2 event on Friday, July 4th at Tolleson Veterans Park, 8601 West Van Buren Street, Tolleson, Arizona Public Hearing Soliciting comments from interested parties in reference to a rezoning application as submitted by Jack Gilmore of Gilmore Planning & Landscape Architecture, 2211 North Seventh Street, Phoenix, Arizona, on behalf of the pending owner, Prologis Inc., Center Court Drive North, Suite 100, Cerritos, California, for rezoning of approximately acres located on the north side of Buckeye Road, starting 810 feet west of the 99th Avenue centerline, from existing zoning designation of General Commercial (C-2) District to new zoning designation of Planned Area Development (PAD) District. 3. Public Hearing Soliciting comments from interested parties in reference to a rezoning application submitted by Michael B. Withey on behalf of the property owners, Rados Properties Arizona Land LLC, requesting rezoning of approximately 80 acres of property located at the southwest corner of 83rd Avenue and Interstate 10 in Tolleson, Arizona from existing zoning designation of Commercial (C-2) and Light Industrial Park District (I-1) to new zoning designation of Planned Area Development (PAD) District. 4. Public Hearing Soliciting comments from interested parties in reference to an application for a Use Permit as submitted by Steve Furness of Sears Holdings Corp., 3333 Beverly Road, A2-382B, Hoffman Estates, Illinois to allow for the display and selling of automobiles at Kmart, 8701 West McDowell Road, Tolleson, Arizona 85353, from July 30 to August 3, 2014 within a C-2 Zoning District. 5. Public Hearing for Fiscal Year Annual Budget and 2015 Tax Levy. 6. Convene into Special Meeting. a. Approve/Deny Resolution No of the Mayor and Council of the City of Tolleson, Maricopa County, Arizona Adopting the Final Budget for Fiscal Year (Roll Call Vote) b. Reconvene into Regular Scheduled City Council Meeting. CONSENT AGENDA ACTION ITEMS Items on the Consent Agenda are of a routine nature and are intended to be acted upon in one motion. Council Members may pull items from Consent if they would like them considered separately. a. Approve Minutes: Regular Scheduled City Council Meeting Minutes of June 10, 2014.

Approve Claims and Bills (claims and bills submitted for approval are all claims and bills incurred no later than 48 hours prior to the Council Meeting and may be reviewed at City Hall during regular business hours). c. Approve second amendment to services agreement with E-Z Towing & Recovery, L.L.C. effective June 24, 2014, between the City of Tolleson, an Arizona municipal corporation and E-Z Towing & Recovery, L.L.C., an Arizona limited liability company. d. Approve second amendment to services agreement with Western Towing of Phoenix, Inc. effective June 24, 2014, between the City of Tolleson, an Arizona municipal corporation and Western Towing of Phoenix, Inc. d/b/a Western Towing a Delaware corporation. e. Approve Resolution No of the Mayor and Council of the City of Tolleson, Arizona, approving the Agreement between the City of Tolleson and the Greater Phoenix Economic Council for Fiscal Year ; and authorizing the Mayor to execute and deliver said Agreement. f. Approve/Deny authorization for the donation of the City of Tolleson s Police Motorcycle Unit #053, 2005 BMW Motorcycle, three Toughbook laptop computers, and four screen monitors to the Globe Police Department. g. Approve third amendment to the Fiscal Year Budget providing for interfund transfers in order to achieve compliance with the expenditure limitations. This request is asking to increase the authority in the Transportation Impact Fee Fund in order to spend the available cash on the Paseo de Luces Project. In total, the Citywide appropriations will remain the same. h. Approve Cash Operating transfer request for the Fiscal Year. The available cash in Paseo de Luces Fund was less than what was approved in the annual operating expenditure budget. If this transfer is approved, the Paseo de Luces project scope will not have to be reduced. i. Approve contract amount of $2,059, to Valley Rain Construction Corporation for Guaranteed Maximum Price #3 (GMP3) for the following work: ALT 1 Medians $111, ALT 3a SRP 12kV Underground $45, ALT 3b Electrical $277, ALT 5 Landscape & Irrigation E of 94th Ave $103, ALT 7b Wayfinding $15, ALT 13 Deferred from GMP2 $750, ALT 14 Lighting $162, ALT 15 Thomas Vet Labs $19, ALT 16 Crystal Rose Funeral Home $10, ALT 17 94th Ave Lot (ONG) 33 spaces $83,141.93
4 ALT 18 Truck Route Markings $6, ALT 20 Plaza at Old Main Flag Pole, Concept A $113, ALT 21 Pocket Park at Bank of the West $138, ALT 22 Additional Furnishings $43, ALT 23 Wash and Seal South Side $22, ALT 24 Additional Signage $91, Contingencies $64, TOTAL $2,059, j. Approve Purchase Order #63990 payable to J2 Engineering and Environmental Design, in an amount not to exceed $58, for Change Order to existing Professional Services Agreement approved by Council on December 11, 2012 for the Downtown Redevelopment Project, for the following design services: Ong Parking Lot; High School Flag Plaza; Pocket Park at Bank of the West; 91 st Avenue Overhead Gateway Coordination; ADOT Freeway Wayfinding Coordination; Seatwalls; Planters; Columns for Traffic Control; and Thomas Vet Parking Lot, Gate, Driveway. REGULAR AGENDA ACTION ITEMS PROPOSED TO BE HEARD 1. Approve/Deny Resolution No of the Mayor and Council of the City of Tolleson, Arizona, approving the Right of Way license granted by Salt River Project Agricultural Improvement and Power District to the City of Tolleson for roadway, traffic equipment, landscaping, water and sewer lines (Rados Tolleson Center); and authorizing the City Manager to execute and deliver said license. 5. Consider and adopt, if advisable, Resolution No establishing an infill incentive district pursuant to A.R.S in an area bounded approximately by boundaries Roosevelt Street (N), 91st Avenue (E), 95th Avenue (W), and Jackson
5 Street (S), and adopting an infill incentive plan to encourage redevelopment in the district; and declaring an emergency. 6. Approve/Deny Ordinance No. 541 N.S. of the City of Tolleson, Maricopa County, Arizona, approving the rezoning of property generally located beginning 810 feet west of the 99 th Avenue centerline, on West Buckeye Road, Tolleson, Arizona from General Commercial (C-2) District to Planned Area Development (PAD) District. 7. Approve/Deny Ordinance No. 542 N.S. of the City of Tolleson, Maricopa County, Arizona, approving the rezoning of property generally located at the southwest corner of 83 rd Avenue and Interstate 10, Tolleson, Arizona from General Commercial (C-2) and Light Industrial (I-1) Districts to Planned Area Development (PAD) District. 8. Approve/Deny Ordinance No. 543 N.S. of the City of Tolleson, Maricopa County, Arizona, amending Article 7-1 General Offenses, Section Fireworks, related to conformance with state law on fireworks, and declaring an emergency. 9. Discuss and, if appropriate, appoint an alternate representative to the Maricopa County Community Development Advisory Committee (CDAC) for Fiscal Year (For Fiscal Year , Council Member Espinoza is the Primary, and Mayor Gámez is the Alternate.) At the May 13, 2014 Regular Scheduled City Council meeting Council Member Espinoza was appointed the "primary" representative, and Mayor Gámez was appointed as the "alternate" representative. Due to the resignation of Jose "Diego" Espinoza, Mayor Gámez will serve as the "primary" representative; therefore, the "alternate" representative position is in need of appointment. CITY MANAGER S REPORT OF CURRENT EVENTS 1. Community Events & Programs: July 4, 2014 and additional updates.
