1 P a g e 1 Marywd University Undergraduate Student Gvernment Assciatin Cnstitutin Ratified: Octber 20, 2015 Jint Statement f Rights and Freedms Academic institutins exist fr the transmissin f knwledge, the pursuit f truth, the develpment f students, and the general well-being f sciety. Free inquiry and free expressin are indispensable t the attainment f these gals. As members f the academic cmmunity, students are encuraged t develp the capacity fr critical judgment and t engage in a sustained and independent search fr truth. Freedm t teach and freedm t learn are inseparable facets f academic freedm. The freedm t learn depends upn apprpriate pprtunities in the classrm, n the campus and in the larger cmmunity. Students shuld exercise their freedm with respnsibility. The respnsibility t secure and t respect general cnditins cnducive t the freedm t learn is shared by all members f the academic cmmunity. Each cllege and university has a duty t develp plicies and prcedures, which prvide and safeguard this freedm. Such plicies and prcedures shuld be develped at each institutin within the framewrk f general standards and with the bradest pssible participatin f the members f the academic cmmunity. Agreeing with this statement by the Jint Cmmissin n the Rights and Freedms f Students, Marywd University sets frth the prcedures, rights, respnsibilities, and guidelines utlined in this handbk as indispensable fr achieving the gals desired: freedm t teach, t learn, and t search fr truth. Frm "Student Rights and Freedms" NASPA, Washingtn, D.C., Nvember 1992 Student Gvernment Assciatin (SGA) Missin The Undergraduate Student Gvernment Assciatin f Marywd University serves nt nly as the vice f the undergraduate students, but als the link between faculty and staff. Adhering t the cre values f Marywd, these student leaders will d everything in their pwer t exercise their leadership skills t represent the student bdy.

2 P a g e 2 Article I. Name and Purpse Sectin I. Name The rganizatin shall be named the Undergraduate Student Gvernment Assciatin f Marywd University, which shall be referred t as the SGA thrughut the remaining dcument. Sectin II. Purpse T serve as the vice f the undergraduate student bdy; T advcate and pursue changes in Marywd University plicy that enrich r enhance the quality f student life; T uphld the SGA Cnstitutin and fllw the prcedures set frth within the Cnstitutin and by-laws in all matters pertaining t the SGA; And as utlined by the student handbk and calendar. Article II. Structure Sectin I. General Assembly Purpse T prvide a frum where undergraduate students may bserve the functining f the SGA and vice their cncerns and/r suggestins t all SGA fficers; T hld the final vte n all issues riginating frm cmmittees; T cnsider new ideas r issues established by fellw undergraduate students and direct them t the apprpriate Huse f Representative member fr further investigatin; T review prgress f all cmmittee meetings as submitted each meeting by their respective cmmittee chairs and secretaries; And t allw nn-elected students t participate in the SGA. Regulatins Each meeting shall be advertised t the University cmmunity at least ne week befre its scheduled time. Advertisements must clearly state the date, time, and lcatin f the meeting as well as cnvey that the meeting is pen t all undergraduate students. Each meeting must be pen t all undergraduate students and be held in a lcatin that can cmfrtably accmmdate the expected meeting turnut. Meetings are t be held n less than nce every tw weeks unless cancelled due t extenuating weather cnditins r sme ther emergency situatin. Any meeting cancellatin shall be relayed t all SGA members and psted at the advertised lcatin f the meeting. Members shall include the Executive Cabinet, the Huse f Representatives, the Senate, and the Senatrs at large. All members, with the exceptin f the SGA at large, shall btain vting pwers during their term. Prcedures The Secretary shall recrd meeting minutes at every General Assembly meeting.

