Aguon, Jr. I. OVERVIEW The Committee on Labor, Public Structure, Libraries and Technology convened the public hearing on November 18,20 at 9:20a.m. in I Liheslatura's Public Hearing Room. Among the items on the agenda was the consideration of Bill No (COR) - "An act relative to equitably implementing the certification pay differential salary adjustments for licensed practical nurses of the government of Guam as mandated by law, by amending of Chapter 6, Title 4, Guam Code Annotated," sponsored by Senator Frank B. Aguon, Jr. Public Hearing Requirements Notices of the hearing were disseminated via facsimile and to all senators and all main media broadcasting outlets on November 9, 20 (5-day Notice) and on November 15, 20 (48- Hour notice) pursuant to meeting the requirements of the Open Government Law. Palacios, Sr. convened the public hearing for the Committee on Labor, Public Structure, Libraries and Technology at 9:20 am, read the title and summarized the contents of Bill No (COR). 6 Committee on Labor, the Public Structure, Libraries and Technology Committee Report on Bill No (COR) Page-2- Lillian Perez-Posadas greeted the Committee and stated that she supports the intent of the legislation. She stated that certification is a post-licensure credential. The license is issued and certification is beyond licensure. Licensed nurses, like registered nurses, are able to further their expertise through taking a national examination. If an LPN takes and passes it, they are entitled for differential pay. The Board does not issue certification. She made a suggestion involving rehiring retired LPNs. She states that they are not allowed to, but there is a critical shortage of nurses which could be partially addressed by allowing retired LPNs to be rehired as Limited Term Appointments. Chairman Palacios asked her to provide a proposal in writing. He asked for Ms. Claros to provide testimony. Ms. Elizabeth Claros stated that the existing language of the law is sufficient. Chairman Palacios clarified that she believes it to already be in effect. Ms. Claros stated that there are no LPNs who have certification in specialty areas. Senator Judith P. Guthertz clarified that certification is required to receive the pay differential. Ms. Claros stated that Personnel Services must contact the licensing boards to assure that credentials are certified. Chairman Palacios asked if they could submit a suggested amendment that they believe would be most appropriate. Ms. Perez-Posadas stated that LPNs are currently eligible, but that none are nationally certified, only licensed through the board. Senator Guthertz asked what the hospital has done to assist LPNs to become eligible, and Ms. Posadas stated that it is up to the individual LPN to seek certification. Senator Guthertz asked whether it is LPNs must be certified to get differential pay and Ms. Perez-Posadas said that it is the requirement to get differential pay. Chairman Palacios clarified that the certification differential is available to LPNs. Ms. Perez-Posadas stated that it is a motivation to increase their skills and knowledge. Senator Guthertz asked if any LPN has done this, but Ms. Perez-Posadas stated that no one has. She stated that there is a purpose to the bill because it needs to be clarified that there is no board certification, it is only through national certification. Senator Guthertz asked whether the examinations are difficult. Ms. Perez-Posadas stated that they are hard, like the licensure examination. They may review and must meet qualifications, like hours worked in a specialty area. Senator Guthertz asked if it is difficult to meet the hour requirements. Ms. Perez-Posadas stated that it is not. Chairman Palacios declared that Bill No (COR) has been duly heard. Chairman Palacios concluded the hearing and requested that written testimony be submitted within the next ten (10) days. He adjourned the hearing at 10:08 a.m. III. WRITTEN TESTIMONIES Elizabeth Claros, Personnel Services Administrator, Guam Memorial Hospital Authority, wrote that she does not support the bill in its current form. She stated that the certification pay 2

