Those wishing to make oral or written statements on this matter may do so during the hearing. Mayor Bonfield asked if there were any questions, comments or concerns. There was no reply. The public hearing closed at 5:32pm. 5:35pm -5:42pm Mayor Bonfield stated the City of Asotin, WA, does hereby give notice of the Shoreline Exemption to the Washington State Department of Transportation for State Route 129 Pavement Improvements. Public Hearing, Monday, December 14, 2015, at 5:35 pm at Asotin City Hall, 121 Cleveland, Asotin, WA. Those wishing to make oral or written statements on this matter may do so during the hearing. Debra Freudenthal spoke on behalf of the Washington State Department of Transportation. Explaining WSDOT is submitting a shoreline exemption request for the State Route 129 Paving and ADA Compliance projects that include the re-paving of the Asotin Creek Bridge (No. 129/10) located within the city limits of Asotin and regulatory shoreline jurisdiction of Asotin Creek. The proposed work includes grinding and repaving of the bridge surface. There will be no structural, off-pavement or in water work and the project will have no riparian or aquatic resource impacts. The construction of this project will begin in the spring of 2016 and will be completed in the fall of Asotin Creek is designated a Shoreline of Statewide Significance. The proposed type of work is considered as normal maintenance and repair of an existing structure and thus, exempt from shoreline substantial development permit requirements under WAC (2)(b) and RCW (3)(e)(i). In addition, it meets the critical area exemption criteria under AMC (C)(2). Mayor Bonfield asked if there were any questions, comments or concerns. There was no reply. The public hearing closed at 5:42pm. Councilmember Schneider made a motion to approve the Shoreline Exemption for State Route 129 Pavement Improvements. Seconded by Councilmember Bly. 2 Councilmember Bly asked Debra Freudenthal of the Washington State Department of Transportation to examine the stormwater drain that is located at the game shack also known as the Asotin County Noxious Weed Office which is located on the state highway. The storm drain is not working and floods that area. Debra Freudenthal of the Washington State Department of Transportation stated she would look into this situation. ORAL COMMUNICATIONS- PUBLIC COMMENT: Mayor Bonfield explained in consideration of others wishing to speak, your remarks will be limited to three minutes for items not listed on the agenda. Please stand, state your name and address for the records. Robert Van Allen stated he has had a business licenses in the State of Washington since Robert Van Allen stated, Bill Frye is not allowing a 90 degree pipe to be installed for the sewer hookup. Robert Van Allen stated Bill Frye told him he wants two 45 degree pipes to be installed for sewer hookups. Robert Van Allen stated he is confused what he is supposed to use. Robert Van Allen stated if the City of Clarkston and Asotin County have amendments he is informed of the changes. Robert Van Allen stated if there is a change to the City of Asotin codes he needs to have an amendment that adopted the code that supports the change of using two 45 degree pipes. Robert Van Allen stated he needs to be made aware of amendments. Robert Van Allen wants to know what he can and cannot use. Mayor Bonfield stated to Robert Van Allen that he failed to install the pipe properly. Mayor Bonfield stated she talked to Mike Winroth and Mike Winroth told her he had to have a new contractor come in and fix it correctly. Mayor Bonfield also stated to Robert Van Allen that he failed to get an inspection. Mayor Bonfield stated to Robert Van Allen the City of Asotin has the right to impose stricter regulations. Robert Van Allen stated to Mayor Bonfield he would like to file a Small Business Impact Statement. City Attorney, Jane Richards stated to Robert Van Allen that she would get the paperwork for him. Robert Van Allen exited the building. Police Chief, Monte Renzelmen stated to the council that he was on scene when Bill Frye was inspecting the pipe when Laki Ah Hi was on site. Robert Van Allen was not there when Bill Frye and Police Chief, Monte Renzelman were on scene. Public Works Superintendent, Bob Portlock inspected the pipe and they then talked about the 90 degree pipe being in error. Mayor Bonfield and City Attorney, Jane Richards explained to the students that were in the audience that the City of Asotin does follow Federal Standard Building Codes, the Uniform Plumbing Codes and the City of Asotin also has City Codes that are imposed and followed. Resident, Charlotte Tuttle reported that the Asotin County Landfill will no longer be accepting aluminum, metal or plastic in the recycle bins. The only product that will be accepted is cardboard and paper products. Signs and educations will be given to the public regarding this new change. CONSENT CALENDAR: 1. Set up City Governed s for Councilmembers Councilmember Bly stated she was concerned about the Mayor and the Council using personal s for work related business. Councilmember Schneider stated he didn t think it was necessary to create a new address just for work related items. City Attorney, Jane Richards stated keep in mind if you are going to have a government and you use it for business and personal it can be asked of public records. City Attorney, Jane Richards stated she would recommend setting up government s that are used just for government business only. If you use your personal for government business it can become part of the public records. 