AN ACT TO AMEND AND 77112, AND TO REPEAL OF CHAPTER 77, ARTICLE 1, TITLE 10, GUAM CODE ANNOTATED, RELATIVE TO THE CHIEF OF POLICE, THE DEPUTY CIDEF OF POLICE, AND THE POLICE COMMANDER OF THE GUAM POLICE DEPARTMENT. 1 BE IT ENACTED BY THE PEOPLE OF GUAM: 2 Section 1. Legislative Findings and Intent. I Liheslaturan Guahan finds 3 that recent events in reference to the process for the confirmation of the Chief of 4 Police posed a question as to who should pay for the tests and examinations, and 1

4 1 background investigation services required under 77109, Chapter 77, Title 10 2 Guam Code Annotated, which also established the qualifications for the Chief of 3 Police. Some of the enumerated qualifications require tests and services for which 4 payment of fees may be required. 5 In the confirmation of Frank Ishizaki in 2004, and in the confirmation of 6 Paul Suba in 2008, the question as to who would pay for the airfare to Hawaii for 7 the police chief nominee, to submit to a polygraph examination, were not dealt 8 with, as both nominees, respectively, were already in Hawaii on official business 9 of their own. However, in both nominations, I Liheslaturan Guahan chose to pay 10 for the polygraph service because it chose to select the polygrapher. The fees for 11 the drug screening tests were paid by the Department of Administration. The 12 psychological examination and the background investigation were provided by 13 government of Guam officials at no cost. 14 So that I Liheslaturan Guahan can conduct efficient and expeditious 15 processes for the confirmation of the Chief of Police, I Liheslaturan Guahan sees it 16 fit, and timely, to provide clarity as to which authority, i.e. the appointing authority 17 or the confirming authority, is responsible for the arrangements and costs 18 associated for compliance with the requirements of 77109, Chapter 77, Title 10, 19 Guam Code Annotated. 20 It is, therefore, the intent of I Liheslaturan Guahan to establish more clarity 21 with respect to the responsibility for compliance with all the requirements of , Chapter 77, Title 10, Guam Code Annotated, by amending Section of Chapter 77, Title 10, Guam Code Annotated, 1s 24 hereby amended to read as follows: 25 " Appointment of the Chief of Police. 2

5 1 The Chief of Police shall be appointed by I Maga 'lahi with the advice 2 and consent of I Liheslaturan Guahan and shall meet the following 3 qualifications: 4 (a) be at least thirty-five (35) years of age; 5 (b) have no less than fifteen (15) years of progressive 6 experience in a governmental law enforcement position, including at 7 least five (5) years at the supervisory command level, and five (5) 8 years in a senior position with law enforcement management 9 responsibilities; 10 (c) graduation with a bachelor's degree or higher in Police 11 Science, Criminal Justice Administration, Public Administration, 12 Law, or closely related field or discipline, at an accredited institution 13 recognized by the Council of Higher Education Accreditation (CHEA) 14 or its successors; 15 (d) have no felony, domestic or family violence convictions; 16 (e) have no misdemeanor convictions involving moral turpitude; (f) submit to and pass a drug screening test, including, but 19 not limited to, urinalysis testing; 20 (g) be of good health and good moral character; 21 (h) submit to psychological testing; and 22 (i) submit to a polygraph examination. 23 (j) No person shall be appointed as Chief of Police before a thorough investigation of the appointee's background and moral character is completed. The scheduling for the tests and services required under this Section shall be the responsibility of the appointing authority. All 3

6 1 tests and services shall be conducted by a licensed professional. The 2 administration, reporting, and records maintenance of the reports, 3 results, and/or findings of any polygraph examination administered to 4 the nominees of I Maga 'lahi (the Governor) for the unclassified 5 position of the Chief of Police of the Guam Police Department shall 6 be treated as personnel information, and at all times shall be handled 7 in accordance with the applicable personnel and civil service laws, 8 rules, and regulations of the government of Guam. 9 The nomination letter shall conform to the above requirements, 10 and the requirements of of Title 4, Guam Code Annotated, or 11 may be returned to I Maga 'lahi (the Governor) by the Speaker of I 12 Liheslaturan Guahan, at the request of the Committee Chairperson, 13 for insufficiency upon failure to include the information or documents 14 required by statute. No nomination package for Chief of Police may 15 be considered by I Liheslaturan Guahan unless the requirements of , Chapter 77, Title 10, Guam Code Annotated, and , 17 Chapter 2, Title 4, Guam Code Annotated, are first met. Failure to 18 meet the requirements shall toll the deadline for Legislative action 19 upon said executive appointment. 20 The nominee for Chief of Police shall not serve in the Guam 21 Police Department, or in any position of authority over the 22 Department, in any capacity without being first confirmed by I 23 Liheslaturan Guahan, except, that if the nominee is a classified 24 employee of the Guam Police Department, the nominee's employment 25 status remains unchanged." 26 Section of Chapter 77, Title 10, Guam Code Annotated, IS 27 hereby repealed in its entirety. 4

