As used in this chater, "drug dealing ffense" 12 means ne (1) r mre f the fllwing ffenses: 13 (1) Dealing in ccaine r a narctic drug (I ), unless 14 the ersn received nl minimal cnsideratin as a result f the 15 drug transactin. 16 (2) Dealing in methamhetamine (I ), unless the 17 ersn received nl minimal cnsideratin as a result f the drug 18 transactin. 19 (3) Dealing in a schedule I, II, III, IV, r V cntrlled substance 20 (I thrugh I ), unless the ersn received 21 nl minimal cnsideratin as a result f the drug transactin. 22 (4) Dealing in marijuana, hash il, hashish, salvia, r a snthetic 23 cannabinid (I ), unless the ersn received nl 24 minimal cnsideratin as a result f the drug transactin. 25 (5) Dealing in marijuana (I ) as a feln, unless 26 the ersn received nl minimal cnsideratin as a result f 27 the drug transactin. 28 SETION 7. I IS ADDED TO THE INDIANA ODE 29 AS A NEW HAPTER TO READ AS FOLLOWS [EFFETIVE 30 JULY 1, 2013]: 31 hater 6.5. Industrial Hem 32 Sec. 1. The fllwing terms al thrughut this chater: 33 (1) "Agricultural hem seed" means annabis sativa seed 34 that meets an labeling, qualit, and ther standards set b 35 the deartment and that is intended fr sale r is sld t, r 36 urchased b, licensed grwers fr lanting. 37 (2) "r" means an cntiguus field f industrial hem 38 grwn under a single license. 39 (3) "Grwer" means a ersn, jint venture, r cerative 40 that rduces industrial hem. 41 (4) "Handler" means a ersn, jint venture, r cerative 42 that receives industrial hem fr scientific research, r fr

7 6 1 rcessing int cmmdities, rducts, r agricultural hem 2 seed. 3 (5) "Industrial hem" means: 4 (A) all nnseed arts and varieties f the annabis sativa 5 lant, whether grwing r nt, that cntain a cr-wide 6 average tetrahdrcannabinl cncentratin that des nt 7 exceed three-tenths f ne ercent (0.3%) n a dr weight 8 basis; r 9 (B) an annabis sativa seed that is: 10 (i) art f a grwing cr; 11 (ii) retained b a grwer fr future lanting; r 12 (iii) fr rcessing int, r use as, agricultural hem 13 seed. 14 The term des nt include industrial hem cmmdities r 15 rducts. 16 Sec. 2. (a) The rductin f, ssessin f, scientific stud f, 17 and cmmerce in industrial hem is authrized in Indiana. 18 Industrial hem is an agricultural rduct that is subject t 19 regulatin b the deartment. 20 (b) All grwers and handlers must have an industrial hem 21 license issued b the deartment. Grwers and handlers engaged 22 in the rductin f agricultural hem seed must als have an 23 agricultural hem seed rductin ermit. 24 (c) An alicatin fr an industrial hem license r agricultural 25 hem seed rductin ermit must include the fllwing: 26 (1) The name and address f the alicant. 27 (2) The name and address f the industrial hem eratin f 28 the alicant. 29 (3) The glbal sitining sstem crdinates and legal 30 descritin fr the rert used fr the industrial hem 31 eratin. 32 (4) If the industrial hem license r agricultural hem seed 33 rductin ermit alicatin is made b a grwer, 34 infrmatin sufficient t establish that the industrial hem 35 cr f the alicant will be at least tw and ne-half (2 1/2) 36 acres in size. 37 (5) An ther infrmatin required b the deartment. 38 (d) An industrial hem license r agricultural hem seed 39 rductin ermit is valid fr a three (3) ear term unless revked. 40 The license r ermit ma be renewed in accrdance with rules 41 adted b the deartment. An industrial hem license r 42 agricultural hem seed rductin ermit is nntransferable.

