OVERVIEW The Committee on Municipal Affairs, Aviation, Housing and Recreation convened a public hearing on May 21, 2010 at 9:00 a.m. in I Liheslatura's Public Hearing Room. Among the items on the agenda was the consideration of Bill/Res No (COR) "An Act Relative to Renaming the South Daiog Dededo Buffer Strip the 'Dededo Veterans' Memorial Park,' Which Extends Partially Across Lot Block 16," sponsored by Senator Tina Rose Mu:fia Barnes. Public Notice Requirements Notices were disseminated via to all senators and all main media broadcasting outlets on May 12, 2010 (5-Day Notice), and again on May 19, 2010 (48-Hour Notice). [ notices also sent to Dededo Mayor's Office and Mayor's Council of Guam] Senators Present Senator Tina Rose Mu:fia Barnes, Chairperson Senator Frank Bias Jr., Committee Member Senator Adolpho Palacios The public hearing was Called-to-Order at 9:04 a.m. II. SUMMARY OF TESTIMONY & DISCUSSION Mayor Melissa Savares-in support-dededo Veterans Organization is currently forming and will provide assistance to the veterans in the community Joe Moore--In Support----Guam Veteran's Motorcycle Club in Dededo, grew up in Dededo and in support of the bill. Joe San Nicolas--In Support-lives in Dededo, born and raised, supports the bill whole heartedly, in Dededo so they can meet there and talk to other vets there about their concerns. John Taitano-In Support-born and raised in Dededo and thinks its time they do something for the vets of Dededo and supports the bill Bernardo F. Cines-In Support---was a commander of P.I. Scouts and a WWII vet, lives in Dededo for 35 years and would like to support the endeavor for the welfare of their community and for the enjoyment.

6 Rick Cruz-In Support---commander of Asia Pacific Military Order of the Purple Heart, composed of combat wounded vets, either in wheel chairs or crutches unable to move around, born and raised in Dededo and will die in Dededo, totally supports it because the group you see in front of you is a dying breed and their time is here and now and would like to see this materialize and see the benefits, walking paths and meeting areas, place and time where they can meet and relive their memories. This group has their own problems that none other can communicate. Convenient place for them to meet. Angel Sablan-In support---where the vets, children and grandchildren can meet and share in their memories. Stand in support of giving them recognition and for all of their services. Support the bill. Sen. TRMB-noting that Frank Bias Jr. to be a cosponsor Sen. Palacios---asking Dededo Vets Org if they are organized yet? Joe San Nicolas- there are other vet orgs in Dededo and this group is trying to gather the other vet orgs in Dededo under one group. Sen. Palacios--Does a veteran have to reside in Dededo to be a member? Joe San Nicolas--Yes, must be a resident of Dededo Sen. Palacios--Can a vet from other villages use the facility Joe San Nicolas--Yes, only to be a member of org you have to be a resident of Dededo Sen. Palacios-So the benefits of the park are open to all? Joe San Nicolas--Yes, yes, Sen. Palacios-So the Dededo vets org will take care of facilities? Joe San Nicolas--Yes yes. Sen. Trmb-did the municipal planning council meet about this? Mayor Savares-yes they did and there is a resolution. We did not have a public hearing, but we did publish it in the morning meeting. Sen. 7 Mayor Savares-as a matter of fact, local businesses came forward and want to adopt a portion to build and maintain. To adopt portions of the park. III. FINDINGS & RECOMMENDATIONS This committee finds that all those who testified fully support the passage of this bill. Dededo Mayor, Melissa Savares, spoke on behalf of the Dededo Municipal Planning Council who also supports the bill. Additionally, she testified that businesses within the village support the renaming of the area and the creation of the park and that these businesses would like to sponsor portions of the park. AN ACT RELATIVE TO RENAMING THE SOUTH DAIOG DEDEDO BUFFER STRIP THE "DEDEDO VETERANS' MEMORIAL PARK," WIDCH EXTENDS PARTIALLY ACROSS LOT BLOCK 16A. 1 BE IT ENACTED BY THE PEOPLE OF GUAM: 2 Section 1. Legislative Findings and Intent. I Liheslaturan Gudhan finds that the 3 Dededo Veterans' Organization in conjunction with the Dededo Municipal Planning Council, 4 seek to rename the strip of parcel identified as the South Daiog Dededo Buffer Strip the "Dededo 5 Veterans' Memorial Park." The identified parcel is located partially across Lot Block 16A. 6 Section 2. A new is hereby added to Article 1, Chapter 8 of Title 1, 7 8 Guam Code Annotated, to read as follows:. 8 " Dededo Veterans' Memorial Park. 9 (a) The South Daiog Dededo Buffer Strip, a strip of land extending partially 10 across Block 16A in the municipality of Dededo, shall hereafter be known as the 11 "Dededo Veterans' Memorial Park." Any provisions in the laws of Guam referring to the 12 South Daiog Dededo Buffer Strip, are hereby deemed to read the "Dededo Veterans' 13 Memorial Park." 1

9 (b) The Dededo Veterans' Organizations and the Dededo Municipal Planning Council shall be granted authorization to erect, beautify and maintain monuments, restrooms, a pavilion for meeting and meditation, a fitness trail, a botanical garden and parking stalls for community use. Plans for the design and development of above identified entities shall be developed by the Dededo Veterans' Organization and the Dededo Municipal Planning Council. (c) The Dededo Veterans' Organization and the Dededo Municipal Planning Council shall cause to be erected appropriate nameplates or signs renaming the South Daiog Dededo Buffer Strip the Dededo Veterans' Memorial Park. (d) The Dededo Municipal Planning Council shall be authorized to receive contributions, both cash and/or in-kind, and conduct fundraisers to fund the construction, beautification and maintenance of the Dededo Veterans' Memorial Park, provided the Dededo Municipal Planning Council maintain non-profit status with 501(c)(3) designation. Upon receiving designation the Dededo Veterans' Organization may receive contributions and conduct fundraisers to assist with the costs associated with construction, beautification and maintenance ofthe Dededo Veterans' Memorial Park. Section 3. Severability. If any provision of this Law or its application to any person or circumstance is found to be invalid or contrary to law, such invalidity shall not affect other provisions or applications of this Law which can be given effect without the invalid provisions or application, and to this end the provisions of this Law are severable. 2
