1 Kimball City Council Regular Meeting April 18, 2012 A regular meeting of the Mayor and City Council was convened in open and public session at 6:00 p.m. on April 18, 2012 at the City Council Chambers. Mayor Schnell and Council members Warner, Haun and Baliman were present. Council member Christensen was absent. Also present were City Attorney Hadenfeldt, City Administrator Farrar, Clerk/Treasurer Russell and Deputy Clerk/Treasurer Strauch. The public was represented. Notice of the meeting was given in advance by publication in the Western Nebraska Observer. Notice of the meeting was given to the members and a copy of their acknowledgement of receipt of notice and the agenda is on record at the office of the City Clerk. Availability of the agenda was communicated in advance notice and in the notice to the members. All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public except as otherwise indicated. Schnell called the meeting to order at 6:00 p.m. and the Pledge of Allegiance was recited. Schnell acknowledged the posted Open Meetings Act poster. At 6:00 p.m., Schnell opened a public hearing on a request to rezone property at 3948 Road 34 N. The property is Big Sky on 3 rd Street. When Kimball did the initial rezoning, this property was zoned as Single Family Residential District (R-1) and the owner is requesting to rezone to Heavy Commercial District (C-5). The Planning Commission met on April 11, 2012 and recommended approval of the rezoning. John Marottek, owner, would like to build personal storage units. One building faces east and west and two buildings face north and south. He will paint the containers that are currently on the property and they will be set on the west side of the property. Mark Davies, 707 Blackman Blvd., commented that it was the City s mistake and it is the City s job to fix it. There being no further discussion, Schnell declared the public hearing closed at 6:03 p.m. Haun moved and Warner seconded to introduce Ordinance 681 and waive the requirement of reading on three different days be suspended. On roll call vote, the following votes were recorded on the electronic voting board. Aye: Warner, Haun, and Baliman. Nay: None. Absent: Mayor Schnell read Ordinance 681 by title only. ORDINANCE NO. 681 AN ORDINANCE AMENDING THE ZONING FOR A TRACT OF LAND SITUATED IN THE NORTHWEST QUARTER OF SECTION 31, TOWNSHIP 15

2 NORTH, RANGE 55 WEST OF THE 6 TH P.M., KIMBALL COUNTY, NEBRASKA, (ALSO KNOWN AS 3948 ROAD 34N) TO HEAVY COMMERCIAL DISTRICT (C-5); PROVIDING FOR THE REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE AND PUBLICATION IN PAMPHLET FORM. Haun moved and Baliman seconded to pass and approve Ordinance 681. On roll call vote, the following votes were recorded on the electronic voting board. Aye: Warner, Haun, and Baliman. Nay: None. Absent: Schnell read a proclamation designating April 27, 2012 as Arbor Day and presented the proclamation to Spud Rowley, Cemetery Superintendent. Schnell read a proclamation for Keep Kimball Beautiful 2012 Clean & Green Cleanup and presented the proclamation to Susie Abramson and Peggy Kramer. April is the month that is nationally known as the Great American Cleanup and Kimball s volunteers do a great job. Schnell spoke about the recycling, paper shredding days, and other services provided by Keep Kimball Beautiful and thanked them for their volunteerism. Schnell opened discussion on appointments to the Economic Development Loan/Citizen s Advisory Committee and the Board of Public Works. Shelly Olsen will replace Jim Garbarino on the Economic Development Committee. Garbarino is moving out of state. Greg Robinson will replace Jim Merryfield on the Board of Public Works. Merryfield has been sent to Afghanistan. Warner said she had a concern about appearances with Robinson being a good friend of the City Administrator and a relative of the Mayor. Schnell said it is difficult to get volunteers to serve on boards and commissions. There being no further discussion, Baliman moved and Haun seconded to approve the Mayor s appointments of Shelly Olsen to the Economic Development Loan/Citizen s Advisory Committee and Greg Robinson to the Board of Public Works. On roll call vote, the following votes were recorded on the electronic voting board. Aye: Warner, Haun, and Baliman. Nay: None. Absent: Schnell opened discussion on a resolution in support of Kimball County s application for Livestock Friendly County designation. Sheila Newell, Kimball County Zoning Administrator, was present to speak on behalf of the Livestock Friendly County designation. The Kimball County Commissioners held a hearing to determine if they wanted to participate so the county could be designated as livestock friendly. They have completed the application and the application requires a resolution of support from the City. This is a promotional, no-cost program. There are currently 14 counties that are livestock friendly. Baliman was at the commissioners hearing and there was a huge outpouring of public comment. She commended Newell for what she has done on this designation and inquired why livestock friendly and not agriculture friendly. Newell responded it is all encompassing and livestock friendly is the designation of the Legislature. Haun said this should have been done a long time ago and is glad it is going forward now.

3 There being no further discussion, Baliman introduced the following resolution and moved its approval. Resolution # Livestock Friendly County Program State of Nebraska WHEREAS, on March 20, 2012 after due publication and notice, the Kimball County Board of Commissioners conducted a public hearing and received comments from the public concerning designation as a Livestock Friendly County; and WHEREAS, on April 2, 2012, the Kimball County Board of Commissioners adopted and passed Resolution # declaring that Kimball County fully supports the Livestock Friendly County Program in Nebraska and respectfully requested that its application for designation as a Livestock Friendly County be reviewed and approved by the Director of the Department of Agriculture; and WHEREAS, the City of Kimball acknowledges that livestock is important to the economic well-being of Kimball County; and WHEREAS, the City of Kimball intends to work with all other governmental jurisdictions within its boundaries in implementing livestock development within the county. NOW, THEREFORE, be it resolved and hereby declared that the City of Kimball, Nebraska fully supports the Livestock Friendly County Program in Nebraska. Absent: Schnell opened discussion on the amended agreement between City of Kimball and Prairie Animal Hospital. It was indicated that Dr. Shaw had requested some changes to the agreement executed earlier this year. In particular, the number of days that the animals would be held. Hadenfeldt commented that Shaw didn t agree with the six day holding and requested it be changed to three business days, unless quarantined. Discussion was held on this change and comment was received from Jeannette Rabender, Chamber Director, who doesn t agree with the change. Haun indicated this is just a guideline and gives the City the guideline of stopping payment. It was indicated

4 that the Police Department are very good about trying to find the owners of the dogs. Baliman commented that Shaw provides a huge service to the City. There being no further discussion, Baliman moved and Haun seconded to approve the amended agreement between City of Kimball and Prairie Animal Hospital and authorize the Mayor to sign the agreement. Absent: Warner moved and Baliman seconded to remove the City of Kimball Employee Handbook from table. On roll call vote, the following votes were recorded on the electronic voting board. Aye: Warner, Haun, and Baliman. Nay: None. Absent: Schnell opened discussion on the City of Kimball Employee Handbook. Discussion was again held on the EIB and Spud Rowley commented on the changes. Baliman has heard from a number of citizens and said her reason for being a council member is to represent the majority of people. She added that she means no disrespect to employees. There being no further discussion, Warner moved and Haun seconded to accept the City of Kimball Employee Handbook as printed and presented. Absent: The City Council reviewed the following items under the consent agenda: 1. Minutes from the April 4, 2012 meeting; 2. Claims; 3. Financial statements. Baliman moved and Warner seconded to approve the consent agenda items as presented. On roll call vote, the following votes were recorded on the electronic voting board. Aye: Baliman, Warner, and Haun. Nay: None. Absent: Christensen. Motion carried.