3 P a g e 3 Each meeting shall begin with a call t rder, fllwed by rll call, and then the apprval f the minutes frm the previus meeting. Each f these prcedures must be cmpleted thrugh a mtining prcess. Each meeting shall prceed accrding t an agenda prepared by the President. This agenda must be apprved by the advisr f the SGA and presented t all thse in attendance during the meeting. Each meeting shall include an alltted amunt f time fr Cmmittee Meetings, during which members and guests may intrduce new gals as well as discuss the status f n-ging gals until they reach reslutin. It shall be during these meetings that Senatrs and Huse f Representatives cllabrate in wrking twards their cmmittee s gals. Each meeting shall include a Cmmittee Reprts sectin, allwing fr the cmmittees t update the General Assembly n the prgress made during their Cmmittee Meetings. Each meeting shall include an Open Flr sectin, during which anyne in attendance may speak. Each meeting shall cnclude with the adjurnment prcedure, which must be cmpleted thrugh a mtining prcess. An example agenda with all f these prcedures can be fund the Appendix I f the Undergraduate Student Gvernment Assciatin Cnstitutin. Sectin II. Executive Cabinet Purpse T versee the SGA and preside ver the General Assembly Expectatins/Respnsibilities T meet with the Adviser every tw weeks as a cabinet t discuss prgress f the SGA and push frward with new ideas; With the exceptin f the President, each member f the Executive Cabinet shall serve as a Cmmittee Chair; T attend SGA trainings including fall training. And t attend all General Assembly meetings. Psitins The members f the Executive Cabinet shall include the President, Vice President, Secretary, Public Affairs Officer, and the Head f Senate. Detailed descriptins f these psitins can be fund in Appendix II f the Undergraduate Student Gvernment Assciatin Cnstitutin. Sectin III. Senate Purpse T be the vice f the undergraduate student bdy, relaying any prblems, questins, and/r cncerns students may have t the Huse f Representatives; And t serve as researchers in cllabratin with the Huse f Representatives t accmplish cmmittee gals. Expectatins/Respnsibilities

4 P a g e 4 T cllabrate with the SGA in the psitive reslutin f student cncerns thrugh dialgue with class peers, ther members f the SGA, and, at times, University fficials; T be respnsible, easily cmmunicable/accessible, and willing t wrk with their fellw peers, members f the SGA, and members f the Marywd Cmmunity; T attend all SGA trainings T serve n assigned SGA cmmittees And t attend all General Assembly meetings. Psitins The members f the Senate shall include the Head f Senate, Class Senatrs, and the SGA at large. Detailed descriptins f these psitins can be fund in Appendix III f the Undergraduate Student Gvernment Assciatin Cnstitutin. Sectin IV. Huse f Representatives Purpse T serve as the liaisn and cnnectr f relatins between the SGA and the area f the Marywd faculty r staff; And t serve as researchers in cllabratin with the Senate t accmplish cmmittee gals. Expectatins/ Respnsibilities T facilitate cntinuus relatins between students and departments by establishing and maintaining strng lines f cmmunicatin with their designated faculty r staff area; T meet at least nce a mnth with their designated departments, relaying any questins and/r cncerns frm any student t their expertise in a timely manner; T attend all SGA trainings T serve n assigned SGA cmmittees And t attend all General Assembly meetings. Psitins The members f the Huse f Representatives shall include the Resident Representative, the Cmmuter Representative, the Athletics Representatives, the Campus Ministry Representative, the Student Activities Representative, the University Offices Representative, the Security Representative, the Fd Services Representative, the Cllege f Liberal Arts and Sciences Representative, the Cllege f Health and Human Services Representative, the Insalac Cllege f Creative and Perfrming Arts Representative, the Reap Cllege f Educatin and Human Develpment Representative, and the Schl f Architecture Representative. Detailed descriptins f these psitins can be fund in Appendix IV f the Undergraduate Student Gvernment Assciatin Cnstitutin.