7 Committee on Labor, the Public Structure, Libraries and Technology Committee Report on Bill No (COR) Page -3- differential is available to Licensed Practical Nurses who have acquired national certification in their area of specialty. Since passage of Public Law , GMH has had no LPN certified in any specialty area. (See attached written testimony.) Lillian Perez-Posadas, RN, wrote that while she supports the concept and intent of the Bill, the language needs to be corrected. She stated that the certification pay differential already includes LPNs. An additional certification credential beyond their required license to practice is required to receive the differential. The language which states "nurses and other healthcare professionals who have a national or Guam Board certification, and are practicing in their area of certification, shall be entitled to a minimum certification pay differential..." but the Board does not issue certification. The Guam Board issues licensure to practice as an LPN, RN or APRN. Certification is a post-licensure credential. She suggested that retired LPNs be allowed to be re-employed to help with the shortage of nurses at Government of Guam health facilities. She hopes that this issue will be addressed in this bill or future legislation. (See attached written testimony.) No additional written testimony was received within the ten (10) day period after the public hearing. IV. FINDINGS AND RECOMMENDATIONS The Committee on Labor, Public Structure, Libraries and Technology hereby reports out Bill No (COR), as introduced, with the recommendation TO PASS. 3

Legislative Findings and Intent: I Liheslaturan Guahan?mds that the salary adjustment mandated pursuant to Chapter 6 of Title 4, Guam Code Annotated, has not been adequately or equitably implemented for all licensed practical nurses practicing in their field of certification in the Government of Guam. At best, partial adjustments were made for some licensed practical nurses in certain agencies, while no adjustments were made for those in other agencies. I Liheslaturan Guahan further finds that other provisions of Chapter 6 of Title 4, Guam Code Annotated, are not being appropriated applied to licensed practical nurses, for example, relative to "work compensation," which applies to overtime, evening differentials and holiday pay. It is the intent of I Liheslaturan Guahan to take a prospective approach to correct the disparity in the assessment and application of the Certification Pay Differential for licensed practical nurses, and to provide for proper compensation across-the-board. It is, further, the intent of I Liheslaturan Guahan to establish a retroactive compensation plan for unpaid and/or underpaid Certification Pay Differential 1

9 1 payment due, from December 30, 2004 (enactment of P.L ) through the 2 date of enactment of this Act and the date of the actual adjustment of the salaries of 3 the licensed practical nurses. 4 Section 2. Implementation of Certification Pay Differential for Licensed 5 Practical Nurses. Section of Chapter 4, Title 6, Guam Code Annotated, is 6 hereby amended to read: 7 " Certification Pay Differential. 8 W) The Director of Administration shall implement a certification pay 9 differential for all nursing and other healthcare professional positions in the 10 government of Guam. Nurses and other healthcare professionals who have a 11 national or Guam Board certification, and are practicing in their area of 12 certification, shall be entitled to a minimum certification pay differential, 13 calculated at the rate of their regular wage plus fifteen percent ( 15%) to rectify an 14 inequity in certification pay. 15 (b) The Director of the Department of Administration shall immediately 16 adjust, prospectively, the salaries of all licensed practical nurses {LPN) who have a 17 national or Guam Board certification and are practicing in their area of 18 certification, so as to be in full conformance with the provisions of this Chapter 6 19 of Title 4, Guam Code Annotated." 20 Section 3. Implementation. (a) The new Subsection (b) added to of Chapter 6, Title 4, Guam Code Annotated, as provided for pursuant to Section 2 22 of this Act, shall be fully implemented by the Director of the Department of 23 Administration by no later than thirty (30) days from the date of enactment of this 24 Act. 2

