4 From the Desk of the President Stephanie Petersen I ve Found the Simple Life, Ain t So Simple Lawyering is a tough job, if you don t know who you are. Partner. Colleague. Board Member. Businessperson. Confidant. Chauffeur. Mother. Daughter. Friend. My list of personal identifiers goes on and on. Life would be so much simpler if each applied just like that, one at a time. But that s not how it is. No, usually they all run together, one tumbling in on top of the next: PartnerColleagueBoardMemberBusinesspersonConfidantChauffeurMotherDaughterFriend. The beginning of a new year is a natural time to stop and think about how I m balancing these different roles every day. While there are challenges and burdens, for sure, there is also great joy in each one. How do we keep a sense of balance, when there are so many jobs demanding our attention? For me, it is spending time doing something that reconnects me to my deepest sense of self. Something that makes me feel fully alive, fully joyful, fully connected with the me I have always known, no matter what phase of life or particular circumstances. For some of you that touchstone may be meditation, sea kayaking, golf, or gardening. It may be going to a ballgame, knitting, or painting a picture. For me it has always been snow skiing. I have been on skis for about as long as I can remember doing any sport at all. I rode the ski bus up to Stevens in elementary school and paid for my seasons pass instructing through college. When I am skiing, I can experience a level of physical toughness that eludes me in any other arena. One of my very oldest and dearest friends is still my ski buddy to 4 Snohomish County Bar News - JANUARY 2013 this day. We grew up skiing together, just as our parents did before us. We both have kids now and hers are graduating high school. We still love to meet up on a blue bird day, ride up on the chair and laugh about all the things we did when we were young and fearless. Now I share skiing with my daughter too, who thank goodness has no inclination to cross to the dark side and ride a snowboard. So if you try to call me at the office in the next few weeks and I m not in, don t feel frustrated. I am probably out there on the mountain, reaching for that touchstone. If my knees can still stand it, I m perched on the lip of a chute, picking my line. As I drop down and carve the first turn, depending on the terrain, Van Halen s Runnin with the Devil or Heart s Even It Up will be pulsing between my ears. Same soundtrack since 1982, no ipod required. When I get back to the office, I ll have remembered who I am. And I ll do a better job for it. Happy New Year Everyone. 5 District Court Judge Snohomish County South District Lynnwood, Washington Salary: $141,710 The Snohomish County District Court has one opening for a judicial position to fill an unexpired term on the court s South District bench. Any individual interested in the position must be a lawyer admitted to practice law in the state of Washington, and a registered voter of the South District Court district. We encourage all young lawyers to attend this meeting. We will be appointing new members to the Young Lawyer Division Board of Trustees and electing new officers. All members are invited to attend. Any active member in the Snohomish County Bar Association is a young lawyer until 36 years of age or until the fifth year in which any member has been admitted to practice, whichever is later. 7 Notice from Judges Bibb, Cowsert and Thorpe, RET Our Superior Court s Guardianship Monitoring Program (GMP) under the supervision of retired judges Bibb, Thorpe and Cowsert is facing a need for replacements for two administrative assistant positions. These are positions entailing the normal office phone, mail and other secretarial functions. They also require computer proficiency using Windows 7 and Office 2007 (Word, Outlook and Excel). Other skills pertinent to Guardianship and functions of our program may be taught on site. We hope for 2 volunteers to serve for between 9: 00 a.m. and 12:00 p.m. on at least 2 days, Tuesday, Wednesday, or Thursday for at least one year. Our volunteers, many of whom have been with us from our beginning in 2000, are a very cordial group and look forward to coming to work to enjoy the camaraderie and advance a worthy cause. That cause is to see that the financial and personal affairs of incapacitated persons (IP s) are properly looked out for. IP s can range from infants to 100 year olds with a wide range of physical and mental disabilities and needs. Often with lay guardians (usually a relative) who need a lot of over-sight and assistance themselves in carrying out the reporting and similar duties of their guardianship. It is felt that a fully, partly or about to be retired paralegal would be a likely population to solicit for applicants for these 2 positions. 