4 ORANGE COUNTY COUNCIL OF GOVERNMENTS Technical Advisory Committee Draft Summary Discussion and Action Minutes Meeting of December 1, 2009 The OCCOG Technical Advisory Committee (TAC) meeting of December 1, 2009 was called to order by Chair Marika Modugno, City of Irvine, at the City of Orange, Conference Room C at 9:04 A.M. Attendees were invited by Chair to introduce themselves. The list of meeting attendees is attached. PUBLIC COMMENT: There were no public comments. ADMINISTRATION 1. OCCOG TAC Meeting Minutes A motion by Tracy Sato, City of Anaheim, with an amendment to the minutes regarding the wording of shall to be replaced to should in the discussion on crafting of a SCS for Orange County (item 4) and with this change she moved approval with a second by Art Bashmakian, City of Westminster, followed by the TAC unanimously approving the minutes of the November 3, 2009 meeting. 2. OCCOG TAC Administration for Calendar Year 2010 Meeting Schedule for OCCOG TAC Calendar Year 2010 Motion was made by Doug Reilly, City of Laguna Woods to move the first meeting in January to January 12 (second Tuesday) with the balance of the calendar to be adopted as proposed with second by Pat Dapkus, City of Huntington Beach, followed by the TAC unanimously approving this motion. Election of Officers Calendar Year 2010 Motion was made by Doug Reilly, City of Laguna Woods, to accept the nomination and to elect the current officers to the same positions for 2010 with second by, City of (TAC members, anyone recall who made the second on this motion). Motion was approved unanimously. PRESENTATION 3. Housing Element SCAG Draft paper The Linkage between Sustainable Communities Strategy and the Regional Housing Needs Assessment (RHNA) released back in September 2009 (starting on page 12 of the agenda packet). A copy of a PowerPoint on this topic was handed out to committee OCCOG TAC Page 1 of 14

5 DRAFT - OCCOG TAC Minutes Meeting of December 1, 2009 Page 2 members called, The RHNA and Sustainable Communities Strategy, November 2009, authored by Mr. Carreras. Mr. Joseph Carreras spoke on this topic in greater detail as the TAC invited him to speak at this meeting. He discussed the issues related to the development of the next RHNA in light of SB The expectation of SB 375 is that the land use capacity identified in the SCS will be linked to housing needs at all income levels. He shared that this is a complex relationship between these two new tools for planning housing growth in the state and local regions. What is anticipated is that local General Plan s will be kept up to date in compliance with state housing goals. One streamlining aspect of the SCS is the CEQA question. If your region s SCS is followed and projects are in compliance with these goals, a project could be exempt from CEQA and more streamlined in moving forward. The purpose of SB 375 is to integrate the housing growth by tying it with regional transportation plans. How to align the two together is something that all MPO s will need to tackle. His paper speaks to how SCAG anticipates it will do this. The issue of emission targets was also covered by Mr. Carreras. The SCAG region will receive its target reduction number in fall of 2010 with the housings target for the next RHNA to follow from State Housing and Community Development. The challenge will be to align these two goals in a proper way. This likely means reducing the total number of vehicle miles traveled or vehicle trips and tying the economic (jobs) base with housing growth to make sure that the two are proportional. The goal is to have a better job/housing balance and fit in the next RHNA. All of this will need to be reconciled. He covered the SCAG timeline (see page 5 of the PowerPoint handout Milestone) and anticipated deadlines dates of the next RHNA. Basically, once the next RTP/SCS is adopted by SCAG the next RHNA and housing element would need to be completed 18 months after the date of this adoption. He referred to the table on the bottom of page 4 with date targets for the next cycle. These dates may change. He explained that the Milestone table on page 5 is an attempt to integrate the statue requirements of the two issues (SCS/RHNA) together. The big question is how to put all of this together and how to do justice to this effort. The timing is still evolving. The difficulty is coordinating the planning process for SCS as well as the RHNA to come up with the final allocation of housing units to local communities. The reality is that jurisdictions with existing transit and large employment hubs will no doubt get more of a housing allocation. The issue of fair share will need to be considered and the definition of what is a fair share is now changing. The issues of housing and social equity are also in the mix. In closing, he shared that this is will be a complex process and he hoped all jurisdictions can work together (be collaborative) with SCAG to complete the next RHNA effort. Chair Modugno asked TAC members to continue to review this paper and share any comments with Mr. OCCOG TAC Page 2 of 14