2. Asotin County Jail Medical Procedure Changes Police Chief, Monte Renzelman stated the city received a clarification memo from the Asotin County Sheriff s Office Jail Commander Smith stating there will be a few changes with the Jail billing procedures. The Jail will be required to contact the respected entity who is responsible for their prisoners prior to medical treatment. This will include all medical transports (emergent may not warrant immediate contact), dental transports, and prescription medication authorization. The entity responsible will authorize treatment and be aware of the charges incurred. Provide the Hospital and the Dentist with appropriate billing information. Prescriptions will also individually be billed to the appropriate entity responsible. These steps and procedures are already in place and is a part of the contract. There is still discussion of who will be responsible for transportation. 3. Opening on the Planning Commission Mayor Bonfield stated there is still an opening on the Planning Commission. It has been advertised on the school reader board and on the back of the utility statement. 4. Asotin Boat Launch and Jetty Restoration Listening Session December 8, :00pm Asotin Community Center Mayor Bonfield reported on the Asotin Boat Launch and Jetty Restoration Listening Session that took place December 8 th at 7:00pm at the Asotin Community Center. Mayor Bonfield stated there were not very many people that attended however, the following was discussed: "What if the Asotin marina were to change its character?" asked Mayor Vikki Bonfield. "What if it did not plan to offer long-term private moorage? Would that be a problem for people?" The small group in attendance was briefed on the status of a planning grant and asked to help shape a scope of work for consultants expected to come on board in early 2016."We want to make sure the boating facility meets public expectations," Bonfield explained. Other questions discussed included the need for boaters to fuel there at the boat launch, and if yes, whether it was regular fuel or included diesel. Moorage fees of some kind would help the city cover operations expenses said Councilmember Appleton. "What if those fees Page 3 of 7

4 Page 4 of 7 were to come from commercial jet boat tour companies, who might be using the Asotin boat basin as a home base?" The city decided to release a survey for the purpose of gathering additional input and plans to conduct interviews as well. The survey can be accessed through the cityofasotin.org website. Mayor Bonfield also explained the history of the marina during the discussion. The marina needs a lot more than being dredged. There was no siltation plan created by the U.S. Army Corp of Engineers. It continues to silt in and would need to be dredged every two years if the city were to keep the marina open at a cost of $100, There s no way the city can afford that. The city did receive a Recreational Conservation Office Grant. The money will allow the city to develop a plan on how to fix the marina so that it won t silt in every couple years. Mayor Bonfield stated she does not believe that the city can come up with a plan so it will never silt in, because you never know what Mother Nature is going to do. But with this plan, the hope is that the city can keep the dredging down to five or six years and open at least a safe place for people to put their boats in and take them out. The reason it is so important to have the marina open for the city is because the city has very little economic development. When the marina was up and running, the city had a lot more economic development in the community. The City of Asotin is the last town before you go into Hells Canyon. The problem is that the Corp of Engineers owns the entire waterfront in the City of Asotin, which also includes 90 percent of our flat land. Because the city doesn t have access to the river, the city can t put anything on the corps property without their permission. It s difficult because the city has so little control over the river an access to the river within the city. Mayor Bonfield stated if the city had access to that, we wouldn t have to solely rely on property taxes for our base. The city would have other ways of making money. Mayor Bonfield stated there will be another meeting after the first of the year. 5. Shoreline Exemption for State Route 129 Pavement Improvements Letter approved. CONSULTANT/CONTRACTOR REPORTS: 1. Keltic Engineering, Inc. a. Shoreline Master Program Update Project #G Keller Associates, Inc. a. USDA (Rural Development) Waste Water Treatment Plant Upgrade CLERK S REPORT: 1. Only Rain Down the Drain- No Lawn Clippings nor Yard Waste Clerk/Treasurer, Tiffany Rogers stated Matt Carlson, Regional Stormwater Coordinator sent information about lawn clippings. These flyers will be distributed to lawn companies for education purposes. 2. City of Asotin Accountability Audit Report Clerk/Treasurer, Tiffany Rogers stated the City has received the final Accountability Audit Report for January 1, 2012 through December 31, Indigent Defense Case tracking from Richard A. Laws Clerk/Treasurer, Tiffany Rogers stated Rick Laws did provide information on how many cases from January November. Clerk/Treasurer, Tiffany Rogers stated she also sent a letter to Rick Laws asking for a copy of his insurance. The city does not have a copy on file. Clerk/Treasurer, Tiffany Rogers suggested setting up a finance committee meeting with Councilmember Appleton, Councilmember Bly and City Attorney, Jane Richards to discuss this matter further. 4. Past Due Utility Accounts for November Clerk/Treasurer, Tiffany Rogers reported there were 43 past due utility accounts for November.