7 1 Section of Chapter 77, Title 10, Guam Code Annotated, Is 2 hereby amended to read as follows: 3 " Powers and Duties of the Police Commander. 4 In the absence or incapacity of the Chief of Police, the Police 5 Commander shall possess all the powers of the Chief of Police, act as the 6 head of the Department, and shall further perform such additional duties as 7 the Chief of Police may prescribe. 8 Section 5. Effective Date. This Act shall become effective upon 9 enactment. 5

Bill No 's legislative intent finds that it is unclear who is responsible to pay for tests, examinations and background investigation required in the appointment and confirmation of the chief of the police of the Guahan Police Department. However the amendments in the Bill do not provide more clarity with respect to the responsibility for the costs associated with the tests, examinations and background investigation of the chief of police nominee. Rather, it prevents the nominee from serving in an acting capacity as chief of police pending legislative confirmation. While this may not be an issue for an outgoing administration, it will hamper the chief executive's ability to command his police department. This delayed supervision of his line agency may be contrary to the Organic Act. The Organic Act affords I Maga 'lahen Guahan with general supervision and control of all executive branch departments of I Gubetnamenton Guahan. The commander in chiefs ability to effectively protect the citizenry of our Island is further impeded by the Bill's elimination of the deputy chief of police position. The Guahan Police Department provides a vital government service and as most other vital agencies the Governor is permitted to appoint a deputy. The deputy chief is appointed by the chief and assists the chief in managing the agency responsible for public safety. Rather than eliminate resources, the government should prioritize its resources toward essential public services such as safety, health and education. The Bill is also flawed as it requires "all tests and services shall be conducted by a licensed professional". However, most polygraph examiners are not licensed professionals but rather certified to conduct or perform polygraphs. While one may argue there is no distinction, strict compliance with the Bill would make it difficult to implement because it requires all tests and

10 services be conducted by a licensed professional which would lead one to reasonably believe it would not accept polygraph examinations conducted by examiners with only a certification. As noted in the Bill's legislative findings, two previous nominees had to submit to polygraph examinations in Hawaii. Like most jurisdictions, Hawaii and California do not license polygraph examiners so there may be a limited number oflicensed polygraph examiners readily available or affordable to the taxpayers of Guahan. While I agree there needs to be clarity to the chief of police confirmation process and which branch is responsible for arranging and paying for the tests, examinations and services, Bill No. 466 is inconsistent with its intent and instead interferes with I Maga 'lahen Guahan's ability to carry out his constitutional role and protect the people of Guahan. Palacios, Sr. I. OVERVIEW The Committee on Public Safety, Law Enforcement and Senior Citizens convened the public hearing on October 22, 2010 at 9:12 a.m. in I Liheslatura's Public Hearing Room. Among the items on the agenda was the consideration of Bill No (COR) - "An act to amend 77109, Chapter 77, Title 10, Guam Code Annotated, relative to the qualifications for the appointment of the Chief of Police" sponsored by Senator Adolpho B. Palacios, Sr. Public Hearing Requirements Notices of the hearing were disseminated via facsimile and to all senators and all main media broadcasting outlets on October 15, 2010 (5-day Notice) and on October 19, 2010 (48- Hour notice) pursuant to meeting the requirements of the Open Government Law. SUMMARY OF TESTIMONIES Chairman Adolpho B. Palacios, Sr. convened the public hearing for the Committee on Public Safety, Law Enforcement, and Senior Citizens at 9:12am, and called Captain Mark Charfauros and Captain Fred Bordallo to testify on the contents of Bill No Chairman Palacios stated that the responsibility for paying for the polygraph hearing was brought up in the last two (2) confirmation processes for Frank Ishizaki and Paul Suba, respectively. Both candidates were in Hawaii and thus able to pay for the polygraph examiner in Hawaii. The requirement in existing law is that the candidate must submit to and pass a polygraph examination. It is ambiguous who will bear the cost of the polygraph examination. This bill makes it clear who shall arrange for the psychological test, urinalysis, background investigation and polygraph examination. It requires that certification be present in the nomination packet that these have been conducted and the results shall be transmitted to the Committee with jurisdiction. The intent is not that results shall be received by the governor, reviewed, and then suppressed. The legislature's responsibility in this matter is to provide advice and consent. He pointed out that there is a ninety (90) day period when the nominee may serve in an acting capacity. This is to make it so that the legislature has the whole ninety (90) days to review the qualifications of the nominee, rather than have some of that ninety (90) day period spent gaining documentation. The amendment of the qualifications makes the polygraph examination an investigation tool for the background investigation. Polygrapher's report never says pass or fail and its best use is as a tool in conducting an investigation. A polygraph is able to narrow down an area where further investigation may be fruitful. The burden would be on the appointing authority to prepare the appointee for confirmation. The legislature may still conduct its own investigation, if it sees fit. Captain Mark Charfauros introduced himself and stated that he is in favor of the bill. He stated that certified polygraphers never use the word "pass" in a polygraph examination because the polygraph is not definitive. It is not used as evidence in a court of law. The questions of the polygraph examination guide a background investigation. He supports the bill in its entirety, but he believes that the same change is appropriate for the Deputy Chief position. Chairman Palacios stated that he was considering whether to include that item in this bill or a separate bill. He thanked Captain Charfauros for his testimony and called on Captain Bordallo to begin his testimony. Captain Fred Bordallo greeted the Senators present and said that he supports Bill He stated that he is acting Services Bureau Chief. He had submitted a concern to the Attorney General of Guam that an individual was acting Chief of Police for over one (1) year. Some Federal positions require that a nominee must await confirmation before they may serve. He stated that if the Governor is serious about his nominee and wanting a smooth confirmation process and the nominee wants the position, they will make the effort to ensure that all the qualifications are satisfied. He stated that this bill would provide that. He also believes that the language "submit to and pass a polygraph examination" is problematic. He stated that he supports the bill and commends Chairman Palacios for sponsoring it. Chairman Palacios addressed the Committee: I've been checked [as] a nominee for U.S. Marshall, for example, here in Guam and I think it should be like that. It should be the appointing authority that must make sure

