1 PLEDGE OF ALLEGIANCE Pledge and presentation of the colors ceremony lead by the Girl Scouts, the following scout members attended: Ally Nelson, Sylvia Baumgardner, Abbi McGee, Sophia Stiles, Olivia Marshall, Kammie Ludwig, Amanda Boyer, Faith Douglas, Megan Plum, Eva Schmitt, Taunya McGee, Jennifer Nelson, Jennifer Stiles, Marcia Boyer, Kim Douglas, and Erin Marshall. The participating Girl Scouts were from the following troops: Cadette & Senior Girl Scout Troop 1320, Junior Girl Scout Troop 8049, Brownie Girl Scout Troop 8655, Brownie Girl Scout Troop 8976, Daisy Girl Scout Troop 5733, and Daisy Girl Scout Troop Scout leaders that were present were Taunya McGee, Brownie Girl Scout Troop 8655 Leader and Cole cabin Day Camp Director and Jennifer Nelson, Brownie Girl Scout Troop 8976 Leader. ROLL CALL The City Council of the City of Geneseo met Tuesday, at the Council Chambers, 115 South Oakwood Avenue. Mayor Linda Van Der Leest called the meeting to order at 6:03 PM. Aldermen Bob Wachtel, Jeanne Hartsock, Keith Kennett, Doug Crowe, Derek Betcher and Justin Snodgrass, answered roll call. Alderman Howard Beck was absent. Also in attendance was City Attorney Virgil Thurman, City Administrator Jim Hughes, City Clerk Loree K. Phlypo, Director Rice, Building Inspector Mills, and Chief Piotrowski were present. Also in attendance Brian DeJohn from the Chamber of Commerce, Greg Ryckaert from Missman Stanley audience members and the press. CHAMBER OF COMMERCE REPORT Mayor Van Der Leest stated that Brian DeJohn didn t have anything to report for the Chamber and that he has been busy with the remodel and administrative duties. It was opened up if anyone had any questions for him, there were none. City Engineering Greg Ryckaert from Missman Stanley reported that they have a new plan for S. State St. Director Rice stated that he hasn t had a chance to go over the new plans, but he will soon. MAYORAL COMMENTS Mayor Van Der Leest recognized Alderman Lowell Ewert for his 25 Years of service to the City of Geneseo. Alderman Ewert was accompanied by several family members and was presented a plaque from the City. There was a standing ovation from all in attendance. Mayor Van Der Leest introduced the newest Police officer on Geneseo s police force, Tim Wise, Officer Wise comes to us from a nearby town. Officer Wise had 2 of his 3 children with him. Mayor Van Der Leest and Council welcomed Officer Wise. Mayor Van Der Leest stated that at the next meeting other new employees from other departments would be here to introduce themselves. 2 Kathy Allen led a prayer for the City. City of Geneseo, Henry County, Illinois CONSENT AGENDA APPROVED BY OMNIBUS VOTE 1. Approval of minutes from City Council meeting February 14, Approval of minutes from Public Hearing on February 14, Approval of minutes from the Committee of the Whole on February 28, Consent agenda items accepted with a corrections to City Council Minutes from February 14, 2012, to page 6 adding Motion by Hartsock, second by Wachtel, an amendment to page 7 adding Voice Vote to entering into Executive Session and page 8 adding Voice Vote with Alderman Ewert absent. Motion by Betcher, second by Crow to accept agenda items as amended. Voice Vote: 6 Ayes, 0 Nays, Beck Absent Proclamations Mayor Van Der Leest proclaimed the celebration of the Girl Scouts 100 year Anniversary with a motion by Kennett, second by Wachtel. All Scouts participating recited the Girl Scout Pledge and introduced themselves and shared what was their favorite badge they had earned. Mayor Van Der Leest proclaimed April 8-14, 2012 to be National Public Safety Telecommunications Week with a motion by Hartsock, second by Crow. ORDINANCES Consideration of Ordinance O , An Ordinance Amending Section of Title IX to Burning of General Regulations of Geneseo s City Code. City Attorney Thurman led discussion and explained that he had updated the wording from the last meeting eliminating the 5 year period for reevaluation of the permit. Thurman felt that this would be unwarranted and by having the paragraph added that states such permit may be subject to review, modification, suspension or termination in the event that any of the circumstances upon which it was issued has changed, would be sufficient to give the City control for unforeseen future changes. Also Thurman added that there would also be control within the individual agreements signed for Annexations. Motion to approve Ordinance O An Ordinance amending section of Title IX of the Burning Regulations of Geneseo s City Code by Snodgrass, second by Kennett.

