The City Council of the City of Papillion met in open and public session at Papillion City Hall on, at 7: 00 PM. City Clerk Elizabeth Butler called the roll. Present were Councilmembers Tom Mumgaard, Jason Gaines, James Glover, Gene Jaworski, Lu Ann Kluch, Bob Stubbe, Steve Engberg and Mayor David P. Black. Councilmember Troy Florance was absent. Also present were City Administrator Dan Hoins, Assistant City Administrator Christine Myers, City Attorney Karla Rupiper, Public Works Director Marty Leming, Planning Director Mark Stursma, Fire Chief Bill Bowes, City Engineer Jeff Thompson, Police Chief Len Houloose, Director of Golf Maintenance Tom James, Finance Director Nancy Purscell and Chief Building Official Todd Aerni. Mayor Black led those present in the Pledge of Allegiance. Affidavit of Publication: Notice of the meeting was given in the Papillion Times, the designated method of giving notice. A copy is available in the office of the City Clerk. Incorporated herein by reference as if fully set out herein is the audio and visual recording of the council meeting. Public announcement that a current copy of the open meeting act is posted in the City Council Chambers. Presentation: Halloween Safe Night: Mayor's Youth Leadership Council ( MYLC) members Bobby Larson and Rylie Herrenbruck made a presentation on the Halloween Safe Night event that occurred on October 24, 2013, at Papillion- La Vista South. 9 P ADMINISTRATOR' S REPORT: City Administrator Dan Hoins gave an update on the following: ( 1) Provided an update on developments in the City including Southbrook residential located near 108th Street and Schram Road; ( 2) Testified on LR 268 and its impact on economic development; ( 3) Provided an update on the potential 911 merger between Douglas and Sarpy Counties. The University of Nebraska at Omaha study revealed there would be cost savings if the two counties merged; and ( 4) Winter Wonderland will be held on Saturday, November 30, 2013 from 5: 00 PM to 9:00 PM. CONSENT AGENDA ITEMS: ( 1) Approval of the agenda as presented; ( 2) Approval of the Minutes from the November City Council Meeting; ( 3) Approval of the bills as presented; ( 4) RES. R A resolution to award the contract for Outfall Section I ( Western Springs Outfall) for S. I. D. No. 292 ( North Shore) to Valley Corporation in the amount of $ 877, Jeff Thompson ; 5) RES. R A resolution to approve the renewal of Maintenance Agreement No 106 with the State of Nebraska Department of Roads Marty Leming ( 6) RES. R A resolution to approve a Water Connection Agreement with S. I. Q. 38 ( Highland Estates) Marty Leming 597-1

