LIQUOR LICENSE APPLICATION BACKGROUND: On February 21, 2018 the City received an application for a new liquor license for Café Yumm! which will be located at 5920 Ulali Drive NE, Keizer, Oregon. The application is for a limited on-premises license. As required by Keizer Ordinance a public hearing was scheduled; notice was published and mailed to all property owners within 200 feet of the proposed establishment. The Keizer Police Department reports a clear background check on the applicants. In addition, the Keizer Community Development Department finds the location of the establishment to be properly zoned and has no additional comment on the application. RECOMMENDATION: It is recommended the public hearing be opened to allow testimony from the applicants or other interested individuals and upon completion, the hearing be closed. It is further recommended the Council recommend approval of the application for Café Yumm! under the guidelines as established by ORS and the Ordinances of the City of Keizer. This recommendation shall then be forwarded to the Oregon Liquor Control Commission for final approval.

SHANNON JOHNSON, CITY ATTORNEY LUBRICATE AND SURVEY SERVICE OTIS ELEVATOR COMPANY For the last several years, Otis Elevator Company has performed the annual survey and regular lubrication of the elevator and equipment located in the City of Keizer Public Works shop. Otis Elevator Company and staff desire to enter into a five year agreement for these services. Under the Keizer Local Contract Bidding Ordinance, any agreement over two years in length must be approved by the City Council. Therefore, this matter is before the Council tonight for approval. RECOMMENDATION: Adopt the attached Resolution authorizing the City Manager to enter into the Lubricate and Survey Agreement with Otis Elevator Company. 9 CITY COUNCIL, CITY OF KEIZER, STATE OF OREGON Resolution R2018- RESOLUTION AUTHORIZING CITY MANAGER TO ENTER INTO LUBRICATE AND SURVEY AGREEMENT WITH OTIS ELEVATOR COMPANY WHEREAS, the City of Keizer Public Works shop building has an elevator in need of an annual survey and regular lubrication by a qualified examiner; WHEREAS, Otis Elevator Company is a qualified examiner; WHEREAS, Otis Elevator Company and City desire to enter into a five year agreement for the services required; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Keizer that the City Manager is authorized to enter into the attached Lubricate and Survey Agreement with Otis Elevator Company. Volunteer of the Quarter Awards MINUTES KEIZER CITY COUNCIL Tuesday, February 20, 2018 Keizer Civic Center, Council Chambers Keizer, Oregon Council President Parsons called the meeting to order at 7:00 pm. Roll Call was taken as follows: Present: Staff: Marlene Parsons, Councilor Chris Eppley, City Manager Kim Freeman, Councilor Shannon Johnson, City Attorney Bruce Anderson, Councilor Nate Brown, Community Amy Ryan, Councilor Development Director Laura Reid, Councilor Bill Lawyer, Public Works Roland Herrera, Councilor Director Absent: John Teague, Police Chief Cathy Clark, Mayor Tim Wood, Finance Director Youth Councilor Samuel Hernandez Tracy Davis, City Recorder Council President Parsons led the pledge of allegiance. Second Quarter 2017 Hans Schneider Nominator Matt Lawyer introduced Hans Schneider noting that Mr. Schneider had put in the sand volleyball courts at Keizer Rapids Park and the adjacent covered shelter. He added that two youth have received scholarships partly because of his volleyball related efforts. Third Quarter 2017 Church of Latter-Day Saints (Daniel Kohler) Nominator Matt Lawyer introduced Daniel Kohler who, along with 200 volunteers from the Church of Latter-Day Saints, volunteered to move 600 cubic yards of engineered wood fiber from the Big Toy to allow for installation of the poured-in-place fall surface. Fourth Quarter 2017 Whiteaker Middle School (James Decker) Nominator Matt Lawyer explained that due to inclement weather in the north Mr. Decker was unable to attend the meeting. Presentation of the award was postponed to the March 5 meeting. First Quarter 2018 Matt Lawyer Council President Marlene Parsons explained that Mr. Lawyer was nominated by Richard Walsh who was unable to attend the meeting. 