3 AYES: 6 Wachtel, Hartsock, Kennett, Betcher,Crow,Snodgrass PRESENT: 0 Consideration of Ordinance O , An Ordinance Amending Ordinance No known as the code for the City of Geneseo by amending title 6, Chapter 10, City Operations: Brush Pickup, to establish rules for access to the City tree and brush burning area and for restrictions and fines for violation of said rules. Director Rice explained that this is to allow applicants to pay a $400 fee and be able to keep the Key to the burn pile for a year and the daily fee is going from $25 to $50. The bold, italics outline the updates to the Ordinance and the word contractor was replaced with applicant due to the fact the certain entities that could qualify for this program may not be contractors. Motion to approve An Ordinance amending Ordinance No known as the code for the City of Geneseo by amending Title 6, Chapter 10, City Operations: Brush Pickup, to establish rules for access to the City Tree and Brush Burning Area and for Restrictions and Fines for Violation of Said Rules by Hartsock, second by Wachtel. AYES: 6 Wachtel, Hartsock,Kennett,Betcher,Crow,Snodgrass RESOLUTIONS R A Resolution Authorizing the Mayor Pro-Tem to Sign and The City Clerk to Attest a Land Purchase Agreement between the City of Geneseo and First United Methodist Church. Motion to approve A Resolution Authorizing the Mayor Pro-Tem Wachtel to Sign and the City Clerk to Attest to a Land Purchase Agreement between the City of Geneseo and First United Methodist Church by Crow, second by Kennett. AYES: 4 Wachtel, Hartsock,Kennett,Crow ABSTAIN: 2 Betcher,Snodgrass R A Resolution in Opposition of Small Arms Manufacturing Bill HB1294. Mayor Van Der Leest stated that this bill would have a devastating effect on the economy of this community. Henry County has approved support of this bill and sent out a Letter to send in support of Municipalities and the Mayor had the City Clerk draft letters to be sent to all State Senators and Representatives. City Attorney Thurman added that passing this Resolution just establishes the City s position on this item.

4 Motion to approve A Resolution in Opposition of Small Arms Manufacturing Bill HB 1294 by Crow, second by Hartsock. OTHER BUSINESS Consideration to allow the Insurance Committee to solicit bids for a Health Insurance Advisor. Director Rice led discussion in Accountant Eickman s absence. An Insurance Advisor would assist the committee in sorting through the options for future health insurance for the City employees. They would be able to answer questions and explain terms as they come up. The difference between an Advisor versus a Broker is that an Advisor wouldn t have a vested interest or sales goal. This would be a person who could educate the Insurance Committee so that they could make a valued decision as the committee moves forward. Motion to approve the Insurance Committee to solicit bids for a Health Insurance Advisor and bring the bids back to the June 12, 2012 City Council meeting for approval by Betcher, second by Kennett. Consideration of a Health Insurance Reserve Fund. Finance Director Hughes led the discussion stating that the development of a fund of this type would allow the City to have a rainy day fund. All employees are being budgeted as if they are under the family plan for insurance and the difference between what they actually have is being put in a reserve fund, this will allow us to have funds for an emergency or to cushion in the event that the insurance rates take a jump. This would also help to offset our OPEB liability (Other Post Employment Benefits). A Resolution would control this fund and it will give direction but be limiting to future Councils that the reserve could not be used. Motion to approve Resolution R A Resolution of the City Council of the City of Geneseo, Illinois to Implement a Written Cash Reserve Policy Establishing A Health Insurance Fund by Wachtel, second by Snodgrass. AYES: 6 Wachtel, Hartsock,Kennett,Betcher,Crow,Snodgrass Mayor Van Der Leest stated that the Electric Department documents included are for your information only, if anyone has any questions please contact Director Opsal. Director Rice stated that contracting out the mowing for the North Cemetery worked very well last year and he would like to go out for an RFP again this year, the company that got the

5 contract last year did an awesome job and when it got dry they didn t just come out to get paid they called and asked if we felt that they needed to mow, also the summer Milling/Asphalt projects he would like to go out for an RFP. Alderman Snodgrass asked if they were going to be doing that Microsurfacing and director Rice stated no, due to the fact that it doesn t hold up as well. Motion to approve Director Rice to go out for an RFP for contract mowing in the North Cemetery and bring it back for approval at the April City Council meeting by Wachtel, second by Hartsock. Motion to approve Director Rice to go out for an RFP for Summer Milling and bring it back for approval at the April City Council meeting by Kennett, second by Betcher. Consideration to allow Director Rice to go out for a quote to TV the Sewer Main on Exchange St.. Director Rice stated that this is needed to help determine the next step of renovation of the street surface. A complete reconstruction of E. Exchange St. will be many years down the road, but by viewing the sewers we can determine how bad they are and decide whether an asphalt overlay should be done. Motion to approve Director Rice to bring back a quote to TV the sewer main on Exchange St by Wachtel, second by Betcher Consideration to allow Director Rice to appoint Peerless Service Co. as the lead consultant, engineer and contractor for all 3 City owned water wells. Director Rice stated that he would like to continue to use Peerless due to the long standing history for service that the City has with them and sign an agreement with them for 2 or 3 years. He attached a letter from Mendota, IL where they named Peerless as their Custodian of Wells for their community. Motion to approve appointment of Peerless Service Co. as the lead consultant, engineer and contractor for all 3 City owned water wells by Snodgrass, second by Betcher. Consideration to work on the crossing of the Hennepin Canal out of Lodge Park in Country Manor. Director Rice stated that there is a Trail Enhancement Grant that the City could pursue, but it could end up costing the City $50,000 to $100,000, does the City at this time want to pursue this? A resident had called and asked about constructing a wooden bridge and Director Rice called the DNR and asked about it, but the crossing would have to be tubed and has to have certain specifications for boat passing. It was determined this maybe be something that could draw a community interest in for a fund raiser? Mayor Van Der Leest asked Brian DeJohn what his thoughts were since he was a member of the Friends of the Hennipen Canal, and he stated