He explained this agreement was to approve an Emergency Water Connection with SID 038. The State of Nebraska designated this area as a Community Well System which allows for special accommodations. BILLS TOTAL: 1, 411, ORDINANCES FIRST READING: ORD An ordinance to amend in its entirety Chapter 117, Fireworks, of the Papillion Municipal Code having to do with fireworks; the General provisions; and licensina and sales of fireworks; and to provide for an effective date thereon. Introduced by Councilmember Glover. ORD An ordinance of the City of Papillion, Nebraska, authorizing the issuance of General Obligation Various Purpose Bonds,_Series 2013, of the City of Papillion, in the principal amount not to exceed one million four hundred twenty-five thousand dollars ($ 1, 425, 000) to pay the costs of certain improvements within Street and Pavina District No of the City; prescribing the form of said bonds; providing for the levy of taxes to pay the same; and orderina the ordinance published in pamphlet form. Introduced by Councilmember Engberg. Mayor Black stated that staff is recommending a waiver of the second and third ordinance readings to allow for these bonds to close in the 2013 calendar year. Councilmember Kluch, to waive the Motion by Councilmember Engberg, second by Mayor Black asked for proponents and second and third readings for ORD opponents. No one came forward. Upon roll call vote, Mumgaard, Gaines, Glover, Jaworski, Kluch, Stubbe and Engberg all voted yes. Voting no: none. Absent: Florance. Motion carried. Motion by Councilmember Engberg, second by Councilmember Jaworski to approve ORD Mayor Black asked for proponents and opponents. None came forward. Upon roll call vote, Mumgaard, Gaines, Glover, Jaworski, Kluch, Stubbe and Engberg all voted yes. Voting no: none. Absent: Florance. Motion carried. ORD An ordinance authorizing the issuance of Highway Allocation Fund Pledge Bonds of the City of Papillion, Nebraska, Series 2013, in the principal amount not to exceed seven hundred seventy-five thousand dollars ($775,000) for the purpose of payina the costs of constructina certain street improvements in the City; prescribina the form of said bonds, Pledging funds to be received by the City from the State of Nebraska Highway Allocation Fund for the payment of said bonds; providina for the levy and collection of taxes to pay the same if necessary; providina for the sale of the bonds; authorizina the delivery of the bonds to the purchaser; providina for the disposition of bond proceeds; and orderina the ordinance published in pamphlet form. ORDINANCES SECOND READING: ORD An ordinance to amend the official zoning map of the City of Papillion adopted by Ordinance No by chanaina boundaries of the zoning map of the City of Papillion in accordance with Section of Papillion City Code to rezone certain real property within the zonina jurisdiction of the City of Papillion, Sarpv County, Nebraska leaally described as Tax Lot 18 in the SE 1/ 4 of the SW 1/ 4 of Section 25, T14N, R12E of the 6th PM., Sarpv County, Nebraska, generally located at S. 66th Street from Agricultural ( AG) to Community Commercial CC), and to provide for an effective date thereof. Mayor Black opened the public hearing and called for proponents and opponents. No one came forward and the public hearing was closed. ORDINANCES THIRD READING AND RESOLUTIONS: RES. R PUBLIC HEARING AND VOTE - A resolution to approve a Preliminary Plat for the property leaally described as being a replatting of Tax Lot 15A and Tax Lot 18 and part of Tax Lot " A" lying within the SW '/ 4 of Section 25 together with part of Tax Lot 20 and part of Tax Lot " F" Ivina within the NE % of the NW % of Section 36, T14N, R12E of the 6th PM, Sarpv County, NE, generally located at S 66" The applicant is Southridae Church of the Assemblies of God, Inc. ( Southridae Valley) Mark Stursma Mayor Black opened the public hearing and called for proponents and opponents. No one came forward and the public hearing was closed. Motion to approve RES. R by Councilmember Gaines, second by Councilmember Stubbe. Council discussion: Councilmember Kluch inquired about the on- street parking as shown in the plat. She asked if there was consideration to move or relocate parking to a parking lot. Planning explained the applicant is in the platting process. The site plan presented is a basic plan to show the intent, but does not include building design and landscaping. Specific site and building designs will be submitted after this plat has been approved. Director Mark Stursma responded that it has not been discussed. He 5

6 Councilmember Kluch requested that staff work with the applicant on building standards. Mr. Stursma confirmed that he would. RES R A resolution to approve a Final Plat for the property legally described as a replatting of parts of Lots 2, 3, 4, and 5, Huntington Park East, a subdivision in Sarpv County NE, together with all of vacated Olson Drive adjacent to Lots 2, 3, and 4, Huntington Park East located in the SE '/ 4 of Sec. 35, T14N R12E of the 6th P. M., Sarpv County NE generally located at 739 Olson Drive The applicant is Bill Black/TBS Investments. ( Huntington Park East Replat 1) Mark Stursma Motion to approve RES. R by Councilmember Engberg, second by Councilmember Kluch. Engberg noted that his motion is contingent upon consistency with the Comprehensive Plan and Subdivision Regulations. ADMINISTRATIVE REPORTS: Committee Reports: None forthcoming. Comments from the Floor: Students from Papillion- La Vista South introduced themselves. Comments from Mayor and Council: Councilmember Glover requested that City Council be notified of all City Board and Commission meetings. Mayor Black provided an update of his events: ( 1) Mayor Black attended a ribbon cutting at Jimmy John' s; ( 2) Mayor Black attended the Veterans Park renaming 6

7 ceremony; ( 3) Mayor Black served as the guest speaker at the Papillion American Legion' s Veterans Day Ceremony, and the La Vista Community Foundation' s Veterans Day Dinner; ( 4) Mayor Black and Dan Hoins attended a hearing on LR 268 regarding an interim study on school district boundaries; ( 5) Mayor Black attended the Midlands Business Journal' s " 40 Under 40" awards ceremony; (6) Mayor Black and Mark Stursma gave a downtown development tour. Mayor Black then commented on the increase in ridership for the Metro Bus Route 93. He also mentioned some businesses there were opening this week. Mayor Black then thanked the City Personnel Committee for the fundraiser held on November 15, ADJOURNMENT: Motion to adjourn by Councilmember Kluch second by Councilmember Glover.