5 P a g e 5 Sectin V. Advisr Appintment f Advisr The advisr shall be the Directr f Student Activities and Leadership Develpment (SALD). Purpse T serve as the direct advisr fr the Executive cabinet; And t serve as the verall advisr fr t the SGA. Respnsibilities/Expectatins T serve as the administrative link/surce f knwledge fr any member f the SGA in any matter and seek knwledge fr any matter necessary; T assist in prviding infrmatin and advice n hw/where t pursue infrmatin relating t issues facing the SGA; T preside ver SGA training; T meet with members f the Executive Cabinet regularly at least twice a mnth; And t meet with each member f the executive cabinet every tw weeks in a One-n-One meeting t discuss prgress, issues, cncerns and ideas related t the students psitin n SGA. Pwers The advisr des nt have vting pwer, but shall advise the gvernment in any matter. The advisr shall preside ver any impeachment hearing and prvide an bjective standpint t bth sides being debated. The advisr des have the right in special circumstances (alleged majr vilatin f student cde f cnduct f ther alleged vilatins f mral character) t meet with a member f the SGA t discuss such issues. If the circumstances are cnfirmed, the advisr des have the chice t remve the student frm their psitin. Article III. Training and Attendance Plicy Sectin I. Purpse and Descriptin f Training T insure that all elected members receive adequate infrmatin n hw t perfrm their duties fr the academic year, and knwledge f Rberts Rules f Order. T create rganizatin wide gals and timelines fr each f these gals t be cmpleted fr the academic year. During training, each elected member will be assigned t ne f fur cmmittees. The Vice President, Public Affairs Officer, Head f Senate, and Secretary will chair each f these cmmittees. (Article VI. Sectin III). Each cmmittee will wrk t establish gals and a timeline f cmpetitin during training.

6 P a g e 6 During Fall Training elected members will have the pprtunity t nminate elected senatrs t serve as the Head f Senate fr the academic year. Nminatins and vting fr this psitin will take place at the fall training. The secnd half f fall training will serve as the first fficial General Member Meeting fr the academic year. Sectin II. Dates and Time f Training Training shall take place within the first mnth f the academic schl year. The date and time f training will nt take place while academic curses are in sessin. All training will take place befre r after academic curse hurs. The training will last as lng as needed, and culd take up t a full day if pertinent infrmatin needs t be discussed. Additinal training dates and times may be created thrugh the academic year by the President as needed. Sectin III. Training Attendance Plicy Attendance n all training dates is mandatry fr elected members f SGA. Training will take place n a time and date where academic curses will nt take place t ensure all student participatin. Elected members wh are unable t attend training fr persnal reasns will be assessed tw absences. Members will frfeit their alltted ne absence per semester (described belw). Any additin absences by these members thrugh the upcming academic year will result in remval frm their psitin Sectin IV. General Meeting Attendance Plicy Attendance f all elected members f the SGA is required at every General Assembly meeting. As a student leader, it is understd that academics cme first. Hwever, hlding an elected psitin is a respnsibility, nt a right. If a member cannt attend fr academic r Marywd spnsred reasns, a twenty-fur-hur-ntice t the Executive Secretary is required via t be cnsidered an excused absence. Failure t d s shall be cnsidered unexcused and shall result in a verbal r written warning f ntificatin frm the Executive Cabinet. If an emergency situatin arises in which ntice cannt be given, it shall be the member s duty t infrm the Executive Secretary f the situatin as sn as pssible t be cnsidered an excused absence. N penalty shall be given fr excused absences. Each elected executive is allwed ne unexcused absence per academic semester. Failure t abide by this plicy shall result in immediate remval frm ffice. Article IV. Electins, Appintments, and Terms f Office Sectin I. Electin Lgistics Spring I- Executive Cabinet Electins

