City Attorney Litfin stated that Councilwoman Tara Campbell recused herself for two cases on Closed Session Item A, Conference with Legal Counsel Anticipated Litigation, Significant Exposure to Litigation, because she has a potential conflict under Government Code Section due to her employment with the County of Orange. City Attorney Todd Litfin also reported that a hearing officer was selected for the Closed Session Item B, Public Employee Discipline/Dismissal/Release. PAGE 3

4 INTRODUCTIONS & PRESENTATIONS CITY OF YORBA LINDA S 50 TH BIRTHDAY CELEBRATION KICK OFF Mayor Peggy Huang welcomed everyone to the City s 50 th birthday celebration and gave a brief account of the City s history. Mayor Huang provided a proclamation to the Yorba Linda Historical Society in honor of the City s 50 th birthday and to thank the Society for being a remarkable resource of information and preserving the City s rich history. Lynne Yauger, President of the Yorba Linda Historical Society, was honored to accept the proclamation on behalf of the Society. She thanked the City Council for the privilege of operating the Susanna Bixby Bryant Museum and announced that after being closed for renovation, the grand re-opening would be on Sunday, June 4 th at 1:00p.m. Mayor Huang recognized former City Council and Commissioners for their contributions and leadership which helped shape Yorba Linda s first 50 years. All of the former Council and Commissioners in attendance were introduced, a photograph was taken with the City Council and they each received a gift in celebration of the City s 50 th anniversary. Mayor Huang also thanked City Attorney Todd Litfin and everyone at Rutan and Tucker, who were the City s legal counsel at the beginning in 1967 and continue to help today by sponsoring tonight s celebration. RECESS Mayor Huang called a recess at 7:01 p.m. and reconvened the meeting at 7:26 p.m. PUBLIC COMMENTS ITEMS ON THE CONSENT CALENDAR OR ITEMS NOT ON THE REMAINDER OF THE AGENDA Jan Horton, former Councilwoman, spoke as President of the Yorba Linda Sunrise Rotary and invited everyone to Lobsterfest on May 19 at the Yorba Linda Community Center. Lourdes Cruz, resident, was introduced as the newest member of the Yorba Linda Sunrise Rotary. Arnie Pike spoke about American Disability Act requirements throughout the City. Richard Debruijn, resident, asked several questions including the status of the Town Center construction, the clean-up of the former Ultramar gas station and the Bastanchury Road Widening Project. 5 Justin Lasley, resident, urged Council to consider adding more patrol officers due to recent residential burglaries. Pat Nelson, resident, asked for an update on the Janeway/Trueblood house. Bill Gorman, resident, spoke about making Yorba Linda and the North Orange County area a tourist destination. He also mentioned solicitors becoming a nuisance at his home. Peter Meng, resident, spoke about spite fencing and trees in the Vista del Verde neighborhood. Julia Schultz, resident, attended the Library Community meeting on April 19 and commented that the access door for the new Arts Center should be designed for height. Kay Dotson, resident, spoke about drought tolerant arterial medians on Santa Ana Canyon road and landscaping near Esperanza Road. CONSENT CALENDAR It was MOVED/SECONDED HERNANDEZ/HANEY - to approve the Consent Calendar. WAIVE READING IN FULL OF ALL ORDINANCES AND RESOLUTIONS ON THE AGENDA waived reading in full of all ordinances and resolutions on the agenda and declared that said titles which appear on the public agenda shall be determined to have been read by title and further reading waived. 2. ACCOUNTS PAYABLE CHECK REGISTER received and filed the Accounts Payable Check Register. 3. APPROVAL OF THE MINUTES OF THE SPECIAL APRIL 3, 2017 CITY COUNCIL/SUCCESSOR AGENCY TO THE YORBA LINDA REDEVELOPMENT AGENCY MEETING approved the minutes of the special April 3, 2017 City Council/Successor Agency to the Yorba Linda Redevelopment Agency joint meeting. APPROVAL OF THE MINUTES OF THE APRIL 4, 2017 CITY COUNCIL/SUCCESSOR AGENCY TO THE YORBA LINDA REDEVELOPMENT AGENCY MEETING approved the minutes of the April 4, 2017 City Council/Successor Agency to the Yorba Linda Redevelopment Agency joint meeting. 