1 M I N U T E R E C O R D PAPILLION CITY COUNCIL MINUTES TUESDAY, APRIL 21, : 00 P. M. The City Council of the City of Papillion met in open and public session at Papillion City Hall on, at 7: 00 PM. City Clerk Elizabeth Butler called the roll. Present were Councilmembers Troy Florance, Tom Mumgaard, Jason Gaines, James Glover, Gene Jaworski, Lu Ann Kluch, Bob Stubbe, Steve Engberg and Mayor David P. Black. Also present were City Administrator Dan Hoins, Assistant City Administrator Christine Myers, City Attorney Karla Rupiper, Public Works Director Marty Leming, Planning Director Mark Stursma, Fire Chief Bill Bowes, City Engineer Jeff Thompson, Police Chief Scott Lyons, Director of Golf Maintenance Tom James, Recreation Director Lori Hansen, Finance Director Nancy Hypse, Parks Director Tony Gowan, Chief Building Official Brian Craig and Interim Library Director Matt Kovar. Mayor Black along with Boy Scout Troop # 359 led those present in the Pledge of Allegiance. Proclamation: Mayor Black proclaimed April 24, 2015 Arbor Day. Tree Board Member Tom Lundahl discussed the Arbor Celebration that will be held at the Papio Bay Sports Complex. Affidavit of Publication: Notice of the meeting was given in the Papillion Times, the designated method of giving notice. A copy is available in the office of the City Clerk. ADMINISTRATOR' S REPORT: City Administrator Dan Hoins gave an update on the following: ( 1) Resolutions for the Slide the City event are on tonight's Agenda; (2) Sumtur Amphitheater is hosting 11 ticketed events this year which is an increase from last year; ( 3) Volunteers are needed for the Half Marathon on May 17, 2015; ( 4) The monthly sales tax has increased 11. 7% over last year; ( 5) Staff is starting to prepare the fiscal budget. Councilmembers were encouraged to submit projects to include in next year's budget. CONSENT AGENDA ITEMS: ( 1) Approval of the agenda as presented; ( 2) Approval of the minutes from the April 7, 2015, City Council Meeting; ( 3) Approval of the bills as presented; ( 4) RES. R A resolution to award the contract for the South Water Tower Painting to J. R. Stelzer Co. of Lincoln, NE in the amount of 175, Jeff Thompson ; ( 5) RES. ORDINANCES THIRD READING AND RESOLUTIONS: ORD An ordinance to amend Chapter 92, Article III, Section 15, Subsections A and F of the Papillion Municipal Code having to do with the adoption of the National Electrical Code; and to provide for an effective date thereon. Motion to approve ORD by Councilmember Engberg, second by Councilmember Florance. Upon roll call vote, Florance, Mumgaard, Gaines, Glover, Jaworski, Kluch, Stubbe and Engberg all voted yes. Voting no: none. Motion carried. RES. R A resolution to approve an Indemnification and Insurance Agreement for the Slide the City event on August 1, 2015 Karla Rupiper Motion to approve RES. R by Councilmember Kluch, second by Councilmember Gaines. Mayor Black called for proponents and opponents. None came forward. Councilmember Mumgaard requested more information on this resolution. Mayor Black responded that the applicant is requesting temporary use of a state highway and therefore the City must indemnify the State. The City in return is requesting the applicant indemnify the City. City Attorney Karla Rupiper added that the indemnification is the primary use of the agreement and the insurance component was added since it is part of the permitting process. She noted that other states have required insurance coverage for this event. The applicant also understands that the indemnification component is being passed onto them. Councilmember Mumgaard expressed concerns about the impact the statute has on these events. Councilmember Mumgaard asked if the applicant had additional costs for insurance. Ms. Rupiper responded that there may be additional costs but that it would not impact the ticket price. Councilmember 5

6 Mumgaard then expressed frustrations with the statute relating to temporary use of a state highway. Mayor Black indicated that the applicant has worked with numerous states for this event and they understand this is part of the process. Upon roll call vote, Florance, Mumgaard, Gaines, Glover, Jaworski, Kluch, Stubbe and Engberg all voted yes. Voting no: none. Motion carried. RES. R A resolution to approve the temporary use of State Highway N- 85 ( Washington Street) from the 6th Street intersection to the 1st Street intersection on August 1, 2015, from 4: 00 AM to 11: 59 PM for the Slide the City event Elizabeth Butler Motion to approve RES. R by Councilmember Engberg, second by Councilmember Stubbe. Mayor Black called for proponents and opponents. None came forward. Upon roll call vote, Florance, Mumgaard, Gaines, Glover, Jaworski, Kluch, Stubbe and Engberg all voted yes. Voting no: none. Motion carried. Mayor Black mentioned that the Historical Downtown Papillion Business Association is assisting with this event. RES. R A resolution to approve a Final Plat for the property legally described as part of Tax Lot 8 and Tax Lot 1 Section 19, T14N, R12E of the 61th PM, Sarpv County, NE, generally located NE of 126th Street & Cornhusker Road. The applicant is Woodland Homes Inc. ( North Shore Phase 3) Mark Stursma Motion to approve RES. R by Councilmember Stubbe, second by Councilmember Kluch. Mayor Black called for proponents and opponents. Proponents: Nancy Pridal, Lamp Rynearson and Associates, W Dodge Road # 100 ( Omaha), stepped forward on behalf of the applicant to answer questions. Upon roll call vote, Florance, Mumgaard, Gaines, Glover, Jaworski, Kluch, Stubbe and Engberg all voted yes. Voting no: none. Motion carried. ORD An ordinance to approve the Change of Zone of certain real property within the zoning jurisdiction of the City of Papillion, Sarpv County, Nebraska, legally described as part of Tax Lot 8 in the S'/ 2 of the SE'/ 4, together with that part of Tax Lot 1 in the S'/ 2 of the SW'/4 all in Section 19, T14N, R12E of the 6th PM, Sarpv County, generally located NE of 126th Street and Cornhusker Road, from Agricultural (AG) to Multiple- Family Residential ( R-4), to amend the official zoning map of the City of Papillion by changing the zoning district boundaries of the zoning map in accordance with Section of Papillion Municipal Code, and to provide for an effective date thereof. Motion by Councilmember Jaworski, second by Councilmember Glover to approve ORD Motion by Councilmember Engberg second by Councilmember Kluch to amend ORD to reflect an adjustment to the number of outlots in North Shore Phase 3 and to change the location from 126th and Lincoln Road to 126th and Cornhusker Road. 6

Voting no: none. Motion carried. RES. R A resolution to approve the First Amendment to the North Shore Subdivision Agreement Mark Stursma Motion to approve RES. ADMINISTRATIVE REPORTS: Committee Reports: Councilmember Glover commented on the, Public Facilities committee meeting. Comments from the Floor: Students from Papillion- La Vista High School introduced themselves. Comments from Mayor and Council: Councilmember Engberg inquired where to find information on Slide the City. Mayor Black indicated that information can be found on Facebook or on Slide the City's website Mayor Black provided an update of his events: ( 1) Mayor Black attended the MAPA Council of Officials Luncheon; ( 2) Mayor Black attended the Chamber's Coffee & Contacts event; ( 3) Mayor Black attended American Legion Post # 32' s steak fry event benefitting the Veterans Park project; ( 4) Mayor Black, Councilmember Stubbe, and Dan Hoins met with Mark Wayne and Denny Wilson from Sarpy County in regard to a sewer study; ( 5) Mayor Black attended the Chamber's Legislative Coffee event; (6) Mayor Black attended a distracted driving simulation at Papillion- La Vista High School.