7 P a g e 7 Executive Cabinet Electins are intended t fulfill nly Executive Cabinet psitins. Candidates running fr President and Vice President are t run n ne ticket. Other members f the Executive Cabinet are t campaign and run n separate tickets. Shall take place fur weeks prir t the end f the spring semester. T run fr the psitin f President and r Vice President, the student must have held, at least, the psitin f General Assembly member. Graduating senirs in the Marywd cmmunity are nt eligible t vte fr Executive Cabinet members spring semester f their senir year. Spring II- Huse f Representative and Senate Electins Huse f Representative and Senate Electins are intended t fulfill all psitins within the Huse and the Senate, excluding the psitins f Freshmen Senatrs. Each candidate is t run individually. Shall take place tw weeks prir t the end f the spring semester; tw weeks after Executive Cabinet electins. Graduating senirs in the Marywd cmmunity are nt eligible t vte fr Huse f Representative r Senatr Psitins during spring semester f their senir year. Fall I Campus Wide Electins Fall electins are t take place within the first tw weeks f the fall semester The incming freshman class senatr psitins will be filled during this electin. Fall semester electins will be held t fill any vacant psitins that were nt previusly filled in Spring I and Spring II electins. All first year and returning undergraduate students are eligible t run fr any additinal vacant psitins, as lng as General Requirements fund in Sectin IV are met. Electin f Head f Senate Head f Senate Electins are intended t fulfill the psitin f Head f Senate. T be eligible, candidates must be at least a sphmre senatr. The electin shall be verseen by the Vice President. Senatrs can nminate themselves. Each nminatin shall be addressed t the Vice President and cunted n the ballt. Each candidate shall have tw minutes t state his/her case fr the psitin. A secret ballt shall then be cnducted, which nly the members with vting pwers may participate. The decisins shall be made by a majrity vte. In the event f a tie, the President shall cast their deciding vte. Shall take place at the first General Assembly meeting, during training, f the Fall Semester Advertisements Electins- Advertisements fr electins shall be psted tw weeks befre the date f the electins and shall include infrmatin n hw t run, in additin t when, where, and hw t vte.

8 P a g e 8 Candidate- Advertisements fr individual candidates shuld be apprved by the SALD ffice. Students may inquire with the SALD Office fr apprpriate places t hang advertisements. Sectin II. Special Electins In the event that a psitin becmes vacant mid-term, a special electin shall be held. The special electin is t be annunced at the first General Assembly meeting fllwing the psitin becming pen and held during the fllwing meeting. The electin is t be advertised t all undergraduate students fr the tw weeks fllwing the annuncement. Any undergraduate student is eligible t run fr the psitin, but vting is nly pen t vting members f the SGA. Candidates shall each give a speech and vting shall take place immediately fllwing thrugh secret ballt. The tabulatins shall be made by the members f the executive cabinet, excluding any members wh may be running fr a psitin. The decisin shall be made by a simple majrity vte. In the event f a tie, the President shall cast their deciding vte. Sectin III. Crdinatr The Vice President shall preside ver all annual electin prceedings including publicity, electin prcedures, and tallying. The Vice President shall als be the main pint f cmmunicatin fr all candidates. Sectin IV. General Qualificatins T be eligible t campaign fr a seat n the SGA the fllwing qualificatins must be met: T qualify as an Executive Officer yu must have participated as a General Member with vting rights fr a minimum f ne academic year. Must be a student in gd academic and judicial standing (If the student des have vilatins f either, r, r bth, the advisr f the SGA shall make a character call and have the final say as t if the student can run fr ffice); Must have a GPA f at least 2.50; Must be a full-time undergraduate student; And must submit t the Executive Cabinet an applicatin fr candidacy at least ne week befre the electins date. Sectin V. Term Limits and Study Abrad The term limit fr every SGA Officer is ne academic year beginning in the Fall Semester after they are elected. Freshmen student terms begin immediately after their electin int ffice. In the case f special electins, terms shall last frm the time f electin until the cnclusin f the academic year. If an elected member wishes t study abrad fr a semester they must uphld all respnsibilities while abrad. This includes cnversing with respective faculty r administratin. All reprts required t be giving during General Member Meetings must be relayed and appinted by a current member present at the meetings.

