These hearings have increased and an additional attorney is needed to provide a sufficient level of service. The involuntary civil commitment costs have been funded through the Chemical Dependency/Mental Health Fund since 2010 and this request will utilize an additional $32,000 for the remainder of The request is supported by the Superior Court bench (see attached letter) as well as Human Services. hl. 3 SNOHOMISH COUNTY COUNCIL Snohomish County, Washington ORDINANCE NO. 13- MAKING AN EMERGENCY APPROPRIATION IN THE CHEMICAL DEPENDENCY/MENTAL HEALTH FUND 124 TO PROVIDE EXPENDITURE AUTHORITY FOR UNANTICIPATED COSTS RELATED TO INVOLUNTARY CIVIL COMMITMENT HEARINGS WHEREAS, Snohomish County contracts with the Public Defender's Association to provide indigent defense services for involuntary civil commitment hearings; and and WHEREAS, there has been an unexpected increase in the number of these hearings; WHEREAS, the addition of a public defender position through the contract between Office of Public Defense and the Public Defender's Association is necessary in order to provide sufficient indigent defense services to support this increase; and WHEREAS, the Chemical Dependency/Mental Health Fund already supports the involuntary civil commitment process; and NOW THEREFORE, BE IT ORDAINED: Section 1. The Council makes the following finding of fact: An emergency appropriation in the Chemical Dependency/Mental Health Fund 124, for the 2013 budget year, in the amount of $32,000, is necessary to provide expenditure authority for unanticipated costs related to attorney fees for involuntary civil commitment hearings. These additional services are funded by fund balance. Section 2. The appropriation unit and allocation details are as follows: 124 Chemical Dependency/Mental Health Fund Adult Misc Attorney Fees $ 32,000 Total Emergency Appropriation S 32,000 ORDINANCE No. 13- MAKING AN EMERGENCY APPROPRIATION IN CHEMICAL DEPENDENCY/MENTAL HEALTH FUND 124 Page 1 of 2

The County Council finds as a fact that the use of funds from the Chemical Dependency/Mental Health Fund 124 is necessary to address unanticipated expenditures for the civil commitment hearings. The need to fund these unanticipated costs was not known and could not have been determined prior to the adoption of the 2013 budget. The Council therefore finds that that the need for the appropriation authorized by this ordinance constitutes a public emergency that could not reasonably have been foreseen at the time of budget approval and appropriation for the year 2013 and hereby authorizes the appropriation. GAER SUPERIOR COURT ADMINISTRATOR BOB TERWILLIGER June 14, 2013 Kristin Crane Snohomish County Office of Public Defense M/S # Rockefeller Avenue Everett, WA Re: Staffing Needs for Involuntary Civil Commitment Proceedings Dear Ms. Crane, The Superior Court convened a meeting on June 13, 2013 to review the impact on the stakeholders caused by the significant increase in the number of involuntary civil commitment hearings being held in Snohomish County. Those in attendance represented the Prosecutor, Human Services, Public Defender, Superior Court Judges, Commissioners and Administration, County Clerk and North Sound Mental Health Services. It is clear that the number of cases being filed under the involuntary civil commitment law have almost tripled in the last 8-10 years. The average case filings related to involuntary civil commitment proceedings is averaging 83 cases a month. This increase in filings has been coupled with a decrease in staffing and funding to support this work load. The conclusion of those at the meeting was that the immediate solution is to add a public defender position through the contract between Office of Public Defense and the Public Defender's Association. It seems appropriate to consider enhancing the funding from the.l% Sales Tax fund already supporting the involuntary civil commitment process to support the need for this additional position. The Superior Court supports the need for this position as a consequence of the unexpected increase in involuntary civil commitments since the beginning of this year.