6 that they are against it, since it would undermine the work that they are trying to accomplish. This item died due to lack of a motion at this time. Consideration to allow the completion of the CMOM/NPDES Permit requirements. Director Rice stated that this is a Non-Funded Governmental Mandate. This is a complete mapping of the city sewer system, in the past we have had area maps of the sewer system but not a whole one, which is required. We have until May to get this map completed and submitted, this goes over the purchasing policy as it is $25,000 total cost. Mayor left at 7:24pm to make copies and Alderman Wachtel left also at 7:25pm. They both returned at 7:26pm. Copies were handed out showing the cost breakdown of the service, to provide an ACAD drawing will be $12,500, to provide a summary report to the IL E.P.A. will be $7,000 and the cost for an additional mapping for water distribution system is $5,500. Motion to approve engineering work for CMOM/NPDES with Missman Stanley Inc. not to exceed engineering cost of $25,000 by Wachtel, second by Snodgrass. Chief Piotrowski reported that there would be some street closings for Tudi s Bark in the Park on Saturday July 21, 2012 and Geneseo Elementary School PTA on Sunday April 29 th, 2012 This is for informational purposed only Chief and City Attorney Thurman reported that the committee to review the current Liquor Ordinance has been looking specifically at the Special Events section, as there have been problems with distinguishing when a special event license is needed. When an event is by invitation they have determined that a special event license isn t needed. If during the Music Fest the band shelter in the park is used and a Beer Garden is utilized there would have to be a subsection in order to locate the Beer Garden in the park as the City has an Ordinance prohibiting alcohol in the park. Proposals and modifications are ongoing. Chief Piotrowski, Finance Director Hughes and Inspector Mills have brought forth the idea of creating a Municipal Code Enforcement System Information for handling Ordinance violations. Hughes stated that it is a process that allows ordinance violations to be taken out of the court situation that involves all types of crimes, making them seem insignificant. Rock Island County has one and it works very well. The presiding judge is usually a retired judge or attorney. Fines seem to incrementally increase more and have more impact on the offender then in the regular court where ordinance violations don t hold much merit when compared to theft or assault. Inspector Mills stated that we might be able to get some information on this through Bi-State. There was a consensus that it was worth exploring for more information. Motion to instruct City employees and department directors to look into and report back in late summer on creating a Municipal Code Enforcement System Information program for the City of Geneseo by Betcher, second by Kennett.

7 City of Geneseo, Henry County, Illinois Consideration of Building Inspector training. Inspector Mills stated that this training is for 2012 Building Codes, it is in Madison Wisconsin and is a 2 day Seminar. This would allow him to get CEU s toward his current certification. Motion to approve Inspector Mills to attend training on 2012 International Building Codes on May 7-8, 2012 in Madison, Wisconsin by Wachtel, second by Kennett. BILLS, BUDGETS, WARRANTS Consideration of Bills Presented for February Motion to approve payment of February bills by Kennett with a second from Crow. Voice Vote: 6 Ayes, 0 Nays, Beck Absent AUDIENCE COMMENTS There were none. EXECUTIVE SESSION Motion by Wachtel, second by Betcher to enter into executive session at 7:42pm under the following statutes: Pursuant to personnel matter pursuant to: 5ILCS 120/2(c)(1) The appointment, employment, compensation, discipline, performance, or dismissal of specific employees of the public body or legal counsel for the public body, including hearing testimony on a complaint lodged against an employee of the public body or against legal counsel for the public body to determine its validity. Pursuant to Litigation Matters pursuant to: 5ILC 120/2(c)(11) Litigation, when an action against, affecting or on behalf of the particular public body has been filed and is pending before a court or administrative tribunal, or when the public body finds that an action is probable or imminent, in which case the basis for the finding shall be recorded and entered into the minutes of the closed meeting. Pursuant to the operation by a municipality of a municipal utility pursuant to: 5ILCS 120/2(c)(23) The operation by a municipality of a municipal utility or the operation of a municipal power agency or municipal natural gas agency when the discussion involves(i)contracts relating to the purchase, sale, or delivery of electricity or natural gas or

8 (ii)the results or conclusions of load forecast studies. RECONVENE TO OPEN MEETING MOTION BY WACHTEL WITH A SECOND BY HARTSOCK TO RETURN TO REGULAR SESSION AT 8:05PM. Casual Days Motion to approve non-union employees to go from 2 to 3 Casual Days by Hartsock, second by Kennett.