9 The Lawyer s Road Review by Pete Patterson Once Upon a Car Wreck: Part 1 On the road, all seems normal now. We periodically see new cars and trucks with the dealers cardboard name plate in the license plate holder, a temporary license issued at the dealer taped to the rear window of the vehicle. New models roll out and people buy them. Not that long ago, it was not so. Once Upon A Car, by Bill Vlasic, traces the history of the auto industry beginning in about GM recognized that fleets of SUV s were being driven out of factories and then just parked, often in newly rented vacant lots, because there were so many of them. The price of gas had climbed, and no one wanted these monsters. By late 2008, a banking crisis dried up credit, and for most of us, the ability to borrow to buy a car is the difference between buying and not buying. No credit? No car. Besides, the country was in recession and unemployment was at it s peak. No job? No car. What happened next reminds me of men in the cockpit of an aircraft struggling for controls while the plane flies into a mountain. No one in the cockpit was really appreciating the danger the company was in, focusing instead on old scores and leftover suspicions while the proximity indicator screamed TERRAIN, TERRAIN, PULL UP, PULL UP. The UAW, Chrysler and GM had a lot of stressful days negotiating about health care, job security, plant closings and wages. But, by 2006, each vehicle produced by GM had a cost $1500 of health care overhead attached to it. This fact, like the mountain ahead, was immoveable. Meanwhile the competition: the Germans, Japanese and French, had none of this expense. Their government was paying the health care costs of the workers. Management, of course, cited the billions and billions they were losing, and the need to cut jobs and plants, but the corporate culture, particularly at GM, assumed the ship would right itself eventually and sales would pick up. No one really believed the numbers were permanent. If the men at the controls were not cognizant of what was happening, think about the passengers: the labor force and stockholders trapped in these doomed carriers. Perhaps they believed the same myth; GM would never die. Chrysler had been owned by the German Daimler-Benz firm for several years before dumping it on a private equity firm Cerberus, named for a mythical three headed dog which guarded Hell and is said to represent Past, Present and Future. The dog too believed in it s own myth; that it could fix any company. They were wrong. In the last couple of these years, the Germans seemed to lose interest in their adopted American cousin and put no money into product development. This meant when gas hit $3.50 a gallon that company had no small cars to sell. Cerberus the dog was supposed to greet souls as they crossed the river Styx to Hades then prevents them from escaping. The irony in this story is Cerberus itself was caught in an underworld state, unable to leave. It s executives scoured the globe for vendors of small engines and a platform to put them in, at one point launching an effort to merge with Renault- Nissan, which failed. Chrysler could not escape it s fate, but it continued to try. One day a man from Chrysler landed in Turin, Italy. The Chrysler man was actually trying to sell off a factory in Brazil to Fiat, when he found himself ushered into the office of the Big Boss, Sergio Marchionne. This is how that meeting was reported: What are you going to do when the American market falls below ten million cars a year? Marchionne asked. Oh that will never happen. the Chrysler man said. Marchionne noted the hubris, calculated Chrylser would be easy pickings later, then expressed some interest in some kind of deal where they might sell the Fiat 500 in America. The Chrysler executive excitedly scampered back to Detroit with the news. But he was too late. Within about a year the American market had fallen below the 10 million car sale mark and there was as of yet no deal with Fiat. The billions ( with a B ) it takes each month to feed the three headed dog and the remarkable fixed costs at GM were just not materializing. One or more companies were going to die. 13 2013 YMCA MOCK TRIAL ATTORNEY VOLUNTEERS NEEDED The 2013 Snohomish County Mock Trial Competition will be held on February 20, 21, and 23, Attorneys are needed to help score the competition. A panel of three attorneys observes each trial, fills out score sheets, and provides helpful criticism at the conclusion of the trial. Volunteers are provided with information on how to score the trials. We expect to have one round of two or three trials on Wednesday, February 20 th and on Thursday, February 21 st, at 5 p.m. On Saturday, February 23rd, there will be three rounds of four trials at 8:30 a.m., 11:30 a.m. and 2:30 p.m. The trials will take place at either the main courthouse in downtown Everett or the Denney Juvenile Justice Center in north Everett.