5. CONTINUE CURRENT IMPLEMENTATION OF CITY COUNCIL POLICY A-6, USE OF GOVERNMENT ACCESS CHANNEL The City Council directed staff to continue to implement current City Council Policy A-6, Use of Government Access Channel (dated October 7, 2014), which includes a fiscal year implementation policy and directs staff to bring back an annual report for the City Council s review. 6. AWARD OF CONTRACT FOR JANITORIAL SERVICES AT CITY FACILITIES The City Council (1) awarded the three year contract for Janitorial Services at City Facilities to Merchants Building Maintenance, Inc., of Santa Ana, CA in the amount of $553, ($184, annually) and rejected all other bids; and (2) authorized the Mayor to sign and City Clerk to attest said agreement. 7. RESOLUTION NO INTENT TO VACATE DESIGNATED LANDSCAPE EASEMENTS WITHIN TRACT FOR LOCAL LANDSCAPING ZONE L2U The City Council (1) adopted Resolution No , declaring its intent to vacate designated landscape easements within Tract 10285; (2) set June 6, 2017 as the Public Hearing date for the vacation process; (3) appropriated $10,000 from the General Reserve fund to cover the costs associated with modifying the existing irrigation system and removing some of the existing ongrade irrigation infrastructure within landscape areas where the irrigation will be stopped; (4) directed staff to obtain release letters from property owners with approved requests to keep any of the existing on-grade irrigation infrastructure; (5) directed staff to send out general notices to designated properties in Local Landscaping Zone L2U once the Public Hearing date has been set; and (6) directed staff to proactively enforce Zoning Code requirements, any development specific Conditions of Approval, City approved Design Guidelines, Mitigation Measures from Environmental Documents, Design Review, and other applicable documents for the areas previously maintained by the LMAD. 8. RESOLUTION NO APPROVING THE CLOSURE OF MAIN STREET FROM IMPERIAL HIGHWAY TO LEMON STREET The City Council adopted Resolution No , approving the closure of Main Street from Imperial Highway to Lemon Street. NOTICE OF COMPLETION FOR BASTANCHURY ROAD IMPROVEMENT PROJECT FROM PROSPECT AVENUE TO IMPERIAL HIGHWAY The City Council accepted the Bastanchury Road Improvement Project from Prospect Avenue to Imperial Highway, authorized the City Clerk to file a Notice of Completion with the County Recorder, and authorized the retention monies to be paid when appropriate to do so. 10. CONTRACT AGREEMENT EXTENTION FOR LANDSCAPE MAINTENANCE SERVICES PACKAGE B TO MERCHANTS LANDSCAPE SERVICES, INC. The City Council approved a contract extension, in the amount of $391,172 for April 1, 2017 to March 31, 2019 for landscape maintenance services of Maintenance Package B to Merchants Landscape Services, Inc. 11. FISCAL YEAR 2016/2017 THIRD QUARTER BUDGET UPDATE The City Council received and filed this report. 12. REPORT OF PLANNING COMMISSION ACTIONS FROM THEIR LAST MEETING The City Council received and filed this report. 13. COUNCIL COMMITTEE AND AGENCY REPORTS The City Council received and filed this report. End of Consent Calendar PUBLIC HEARINGS 14. CONTINUED PUBLIC HEARING DECLARING THE VACATION OF DESIGNATED LANDSCAPE EASEMENTS WITHIN TRACTS 15983, 15984, 16028, 16043, 16044, 16045, 16144, AND FOR LOCAL LANDSCAPING ZONE L5A a. Open Public Hearing Mayor Huang stated that the public hearing remained open from the March 21, 2017 City Council meeting. b. Staff Report Public Works Director/City Engineer Michael Wolfe provided a PowerPoint presentation of the landscape easements, Pre and Post Proposition 218 outreach efforts, and responded to Council questions. Take Testimony The following members of the public spoke regarding the vacation of designated landscape easements in certain tracts for Local Landscaping Zone L5A: Paul Degrassi, Tracy Frasz, Justin Lasley, James Williams, Barbara Williams, Kim Stoica, Peter Meng, Pat Nelson, Laura Barnes, Robert Perkins, Kay Dotson, Teresa Degrassi, Patti Demonde d. Close Public Hearing Mayor Huang closed the Public Hearing. e. Make