A TAC member asked that this topic be included in the next agenda so we can continue to review the aspects on how to integrate this effort. Please send comments to Chair Modugno or Mr. Carreras as soon as you can. DISCUSSION AND ACTION ITEMS 4. Orange County Projections (OCP 2010)/SCAG 2012 Regional Transportation Plan and Growth Forecast (This item was discussed ahead of item 3 as the speaker was delayed in arriving to the meeting) The purpose of this item on the agenda is to recap the coordination of efforts for the next OCP and SCAG s growth forecast processes and share thoughts on the SCAG data that will be provided to jurisdictions. Ms. Diep covered this topic by passing out a sheet tailored for each OC jurisdiction listing the housing growth projected in OCP-2006 and January 1, 2009 housing unit estimate based on Housing Inventory System (HIS) reports for each jurisdiction. CDR is asking for your input on the control totals on the number of units finaled or expected to be completed from January 2009 to July She covered the request details as noted on the handout. July 1, 2010 is the next milestone date for OCP She asked for responses by the end of the week (December 4) along with completing the HIS report to December 1, 2009 asked for in November. Ms. Diep thanked all for our assistance on this as CDR has tight timeframes to complete work on the baseline figures so it can be given to SCAG as part of the SCS process. 5. SCAG Framework and Guidelines for the Development of Subregional SCS/APS (Ms. Modugno/Charlie Larwood, OCTA to provide update on this topic) Draft framework and guidelines for the development of a Subregional SCS/APS Draft SCS Collaborative Process (most jurisdictions will do with this effort) Ms. Modugno noted that the OCCOG voted to prepare an Orange County SCS at their November Board meeting. The issues related to doing this work and how local cities will assist in producing a local SCS was covered. OCTA Board will take action on this item on December 14. If approved, OCTA as OCCOG staff will be the lead in putting this together. The public participation element will also need to be included in this effort. A brainstorming conference call is set for December 17 at 9am to develop a list of next steps. Mr. Larwood shared that likely the SCS framework/guidelines from Huasha Liu, SCAG, will be a possible framework Orange County will follow to prepare our own SCS. Ms. Sato, City of Anaheim, shared a number of points related to this framework: How do we prepare a sub-regional SCS which has an earlier timetable for completion? How is it tied to the next cycle of RHNA? Since the RHNA timeline is later, it may be difficult to do it at the same time as RHNA. OCCOG TAC Page 3 of 14

How will we establish overall policies and goals for the Orange County sub-region? o Example: Inclusion of BMP s from CARB (these are not yet crafted and might not be done as the OC/SCS is being developed) Ms. Diep shared some of her insights on the OC-SCS and how it will interface with the SCAG s SCS. Mr. Larwood shared additional OCTA concerns on how this effort will be completed. Ms. Modugno shared that the City of Irvine has developed an internal City task force to get ready for this effort. A discussion ensued on what the OCCOG Board action did in accepting delegation to create an Orange County SCS. They approved this action asking for a MOU with SCAG to cover OCCOG and OCTA. Key is the desire to protect Orange County so that SCAG will not make modifications to Orange County s SCS. If a satisfactory MOU cannot be reached between OCTA/OCCOG/SCAG on terms of the subregional SCS, then Orange County will not pursue a delegated SCS but will work through SCAG s collaborative process. The language still needs to be crafted so this can be developed. This item is still a moving target and the process is still being formulated. The suggestion was made for the OCCOG TAC SCS working group to craft a list of technical concerns and submit them to OCCOG staff. 6. SB 375 Update Chair Modugno provided updates of the following items: SCAG SB 375 Regional workshop of November 18, 2009 in Ontario, CA This workshop was attended by many of the TAC members. The morning included comments from the RTAC members from the SCAG regions and the afternoon session included a panel discussion by local stakeholders of the potential impacts SB 375. The discussion was helpful. 1. Regional Targets Advisory Committee November 19, 2009 meeting The ARB received a similar report as given at the regional workshop the day before by the local representatives on the RTAC. A PowerPoint presentation detailing the methodology recommendations proposed by the RTAC in the report released from September. There is interest from the RTAC membership to raise the GHG target levels. CARB didn t take action with the report. OCCOG TAC Page 4 of 14

SCAG Meetings Chair Modugno covered the following topics below: Subregional Coordinators Group is meeting later in the afternoon and will be receiving an update on SB 375, including discussion of the draft SCS Framework and Guidelines, the growth forecast and SB 375 outreach efforts. Community, Economic, and Human Development Committee: The CEHD Committee will receive a report from the Fiscalization of Land Use Subcommittee. An update on SCAG s draft SB 375 Subregional Framework and Guidelines will also be provided. Joint Meeting of the SCAG Regional Council, the Southern California Leadership Council, and Global Land Use and Economic Council: There will be a special joint meeting prior to the regularly scheduled Regional Council meeting. The joint meeting of the Regional Council, SCLC, and GLUE Council will feature comments from former Governors Pete Wilson and Gray Davis, RTAC members Art Leahy and Greg Devereaux, Assembly Speaker Karen Bass, and ARB Chairwoman Mary Nichols. Regional Council: The Regional Council will consider adopting the conformity analysis and resolutions associated with Amendment #2 to the 2008 Regional Transportation Plan and Consistency Amendment #08-24 to the 2008 Regional Transportation Improvement Plan (RTIP). Additionally, the Regional Council will consider approval of the Program Environmental Impact Report Addendum #2 for the 2008 Regional Transportation Plan Amendment #2. Policy committees will be meeting at 9:00 am on Thursday. 8. OCCOG Board Meeting of November 19, 2009 David Simpson, OCCOG noted that there wasn t too much to recap from this meeting as it was short and the Board covered many of the same topics that we have already covered at this meeting. 15 OCCOG Technical Advisory Committee January 12, 2010 Item 3: Recommended Action: Orange County Projections 2010 Control Totals Approve and forward OCP-2010 control totals to the OCCOG Board for approval. Report Ms. Deborah Diep will present the Orange County Projections control totals to the OCCOG TAC for approval and forward to OCCOG Board. Once the OCCOG Board has approved the county totals, the projections will be disaggregated to the city and small area levels. The CDR will meet with all Orange County jurisdictions in spring 2010 to review growth in their cities. The information collected at the jurisdiction meetings will be incorporated in to the Orange County Projections and disaggregated data will be reviewed by individual jurisdictions. The local review of the updated dataset will begin in late spring/summer Attachments: 1.
