The Public Hearing was called to order at 10:14 A.M. Senators Present (as of the time of discussion of Agenda Item: Bill No (COR)): Senator Frank B. Aguon, Jr., Chairperson Senator Adolpho B. Palacios, Vice-Chairperson Senator Thomas C. Ada, Committee Member Senator Telo Taitague, Committee Member II. SUMMARY OF TESTIMONY & DISCUSSION CHAIRMAN FRANK B. AGUON, Jr.; convened the public hearing and discussion on: Bill No (LS). Bill No. 346 introduced by the Vice Chairman Adolpho B. Palacios, is an AN ACT TO AMEND 8107 AND 8108, CHAPTER 8, TITLE 7 GUAM CODE ANNOTATED; RELATIVE TO INCLUDING SCHOOL ATTENDANCE OFFICERS UNDER THE PROVISIONS OF SPECIAL DEPUTY APPOINTMENTS, and if I can invite the following individuals: James Petite, Gary Camacho, Jessica Camacho, and General Tydingco. Senator Palacios if you could just provide some brief comments on your Legislation. ADOLPHO B. PALACIOS, SR.: Thank you Mr. Chairman! Mr. Chairman, I was approached by the School Attendance officers, formerly known as Truant Officers, respective to this issue, and they' ve always been appointed Special Deputy Marshals to the courts process for the enforcement of truancy laws, and of course for their role in bringing in minors who have attendance or behavioral problems in the school systems. So, essentially, they are school officers for that purpose. The problem came about when the new replacements for retiring truant officers submitted a petition to the court for an appointment as a Special Committee Report Bill No (LS)

6 Deputy, and someone in court noticed that actually there is no provision in law that would make them eligible for appointment, even though there has been an appointment. So what happened was that there is no new appointment made by those that still remain with the school systems - that have been appointed but is not renewable, it's just a onetime appointment just as long as the individual remains in that office. So right now they are down to 5, and the fact that the appointments would not be revoke, it appears to me that the court supported this Bill that would actually allow them to be included in that protection for that special appointment and the amendment appears on page 3 line 15, by inserting the school attendants offices of the Department of Education under the section shall exercise their office in manners concerning truancy proceeding to the superior court of GUAM - and of course the appointment would have to refer to page 2, by inserting the special appointments of deputies on line 20 - and those are the people that may be appointed special deputies, private processors and so forth. So there I inserted the school attendance officers for the Department of Education; special Deputy marshals and of course the ones that I've just recited on page 3, item line 15, specifically, in relation to their in the Department of Education as truancy officers - so it's a restricted appointment and it's restricted purpose would allow the individuals yielding before us to provide more detailed testimonies and to answer some questions. But this is the proposal of this bill. Thank you Chairman CHAIRMAN: Thank you very much Sen. Palacios. Jessica, would you like to open up the discussion. Sorry gentlemen, I'm yielding to the ladies. Jessica Camacho: Provided oral testimony IN SUPPORT of Bill No (LS); Good afternoon Senators. Good afternoon Sen. Aguon. Thank you for having us here today to give testimonies for this bill in regards to the special deputization of our school attendant officers. My name is Jessica Camacho. I'm with the Guam Department of Education; and speaking for the department at this point we are in favor of this bill. Definitely by the duties of this [position] we feel that they need to be deputized in order to implement their duties at these times. We understand the history of what occurred with Senator Palacios with previous laws. We do have concerns that we would like to insert into the bill, and we are asking that possible training would be provided to our school attendant officers. I understand that special education officers have special training because our officers would not have any weapon s with them, they would not be carrying any guns like other deputy marshals we have, so we would like to provide some special training. Would it be with the GPD, Probation Officers so we could look into what kind of training would be needed for them? It was also brought to my attention with the deputies - attendants would be trained for some constitutional rights so that our people are fully aware of the constitutional rights of our students as well as maybe the parents when they are encountered. So that we don't violate any rights that they may encounter during their duties- the main concern is their liabilities concerning any of the people or the students that we are involved with or that we work with at this point. CHAIRMAN: Thank you very much Mrs. Camacho. Ms. Lisa Garcia. Ms. Garcia, please proceed. Lisa Garcia: Provided oral testimony IN SUPPORT of Bill No (LS); Good afternoon, and again I would like to thank all of you! Especially Senator Palacios for introducing this Bill and I'm in support of this only because of urn... I'm the supervisor for the Attendance Officers, and this would realy help and expedite the process in apprehending these individuals or these minors that are not in school - and so I would like to say that I am for it and I hope I have your support. Senator Aguon: Thank you very much Ms. Garcia. Mr.Petiite, please proceed. James Petiite: Provided oral testimony IN SUPPORT of Bill No (LS); Thank you senators for allowing us, me, to testify here. I noted that when Senator Palacios and I spoke about a year ago on this issue and he gave me the history of why we are here now, and just like what Ms. Camacho was saying at this point we only have like 5 people that actually have been deputized to serve summons and detain students and take them either to DYA or the Court. That puts Ms. Garcia here at a bad situation- 5 or 4 other individuals that Committee Report Digest Bill No (LS) 2

