BACKGROUND: The Snohomish County Parks and Recreation Department currently has the authority to allow opening or consumption of alcoholic beverages on the premises of the Evergreen Fairgrounds and at Willis Tucker Community Park by SCC , last amended by Ordinance on October 11, The parks department desires to expand the ability to allow opening or consumption of alcoholic beverages to other property under the custodianship of the department; as designated by the director of parks and recreation. The amendment to to sec Code would allow the parks director only to permit the opening and consumption of alcoholic beverages at specific parks at specific dates, times and events while following the Washington State's Liquor Control Boards requirements for a special occasion license or a banquet permit. Snohomish County Code Section , last amended by 12 Ordinance on October 11, 2016, is amended to read: Evergreen fairground and licensees of Snohomish county airport 15 and Snohomish county department of parks and recreation The opening or consumption of alcoholic beverages shall be permitted on the 18 premises of the Evergreen fairground, as described in SCC ; the 19 Snohomish county airport, as described in sec and ((the outdoor 20 patio of the Grand Terrace Room and indoor facilities at 'Millis Tucker Community 21 Park located at 6705 Puget Park Drive, Snohomish, 'WA 98296))other property 22 under the custodianship of the department of parks and recreation designated by 23 the director of parks and recreation pursuant to the terms of either a special 24 occasion license, pursuant to RCW and Chapter WAC, or a 25 banquet permit, pursuant to RCW and Chapter WAC, 26 hereinafter collectively referred to as liquor license, issued to the person 27 occupying such premises by the Washington state liquor control board; 28 PROVIDED, That such person shall have secured a license or permit to use such 29 premises, hereinafter referred to as a facility license, from Snohomish county, 30 and PROVIDED, FURTHER, That: (1) No such facility license shall be issued by Snohomish county except upon 33 written application stating that the licensee intends to seek a Washington state 34 liquor license and the terms of such license; (2) No liquor shall be served at a licensed event until the county receives written 37 confirmation of the licensee's successful application for a liquor license from the 38 Washington state liquor control board; (3) The licensee shall indemnify and hold Snohomish county harmless from any 41 liability arising out of any activity conducted permitted by such licensee on county 42 property; (4) The licensee shall provide commercial general liability insurance in an 45 amount not less than $1,000,000 combined single limit bodily injury and property ORDINANCE NO. 17-_ RELATING TO LIQUOR ON CERTAIN COUNTY PROPERTIES; AMENDING sec

Liquor liability and/or host liquor liability must be noted on the evidence of insurance. Snohomish county, its officers, and employees shall be named as additional insured, with an additional insured endorsement. The policy shall not be reduced or cancelled without 45 days' written notice to the county. The licensee shall provide to the county a certificate of insurance with endorsements prior to the event and, upon written request of the county, a duplicate of the policy as evidence of the insurance provided; (5) If required by the director of the airport or the director of the department of parks and recreation, the licensee shall provide crowd control by the sheriffs reserve, other police reserve, or such other security personnel as approved by the sheriff of Snohomish county. 6 APPROVED: October 11, 2006 EFFECTIVE: October 23, 2006 SNOHOMISH COUNTY COUNCIL SNOHOMISH COUNTY, WASHINGTON ORDINANCE NO REGULATING LIQUOR ON CERTAIN COUNTY PROPERTIES; AMENDING CHAPTER SNOHOMISH COUNTY CODE NOW, THEREFORE, BE IT ORDAINED: Section 1. Snohomish County Code Section , adopted by Resolution No on July 2, 1979, is amended to read: Intoxicating liquor on county property. No person ((shah)) may be in possession of an open package containing intoxicating liquor or consume intoxicating liquor, as defined in SCC , on any county park, fairground, building, or other property of Snohomish county,. except as provided for in this chapter. Every person who violates any provision of this section shall be guilty of a misdemeanor and upon conviction thereof shall be punished as provided in sec Section 2. Snohomish County Code Section , last amended by Ordinance No on April 6, 1981, is amended to read: ( (E:,i:eeptiee ) )Leased facilities. ((The provisions of SCC shall not apply to)) The opening or consumption of alcoholic beverages shall be permitted on any premises or property of the county ((H:eW)) leased to another party or otherwise contractually bound by an operator or concessionaire agreement for a term of one year or more, including the clubhouse at Kayak Point golf course and the Future of Flight Aviation Center, PROVIDED the lessee or other person occupying the premises or property has obtained a valid license from the Washington state liquor control board permitting ((upon v1hich)) the sale of intoxicating liquor ((is now or hereafter authorized by a valid and subsisting license issued by the Washington state liquor control board)).