10 1 (b) If necessary, the Director of the Department of Administration shall 2 submit to I Liheslaturan Guahan a request for a supplemental appropriation as 3 required to fund the Certification Pay Differential salary adjustment mandated 4 pursuant to Chapter 6 of Title 4, Guam Code Annotated and this Act. However, it 5 is further provided that the Director shall not delay the immediate implementation 6 of the salary adjustment for the licensed practical nurses which shall be effectuated 7 pursuant to Subsection (a) of this Section. 8 (c) The Director of Administration shall annually submit to I Liheslaturan 9 Guahan the amount of funding required for the retroactive payment plan, as 10 provided for in Section 4 of this Act, with the Fiscal Year Budget request of the 11 Executive Branch of the government of Guam. 12 (d) The Director of Administration shau insure that all applicable sections 13 and provisions of Chapter 6, Title 4, Guam Code Annotated, wherein "nurses" are 14 referenced, are applied to licensed practical nurses. 15 Section 4. Determination of Retroactive salary adjustment and 16 development of a compensation payment schedule for unpaid and/or 17 underpaid Certification Pay Differential payments due licensed practical 18 nurses. I Liheslaturan Guahan recognizes that the Certification Pay Differential 19 adjustment for the salaries of licensed practical nurses, as mandated pursuant to 20 Chapter 6 of Title 4, Guam Code Annotated, should have been effected with the 21 enactment of Public Law on December 30, 2004, which amended 22 subsection (e) of 6229, Chapter 6, Title 4, Guam Code Annotated, and included 23 licensed practical nurses in the definition of "Nurses." It is the intent I 24 Liheslaturan Guahan to correct this failure of the government to perform the 25 mandated salary adjustment and to mandate the calculation of payment due them 3

11 1 from the date they qualified to participate, and to mandate the development a three 2 (3) year payment plan to compensate the licensed practical nurses for payments not 3 received prior to the enactment of this Act. It is hereby mandated, that: 4 (a) The Director of the Department of Administration shall retroactively s calculate the amount due to all qualified government of Guam licensed practical 6 nurses for the period beginning on December 30, 2004, the date of enactment of 7 Public Law , to the date of enactment of this Act and the actual adjustment 8 of the salaries of the licensed practical nurses, as mandated pursuant to this Act. 9 (b) The Director of the Department of Administration shall audit the 10 work dates and hours of licensed practical nurses from December 30, 2004, to date, 11 so as to insure that proper compensation is paid for any time provisions 12 are applicable, and accordingly, immediately pay any unpaid wages determined to 13 be due. 14 (c) The Director of the Department of Administration shall submit to I 15 Lihes/aturan Guahan, by no later than thirty (30) days from the date of enactment 16 of this Act, a three (3) year payment schedule to pay the salaries determined to be 17 due the licensed practical nurses, subject to the availability of funds. 18 Section 5. Effective Date. This Act shall become effective immediately 19 upon enactment. 4

Submitted by: Lillian Perez... Posadas, RN, MN Good morning Senator Palacios and Senator Guthertz! Thank you for this opportunity and for the introduction of this proposed legislation. My name is Lillian Perez-Posadas and I am here as a private citizen, as a professional registered nurse and as the former Hospital Nursing Services Administrator. I feel it is my duty to provide testimony in support of the plea of the LPNs seeking equitable and just compensation. Historically, our island community did not recognize LPNs as ''professionals" based on the criterion used to define "professionals'' however, that mindset was changed back in 2004 when PL was enacted. PL amended the dcflllition of a.. nurse" to include LPNs thus establishing a precedence that LPNs arc indisputably an echelon of professional nurses and they rightfully deserve to be regarded as "professionals". While I am in support of the concept and intent of tltis Bill with regards to implementing the "certification pay differential'' for LPNs, the language and the content of the Bill in its current form needs to be corrected. First and foremost, a 15% certification pay differential is already available and in existence for "nurses and allied healthcare professionals" employed throughout our Government of Guam agencies. Secondly, this 15% certification pay differential is an incentive for nurses and allied healthcarc professionals who possess national certification credential beyond the required licensure to practice in their field of discipline. LPNs or RNs practicing/working as a licensed or registered nurse within the Government of Guam health agencies do not automatically qualify for the 15% certification pay differential. They have to possess the additional certification credential beyond their required license to practice. This is what I tltink needs to be clearly articulated in this proposed legislation or any public policy that pertains to the issue of certification pay differential. The language/verbage as written in PL and in Bil/ that states, "Nurses and other healthcare professionals who have a national or Guam Board certification, and are practicing in their area of certification, shall be entitled to a minimum certification pay differential, calculated at the rate of their regular wage plus fifteen percent ( 13%) to rectify an inequity in certification pay" needs to be amended/corrected. Firstly, Guam Board does not issue "certifications". The Guam Board issues/grants licensure to individuals who apply for licensure and who meet the requirements to practice as an LPN, RN or APRN. licensure is the ba.."lic requirement. It is what's required by law in order

