, we have capable architects and construction managers that all assisted in briefing this group and sort of formulating the packages and looking at how to most widely cast a net. It s obviously desirable that we engender the most competition that we may possibly can in delivering these projects. We prepared this specification and these documents in such a way as to engender increased competition across the board, ensuring that we follow both our procurement procedure and best practices in construction award. We were fortunate to get the respondents we did and are eminently confident that this project will be delivered pursuant to the plans and within the constraints of the contract that we ll enter into with each of these bidders. I can certainly expand if there s any other questions about sort of the procedures we went through but timeframes we have been looking at this project and various options and different iterations and wanting to maximize the cost efficiency and construction schedule efficiency for longer than I ve actually even been here but certainly my whole tenure here and can say that the capabilities of the team that have been looking at that are on display in what has been put forth on the street and what was bid on. So, the costs as they have come in are within the budget we ve assigned and allow us to move forward in a way that we intend to keep that throughout the duration of this two year project. Chair Arkoosh: Mr. Bonner, I know that we had in the original design of this project; we had estimates that were given to us by those folks about what these components were likely to cost. Are the bids that have come in within those ranges? Mr. Bonner: Absolutely, so actually part of, and again, this gets to the advantage of planning and diligent preparation for these projects- our team is able to issue and constantly throughout the process updates designs based on cost estimates and the cost estimates and the bids that come in are certainly within the range. So, the straight answer to your question is absolutely- the bids as they have been received hue to the estimates that were prepared throughout the project and certainly as we went into the bidding process. Commissioner Gale: To follow up on that, I understand that there s a review team and they ve spent countless hours reviewing this process that s where I don t see the common sense of how such a strong effort in reviewing the

7 applications, how we couldn t capture more interest in the project. So there has to be a problem for one person to bid on all this work. So to me, that displays there s an issue. If I own this building and I wanted to put a new façade on the exterior, I would want at least 3, 4 bids on the project to get an idea of what other firms and companies are willing to do with the project and where they come in pricewise at least. So something is wrong with the procedure here. It s been for years discussed, and here we vote today for over $23 million with not many businesses interested in doing the project. I m sure all these firms are capable, I m sure they re capable of doing a very good job on the project but there s also 507 that received this and they show no interest at all. So that s my concern and it s very unfortunate that the Board doesn t share that same concern. COO Soltysiak: I would just make a couple more notes for the Commissioners consideration. The bulk of this award is for the general contracting contract which is the $20 million portion. On that portion we did receive, fortunately, 4 bids and we were able to go with the lowest one which was quite a bit lower than the others. You know, the bad news is we obviously received one; we want to receive more competition for all of our bids. Unfortunately, this isn t all that unique. We have projects across the County that are themselves unique and that then seems to dictate the levels of interest from area contractors. So it s not for lack of trying as you can see the hundreds of folks who were reached out to and I think at least two per-bid meetings where we had a couple of dozen representatives from various companies show up and our hunch is that once the uniqueness of this project and certainly the duration, over a 19 month period, that likely whittled down the interest of some firms. To Mr. Bonner s point, I d say the good news is that the bids we did receive were on point and responsive and within budget and if that weren t the case, certainly on their responsiveness and capabilities, we would not be recommending that these firms be approved. Ms. Pauline Braccio of Towamencin Township made a public comment regarding contract award #10 and that she agreed with Commissioner Gale s comments. Chair Arkoosh responded to Ms. Braccio about the County s procurement policy. There were no further board comments. There were no further public comments. General Public Comment Ms. Pauline Braccio made a public comment. Commissioners Comments

8 Chair Arkoosh commented on the Voting Machine Town Hall coming up on February 24, The Chair mentioned that the County will be taking action to purchase new voting machines, with the goal of purchasing the new machines in The County is inviting the public to an Open House on Saturday, February 24 th at the Montgomery County Community College s Health Sciences Center Gym. The County will have voting machine vendors on site with machines that have been certified, or are currently in the process of being certified, for use in the Commonwealth of Pennsylvania. Doors will open at 9:30am. The Commissioners will hold a public forum at 10:00am that will outline the process for replacing the voting machines, and will then give residents the opportunity to publicly comment. When the forum concludes, residents will have the opportunity to view and test out the machines on-site and offer written feedback on the machines. The County will be advertising the Open House on the County website, social media, and through . Further questions can be directed to Corrie Emerson, our Public Affairs Manager. Vice Chair Lawrence mentioned the Eagles Pep Rally on the Courthouse steps on February 2, Upcoming Meeting Dates The next meeting of the Montgomery County Board of Commissioners will be at 10am on Thursday, February 15, Adjournment On motion of Vice Chair Lawrence, seconded by Commissioner Gale, the February 15, 2018 meeting of the Montgomery County Board of Commissioners was adjourned. Salary Board Controller Karen Sanchez made a motion to approve the February 1, 2018 Salary Board presentation as given by our Director of Human Resources, Donna Pardieu, and to authorize the proper County Officials to execute the same. Vice Chair Lawrence seconded the motion. There was no board comment. There was no public comment. Chair Arkoosh brought the motion to a vote and the first motion of salary board was adopted unanimously. Adjournment On motion of Controller Sanchez, seconded by Vice Chair Lawrence, the February 1, 2018 meeting of the Montgomery County Salary Board was adjourned.