7 are truant officers and cannot perform that function. And as what Jessica was saying as part of a liability situation - these individuals do they perform a very important function. Not only with one of the five bills of the Guam Education Policy Board - but the action plans to increase the current graduation situation rate while decreasing the truancy rate, and these individuals play a very integral part of that and other issues. You know that there are other kids that are truant. There are always reasons why other kids are in crises, you see. When you see that you have families in crises, and these are our future leaders on Guam, these kids that put themselves in situations - that should have help from their parents - by not being responsible enough to attend school. This is not an issue that falls upon parenting. I have 4 children myself and everyone of them are in school or have graduated because I value that. I value education and what these fine Attendance Officers do to also articulate the same spirit when parents talk with them. The training that Ms. Camacho was alluding to would probably be the same training that maybe the peace officers or marshals would receive when it comes to detaining or restraining. Obviously we don't want to trifle with their rights. Whatever constitutional rights they may have as young children or even as parents when we take them to court for a petition. One other issue on page 3, section 8107, lines we talk about the appointments. The only thing we would like to add is that appointment could be changed so that such appointments would be in effect until either the employee's leaves or retires from the department. Because when you are doing this on an annual basis - when you come back, you have to continue deputizing them and I wouldn't think that was the intent. The intent was to make sure that these individuals there were legally given the authority to do their jobs. One other issue, 17 SCOG 64 c, outlines the job descriptions of attendance officers. We would like some reference to that in this current amendment to this particular law. Thank you very much. CHAIRMAN: Thank you very much Mr. Petite. Gary. Gary Camacho: Provided oral testimony IN SUPPORT of Bill No (LS); Thank you. I would like to introduce myself. I'm Gary Camacho and I'm here as a private citizen. I'd like to note though that I've done truancy prevention and enforcement for the last 18years, I use to be with the departments. I'm here in support of Bill ; I'm in support ofbill for reasons: One, it defmes officially the powers and authorities of the attendant officers as court judicial officers. Two, I support the bill because it allows the department and the officer's continuity of operations and procedures in place right now currently, and in the execution of all orders to truancy cases. Three, this bill allows for the effective and efficient processing. If not for this particular power of these special deputies, it would be running circles of these education and the courts. We file, in my experience when I was there, about 500 cases on the average, a year. So that gives you an idea of how much paper work - back and forth occur - if these were to be shared in the marshals office. So when this particular operation was implemented back 15 to 20 years ago, it was done for convenience and effectiveness - and also in the hopes that it would supplement and help assist the marshals office in their serving of legal documents. The idea of picking up kids, like what Mr. Petite explained on the safety of situations or issues- in the entire 18 years that I've operated when employed there. There was never any safety incidents, we have the ability and the arrangements with public safety. And Mr.Palacios is aware of that because he was once there - calling the officers at any point - at any time - if there would be any safety issues involved. So for those reasons, I hope that you would consider and make this amendment. Safety issues are important but I think that the safety training can come as the department hires more officers - that can fall into place. Thank you very much! 8 Phil Tydingco, Chief Prosecutor, Office of the Attotney General: On behalf of the Attorney General's Office, we support the amendment proffered by Senator Palacios. It is always important to make clear the authority of the special appointments - and I think there was a suggestion, I think it's underlined where the amendment would occur on page 3 - you may want to add where it says at line 17 concerning truancy proceeding of the Superior Court of Guam, "and in accordance of'. And add "in accordance with the" GCA which spells out their functions or duties - because I think some of those duties may occur before they even get into court, and it kind of looks like a restriction - in proceeding in accordance with the - there's a technical addition to it that would be fme; and so that's all I have. Thank you. CHAIRMAN: Thank you very much Mr. Tydingco. Mr. Nishihara. Fred Nishihara: Provided oral testimony IN SUPPORT of Bill No (LS): Fred Nishihara here from DOE. We support the amendment, for sure, to the proposed statue as existing- well maybe the best way