18 COMMITTEE REPORTS PUBLIC TESTIMONY She introduced Matt Lawyer and reviewed his volunteer efforts including working on the construction of the Big Toy, participating in the development of the citizen survey regarding a parks fee, and volunteering efforts through the Claggett Creek Watershed Council. Dylan Juran, Keizer, reported on the recent Parks Board public hearing noting that after hearing the testimony of Kerryann Bouska, Marion County Prevention Program Supervisor, and that of several Keizer citizens, the Board discussed the issue at length and decided to recommend to Council that the current parks rules in the ordinance be amended to remove reference to specified areas and smoking of all materials in all parks be banned. Matt Lawyer, Keizer, reported on the recent Planning Commission meeting noting that the Commission approved text amendments related to the Keizer Station Master Plan amendment process with the inclusion of the words Keizer Station Master Plan as all-inclusive language to those portions of the Development Code and allowing staff to make changes to correct any scrivener s errors as necessary. Jose Dominguez, Keizer, representing the Latinos in Action Committee, provided information about the committee, its leaders, efforts and successes. He noted that the committee has worked diligently to develop relations in the community, held numerous community forums, and has been instrumental in connecting the faith, educational, and business communities in Keizer. He requested a waiver of fees for the community center for a Latino Active Scholarship Reception noting that the goal of this program is to help young people from McNary High School. He also solicited sponsors for the youth. City Manager Chris Eppley noted that this is a group that Councilor Herrera actively sits on and if a Councilor is part of a group they have the ability to use the Community Center as part of their community outreach. Council President Parsons requested that this be put on the next meeting agenda. Bill White, Keizer, questioned who he should contact regarding street issues. He was given Bill Lawyer s name. Mr. White indicated he wanted to discuss crosswalk issues with Mr. Lawyer. PUBLIC HEARINGS a. Liquor License Application Hop Jacks City Manager Chris Eppley reported that an application was submitted for a Liquor License from Hop Jacks, Keizer, Oregon. A background check was done and calls for service are within the City recommended standards. Staff recommends that Council review the application and forward a recommendation to the OLCC for approval. Council President Parsons opened the Public Hearing. Kevin Eggen, Bonney Lake, Washington, and Tommy Tribbett, Keizer, provided information about the establishment including the many areas in which the organization is involved in the community including a good Keizer City Council Regular Session Minutes Tuesday, February 20, Page 2
19 neighbor fund, a kids feeding kids program, fundraiser take over nights, and volunteering in schools and the humane society. They announced that the plan is to open March 26. With no further testimony, Council President Parsons closed the Public Hearing. Councilor Freeman moved that the Keizer City Council approve the application for Hop Jacks under the guidelines established by ORS and the Ordinances of the City of Keizer. This recommendation shall then be forwarded to the Oregon Liquor Control Commission for final approval. Councilor Anderson seconded. Motion passed as follows: AYES: Parsons, Freeman, Reid, Ryan, Herrera and Anderson (6) NAYS: None (0) ABSTENTIONS: None (0) ABSENT: Clark (1) b Keizer Liquor License Renewals City Manager Chris Eppley explained that each year the Oregon Liquor Control Commission requires liquor establishments to renew their license to sell alcoholic beverages. The City has an ordinance that outlines guidelines for the annual review. Staff recommends Council open the public hearing, receive testimony, close the public hearing and forward a recommendation for renewal to the Oregon Liquor Control Commission. Councilor Reid reported on the Stormwater Advisory Committee, Future Business Leaders of America competition, Miller Park cleanup, Kurt Schrader roundtable and the Keizer Heritage Foundation Board. She announced the upcoming Ron Wyden community town hall, Keizer Homegrown Theater open house, and the Southeast Keizer Neighborhood Association meeting. Councilor Freeman thanked Councilor Parsons and Mayor Clark for covering her meetings while she was on vacation and urged everyone to