Determination It was MOVED/SECONDED HERNANDEZ/CAMPBELL to receive and file the easement vacation process report and accept a petition requesting a Proposition 218 revote from the property owners in L5A; adopt Resolution No initiating proceedings to levy a proposed new or increased assessment for the City of Yorba Linda Street Lighting and Landscaping Maintenance Assessment District and ordering the Engineer to prepare and file a standalone report for Local Landscaping Zone L5A for Fiscal Year 2017/2018 in accordance with Article 4 of Chapter 1 of said Act; to appropriate $5,000 for the development of the Engineer s Report and associated ballots; and to direct staff not to cease irrigation on the easements and to backfill the Zone with General Fund money. MOTION CARRIED by the following roll call vote: AYES: NOES: ABSENT: Campbell, Haney, Hernandez, Huang, Lindsey None None CONTINUED PUBLIC COMMENTS - None CITY MANAGER S REPORT/MAYOR S REPORT/MATTERS PRESENTED BY COUNCILMEMBERS/OTHER AGENCY REPORTS City Manager Mark Pulone responded to public comments and stated that the Town Center project is currently undergoing grading and that the parking structure should be completed by the end of this year. City Manager Pulone said that the former Ultramar gas station is nearing completion of the clean up process. He added that the City is paying for the cost of cleaning with reimbursement from the State. Mr. Pulone also mentioned that the City was working with Fresh Market to promote tenants to most likely sublease the property. PAGE 8

9 City Manager Pulone stated that the City has been very fortunate to be able to maximize the City s dollars by obtaining grant funding for projects. He said the City would continue to apply for additional funds through OCTA as they become available to complete the remaining portions of the Bastanchury Road Widening. City Manager Pulone, in response to a comment about the future Arts Center, said he appreciated the feedback from the residents which reflected the value of having community meetings. He stated that the design for the Arts Center has not yet been completed but the architects are very engaged and listening to the community. City Manager Pulone commented that the City is actively discussing options for the Janeway/Trueblood house and would come back to Council with an update soon. Councilwoman Beth Haney attended a recent Yorba Linda Water District Board meeting and said the Board had authorized staff to work with the Finance Department on revenue bonds. She also reported on the construction being done at the Fairmont Booster Station and said the new Booster Station would bring savings of over $1,000,000 annually. Councilman Gene Hernandez said that he attended the Donate Life Run/Walk over the weekend and heard touching stories from transplant survivors. He also attended the Athletic Wall of Fame and the Village Preschool s 57th anniversary celebration as well as an Eagle Scout Court of Honor at the Masonic Lodge. Councilman Hernandez announced that the meeting tonight would be closed in honor of Patrick Flynn, Sr., a longtime Yorba Linda resident who was instrumental in building the Yorba Linda Veterans Memorial at Veterans Park. Councilwoman Tara Campbell announced that it was National Small Business Week and encouraged everyone to shop and dine in Yorba Linda to support the local businesses. Councilwoman Campbell thanked staff for an incredible kick off ceremony. She also thanked all of the former Council and Commissioners who were instrumental in bringing Yorba Linda to where it is today. Councilwoman Campbell wished all the mothers a Happy Mother s day. Mayor Peggy Huang also thanked staff for a successful kick-off celebration. Mayor Huang stated that the Orange County Mosquito and Vector Control District was directed by the courts to do more to educate the community. She announced that the Yorba Linda Country Riders will be hosting an educational outreach meeting tomorrow at the Community Center regarding the West Nile Virus. Patrick Flynn spoke about his father Patrick Flynn, Sr. who passed away on April 18, 2017 and thanked Council who attended his funeral. PAGE 9
