4 ITEM # Update to the Central Orange County Watershed Management Area Executive Action Plan (Recording: 00:06:50) Ms. Carr began the discussion of the latest draft of the Executive Action Plan (EAP) stating that this presentation is a result of the updates and feedback from the Newport Bay Watershed Management Committee (MC). Amanda encouraged discussion, questions or clarifications and next step directions for the MC. Chris Crompton s presentation was an update to the 2010 Executive Action Plan (EAP), starting with an overview, highlighting each section of the EAP, its issues, as well as potential recommended changes and included key decisions for the Executive Committee (EC) to consider. Committee members questions and comments were from 00:25:43 to 01:24:54. Andrew Hamilton requested a discussion of sediment in Serrano Creek at a future meeting. Mayor Bernstein requested the funding formula in the revision of the TMDL funding forecast. Action Items: Send digital copies of the 2010 EAP, 2017 EAP and any progress reports or past presentations of the EAP. Give the EC a brief summary of the types of changes, showing the difference between the two documents, as in (1) editing and clarifying the document information, (2) the new sections illustrating progress using charts and (3) a table of significant achievements over the next five years. Educate the public on water issues and water advocacy groups, utilizing and coordinating with the cities, the water districts and state agencies; a one-page update of the EAP summarizing our progress from 2010 to Add Serrano Creek to the EAP schedule. The Chair opened the floor for comments and questions; there were none from the audience. Recommended Action: Review, comment and provide direction ITEM # 4 Research Update: University of California Irvine Study Development of Modeling Tools to Manage Sediment for Sustainable and Resilient Coastal Lowland Habitat in Southern California (Recording: 01:15:24) Eric Stein, PhD, Principal Scientist with Southern California Coastal Water Research Project (SCCWRP) gave a presentation on the joint effort of UCI and SCCWRP in using data on sediment production to create modeling tools to achieve long-term sediment management in the Upper and Lower Newport Bay and the Newport Bay Watershed. Committee members questions and comments were from 01:17:57 to 01:40:17. Action Item: Include a suggested time line for each agenda item Recommended Action: Bring this item back to the Executive Committee with a report of preliminary findings before final report is submitted ITEM # 5 Election of Officers (Recording: 01:40:36) Chair Swan opened discussions for the election of the chair and vice chair positions for the Executive Committee. Supervisor Do motioned for Peer Swan to remain Chair and to continue to have the supervisor serve as Vice Chair and to change the term limit from a two-year term to an annual term. Chair Swan divided Supervisor Do s motion into two items (Item 5A) the election of the Chair and Vice Chair and (Item 5B) changing the term limit. 5A Election of Chair and Vice Chair for Recommended Action: Elect Chair and Vice Chair for Motion: First/Second: Objections: Elect Peer Swan as Chair and Supervisor Do as Vice Chair Supervisor Do/ Andrew Hamilton None Newport Bay Watershed Executive Committee Page 4 of 10 Minutes, June 21, 2017

5 Outcome: Peer Swan and Supervisor Do were unanimously elected as Chair and Vice Chair, respectively, each serving a two-year per agreement, pending the outcome of Item 5B 5B Term-Limit Amendment to Agreement D An annual term will give the supervisor time to become familiar with the committee and its goals/objectives and then, will go on to lead in the second year, thus giving the committee a better-prepared Chair in that year. If we remain with the two-year process, the current supervisor may not be on the Executive Committee for their second year. Chari Swan commented he would like to start process now. Since the EAP is in process of being amended, this could be on that list of amended items. Action Item: Amanda will ask County Counsel the process to address the term limit issue and report her findings in the June meeting Recommended Action: Remove two-year term limit to one-year term limit pending amendment to Agreement D Motion: First/Second: Objections: Outcome: Change Chair and Vice-Chair length of service from two years to one year Supervisor Do/Andrew Hamilton None Item will be added to the agenda for the June 21, 2017 meeting ITEM # 6 Executive