visit the new businesses opening in Keizer. Councilor Freeman thanked the students and urged them to attend Council meetings. Gary Blake and Rhonda Rich from West Keizer Neighborhood Association summarized the Annual Report, thanked specific people who had participated in past meetings, reviewed accomplishments, highlights and goals and requested recognition for another year. 24 COMMITTEE REPORTS PUBLIC TESTIMONY PUBLIC HEARINGS None Matt Lawyer, Keizer, representing the Claggett Creek Watershed Council, reminded everyone of the upcoming Civic Center clean-up event, the quarterly meeting and the Keizer Arboretum Grand Opening event. Colleen Busch, Cherriots Board member, provided information about Cherriots service, outreach programs, and the Better Cherriots proposal. Charles Anderson, Keizer, complained about parking, trash, traffic, vandalism and graffiti in his neighborhood near McNary High School. Councilor Ryan explained that the school district is aware of the problem and is working to remedy it through the upcoming bond measure. ADMINISTRATIVE ACTION a. Waiver of Community Center Rental Fee Latinos En Accion Committee b. RESOLUTION Authorizing Finance Director to Enter Into Engagement Letter with Piper Jaffray City Manager Chris Eppley reminded Council that this request was received at the last Council meeting. The staff report provides several options in response to the request. Pastor Jose Dominquez summarized the request that was brought to Council and provided details regarding the proposed event. Councilor Herrera moved that the Keizer City Council choose Option #4 (waive the rental fee and the security-cleaning deposit but charge for staffing time). Councilor Anderson seconded. Councilor Ryan noted that in support of this event she would pay the $80 staffing fee if the motion passed. Finance Director Tim Wood explained that these resolutions are related to financing the replacement of the Dearborn Bridge and summarized information in his staff report. Councilor Herrera announced Teacher Night for Kennedy Elementary School at McDonalds, the Bridging the Gap event at McKay, and the McNary Leadership Group Country Glen Park revitalization project and congratulated McNary sports teams on their accomplishments. Councilor Parsons announced the Traffic-Bikeways-Pedestrian Committee meeting and the Young Life Banquet. Mayor Clark interjected that she had received a request from Councilors Parsons and Freeman to switch assignments on Traffic-Bikeways and Planning so Councilor Parsons will now serve as liaison for the Traffic- Bikeways Committee and Councilor Freeman will serve as liaison for Planning Commission. Councilor Reid reported on the Ron Wyden town Hall, Keizer Homegrown Theater Open House, Southeast Keizer Neighborhood Association meeting, Read Across America at Forest Ridge and the Lend Me a Tenor performance at McNary. She noted that winter sports are wrapping up but new ones are coming up and announced the upcoming Distinguished Young Women meeting. Councilor Freeman reported on the Community Conversation and announced upcoming Storm Water Advisory Committee, Planning Commission, West Keizer Neighborhood Association and Volunteer Keizer City Council Regular Session Minutes Monday, March 5, Page 3
26 OTHER BUSINESS WRITTEN COMMUNICATIONS Coordinating Committee meetings. She also thanked everyone who had signed up for the Civic Center cleanup event. Councilor Ryan reported on Coffee with a Cop, Breakfast with the Chief which is the kickoff for the construction of the Salem Police Department, Keizer Arts Commission Story Pole outreach meeting, and the Dorchester Conference. She invited everyone to the upcoming congressional district debate and the leadership prayer at the capitol. Mayor Clark thanked Council President Parsons for covering for her while she was on vacation. She reported on Keizer Homegrown Theater Open House, Salem-Keizer Area Transportation Study meeting, Coffee with a Cop, Strategic Economic Development Corp agricultural breakfast, the Mid-Willamette Area Commission on Transportation and the Read Across America event. She announced upcoming events including Habitat for Humanity ground breaking in south Salem, International Women s Day dinner, Strategic Economic Development Corp Board meeting, the Green Awards with Marion County Environmental Services and the Forest Ridge Elementary School City Hall tour.
