The City Council of the City of Papillion met in open and public session at Papillion City Hatl on, at 7: 00 PM. City Clerk Efrzabeth Butler called the roll. Present were Councilmembers Tom Mumgaard, Jason Gaines, James Glover, Gene Jaworski, Lu Ann Kluch and Acting Mayor Troy Florance. Mayor David P. Black and Councilmembers Bob Stubbe and Steve Engberg were absent. Also present were City Administrator Dan Hoins, Assistant City Administrator Chris Myers, City Attorney Karla Rupiper, Public Works Director Marty Leming, Planning Director Mark Stursma, Deputy Fire Chief Jeff Jones, City Engineer Jeff Thompson, Police Chief Scott Lyons, Recreation Director Lori Hansen, Finance Director Nancy Hypse and Parks Director Tony Gowan. Acting Mayor Florance led those present in the Pledge of Allegiance. Affidavit of Publication: Notice of the meeting was given in the Papillion Times, the designated method of giving notice. ADMINISTRATOR' S REPORT: City Administrator Dan Hoins gave an update on the following: ( 1) The City received a bond rating of Aa2. A multiple page report was provided to the City explaining the rating. He thanked the Finance Department for their work; ( 2) The Library received the Gold Standard accreditation. He thanked the Library Board of Advisors and Library staff for their work; ( 3) Provided updates on the Halleck Park Shelter renovation and displayed a picture of the new sign at the Police Department. Motion by Councilmember Mumgaard, second by Councilmember Jaworski to approve ORD Acting Mayor Florance asked for proponents and opponents. Proponents: Bruce Lefler, Vice President, Ameritas Investment Corporation, 440 Regency Parkway Drive, Suite 222 ( Omaha), stepped forward to discuss the bonds. He reported on the final numbers for the 2010 and 2010B bond series that were marketed. He noted that there was a slight change in the final numbers from the staff report issued last Friday to this morning ( final number $8,545,000). He also noted that this bond will be paid off in the same time period as #he reissued bonds with a lower interest rate of 2. 04%, saving the City$ 550,000. Upon roll call vote, Florance, Mumgaard, Gaines, Glover, Jaworski and Kluch all voted yes. Voting no: none. Absent: Stubbe and Engberg. Motion carried. 4

5 ORD AN ORDINANCE AUTHORIZING THE ISSUANCE OF HIGHWAY ALLOCATION FUND PLEDGE BONDS OF THE CITY OF PAPILLION. NEBRASKA, SERIES 2015, IN THE PRINCIPAL AMOUNT OF NOT TO EXCEED THREE MILLION DOLLARS ($ 3, ) FOR THE PURPOSE OF PAYING THE COSTS OF CONSTRUCTING CERTAIN STREET IMPROVEMENTS IN THE CITY PRESCRIBING THE FORM OF SAID BONDS: PLEDGING FUNDS TO BE RECEIVED BY THE CITY FROM THE STATE OF NEBRASKA HIGHWAY ALLOCATION FUND FOR THE PAYMENT OF SAID BONDS: PROVIDING FOR THE LEVY AND COLLECTION OF TAXES TO PAY THE SAME IF NECESSARY PROVIDING FOR THE SALE OF THE BONDS: AUTHORIZING THE DELIVERY OF THE BONDS TO THE PURCHASER: PROVIDING FOR THE DISPOSITION OF BOND PROCEEDS; AND ORDERING THE ORDINANCE PUBLISHED IN PAMPHLET FORM. Motion by Councilmember Mumgaard, second by Councilmember Gaines to approve ORD Acting Mayor Florance asked for proponents and opponents. Proponents: Bruce Lefler, Vice President, Ameritas Investment Corporation, 440 Regency Parkway Drive, Suite 222 ( Omaha), stepped forward to discuss the bonds. He explained that this bond could not be marketed with the previous bond due to state law, but rather will be marketed in 15 days. He noted that this bond will issue $ 3 million in highway allocation bonds under the parameter's set forth in the ordinance. Councilmember Mumgaard asked what the difference is between the general obligation bonds and this highway allocation bonds. Mr. Lefler explained that the general obligation bonds are an obligation against the taxing authority of the City. The highway allocation bonds are a pledge of the highway allocation funds from the State of Nebraska to the City. He noted that the highway allocation funds are limited to the issuance amount, in that the City cannot issue more highway allocation funds today than is received from the state to pay for it. Councilmember Mumgaard clarified if the bonds will get repaid from different sources. Mr. Lefler confirmed that the highway allocation bonds are strictly for streets and highway prajects. The money for these bonds comes from the state funds and the calculation used to determine the amount the City receives such as the gas tax, lane miles, etc. Councilmember Mumgaard noted that the Legislature increased the gas tax last year which allowed the City to issue these bonds and build this street. He thanked the Legislature for this beneficial tax. Councilmember Mumgaard than asked Public Works Director Marty Leming about the timeline for the completion of Schram Road. Nir. Leming responded that TD2 has 5

6 started the design phase of this project with the hope of starting next summer. Councilmember Mumgaard then noted that the 84th Street project should be completed by then. ORD AN ORDINANCE TO AMEND & 9-1 OF CHAPTER 9 OF THE PAPILLION MUNICIPAL CODE TO PROVIDE CONSISTENCY WITH & 9-4(C) OF CHAPTER 9 AND OF CHAPTER 130. HAVING TO DO WITH THE LIBRARY BOARD OF ADVISOR' S SELECTION OF THE INTELLECTUAL COLLECTION. DISPLAYS OR PRESENTATfONS: TO AMEND & 9-4(A) OF CHAPTER 9 OF THE PAPILLION MUNICIPAL CODE TO PROVIDE FOR THE ELECTION OF A VICE CHAIRPERSON TO THE LIBRARY BOARD OF ADVISORS; TO REPEAL 9-4( E) OF CHAPTER 9 OF THE PAPILLION MUNICIPAL CODE TO ELIMINATE THE ANNUAL REPORTING REQUIREMENT SET FORTH THEREIN, BEING CONSISTENT WITH THE CITY' S OPERATION OF A CHAPTER 16 LIBRARY; AND TO PROVIDE FOR AN EFFECTIVE DATE. ORDINANCES SECOND READING: ORD AN ORDINANCE TO AMEND THE BUDGET STATEMENT TO BE TERMED THE ANNUAL APPROPRIATION BILL WHICH WAS ADOPTED ON SEPTEMBER BY ORDINANCE 1721; TO APPROPRIATE SUMS FOR NECESSARY EXPENSES AND LIABILITIES TO PROVIDE FOR AN EFFECTIVE DATE.