9 P a g e 9 Vlunteers will first be sught t assist the bard member while they are abrad. If there are multiple members wh wish t assist, a special electin will be held. If there are n members wh wish t assist in the reprting, the President wuld assume the respnsibilities until a member can be fund. They must let the executive cabinet knw in advance what meetings they will nt be attending in rder t avid being marked absent. Sectin VI. Prcedures Specific electin prcedures are t be left pen fr further prgress. Examples include ballt bxes, nline vting, etc. Hwever, all methds used fr electins shall be available fr all undergraduate students, allwing nly ne vte per student, per electral prcess. Sectin VII. Tabulatin and Results The Vice President, with assistance frm the Adviser, shall be respnsible fr the tabulatin f vtes within twenty-fur hurs f the plls clsing. All candidates shall be infrmed f the results befre they becme public and shall be ntified via immediately fllwing the tabulatin f the vtes. Article V. Vacancies/Remval frm Office Sectin I. President Shuld the psitin f the President becme vacant mid-term, the Vice President shall succeed. The new President shall remain in ffice fr the remainder f that term. Sectin II. Vice President, Secretary, Public Affairs Officer Shuld the psitin f Vice President, Secretary r Public Affairs Officer becme vacant mid-term, the President shall appint a present member. The new appinted member shall remain in ffice fr the remainder f that term. Sectin III. Head f Senate Shuld the psitin f Head f Senate becme vacant mid-term, a new Head f Senate shall be elected. (Article IV. Sectin I) All current Senatrs are eligible t run fr this vacant psitin. The electin shall be annunced at the first General Assembly meeting fllwing the psitin becming vacant and held during the fllwing meeting. Advertisements fr this vacant psitin shall be made t all current Senatrs between the tw afrementined meetings. During the electin, each candidate shall give a speech and vting shall take place immediately fllwing thrugh secret ballt. Vting shall nly be pen t members f the SGA with vting pwers.

Abuse/misuse f pwer Insufficient time t accmplish tasks Actins unbecming f a member f SGA Unbecming actins include any participatin in illegal activities, vilatin f the Marywd Handbk, r immral behavir. Article VI. Cmmittees Sectin I. Existence Cmmittees shall be created r ablished based n the needs f the current Marywd envirnment. Thus said, cmmittees shall be created by the discretin f the SGA Executive Cabinet depending n the gals set frth. The creatin f cmmittees will take place during fall training, and must be vted n at the first meeting f the year by the General Assembly (Article III. Sectin I) t ensure there is cmmn interest in each created cmmittee. Examples f cmmittees include: Academic Cmmittee, Student Issues, IT services, Fd Services, etc. At SGA training the rles and descriptins f each cmmittee shall be described t all members. Members frm the Executive Cabinet, Huse f Representatives, and Senate shall be assigned t their cmmittees at this time. (Article III. Sectin I) Sectin II. Purpse T bring tgether the SGA members with similar interests and prvide a frum fr thse members t accmplish gals. By dividing the General Assembly int cmmittees, mre gals can be accmplished within different areas f the University. Sectin III. Cmmittee Chairs

11 P a g e 11 Chairs f the cmmittees shall be an Executive Cabinet member that has specific interest in that cmmittee s gals. Their duties shall include guiding the students in the cmmittee and assisting the cmmittee in crdinatin f respnsibilities and prviding insight and advice when needed. Key cmpnents t success include: delegatin, cmmunicatin, setting gals and assigning tasks in between meetings. Sectin IV. Membership Members f the Senate and Huse f Representatives shall be assigned t cmmittees by the Executive Bard. Members f the Executive Cabinet have the right t mve cmmittee members at any time deemed necessary and beneficial t the SGA rganizatin. New members are welcme t jin cmmittees thrughut the year. These new members shall be infrmed f current prgress f gals and being wrk n thse gals. Sectin V. Expectatins/Respnsibilities f Cmmittee Chairs and Members It is the expectatin and respnsibility f Cmmittee Chairs t insure all cmmittee members have a delegated wrk lad, and all gals are n the required timeline t cmpletin. Cmmittee members are t actively participate in cmmittee meetings, trainings, as well as utside assignments. Failure t d s can result in remval frm ffice. Sectin VI. Regulatins The list f the cmmittees shall be stated in Appendix VI f the Cnstitutin f the Undergraduate Student Gvernment. Since issues facing the SGA can and d change thrughut the years, the names and purpses f the cmmittees shall be chsen by the executive cabinet during SGA training. Therefre the list and the Appendix shall be updated prir t each academic year. The cmmittees may als change thrughut the year if a cmmittee has cmpleted all f its tasks in the eyes f the executive cabinet. If this ccurs, the President has the right t disslve the cmpleted cmmittee and name a new cmmittee. By default, the members f the ld cmmittee shall becme members f the newly created cmmittee. Sectin VII. Prcedures Meetings shall ccur at an alltted time slt within the regularly scheduled General Assembly meeting. This time slt shall be annunced by the President at each meeting prir t breaking up int cmmittees. The secretary f each cmmittee shall be appinted by the Cmmittee Chair, therefre cannt be a member f the Executive Cabinet. Each meeting, the secretary f the cmmittee must review the previus meeting s minutes and updates shall be prvided n the afrementined tpics. Each meeting shall include a wrkshp cnsisting f discussin explaining hw the infrmatin presented can be used t further advance prgress f the gal.

