1 M I N U T E R E C O R D PAPILLION CITY COUNCIL MINUTES TUESDAY, APRIL 17, 2012 CaD- 7: 00 P. M. The City Council of the City of Papillion met in open and public session at Papillion City Hall on, at 7: 00 PM. City Clerk Elizabeth Butler called the roll. Present were Councilmembers Troy Florance, Tom Mumgaard, Brian Liesveld, Gene Jaworski, Lu Ann Kluch, Bob Stubbe, Steve Engberg and Mayor David P. Black. Councilmember James Glover was absent. Also present were City Administrator Dan Hoins, Assistant City Administrator Christine Myers, City Attorney Karla Rupiper, Public Works Director Marty Leming, City Planner Brian Craig, Fire Chief Bill Bowes, City Engineer Jeff Thompson, Police Chief Len Houloose, Director of Golf Maintenance Tom James, Recreation Director Lori Hansen and Deputy Treasurer/ Insurance Coordinator Robin Hovseth. Mayor Black introduced the Singing Seniors and commented that this group is part of the Senior Center and they are celebrating their sixth year anniversary. He stated that the Senior Center plays an important role in the community. Recreation Director Lori Hansen added that the Singing Seniors are great ambassadors for the City. Senior Center Coordinator Laura Jean O' Connor stated that the Singing Seniors perform ten different variety shows. The Singing Seniors sang two songs from the 1950s. The Singing Seniors led those present in the Pledge of Allegiance with a version by Red Skelton. Proclamation: Mayor Black read an Arbor Day Proclamation. Tree Board member Jason Allen accepted the proclamation and mentioned that Papillion has been named a Tree City USA for the past 23 years. Mr. Allen then discussed the plans for the Arbor Day Celebration on April 27, 2012, which will honor David Mooter, who was instrumental in starting the Papillion Tree Board. ADMINISTRATOR' S REPORT: City Administrator Dan Hoins provided the Administrator' s Report: ( 1) Thanked the Singing Seniors for leading everyone in the Pledge of Allegiance; ( 2) Staff visited with downtown business owners to discuss their concerns for the proposed downtown project. The City is currently working with RDG Planning and Design to address these concerns. Staff will also continue dialogue with downtown business owners on this project. Mr. Hoins mentioned that the next step for 1

2 this project is to present the final design to Council when this project is ready to go to bid; ( 3) The lease agreement between the City of Papillion and the Rural Fire Department is up for renewal in October. Staff is working with the Rural Fire District and Papillion Volunteer Fire Department to renew this agreement for an additional term; ( 4) Pro Sports board members met with staff to discuss recreational improvements and additional recreational space, as participation in activities has doubled in the last 5 years. Staff shared the Comprehensive Plan with this group and Pro Sports board members are willing to assist the City. Mr. Hoins mentioned that Pro Sports' proposed projects would impact next year's budget; and ( 5) Recognized and thanked the Parks Department for cleaning the fields for a softball game after severe weather. Mr. Hoins received compliments from residents in Kearney and Omaha. BILLS TOTAL: $ 1, 224, ORDINANCES FIRST READING: ORD An ordinance to vacate part of 72nd Street Right-Of-Way located in the NW1/ 4 of Section 25, Township 14 North, Range 12 East of the 6th P. M., Sarpy County, Nebraska and to provide for an effective date thereof. Introduced by Councilmember Engberg. ORDINANCES SECOND READING: ORD An ordinance to authorize the Mayor and City Clerk to sign a Special Warranty Deed to convey real estate as described herein to Eric M. Parks and Joni T. Parks, as husband and wife, for good and sufficient consideration and to provide for an effective date thereof. Mayor Black opened the public hearing and called for proponents and opponents. Proponents: Bobby Larsen, Mayors Youth Council, thanked the Mayor and City Council for bringing SAC Federal Credit Union to Papillion. Mr. Larsen believes that SAC Federal Credit Union will bring more jobs to Papillion and will retain youth in the area. No one else came forward and the public hearing was closed. Mayor Black advised that staff is recommending a waiver of the third ordinance reading to assist with the construction timeline for this project. He explained that once the ordinance is approved, there is a 30 day remonstrance period. Motion by Councilmember Engberg, second by Councilmember Jaworski, to waive the third ordinance reading for ORD Mayor Black asked for proponents and opponents. None came forward. Council discussion: Councilmember Mumgaard inquired about the 30 day remonstrance period. City Attorney Karla Rupiper responded that the remonstrance period is required by law to allow time for the public to file a petition on the conveyance. Councilmember Mumgaard commented that by waiving the third ordinance reading, it would be one less opportunity for the public to voice their opinion. Mayor Black responded that with the 30 day remonstrance period, the public has a longer period to provide input on this matter. Councilmember Mumgaard clarified that if the third ordinance reading is waived the public still has 30 days to voice their opinion on this agenda item. Mayor Black responded that the public has more time with the remonstrance period than they would during the normal passage of an ordinance. Upon roll call vote, Florance, Mumgaard, Liesveld, Jaworski, Kluch, Stubbe and Engberg all voted yes. Voting no: 5

R A resolution to accept a conveyance of real estate from Papillion Development Land, LLC to the City of Papillion by General Warranty Deed for Outlot D and Outlot_ E, Shadow Lake Towne Center, generally located on the south side of Schram Road west of 72nd Street Karla Rupiper Motion to approve R by Councilmember Kluch, second by Councilmember Florance. Mayor Black called for proponents and opponents. None came forward. Upon roll call vote, Florance, Mayor Black announced that the remaining agenda items are all related to the CVS Pharmacy development on the SW corner of 84 th Street and HWY 370. ORD An ordinance to amend the official zoning map of the City of Papillion adopted by Ordinance No by changing boundaries of the zoning map of the City of Papillion in accordance with Section of Papillion City Code to rezone certain real property within the zoning jurisdiction of the City of Papillion, Sarpv County, Nebraska to rezone Lots 1 and 2, Gold Coast Heights, a subdivision as platted, surveyed, and recorded in Sarpv County, NE together with tax Lot 10 lying in the SE % of Section 34, T14N, R12E of the 6th P. M. from Community Commercial ( CC) to Mixed Use ( MU), and to provide for an effective date thereof. Motion to approve ORD by Councilmember Stubbe, second by Councilmember Jaworski. Upon roll call vote, Florance, Mumgaard, Liesveld, Jaworski, Kluch, Stubbe and Engberg all voted yes. Voting no: none. Absent: Glover. Motion carried. RES. R A resolution to approve the Gold Coast Heights Replat 1 Final Plat for the property legally described as Replat of Lots 1 and 2, Gold Coast Heights together with Tax Lot , generally located on the SW Corner of 84th Street and HWY 370. The applicant is Orange Development, Inc. ( Gold Coast Heights Replat 1) Mark Stursma Motion to approve R by Councilmember Jaworski, second by Councilmember Stubbe. Mayor Black provided an update on his events: ( 1) Mayor Black and Councilmember Mumgaard attended the Government Affairs Committee meeting; ( 2) Mayor Black Sundaes event in Lincoln at the State Capitol; ( 3) Mayor Black met attended the Sarpy with Peggy Montgomery from the Library Board; ( 4) Mayor Black met with Paul Schroeder regarding Library Board applications; ( 5) Mayor Black attended the ribbon cutting at Oh Darling!; ( 6) Mayor Black attended the ribbon cutting at Miracle Ear; and 7) Mayor Black attended the ribbon cutting at TTM Toys.
