OVERVIEW The Committee on Municipal Affairs, Aviation, Housing and Recreation convened a public hearing on Wednesday, October 20, 2010 at 1:00 P.M. in I Liheslatura's Public Hearing Room. Among the items on the agenda was the consideration of Bill No (COR) - "An act to amend 1013 of Title 1, of the Guam Code Annotated, relative to delegating all liberation festivities to the Mayor's Council of Guam.," sponsored by Judith T. Won Pat, Ed.D., Tina Rose Muiia Barnes. Public Notice Requirements Notices were disseminated via to all senators and all main media broadcasting outlets on Wednesday, October 06, 2010 (5-Day Notice), and again on Wednesday, October 13, 2010(48-Hour Notice). On Tuesday, October 19, 2010, an amended noticed was sent out to all senators and all main media broadcasting outlets. Senators Present Senator Tina Rose Mufia Barnes, Chairperson Senator Judith P. SUMMARY OF TESTIMONY & DISCUSSION Senator Tina Rose Muiia Barnes, Chairperson, Committee on Municipal Affairs, Aviation, Housing and Reacreation. Senator Tina Rose Muiia Barnes, stated for the record that the public hearing will be for Bill , and is introduced by Speaker Judith T. Won Pat, Ed.D. and Senator Tina Rose Mufia Barnes, which specifically states an act to amend 1013 of Title 1 of the Guam Code Annotated, relative to delegating all of the Liberation Festivities to the Mayor's Council of Guam. 1

Senator Tina Rose Mufta Barnes acknowledged all of the mayors/vice mayors that were present, which included Mayor Melissa Sevares of Dededo, Executive Director of Mayor's Council of Guam, Angel Sablan and Vice Mayor Robert Hoffman of Sinajafia, Mayor Paul McDonald of Agana Heights, Mayor Ben Gumataotao of Piti, Mayor Robert Lizama ofyigo, Mayor Carol Tayama of Agat Senator Tina Rose Mufi.a Barnes gave the floor to Mayor Melissa Sevares. The Honorable Melissa B. Sevares, Mayor of Dededo, President, Mayor's Council of Guam. Mayor introduced herself for the record that she is Melissa Sevares, Mayor of Dededo, President of the Mayor's Council of Guam, and that she is in support of Bill Mayor Sevares said that the Mayor's Council has succeeded for the past two years in taking charge of the Liberation Festivities. "With the help of our partners, all mayors, vice-mayors and their staff, we did it together under the leadership of the Executive Director who was very instrumental in delegating his authority as the Overall Chairperson for this event." Sevares said that right before Liberation Day this year, they (Mayor's Council) were visited by the Office of the Public Auditor. Sevares told them that the Mayor's Council of Guam's administrative office is centrally located for all the mayors throughout the island, and that it is a facility where records are maintained and that there is a consistency with these records, despite the fact that mayors come and go and are replaced by new mayors. These records remain intact, and are accessible. Sevares said that for the last two years, there has been more accountability with the Mayors Council taking over, even though there are many things that entail such a responsibility, such as having to apply for utilities, getting all the vendors together, making reimbursements where it is needed, making sure that they are in compliance with Public Health/Environmental Health regulations regarding sanitation, trash daily pickups, etc. Sevares said also that this year, they were given $15,000 for seed money to plan the event and that it really helped them a lot, compared to the first year when they were given no money to start with and had to start from ground up. Sevares said that with the help of the seed money and the success of the Liberation festivities, they were able to help support the gala that the GMH volunteers had put together and the reason being is that it is events like this that help their respective villagers. 2