10 18-C. 31 MONTGOMERY COUNTY COMMISSIONERS February 1, 2018 On motion of Commissioner Gale, seconded by Vice Chair Lawrence, it was unanimously adopted that: BACKGROUND 1. In 1970 the Montgomery County Planning Commission established a program for the provision of community planning assistance service for county townships and boroughs by the staff on a 50/50 cost sharing basis (municipality and county), by actions reflected in Resolution 70-1 as amended 2. In 1983, Montgomery County Planning Commission reaffirmed said program and modified the scope of services to be provided, by action reflected in Resolution The municipality listed in the attached Exhibit 1 has requested community planning assistance from the Montgomery County Planning Commission. 4. The staff of the Montgomery County Planning Commission have met with the municipality to discuss the scope and nature of the requested planning assistance services in accordance with Resolution as amended. 5. The Board of the Montgomery County Planning Commission has reviewed the proposed contract listed below and found them to be in accordance with the current Board Policy. NOW THEREFORE BE IT RESOLVED that the proper County Officials, in accordance with the authority conferred by law, subject to the approval of the County Solicitor, are hereby authorized to approve the contract for municipal planning assistance with the Pottstown Metro Area Regional Planning Commission, as outlined in the attached Exhibit.

12 MONTGOMERY COUNTY COMMISSIONERS February 1, C. 32 On motion of Vice Chair Lawrence, seconded by Commissioner Gale, it was unanimously adopted that: BACKGROUND 1. Montgomery County owns and maintains a network of recreational parkland and recreational trails. 2. In order to meet an increased demand, the North Penn Water Authority (the NPWA ) has undertaken a project to install a new water transmission main line in the area of Skippack Township (the Project ). 3. The Project will cross over certain lands of the County in Central Perkiomen Valley Park near the Perkiomen Creek. 4. The NPWA has requested that the County grant it certain easements to permit the construction of the Project across the County s property. 5. the NPWA has agreed to take certain steps ensure that area is restored to preconstruction condition upon completion of the Project 5. Given the public benefit of the Project, the County desires to assign the requested easement to the NPWA to allow for the completion of the Project. NOW THEREFORE BE IT RESOLVED that the proper County Officials, in accordance with the authority conferred by law, subject to the approval of the County Solicitor, are hereby authorized to execute the necessary documents to grant the necessary easements to the North Penn Water Authority for the purposes of constructing and maintaining a new water transmission main line across County property, as specified in the attached Exhibit

The Finance Department recommends entering into the first available one (1) year contract renewal with The PFM Group of Philadelphia, PA, to provide continued Financial Advising Services to the County as requested under RFP NOW THEREFORE BE IT RESOLVED, that the proper County Officials, in accordance with the authority conferred by law, subject to the approval of the County Solicitor, are hereby authorized to enter into a contract renewal with The PFM Group of Philadelphia, PA, for Financial Advising Services.

The Information Technology Solutions Department recommends entering into the second available contract renewal for a period of one (1) year, with an option for two (2) remaining annual extensions. NOW THEREFORE BE IT RESOLVED, that the proper County Officials, in accordance with the authority conferred by law, subject to the approval of the County Solicitor, are hereby authorized to enter into a contract renewal with RSM US LLP of Moorestown, NJ for Microsoft Certified Sharepoint Partner in accordance with the original rate schedule as per RFP

In 1997, the Commonwealth of Pennsylvania instituted, through a waiver from the federal government, a county-based HealthChoices program to implement a Managed Care System for the provision of behavioral health services to Medical Assistance recipients. 2. Pursuant to the applicable state procedure for selecting a managed care organization, the Department of Behavioral Health/Developmental Disabilities (BH/DD) issued a Request for Proposal dated June 14, 2015 seeking responses from qualified Managed Care Organizations (MCOs). 3. The Board of Commissioners have approved Resolution 15-C. 33 to enter into a contract with Magellan Behavioral Health of Pennsylvania, Inc. to provide Behavioral Health Managed Care Services for the County s HealthChoices program for the calendar year 2016 with four (4) annual extensions. 4.