15 ; :57PM; ; # 3/ 3 2 for an individual to practice as an LPN, RN or APRN. The certification is an additional credential beyond the licensure requirement. It is a "post-licensure" credential. And it is for this reason that the "certification pay differential" is given as an incentive pay to recognize and compensate nurses and healthcare professionals for their attainment and achievement of this additional credential and expertise. LPNs, just like RNs, have the option to apply to a national entity/organization to take a certification examination. Such national organizations are the National Federation of Licensed Practical Nurses, Inc. (NFLPN) and the National Association for Practical Nurse Education & Service, Inc. (NAPNES). These entities proffer certification examinations specifically for LPNs in such specialty areas as Intravenous Therapy & Gerontology Care, Long-Term Care Nursing and Pharmacology. LPNs, upon meeting the requirements for any of these certification programs have the option to apply to take the certification examination that is related to their field of practice and upon passing the examjnation, they are then entitled to receive the 15% certification pay differential. A national certification credential for LPNs and RNs is OPTIONAL ~ it is not a ''requirement". Along the same lines that affect LPNs and the practice of professional nursing on our island and, with your permission, I would like to bring forth an issue that needs to be addressed in an effort to mitigate the shortage of nurses on island. There are many LPNs who retired from Government of Guam and are willing and available to return to the health care workforce within our Government of Guam facilities however, the current law that allows retired RNs and teachers to be re-employed is only specific to RNs and teachers. There are many retired LPNs that can be re-employed which will be a tremendous help to the perennial shortage of nurses throughout our Government of Guam health facilities. I put this matter on the table in hopes that you will either incorporate language into this Bill in its amended/corrected version allowing retired LPNs to be reemployed or perhaps craft a separate Bill relative to the re-employment of Government of Guam retired LPNs back into the Government of Guam workforce. Claros, I am the Personnel Services Administrator at the Guam Memorial Hospital Authority and I am providing written testimony not in support ofbill (COR) as presented in its Current Bill Form. The passage of Public Law , The Recruitment and Incentives of Nurses and Health Care Professionals only addressed Licensed Registered Nurses and Licensed Allied Healthcare professionals. Public Law , references Certification Pay, sub-section (Certification Pay Differential) these groups of nurses and allied healthcare professional shall be entitled to 15% Certification Pay who have acquired national or Guam Board certification who are practicing in their area of specialty. This is being provided to those registered nurses and allied health care professional who provide the national certification documentation. The Guam board does not issue national certification in the area of specialty but issues licenses to practice on Guam. The passage of Public Law amended the definition of ''Nurses" to include License Practical Nurses. The driver of passage of then Bill352 was due to the issues facing that hospital which did not include the LPN' s as professionals and were excluded from the weekend pay definition. With the Weekend Pay definition, the Nurses Aides, Patient Couriers and technicians are not a part of that compensation.

17 In FY2007, the Board authorized the compensation of the LPN's to an adjustment of25% which is equal to that of the employees in the Licensed Allied Healthcare group - the 25% Incentive. The adjustment was supported by the Hay Study which was completed in 2006 whereby the hospital did show that the registered nurses were still within the national pay compensation, however, it did indicate that the LPN' s and the Allied Healthcare Professionals were already lagging in compensation. The LPN' s were adjusted but the Allied Healthcare professional remained status quo to this date. Since the passage of Public Law , to date the Hospital has had NO LPN certified in any specialty area. Currently, there are a total of 94 employees receiving Certification pay who are Registered Nurses and Licensed Allied Professional (such areas as in PT, RT, and Radiology).