Don't wait until the legislature finds out through the process that you did this or you did that. Wouldn't that be the case, then? I mean, it should be standard. If I'm going to nominate you... it would reflect on me if I nominate the wrong guy, so I'm going to make sure, on my own, for my own sake, as the appointing authority, that you're ready. [That] I'm ready to put my name on you, that you're my nominee. And it's disturbing because that is not the mentality of some appointing authorities sometimes. It makes sense that who you want to promote, you're not embarrassed in the end. So you want to be sure and that's why I say it's so easy to understand and accept this. You don't need to be told, 'Clean your nominee or give us a clean nominee before you give us anybody.' And I think that the role of the legislature is just to confirm what you sent to us, and we scrutinize that, but it's not necessarily the legislature that is going to set up all this... by the way, the urinalysis test is at his cost and that's one of the requirements. And they cannot understand why that the polygraph exam, part of it, be the obligation of the hearing committee. The background investigation, that was voluntary and we were able to do that. And, of course, I always say that it does not preclude the Committee chair, for example, from engaging a private investigator and say, 'I just want a separate, independent investigation. I'm the hearing person, I want to know.' You see? And so there's again the additional checks and balance[s]. And that's really, this whole thing. So hopefully this bill would settle that. I want to ask just you for your response, the both of you, what do you think about the idea of an appointee for Chief of Police not assume the office until confirmed? You know why? I have experience, for example, this was when Jim Miles got into the Department and we were there and, so, we debated this issue. And here you are, the Chief of Police, Acting Chief of Police, you've got complete control. You can take back the specs and amend them, for example, of a police cruiser, during your acting time. But, in this case, in Miles' case, he ended up not confirmed. But he had knowledge of all this sensitive intelligence and everything. He was able to access background information of peoples' record, sensitive record[s]. But then he was not confirmed. So probably, probably, it's relevant for the position, only for the position of Chief of Police, that the nominee not assume the office until confirmed. Captain Bordallo stated that Justices do not assume office unless they go through confirmation, first. The transition team would need to be prepared before they take office. The Governor would have to either accept the courtesy resignation of a prior appointee and rely upon the professional management employees or allow appointees from a previous administration to stay on while their appointee awaits confirmation. Chairman Palacios suggested that, in such an instance, a local polygraph examiner may be acceptable. Captain Bordallo stated that if this applies to the Chief of Police that it should apply for other directors as well. Chairman Palacios stated that he may consider introducing a stand-alone bill on the issue.