Officer Report (Recording: 01:46:06) Amanda Carr, County of Orange 1. Ms. Carr gave an update on the North and Central Orange County Watershed Management Areas Integrated Regional Watershed Management Plans, stating that at the June 21, 2017 Executive Committee Meeting, they will have recommendations for a combined North and Central Orange County IRWM Plan. 2. The Orange County Storm Water Resource Plan was presented to the Department of Water Resources on February 28, 2017 to ensure our ongoing eligibility for State-funded Grant Programs for all three Orange County Watershed Management Areas. This plan is available for future Grant funding and State Bond funding requests. Action Item: Dr. Bernstein requested a copy of the plan; Amanda will provide one to all Executive Committee Members. 3. San Diego Creek Sediment Removal Activities - Update for In-Channel Basin 3 (completed), between Culver and Jeffrey (60,000 cubic yards/to be completed by April 1 st ) and along the 405 to the 405 loop (370,000 cubic yards/start day in Fall of 2017). ITEM # 7 Executive Committee Members Comments (Recording: 01:57:01) Von Blasingame-no comments Navarro-was disappointed enough time was not allocated for Dr. Stein s presentation (Item #4); she supports his project; mentioned the Climate Science Alliance for the South Coast Eco-region; would like to hear Dr. Stein s recommendations at another meeting Swan-reiterated the committee requested a report before the recommendations Hamilton-expressed his congratulations to the Chair and Vice Chair Bernstein-also expressed his congratulations and welcomed the new committee members Swan-no comments ITEM # 8 Public Comments (Recording: 01:59:00) The Chair opened the floor for comments and questions; there were none from the audience. 7 ITEM # 2. STATUS OF PREPARING AN UPDATED INTEGRATED REGIONAL WATERSHED MANAGEMENT PLAN FOR NORTH AND CENTRAL ORANGE COUNTY Presentation by: Marsha Westropp, Orange County Water District (15 minutes) The Integrated Regional Water Management (IRWM) program was created by the state in 2002 in order to fund projects implementing water management solutions on a regional scale. A year later, the Orange County Board of Supervisors initiated a process to develop a county-wide water quality strategic plan, which led to the creation of three watershed management areas (North, Central and South). The Newport Bay Watershed Executive Committee oversaw the preparation of the Central Orange County Watershed Management Area s IRWM plan that was completed in The County of Orange facilitated development of the North Orange County IRWM Plan that was finished in The statewide IRWM program is administered by the Department of Water Resources (DWR). Proposition 84 (passed in 2006) created Funding Areas for the disbursement of IRWM funds, specified funding levels for the areas, and required projects to be included in an IRWM plan in order to be eligible for funding. For this grant program, the North and Central Orange County Watershed Management Areas elected to participate in the Santa Ana Watershed IRWM program, also known as the One Water One Watershed (OWOW) program that is administered by the Santa Ana Watershed Project Authority. (South Orange County is included in the San Diego Funding Area.) A new round of grant funding from Proposition 1 is expected to be available in early To prepare for this grant round, the County of Orange is managing the effort to update the IRWM plans and combining the North and Central IRWM plans into one. The planning effort enables a wide-range of stakeholders to participate in setting regional water resource management priorities and to develop a list of regional, multi-benefit, multi-agency projects. With completion of the plan, the North and Central Orange County area may elect either to participate in the IRWM program as part of the OWOW program or to submit an application to DWR to become a separate region and compete with SAWPA for Prop. 1 funds. Marsha Westropp, Senior Planner for the Orange County Water District will present an update on the ongoing stakeholder effort to prepare a combined North and Central Orange County Integrated Regional Water Management Plan. Stakeholders began meeting in February to develop the framework for updating the plan. Goals, objectives and strategies for management of water resources in the region were drafted. These will form the basis for determining regional priorities and to create a process to rank priority projects. 