12 P a g e 12 Article VII. Funding Allcatin and Budgets Sectin I. Funding & Budgets SGA shall have exclusive versight f their yearly allcated budget frm Marywd University. SGA has full authrity t allcate these funds t individuals, rganizatins, and departments as deemed necessary. SGA reserves the right t grant r deny any funding request brught frth. Sectin II. Oversight The Head f Senate shall versee all funding requests n submitted n behalf f recgnized-funded rganizatins, individuals, and departments. Decisins fr funding requests are made by the Executive Cabinet during their bi-weekly meetings with the adviser. Sectin III. Timeline fr Apprval All funding requests must be submitted t the Head f Senate a minimum f three weeks prir t when funding is needed. After allcatins have been apprved, an individual frm the requesting grup must sign a cntractual agreement and return t SGA within five business days. Withut a return f cntract, SGA has the right t rescind the funding ffer. Sectin IV. Individual Funding Requests SGA will cnsider a limited amunt f individual undergraduate cnference funding requests. SGA will nly cnsider reimbursement f the individual s registratin fee fr the cnference. Undergraduate individuals are ineligible t request funds fr transprtatin, htel, r fd. Sectin IV. Recgnized Funded Student Organizatin Requests All recgnized, funded undergraduate student rganizatins are eligible fr SGA funding while acting in accrdance with the fllwing stipulatins. The rganizatin must re-recgnize within the first three weeks f the fall semester Tw members f the rganizatin must attend all Cuncil f Clubs meetings. The rganizatin must cmplete a service prject thrugh Campus Ministry each semester. The rganizatin must submit an End f Semester Reprt at the cnclusin f each academic semester. All paperwrk must be submitted t the Graduate Assistant f Student Activities prir t submissin t SGA t insure the rganizatin is in cmpliance befre funding requests will be cnsidered. Article VIII. Amendments

13 P a g e 13 Sectin I. Definitin An amendment shall be defined as any change t the physical wrding and cntent f the Cnstitutin f the SGA. An amendment culd be an additin t the cnstitutin, the remval f part f the cnstitutin, r bth. Sectin II. Prpsal f Amendment Prcedure An amendment can be created by any elected member f the SGA. The prpsal must be typed and prperly detailed. The authr must als prvide a written explanatin t what wuld be changing within the cnstitutin if this amendment passes. The amendment must have five signatures in rder t be frmally prpsed t the general assembly fr vting: The authr, 2 members f the Huse f Representatives and 2 Senatrs Once fficial, the amendment must be sent t the President t review and t be placed n the agenda fr the next SGA Meeting. The President shall send ut the prpsed amendment via t the SGA prir t the next SGA meeting. Sectin III. Presentatin f Amendment Prcedure This must nly take place at an SGA meeting where there are at least 60% f the vting members present. The authr f the amendment shall present the amendment t the SGA, reading it thrughly and prviding any backgrund infrmatin related t the creatin f the amendment. The authr shall field questins frm the General Assembly abut the amendment; this prcess shall nt t exceed ten minutes. After ten minutes have passed, the President shall then begin the ratificatin prcess. Sectin IV. Ratificatin Prcess The President shall preside ver the Ratificatin Prcess. This prcess is set in place t make any changes (if felt necessary by the SGA) t the amendment as well as t pass the amendment. Changes t Amendments Any elected member f SGA can prpse a change, r amendment t the amendment. This must be dne verbally and must be acknwledged by the President. Once acknwledged, the authr f the change has the pprtunity t explain the change. After explanatin, the authr shall field questins fr n mre than five minutes. Once the time has elapsed, there shall be an immediate vte n the change t the amendment. The President shall cnduct the vte, dne by shw f hands. A simply majrity shall pass the change t the amendment. There shall be a limit f nly three pssible changes f an amendment. Ratificatin f Amendment