She asked whether polygraph examiners are available. Captain Bordallo stated that there are two (2). Although they are trained and certified through the school where they received their training, there is no general policy sanctioning their polygraph examiners. Captain Charfauros stated that the polygraph is only as good as the examiner and that they should be licensed and recertified. Chairman Palacios stated that the only polygraphers which were available on island are the GPD polygraphers, where there would be an apparent conflict, which is why the Chief of Police nominees have been sent to Hawaii. Chairman Palacios asked Captain Charfauros whether confirmation should be required before a nominee assume the position of Chief of Police. He questioned whether this might be an interference in the separation of powers. He stated that there would not be such a problem with it practically because there is still a Commander, which could act as Chief of Police. He stated that the legislature should also be required to act upon it because otherwise it could merely neglect to hold a hearing, keeping a nominee in limbo. He said that it is a good idea, but it depends upon the language. Captain Cris Castro asked how long a nominee would be able to serve as a Chief of Police. Chairman Palacios stated that a nominee serving in an acting capacity is not extendable and that he or she must be re-nominated after one (1) year has passed. Captain Castro supports the bill. Chairman Adolpho B. Palacios, Sr., declared that Bill No (COR) is duly heard. Chairman Palacios concluded the hearing and requested that written testimony be submitted within the next ten (10) days. He adjourned the hearing at 12:03 p.m. III. WRITTEN TESTIMONIES No written testimony received within the ten (10) day period after the public hearing. IV. Legislative Findings and Intent. I Liheslaturan Guilhan finds that recent events 3 referenced to the process for the confirmation of the Chief of Police posed a question as to who 4 should pay for the tests and examinations, and background investigation services required under , Chapter 77, Title 10 Guam Code Annotated established the qualifications for the 6 Chief of Police. Some of the enumerated qualifications require tests and service for which payment 7 of fees may be required. 8 In the confirmation of Mr. Frankie Ishizaki in 2004, and in the confirmation of Mr. Paul Suba 9 in 2008, the question as to who would pay for the airfare to Hawaii for the police chief nominee, to 10 submit to a polygraph examination were not dealt with, as both nominees respectively were already 11 in Hawaii on an official business of their own. However, in both nominations, I Liheslaturan 12 Guahan chose to pay for the polygraph service because it chose to select the polygrapher. The fees 13 for the drug screening tests were paid by the Department of Administration. The psychological 14 examination and the background investigation were provided by government of Guam officials at no 15 cost. 1

27 1 So that I Lihes/aturan Guahan can conduct an efficient and expeditious processes for the 2 confmnation of the Chief of Police, I Liheslaturan Guahan sees it fit, and timely, to provide clarity 3 as to which authority, i.e. the appointing authority or the confirming authority, is responsible for the 4 arrangement and costs associated for compliance with the requirements of 77109, Chapter 77, Title 5 10, Guam Code Annotated. 6 It is therefore the intent of I Liheslaturan Guahan to establish more clarity with respect to the 7 responsibility for compliance with all the requirements of 77109, Chapter 77, Title 10, Guam Code 8 Annotated, by amending Section , Chapter 77, Title 10, Guam Code Annotated, is hereby amended as 10 follows: 11 " Appointment of the Chief of Police. 12 The Chief of Police shall be appointed by I Maga '/ahi with the advice and consent of I 13 Lihes/aturan Guahan and shall meet the following qualifications: 14 (a) be at least thirty-five (35) years of age; 15 (b) have no less than fifteen ( 15) years of progressive experience in a 16 governmental law enforcement position, including at least five (5) years at the 17 supervisory command level and five (5) years in a senior position with law enforcement 18 management responsibilities; 19 (c) graduation with a bachelor's degree or higher in Police Science, Criminal 20 Justice Administration, Public Administration, Law, or closely related field or discipline, 21 at an accredited institution recognized by the Council of Higher Education Accreditation 22 (CHEA) or its successors; 23 (d) have no felony, domestic or family violence convictions; 2

The 9 investigation processes may include the use of a polygraph examination. the result of 10 which may be utilized as a guidance in furtherance of the investigation required herein. 11 The scheduling for the tests and services required under this Section shall be the 12 responsibility of the appointing authority. All tests and services shall be conducted by a 13 licensed professional. 14 The nomination letter and attachments to be transmitted to I Lihes/aturan Gullhan 15 pursuant to Chapter 2. Title 4, Guam Code Annotated "Submission for 16 Legislative Advice and Consent", for Chief of Police, shall include a certification that the 17 tests and services have been conducted on the appointee by a licensed professional, and 18 that the result of each test and service will be transmitted directly from the office of the 19 licensed professional to I Lihes/aturan Guahan. 20 No nomination package for Chief of Police may be accepted by I Liheslaturan 21 Guahan unless the requirements of 77109, Chapter 77.