8 ITEM # 3. IMPLEMENTATION OF NEW STATE TRASH REGULATIONS IN THE NEWPORT BAY WATERSHED Chris Crompton, County of Orange In 2015 the State Water Resources Control Board adopted statewide regulations for the control of trash entering the municipal storm drain system. The regulations are often referred to as the Trash Amendments or Trash Provisions. Implementation of the regulations is set to commence in June 2017 with action expected from the Santa Ana Regional Water Quality Control Board. Their action, likely through a Water Code 13267/13383 order, will set in motion an initial 3-month period where the County and cities must consider and select the approach to compliance they intend to take, either the installation of full capture devices in high priority areas (termed Track 1) or a plan that uses a combination of controls that is equivalent to Track 1 but with more flexibility (termed Track 2). Full compliance is expected in 10 years. This agenda item will provide a number of short presentations on the Trash Amendments and the potential approaches to compliance being considered in the Newport Bay watershed. A) SANTA ANA REGIONAL BOARD IMPLEMENTATION OF THE TRASH PROVISIONS Presentation by: Barbara Barry, Santa Ana Regional Water Quality Control Board (10 minutes) The Trash Provisions refer to the amendment to the Water Quality Control Plan for Ocean Waters of California to Control Trash (Ocean Plan) and the amendment to the Water Quality Control Plan for Inland Surface Waters, Enclosed Bays, And Estuaries Of California (ISWEBE Plan), adopted by the State Water Board on April 7, The Trash Provisions establish a statewide water quality objective for trash and a prohibition of trash discharge, or deposition where it may be discharged, to surface waters of the State. The Trash Provisions require implementation of the prohibition through requirements incorporated into Phase I MS4 Permits and/or through monitoring and reporting orders, by June 2, Since the Trash Provisions have not yet been implemented through the North Orange County MS4 Permit, the Santa Ana Regional Board is implementing some of the requirements of the Trash Provisions through an Order in accordance with Water Code section The remainder of the requirements will be implemented through the next iteration of the North Orange County MS4 Permit. B) 2016 NEWPORT BAY TRASH MANAGEMENT PLAN FRAMEWORK Presentation by: Ted von Bitner, AMEC-Foster Wheeler, (10 minutes) In 2011, the County of Orange received a grant from Department of the Interior, through the U.S. Fish and Wildlife Service Coastal Impact Assistance Program to develop a Trash Management Plan Framework for the Newport Bay Watershed. The intent behind development of the Plan was to create the technical approaches needed for managing and monitoring trash on a watershed scale. The Newport Bay Trash Management Plan Framework is consistent with the Trash Amendments and the approaches and implementation efforts are aligned with the regulatory requirements. The Plan development process involved preparing a number of technical reports and conducting a field-based pilot project with a watershed city Newport Bay Watershed Executive Committee Page 8 of 10 Staff Report, June 21, 2017

9 C) CITY OF TUSTIN TRASH CONTROL ACTIVITIES Presentation by: Alex Waite, City of Tustin (10 Minutes) I The City of Tustin began installing full capture devices three years ago with the assistance of OCTA M2 Environmental Cleanup Program. The City currently owns 1,226 catch basins within its jurisdiction and 479 of these come under this requirement. Staff anticipates that the City will retrofit these catch basins within two years. Full capture devices are focused on the priority areas in the Trash Provisions including industrial, commercial, high density residential, mixed urban, and public transportation stations. In addition, the City has a weekly street sweeping schedule, which resulted in 964 tons of debris being picked up. The City has installed trash containers at all bus stops within in jurisdiction which are emptied multiple times each week. The City also cleans its catch basins three times a year, removing 343 tons of debris from the system last year. D) CITY OF NEWPORT BEACH TRASH/DEBRIS CAPTURE EFFORTS Presentation by David Webb, City of Newport Beach (10 Minutes) The City of Newport Beach will present and discuss the City s past, present and possible future efforts toward the capture and removal of trash and debris prior to it entering the storm drain system and/or the bay and ocean.