November 2015 District Court Clerk/Treasurer, Tiffany Rogers reported, November 2015 District Court collected $983.00, of that the City sent $ to Washington State Department of Treasurer, Crime Victims fund $6.63 and the City of Asotin deposited $ a 75.49% rate of income from District Court. Police Chief, Monte Renzelman stated there were five tickets issued between October 29 th and November 24 th. Those tickets have now been expired because they have to be filed with the court within five days and the City was not allowed to file those tickets. City Attorney, Jane Richards explained the District Court situation to the students that were in the audience. 6. Department of Ecology Stormwater Audit January 27,2016 Clerk/Treasurer, Tiffany Rogers stated the Department of Ecology will be conducting an audit of the City of Asotin s Stormwater Management Program on January 27, This is required through the NPDES Phase II Municipal Stormwater Permit. Department of Ecology is piloting an audit program that will review specific components of the Municipal Stormwater Management Program. Matt Carlson, Regional Stormwater Coordinator stated he will be present for the audit Regional Stormwater Annual Report Clerk/Treasurer, Tiffany Rogers stated Matt Carlson, Regional Stormwater Coordinator has completed the 2014 Annual Report for the City of Asotin Stormwater. POLICE REPORT: 46 Calls in November Warrant Juvenile Arrest Marine Incident another boat Programs Kids and Cops Accepted in WASPIC Server at Tri-State Festival of Trees Tea Charged Prostitution Case Seat Belts Save Challenge Campaign 12/1/15 marked the kick-off of the Seat Belts Save Challenge, a campaign that will continue through Friday, December 18th and aims to educate students, parents, and community members on the importance of buckling up! The spotlight of the campaign is "Buckle Up! Your Family is Waiting for You!" Data showed that of the 65 cars checked, 89.23% of passengers were buckled up; leaving 10.77% without a seat belt. Along with posting to social media on a regular basis, please see the plan for advocating below: Tuesday, December 1: Unannounced seat belt check #1 Thursday, December 3: Presentation with Officer Adelsbach to grades 9-12 during the first minutes of 1st-4th hour (you will be notified if your class is affected); PSA showing prior to Spirit Week Movie night Friday, December 4: Booth at Battle of the Colors game featuring a pledge banner to sign, pledge cards, flyers, candy, etc. -- open for both Pomeroy and Asotin Monday, December 7 - Friday, December 11: Advocating this week will be done heavily through posters and silhouettes throughout the high school hallways; a fact regarding seat belt safety will be read over the intercom each morning; the middle bulletin board in the hallway will be decorated Thursday, December 10: Flyers on all cars in the high school and marina parking lots Monday, December 14 - Friday, December 18: Message on reader board Thursday, December 17: Unannounced seat belt check #2 to check progress/success of campaign Quick numbers update: Page 5 of 7

Stormwater - Jennifer Bly COUNCIL COMMUNICATIONS: Mervin Schneider-None Joe Appleton-None Jennifer Bly- Councilmember Bly stated there was a professional Stormwater slideshow presentation given from the Stormwater Maintenance Crew at the Stormwater meeting today. The Stormwater employees do all the work themselves. They do not hire engineers to calculate the radius or measurements to direct the stormwater where it needs to go. Councilmember Bly stated our Stormwater money is going for a good purpose. The crew is very helpful and professional. They are open to suggestions and are able to fix many problems as they arise. Bob Van Pelt-Absent George Tucker-None MAYOR S REPORT: RCO Grant Mayor Bonfield stated the City of Asotin received three RFQ s for the Boat Launch and Jetty Restoration project. All three are highly qualified engineering firms. The contract will be awarded in January. The City of Asotin needs to make sure the engineers are aware of the smaller sized budget. ORAL COMMUNICATIONS- PUBLIC COMMENT CONTINUED: Robert Van Allen presented himself again to the council at 6:26PM with a cell phone that was on speaker phone mode with Mike Winroth on the line. Robert Van Allen approached Mayor Bonfield with the phone. Mayor Bonfield asked Mike Winroth if he had to hire someone to fix the sewer at his new construction site. Mike Winroth stated Laki Ah Hi had to tap into the sewer when they changed the line into the house underneath. Laki Ah Hi tapped the sewer and run a new line under the house at the proper grade. Mike Winroth explained on the phone that he never told Mayor Bonfield that Bob Van Allen did anything wrong. Mike Winroth Page 6 of 7

7 explained he received a phone call from the Plumbing inspector which stated an incorrect 90 degree pipe was used verses two 45 degree pipes. Mayor Bonfield stated to Mike Winroth that she thought she understood Mike Winroth hired Laki Ah Hi to redo the pipes. Mayor Bonfield asked Mike Winroth, so Laki Ah Hi had to fixed it? Mayor Bonfield asked Mike Winroth if he was going to pay Bob Van Allen for the work he did. Mike Winroth stated yes he was going to pay him. Mike Winroth explained it was Laki Ah Hi that asked Bill Frye for the plumbing inspection and that s when the 90 degree pipes were located. RESOLUTIONS & ORDINANCES: 1. EXECUTIVE SESSION: RCW (i) 6:40pm-7:20pm Mayor Bonfield asked for an executive session for 15 minutes regarding contracts. Mayor Bonfield asked for an extension of an additional 15 minutes. Mayor Bonfield asked for another extension of an additonal10 minutes. Councilmember Appleton made a motion to authorize City Attorney, Jane Richards to investigate hiring an additional attorney to help with the contracts. Seconded by Councilmember Bly. There was no discussion. Aye Councilmember Bly, Aye Councilmember Appleton, Aye Councilmember Schneider, Nay Councilmember Tucker due to expense. Motion carried.