I can explain why we need this - for this particular amendment on an any Monday or Friday you will fmd me in front of the judge of the juvenile proceedings - and truancy could not have a prosecution or carry out the courts orders or execute them. We have 30,000 students- you have 5 people who can basically executes them, so you can imagine all the juggling - so we need every one of our truancy officers available to help out. Remember the main goal is for the truancy officers - are to have the students come to school. Not only requesting for these amendments to be done- but if you could expedite these because right now we have -I'm not sure of what the numbers are we have (Lisa Garcia: 5 deputize marshals) and how many do we not have that aren't (Lisa Garcia: 5) half the force basically right now can't carry out all the functions that we possibly could. We would double up our ability to pick up truancy students, go to their homes, do everything that they can. I can keep going down. They do so many duties - just as important. Just like I say at - we appear without prosecutors because all we want is the interest of the families - to get the students in school, so it's really an important amendment. So I would request that it could be expedited. Thank you. CHAIRMAN: Thank you very much. Mr. Attorney Nishihara. Just a follow up question. I think that the training component is certainly very critical in this case, but, there was earlier 5 deputized truant officers, and 5 that are not deputized with the same title- is there a reason why you are given five 5? Is there a reason why weren't you given 6 or 7? Fred Nisihara: This is how the numbers turned out. There are other positions that are opened (Lisa Garcia: There's about 3) - what would restrict or what is restricting the additional 5 from being official deputized truant officers. Gary Camacho: The way the law was written, and the law that they used back in - I think when Judge Abate signed off on their appointments - you know there was an error because in here that particular section of the law they make reference through here. That when we talk about special deputized marshals, we talk about the marshal of the court requesting the Chief Justice - may appoint the department of law, department of revenue an tax, government of Guam and I believe that they also attached department of administration that they were at one time but there was no mention of the Guam Education Division as it relates to school attendance officers. Their functions are a little different from other employees within that department - you know the nature of that work. CHAIRMAN: I guess my question is if it was quantified in law that DOE is only restricted to 5 officially identified Truancy Officers. James Petiite: They are not restricted - that it's just their staff at this point. So in a year it can change. CHAIRMAN: Right. Committee Report Digest Bill No (LS) 4

9 Fred Nishihara: Maybe I could answer that question Senator. The reason is that because the courts are saying now that these are the only people we can swear in- that it's not authorized- so that's basically it. Senator Aguon: Okay. But let me go back to square one, so that I understand exactly how this is to eventually to be reported out - if I may Senator Palacios. You have I 0 positions that may have been filled. Correct? Fred Nishihara: Yes. CHAIRMAN: But only 5 deputized truancy officers. Now I'm going back to the question I posed earlier. Why is the restriction at 5 - why is that kept at 5, not all I 0 being deputized. Is there a restriction by code or issued by the court? Gary Camacho: Well Senator, what happened over the years when this was authorized by the court- we went in a group, so to speak, and deputized I believe 8 on the first batch. Through the years, rotation, resignations and stuff, the numbers declined. When we actually submitted this five, the five that are presently not deputized, the courts came out and said that they have no authority by law. They discovered that the authority they were banking on previously had no, gate was really not... (Can't make out what Mr. Camacho said at this point) so for that reason the department was left with 5 officers and previously appointed over the years and for the 5 new ones that are not. Senator Aguon: So based on this measure - identified truancy officers would be allowed to participate in that process. Gary Camacho: Correct. CHAIRMAN: But is that restriction still in place or is this addressing that law? James Petiite: This is addressing that error on the deputation 20 some years ago. And one of the things that we were concerned about, is that when I sent a letter to the superintendent last year to request - when I was administrator of that division - I requested for the new hires to be deputized as was traditional or SOP - and when we got the response back from the Chief Marshal Perry Taitano there might have been an error. We can't do this, but at the same time they never revoked the authority of the 5. That is why now we all have to be on the same page. CHAIRMAN: Okay. Now I understand it- that you have clarified this. I appreciate it. Senator Palacios. PALACIOS: Let me just elaborate. That I think that the original appointments were made- I guess I should say improperly- but that was an oversight. Now, when the request for new appointments came through, that's when they found out that; wait a minute, they are not eligible for appointment. So now this bill will make them eligible; and at the same time, probably, the 5 new ones will have to be reappointed just for legalities sake. The 5 old ones too, to comply if this should become law. So that would take care ofthat. But there was never really a restriction. They just weren't eligible when the judge appointed them that way. James Petiite: Right. If I may just add about saying the 5 that are over-taxed - see the other half of their job is that they have case management. You need to meet with families, you need to meet with these kids. I mean this is not a one time thing - [*snapped the fmger*] - "then poof', you're a truant. Just following up identifying the reasons these kids are truant, and addressing them to the very services that we have through our spread of social programs, counseling programs, nursing programs in DOE; and now this will just allow them Committee Report Digest Bill No (LS) 5

