(2) An: (A) emlee; and (B) emler; subject t the federal Railwa Labr Act (45 U.S et seq.). (3) An emlee emled n rert ver which the United States gvernment has exclusive jurisdictin fr the urse f labr relatins. (4) An emlee f the state. (5) An emlee f a litical subdivisin (as defined in I ). Sec. 2. This chater des nt al t the extent that it: (1) cnflicts with; r (2) is reemted b; federal law. Sec. 3. Nthing in this chater is intended, r shuld be

2 2 cnstrued, t change r affect an law cncerning cllective bargaining r cllective bargaining agreements in the building and cnstructin industr ther than: (1) a law that ermits agreements that wuld require membershi in a labr rganizatin; (2) a law that ermits agreements that wuld require the ament f dues, fees, assessments, r ther charges f an kind r amunt t a labr rganizatin; r (3) a law that ermits agreements that wuld require the ament t a charit r a third art f an amunt that is equivalent t r a r rata art f dues, fees, assessment, r ther charges required f members f a labr rganizatin; as a cnditin f emlment. Sec. 4. As used in this chater, "emler" means: (1) a ersn emling at least ne (1) individual in Indiana; r (2) an agent f an emler described in subdivisin (1). Sec. 5. As used in this chater, "labr rganizatin" means: (1) an rganizatin; (2) an agenc; (3) a unin; r (4) an emlee reresentatin cmmittee; that exists, in whle r in art, t assist emlees in negtiating with emlers cncerning grievances, labr disutes, wages, rates f a, r ther terms r cnditins f emlment. Sec. 6. As used in this chater, "ersn" means: (1) an individual; (2) a rrietrshi; (3) a artnershi; (4) a firm; (5) an assciatin; (6) a crratin; (7) a labr rganizatin; r (8) anther legal entit. Sec. 7. As used in this chater, "the state" includes: (1) a bard; (2) a branch; (3) a cmmissin; (4) a deartment; (5) a divisin; (6) a bureau; (7) a cmmittee;

3 3 (8) an agenc; (9) an institutin (including a state educatinal institutin as defined in I ); (10) an authrit; r (11) anther instrumentalit; f the state. Sec. 8. A ersn ma nt require an individual t: (1) becme r remain a member f a labr rganizatin; (2) a dues, fees, assessments, r ther charges f an kind r amunt t a labr rganizatin; r (3) a t a charit r third art an amunt that is equivalent t r a r rata art f dues, fees, assessments, r ther charges required f members f a labr rganizatin; as a cnditin f emlment r cntinuatin f emlment. Sec. 9. A cntract, agreement, understanding, r ractice, written r ral, exress r imlied, between: (1) a labr rganizatin; and (2) an emler; that vilates sectin 8 f this chater is unlawful and vid. Sec. 10. A ersn that knwingl r intentinall, directl r indirectl, vilates sectin 8 f this chater cmmits a lass A misdemeanr. Sec. 11. An individual wh is emled b an emler ma file a cmlaint that alleges a vilatin r threatened vilatin f this chater with the attrne general, the deartment f labr, r the rsecuting attrne f the cunt in which the individual is emled. Un receiving a cmlaint under this sectin, the attrne general, deartment f labr, r rsecuting attrne ma: (1) investigate the cmlaint; and (2) enfrce cmliance if a vilatin f this chater is fund. In additin t an ther remed available under this chater, if the deartment f labr determines that a vilatin r a threatened vilatin f this chater has ccurred, the deartment f labr ma issue an administrative rder rviding fr an f the civil remedies described in sectin 12 f this chater. The deartment f labr ma adt rules under I , including emergenc rules under I , t carr ut its resnsibilities under this chater. Sec. 12. (a) If an individual suffers an injur: (1) as the result f an act r ractice that vilates this chater; r

4 4 (2) frm a threatened vilatin f this chater; the individual ma bring a civil actin. (b) A curt ma rder an award f an r all f the fllwing t an individual wh revails in an actin under subsectin (a): (1) The greater f: (A) actual and cnsequential damages resulting frm the vilatin r threatened vilatin; r (B) liquidated damages f nt mre than ne thusand dllars ($1,000). (2) Reasnable attrne's fees, litigatin exenses, and csts. (3) Declaratr r equitable relief, including injunctive relief. (4) Other relief the curt cnsiders rer. (c) The remedies and enalties set frth in subsectin (b) are: (1) cumulative; and (2) in additin t ther remedies and enalties imsed fr a vilatin f this chater. Sec. 13.