Sevares said that clarification is needed here because Mayors council tries to always include the private sector as well as GovGuam agencies to partake in the Liberation festivities and floats, and sometimes it is supplies that they already have in their warehouse. "Sometimes it is just a surplus of supplies that are already there." Items used are already in their inventory that was previously funded by their respective agencies for other projects that have already been completed. The Honorable Ben Gumataotao, Mayor of Piti Mayor Ben Gumataotao asked that the Senators "give us the flexibility of running the carnival." Asked Senators that games of chance and maybe even perhaps cockfighting be permitted, as it is only once a year. Mayor Gumataotao noted that it is really hard to run a carnival without any funding, and that the only funding they get is from the profits of vendors. Mayor Gumataotao noted that they were only given $15,000, and that the cost of living keeps going up. "Let us run it as long as the accountability is there" was his closing comment. The Honorable Robert "Bob" S. Lizama, Mayor of Yigo Mayor Lizama noted that his only involvement this year was assisting the individual running for Miss Liberation Contest, as she is from Yigo. "To be given this responsibility for two years already says a lot." Noted that certain individuals needed to be credited and commended his colleagues, and that he wanted to see how we can change the law to have the Council in charge of the Liberation Festivities, and that it was a very good opportunity to do so. Noted that he was discouraged in 2004 in having the village of Yigo participate in building their own float because of the concern of utilizing government funds. Said that he couldn't see why his hands were tied to purchase the materials that were necessary to build the float. Said that building the float brought out the community of Yigo and stood firm to build it. Used mayors' operational fund because he believed it was important for his community. Reiterated Sevares' conunent that line 7 needed clarification. The Honorable Carol S. Tayama, Mayor of Agat Mayor Tayama stated that she is also in favor of Bill , and said for the record, the Mayor's Council did a great job the last two years. "With this bill, we could do proper planning, like even right now. We don't want to plan at the last minute, because like the mayor of Yigo said, we are all very busy." Said that she was the Chair for the Queens Committee this year, and that alone was a full-time job. 3

McDonald, Mayor of Agana Heights Mayor Paul McDonald stated that he was the Chair for the Vendors of Liberation. Said that last year they made $40,000, and this year made $60,000. Said that he thinks it will be a good idea to have games of chance available at the carnival and believed that this will be a good source of getting money. Said that permits from Public Health is a headache, and had to turn away a lot of people because it wasn't generally worth it for many people to participate as vendors because it would require approximately $6000 to set up for the carnival. Said it would be best if Public Health were a little more lenient and realistic, for instance, to allow Tan Ana sell bofielos lemmai. Mayor's Council was unable to sell alcoholic beverages and additionally had to pay compliance officer of Department of Rev. & Tax $25,000 because of a new policy that they were in violation of and because they (Rev~ Tax) wt->re not consistent. Noted that Guam has had carnival for sixty six years and never had any kind of problem like that before. "Let's allow our locals to come in and sell, like it used to be. Let's not make it commercial." Mr. Angel Sablan, Executive Director of the Mayor's Council of Guam Angel Sablan mentioned that at the opening of the Liberation Festivities of last year, the Governor commented that he was happy with the outcome of the Liberation Festivities, and that he said that he would give it to them (Mayors Council of Guam) the following year as well because of their outstanding job. Mentioned that $10,000 will be set aside for next year's festivities. "The only reason why this bill is necessary is for proper planning." Said that they were lucky to have corporate sponsors this year. Commented that there should be an entity that would ensure permanency, consistency, proper planning, and continuity for the Liberation Festivities. Told Senators that they are finding that the grounds of Paseo is too small to accommodate more people/vendors. Should start looking for a bigger space to host the carnival permanently. Recommended that a Provision be put in the document that the governor "shall furnish a suitable site". Noted that Ipao is a burial ground and that it is not recommended to have it there. Recommended that a provision be included that the "governor shall allow the Mayor's Council of Guam to operate games of chance if they choose to do so." Senator vicente "ben" c. pangelinan Senator Ben Pangelinan said authority now rests with the Governor. The Honorable Robert "Bob" S. Lizama, Mayor of Yigo Mayor Lizama said that "this games of chance would definitely would help our humanitarian services that we provide" and said that games of chance would provide a 4

The Honorable Paul M. McDonald, Mayor of Agana Height Mayor McDonald said that he knows for a fact that the bulk of money of profits was made was from the games of chance that were allowed. Senator vicente "ben" c. pangelinan, Committee Member Senator Ben Pangelinan said that by giving this to the Mayors Council, "it takes the politics out of it." No one single individual identified with it. This is a collaborative ettort of the Mayors Council and it allows all of us to celebrate and give the people of Guam that time to enjoy and learn this portion of our history. Senator Telo Taitague, Committee Member Telo Taitague said that when she was in charge of Queen's committee in 2007, she always thought since then that these festivities should be run by the mayors, and also she said that she understands how much work goes into planning for these events. Said that even the task of getting girls to run for Liberation Queen was difficult. With this bill, basically you would have the ability to run these festivities. Said that the only thing the Council wouldn't have is to dictate agencies to be there because that is under the executive branch. Said that she believes in the abilities of the Mayor's Council. Senator Telo Taitague said, "You definitely have my support on this and I appreciate all the hard work you've done. Good Luck." Senator Frank F. Bias, Jr., Committee Member Senator Frank Bias recognized that in the proposed legislation, we should strike out the section where it says that it must be done 'after working hours' because this is already set forth in the Organic act, and there should be no conflict. Firmly believes that these festivities should remain with the Mayors Council because they know it best. This is an island fair and there should be absolutely no reason why workers should not be permitted to work on these things during regular working hours. The Honorable Melissa B. Sevares, Mayor of Dededo, President, Mayor's Council of Guam. Sevares' clarified that mayors still take care of their daily duties within their respective villages. 5