10 to legal and statutory authority that they the 5 would have at this point, that the five that don't have at this point. CHAIRMAN: Senator Palacios, anything else? PALACIOS: Just one question - not a question - but for purpose of information for the listening audience; why do they have to be deputized? I know why they have to be deputized - but why do they have to be deputized - and could they still do educational case management and supervision? Maybe you could explain. James Petiite: They can do the case management. There is no problem with that. PALACIOS: I think it's because of the relationship between the school system; so I want you to explain that. James Petiite: It's their ability to serve summons and- but not everybody can detain a student. I cannot. PALACIOS: So it's for that purpose they need to be deputized, and essentially be limited to officials. Thank you Mr. Chairman. CHAIRMAN: Thank you very much for that clarification. Just some follow up questions. I know that the training component is a major aspect. But then, if the Legislature goes into session next month and this passes and is signed into law, without any funding mechanism- now is there any way that the department can work with the court or other law enforcement agency, so that you can get your truant officers to participate in some of the training programs? James Petiite: One other thing I did a couple years ago was - that with some of our truant officers - was that school administrators worked with GPD to get them trained with certain - secure - some illegal issues - so I think our relationship with GPD or the court would be very favorably - me making sure these people would get what they wanted and not some inflated cost. CHAIRMAN: Now James, you have served a life time appointment, or life time designation- you have been a truant officer and being deputized, is there a requirement for getting a recertification; or would there be a requirement for recertification every 3 years to upgrade training, or what not? Because, if you're looking at a life time designation, I would think that every 3 to 4 years these individuals would have to go through more current training activities. James Petiite: Ms. Camacho would be the one able to develop the SOP there. But whatever training our marshal peace officers get, that's continuous right in certain areas - that would be something she would need to define. CHAIRMAN: But it does not incorporate into the title and the position requirements, as a deputized truant officers; it may obviously fall into the crack of the legislature 5-7years from now. Down the road we would have deputized officers who are not getting recertified or getting current training - only on basic limited resources. If there is that, tie in the terms that every 3 to 4 years you need to be recertified. If only to stay current on jurisdictional legal aspects. I think that would impose a restriction in regards to proceeding, and also the legislature to provide resources. Jessica Camacho: it would have to be inserted into the law because I was looking up and... Committee Report Digest Bill No (LS) 6

11 CHAIRMAN: We would leave that to the sponsors of the legislation. But those were some intial concerns because of the training, and obviously we can provide the mechanism and identification, but if there is no training, no recertification - if there is no clarification in terms of the overall authority, then it may be a challenge. But thank you very much again. Senator Taitague. TAITAGUE: I want to thank you Mr. Chairman for asking those questions earlier to get a better understanding of what's going on. And I'm just amazed by 500 cases a year. I look at you as a supervisor, and it's definitely needed and to retain. What's the retention rate? With in regards to your truant officers - with the 10 that you have their right now. You said you have 5 that were deputized - obviously they have been there for quite awhile- you since then have retired Mr. Camacho from being a truant officer, as you mentioned earlier. Gary Camacho: Four, I believe, have retired out of the 5 original batch that were appointed. TAITAGUE: So there were 10 -then 5 retired - then 10 came on board. So that's good that's very good with the amount of case workers have so are there any other vacancy's opening other than the 10 you have in. How many more other individuals do you need to help your department? Jessica Camacho: For now we will be proposing our local budget 3 more positions. TAITAGUE: Three more positions. I wouldn't be surprised. There are more schools out there being developed, and it has been growing quite a bit; and that would help in keeping the retention of individuals that are not overworked and decided to leave. Of course you have to deal with DY A and with people probably in the juvenile division of GPD in the court your probation to work on something.
