4 PUBLIC HEARING REPORT Resolution No (COR), Relative to supporting the passage ofh.r and S.1939, "The Agent Orange Equity Act of 2009"; and requesting the assistance of Guam's Delegate to Congress in ensuring Guam's veterans excluded from coverage under the current statute due to their "Blue Water Navy" designation are included in the amendments proffered by legislation before the United States Congress. Resolution Digest: Resolution No (COR) was introduced on February 4, 2010 with Senator James V. Espaldon as its primary sponsor and Senators Tina Rose Mufia Barnes, ben pangelinan and Judith T. Won Pat as its main and co-sponsors. The resolution was referred by the Committee on Rules to the primary sponsor for public hearing on February4, A public hearing was scheduled for March 10, 2010 at 9:00a.m. in the Legislature's Public Hearing Room. First notice of the Public Hearing was sent via electronic format to all senators and to media outlets, including print and media entities, for announcement as a Public Service on March 3, Notice of the hearing was listed in the Guam Legislature's Home Page, under the link "Legislative calendar". Public Hearing: The public hearing on Resolution No (COR) was called to order at 9:10 a.m. on Friday, March 12, 2010 by its primary sponsor Senator James V. Espaldon. Members present were Senators Tina Rose Mufia Barnes, Telo Taitague, and Ben Pangelinan. Senator Espaldon briefly described the resolution's intent and provided some background on the issue addressed by it: Agent Orange compensation for veterans with the designation as "Blue Water Navy''. Senator Muna Barnes read into the hearing record a letter from Guam Delegate Madeleine Z. Bordallo (see attachment). She also mentioned her involvement as the primary sponsor of a previous resolution during the 29GL which also dealt with Agent Orange. Members of the public providing oral testimony were Mayor Vicente Gumataotao of Piti and Mr. Joseph Ignacio, Army Veteran. 1

5 o o Mayor Gumataotao: Supports the resolution and urges its passage by the full body. He stated the inclusion of"blue Water Navy'' veterans was long overdue. He hopes the United States Congress will pass the measures before them and provide recognition of Guam's veterans who are affected by Agent Orange, by including them as persons eligible to submit claims of exposure to Agent Orange and suffering as a result. Mr. Joseph Ignacio: Discussed his documentation of his exposure to Agent Orange and his fight to deal with the afflictions he suffered as a result of the exposure. He went into great detail on his resulting medical history and the treatment he received and continues to receive. He explained to the members present that he felt it necessary to "tell his story" so they would better understand what the effects of Agent Orange can be. He also stated that he had been receiving an annual check totaling $800 as compensation for his exposure, but the checks have ceased after several years. He urged the senators to support the plight of veterans exposed to Agent Orange by passing the resolution. Senator Espaldon thanked the witnesses for their testimony and asked if any other members had questions for the witnesses. Senator Pangelinan thanked Mr. Ignacio for his testimony. He said it helps to understand the system so the Legislature can assist the veterans. He is in full support of veterans receiving compensation if they are suffering from Agent Orange exposure. Senator Muiia Barnes stated she can understand Mr. Ignacio's suffering since she also suffers from psoriasis. She offered her support for all veterans issues. Senator Taitague thanked Mr. Ignacio for his service to his country and continuing to offer his help to other veterans. She state Congress needs to pass the two (2) pieces of legislation before them. Senator Espaldon asked Mr. Ignacio if he would be willing to allow the 30GL to make copies on his documents to further support the resolution. Mr. Ignacio said he would be willing to do so. There being no other witnesses present to provide testimony, Senator Espaldon announced that written testimonies will be accepted for up to ten (10) days from the public hearing's date. 6 Findings and Recommendation: Testimonies received on Resolution No (COR) were in full support of its passage. Members present voiced their support for the resolution's intent. The primary sponsor transmits to the Committee on Rules this public hearing report and requests the placement of Resolution No (COR) on the session agenda with a recommendation "TO PASS". 3

7 IMINA 'TRENT ANA LIHESLATURAN GUAHAN 2010 (Second) REGULAR SESSION Resolution No. ~-30 {!f ~ Introduced by: Relative to supporting the passage of H.R and S.,1939, "The Agent Orange Equity Act of 2009"; and requesting the assistance of Guam's Delegate to Congress in ensuring Guam's veterans excluded from coverage under the current statute due to their "Blue Water Navy" designation are included in the amendments proffered by legislation before the United States Congress. 1 BE IT RESOLVED BY IMINA' TRENT A NA LIHESLATURAN GUAHAN: 2 WHEREAS, various herbicide agents have been used and stored on Guam and exposure to 3 them has been documented as recently as 2007, with the Veterans Administration (VA) 4 acknowledging the illness of Air Force veteran Robert E. Sullivan due to exposure to Agent Orange 5 at Andersen Air Force Base; and 6 WHEREAS, existing federal law in 2007 mandates certain presumptions must be met before 7 a claim can be recognized and compensated by the VA, among which was the presumption that 8 compensation was only due to those in the military service and not to civilian employees; and 9 WHEREAS, IMina Bente Nuebi na Liheslaturan Guahan adopted Resolution No. 95 which 10 requested Guam's Delegate to Congress to include Guam in the "Civilian Agent Orange Act of "; and 12 WHEREAS, Congress now has before it H.R and , "The Agent Orange Equity 13 Act of 2009", which seek to amend and clarify the presumptions used by the VA in their review and 14 approval of claims submitted by "Blue Water Navy" veterans who believe they were exposed to 15 Agent Orange during their tours of duty in the Republic of Vietnam inland waterways, ports, and 16 harbors and while serving in Johnston Island during the period of April 1, 1972 until September 30, ;and 1

8 1 WHEREAS, Guam has a number of veterans that would qualify for compensation under the 2 proposed amendments and, if granted inclusion, would be treated as equitably as all those who 3 previously had been made eligible by action of the United States Congress; now, therefore, be it 4 RESOLVED, IMina' Trenta na Liheslaturan Guahan does support the inclusion of Guam 5 and her veterans in H.R and Se1939; and, be it further 6 RESOLVED, I Liheslaturan Guahan does wholeheartedly support the passage of H.R and S,1939 in the hopes of equitably including all veterans exposed to the ravages of Agent Orange, 8 regardless of whether they had "boots on the ground" or "boots in the water"; and be it further 9 RESOLVED, I Liheslaturan Guahan respectfully request Guam's Delegate to Congress to 10 make every effort to ensure Guam's "Blue Water Navy" veterans, and all "Blue Water Navy" 11 veterans are afforded the same ability to seek compensation for exposure as those persons currently 12 eligible; and be it further 13 RESOLVED, that the Speaker certify, and the Secretary of the Legislature attest to, the 14 adoption hereof and that copies of the same be thereafter transmitted to: to the Honorable EricK. 15 Shinseki, Secretary of Veterans Affairs, to the Honorable Madeleine Z.