Bias, Jr., Committee Member Senator Bias agreed and said that he knows that daily duties will not be compromised at all, but by striking out this language, it gives them more flexibility and more t ime to get these things done. Senator Tina Rose Muna Barnes, Chairperson, Committee on Municipal Affairs, Aviation, Housing and Recreation Senator Barnes said that this will be duly noted. Senator Thomas C. Ada, Committee Member Senator Tom Ada thanked mayors for doing a wonderful job and thanked them for all their hard work. Senator Tina Rose Muna Barnes, Chairperson, Committee on Municipal Affairs, Aviation, Housing and Recreation Senator Barnes said that the 30th Legislature continues to make a real effort to work hard with the Mayors Council of Guam, and thanked all of them for coming to share their input on Bill Senator Barnes announced to the floor that the Legislature will continue to accept electronic testimonies at her address at tinam una barn es@gmail. com or at the physical address of the Legislature, 155 Hesler Place, Hagatna, Guam. Public Hearing was adjourned at 3:21p.m III. FINDINGS & RECOMMENDATIONS In line 7 of Page 2, it reads, "Unless appropriated by the Legislature, or approve by the governing board or applicable autonomous agencies, no government funds or materials shall be used in the preparation of these floats." Mayor Melissa Sevares of Dededo made the recommendation to make clarifications here because she indicated that sometimes, GovGuam agencies just have a surplus of supplies in their offices because these supplies were previously purchased for projects that were already completed. 6

While nothing is stipulated in the legislation regarding vendors, Mayor Paul McDonald made a recommendation that Public Health regulations should be more lenient in their policies relative to vendors, to allow older people who would like to sell items such as bonelos lemmai at the event. In line 15 of Page 2, it reads, "lhe government may furnish a suitable site, if needed, but neither it nor any agencies, instrumentalities, nor employees may otherwise participate in the planning and preparation for the Island Fair during work hours or use government supplies or equipment; provided, that employees or participating departments or agencies may be given a limited time to prepare departmental or agency floats for the designated parades." Executive Director Angel Sablan recommended that instead of the ''The government may furnish a suitable site", it should specifically read, "The government shallfurnish a suitable site." Senator Frank Bias, Jr. made reference to the same sentence, where it reads, "nor employees may otherwise participate in the planning and preparation for the Island Fair during work hours". Senator Bias recommended that this language be struck out, as it is supported also in the Organic Act of Guam, and there should be no conflict. Mayor Robert lizama and Mayor Paul McDonald both recommended that there should be a provision in the bill that permits the operation of games of chance. BE IT ENACTED BY THE PEOPLE OF GUAM: 2 Section of Chapter 10 of Title 1 of the Guam Code Annotated is 3 hereby amended to read: 4 " Guam Island Fair Committee. 5 The Go"v,emor Mayor's Council of Guam IS. authorized and 6 requested to annually appoint a Guam Island Fair Committee to plan 1 and make appropriate arrangements for the celebration of this Fair. The 8 Committee shall be composed of members of patriotic, religious, or 9 other civic organizations. Taitague AN ACT TO AMEND 1013 OF TITLE 1, OF THE GUAM CODE ANNOTATED, RELATIVE TO DELEGATING ALL LIBERATION FESTIVITIES TO THE MAYOR'S COUNCIL OF GUAM. 1 BE IT ENACTED BY THE PEOPLE OF GUAM: 2 Section of Chapter 10 of Title 1 of the Guam Code Annotated is 3 hereby amended to read: 4 " Guam Island Fair Committee. s The Governor Mayor's Council of Guam IS, authorized and 6 requested to annually appoint a Guam Island Fair Committee to plan and 7 make appropriate arrangements for the celebration of this Fair. The 8 Committee shall be composed of members of patriotic, religious, or other 9 civic organizations.
