1 Page 1 () I. Section Annual Conference The ABA Litigation Section Annual Conference will be held April 18 20, 2012, at the JW Marriott in Washington, DC. The Committee will be featured in a program at the conference focusing on the international aspects of class-action litigation and mass tort issues. A. Scheduled Committee Attendees 1. Yes: David Schwan (arrives Wednesday); Beatty O Donnell (arrives Wednesday evening); Rudy Perrino (arrives Friday afternoon, with a potential excursion Wednesday afternoon to attend the Editor s Symposium and Committee dinner) 2. Maybe: Doug Pepe (depends on potential settlement); Duke Maloney 3. No: David Lester; Andrew Scholz; Karen Woodward B. Meeting Schedule 1. Wednesday, April 18 a. Editor s Symposium (afternoon) i. This is scheduled for 2 4 p.m. b. Welcome Reception (early evening) c. Committee Dinner (evening) i. Beatty has not yet located a place for dinner, but she is looking for a nice restaurant within walking distance of the JW Marriott. ii. Beatty emphasized that this is a good event for networking. 2. Thursday, April 19 a. Practice Networking Luncheon (12:15 p.m.) b. Committee Expo (6-7 p.m.) i. The Committee Expo is open to all attendees and will feature leaders from over 40 Litigation Section committees.

2 Page 2 ii. iii. iv. This year s Expo is titled GAME ON!, and each committee s table theme will be an assigned game show or board game. The Litigation Section has assigned Trivial Pursuit to the Mass Torts Committee. David Schwan, Beatty O Donnell, and Paul Majkowski will prepare table materials, collect and organize questions for our mock trivial pursuit game, and sit at the table. v. Paul, a competitive Trivial Pursuit player, suggests that we should come up with questions for participants centered on the traditional colors and categories of the original Trivial Pursuit game. vi. After discussing what our categories should be, we decided on the following categories, with Subcommittee Question assignments in parentheses: a) Spills (Toxic Torts); b) Disasters (MDL and Class Actions); c) Crashes (Aviation); d) Drugs (Pharma and Medical Devices); e) Mass Torts Movies (Young Lawyers); and f) The Practice (Experts/Evidence). vii. viii. Each subcommittee should come up with five (5) questions in their assigned category. These questions should be of varying degrees of difficulty (easy, moderate, and hard). Our tentative plan is that when a participant visits the table, we can give away small prizes for correct answers, and if the person answers three questions correctly, he or she would be entered in a drawing for a grand prize, which could be a Kindle Fire. 3. Friday, April 20 a. Committee Networking Coffee Hour (7:30 8:30 a.m.)

3 Page 3 II. Aviation Annual Meeting Report A. The Aviation Subcommittee Annual Meeting and CLE will be held Thursday, June 7, starting at 8:30 a.m. and ending at 6 p.m. It will be at the University Club on 5th Avenue in New York City, a few blocks north of Rockefeller Center. B. According to Duke Maloney, Jennifer Weed has done a great job in overseeing the program; she is diligent and responsive. C. All of the speakers have been chosen, except for the luncheon speaker. Senator Gillibrand (D-NY) is a maybe, although Duke continues to search for a confirmed speaker. D. This one-day CLE will feature a mock trial, including a judge and jurors. For more information, please contact Duke Maloney. III. ABA Annual Meeting A. The ABA s Annual Meeting will be held August 2 7, 2012, in Chicago. B. The Committee is working via conference calls to put a spectacular panel together. C. Daniel R. Karon (Goldman Scarlato Karon & Penny, P.C.), from the Class Action and Derivatives Securities (CADS) Committee, has been leading the charge to secure the following speakers: 1. Cheryl Woodin (Canadian class counsel); 2. Justice Brian Riordan (Canadian judge who oversaw a large tobacco case that went to trial in Montreal, Quebec); 3. Professor Brian Fitzpatrick of Vanderbilt University Law School (well known in class actions realm); 4. Margaret Lyle (Of Counsel, Jones Day -- Dallas, TX); and 5. A federal judge with class action experience. D. Our panel presentation will likely be in a talk show format. IV. Annual Joint CLE planning A. Karen Woodward reports that the numbers for the recent conference in January were pretty good, and it was a profitable event.

4 Page 4 B. Catherine Riegle and Eric Andreas will be co-chairs of the planning committee for next year s conference, which will meet soon. C. We should brainstorm topics for panel presentations, and try to come up with novel ways to present information. V. Committee Reports A. Aviation 1. See above regarding the upcoming Aviation Annual CLE in New York on June Duke is working with his members on an article to be released soon. B. Toxic Torts 1. Andrew reports that on publications side, he has submitted one article for the latest quarterly and another article is coming along with a website contribution. There is an upcoming chemical and toxic tort regional conference in which the Toxic Torts Subcommittee will present a panel. C. Pharma and Med. Devices 1. Karen Woodward is organizing a panel for an upcoming CLE. 2. She is also working on securing an article for the March 15th deadline. D. MDL & Class Procedures 1. David Lester and Ina Chang have been working on the publications front, and Ina will ensure that the group meets the deadlines. 2. David and Ina have reached out to at least one person from the Joint CLE about potentially joining and helping out with publication requirements. E. Experts and Evidence 1. Doug and Tim, who have worked very hard and published several articles, are trying to get additional authors for the website and quarterly publications.

5 Page 5 F. Young Lawyers 1. We have recently submitted an article from Crystal Axelrod on the proper use of PowerPoint presentations in the courtroom. Ms. Axelrod drew on her experience as a federal bankruptcy clerk in Austin, Texas. 2. We are also working to secure an author for April s website contribution. G. Membership and Diversity 1. The Membership and Diversity Committee still needs help with their activities. Please check with your colleagues to see if they would like to join the Membership and Diversity Subcommittees. 2. In February 2012, there were 16 adds and 6 drops in the membership department. 3. Jackie McCreary continues to work on obtaining speakers and topics for a webinar, possibly with the assistance of the Minority Trial Lawyers Committee. If anyone has ideas for a speaker at a webinar, she would appreciate suggestions. DMSLIBRARY