8 7 1 (e) An agricultural hem seed rductin ermit authrizes a 2 grwer r handler t rduce and handle agricultural hem seed 3 fr sale t licensed industrial hem grwers and handlers. A seller 4 f agricultural hem seed shall ensure that the seed cmlies with 5 an standards set b the deartment. The deartment shall make 6 available t grwers infrmatin that identifies sellers f 7 agricultural hem seed. 8 (f) Subject t deartment guidelines, a grwer ma retain seed 9 frm each industrial hem cr t ensure a sufficient sul f 10 seed fr that grwer fr the fllwing ear. A grwer des nt need 11 an agricultural hem seed rductin ermit in rder t retain 12 seed fr future lanting. Seed retained b a grwer ma nt be sld 13 r transferred and is nt required t meet the deartment's 14 agricultural hem seed standards. 15 (g) Ever grwer r handler must kee recrds in accrdance 16 with rules adted b the deartment. Un at least three (3) das 17 ntice, the deartment ma audit the required recrds during 18 nrmal business hurs. The deartment ma cnduct an audit fr 19 the urse f ensuring cmliance with: 20 (1) this chater; 21 (2) rules adted b the deartment; r 22 (3) industrial hem license r agricultural hem seed 23 rductin ermit requirements, terms, r cnditins. 24 (h) In additin t an audit cnducted in accrdance with 25 subsectin (g), the deartment ma insect an industrial hem 26 cr during the cr's grwth hase and take a reresentative 27 cmsite samle fr field analsis. If a cr cntains an average 28 tetrahdrcannabinl cncentratin exceeding three-tenths f ne 29 ercent (0.3%) n a dr weight basis, the deartment ma detain, 30 seize, r embarg the cr. 31 (i) The deartment ma charge grwers and handlers a 32 reasnable fee as determined b the deartment. 33 Sec. 3. (a) In additin t an ther liabilit r enalt rvided 34 b law, the deartment ma revke r refuse t issue r renew an 35 industrial hem license r an agricultural hem seed rductin 36 ermit and ma imse a civil enalt fr a vilatin f: 37 (1) a license r ermit requirement; 38 (2) license r ermit terms r cnditins; r 39 (3) a rule relating t grwing r handling industrial hem. 40 (b) The deartment ma nt imse a civil enalt under this 41 sectin that exceeds tw thusand five hundred dllars ($2,500).

I , AS AMENDED BY P.L , 7 SETION 34, IS AMENDED TO READ AS FOLLOWS [EFFETIVE 8 JULY 1, 2013]: Sec. 14. (a) A ersn hlding a certificate r license 9 issued under this article must cml with the alicable standards and 10 rules established under this article. A certificate hlder r license 11 hlder is subject t discilinar sanctins under subsectin (b) if the 12 deartment f hmeland securit determines that the certificate hlder 13 r license hlder: 14 (1) engaged in r knwingl cerated in fraud r material 15 decetin in rder t btain a certificate r license, including 16 cheating n a certificatin r licensure examinatin; 17 (2) engaged in fraud r material decetin in the curse f 18 rfessinal services r activities; 19 (3) advertised services r gds in a false r misleading manner; 20 (4) falsified r knwingl allwed anther ersn t falsif 21 attendance recrds r certificates f cmletin f cntinuing 22 educatin curses required under this article r rules adted 23 under this article; 24 (5) is cnvicted f a crime, if the act that resulted in the 25 cnvictin has a direct bearing n determining if the certificate 26 hlder r license hlder shuld be entrusted t rvide emergenc 27 medical services; 28 (6) is cnvicted f vilating I ; 29 (7) fails t cml and maintain cmliance with r vilates an 30 alicable rvisin, standard, r ther requirement f this article 31 r rules adted under this article; 32 (8) cntinues t ractice if the certificate hlder r license hlder 33 becmes unfit t ractice due t: 34 (A) rfessinal incmetence that includes the undertaking 35 f rfessinal activities that the certificate hlder r license 36 hlder is nt qualified b training r exerience t undertake; 37 (B) failure t kee abreast f current rfessinal ther r 38 ractice; 39 () hsical r mental disabilit; r 40 (D) addictin t, abuse f, r deendenc n alchl r ther 41 drugs that endanger the ublic b imairing the certificate 42 hlder's r license hlder's abilit t ractice safel;

A certified c f the recrd f discilinar actin is 34 cnclusive evidence f the ther jurisdictin's discilinar actin. 35 (e) The deartment f hmeland securit ma rder a certificate 36 hlder r license hlder t submit t a reasnable hsical r mental 37 examinatin if the certificate hlder's r license hlder's hsical r 38 mental caacit t ractice safel and cmetentl is at issue in a 39 discilinar rceeding. Failure t cml with a deartment f 40 hmeland securit rder t submit t a hsical r mental examinatin 41 makes a certificate hlder r license hlder liable t temrar 42 susensin under subsectin (i).

12 11 1 (f) Excet as rvided under subsectin (a), subsectin (g), and 2 sectin 14.5 f this chater, a certificate r license ma nt be denied, 3 revked, r susended because the alicant, certificate hlder, r 4 license hlder has been cnvicted f an ffense.
