Roll Call #1: Present: Mayor Salvador Garza, Council Members Ken Goad, W. Wayne Dennis, Russell Fleming, Corine Andersen, Peter Schwartzman, Wayne Allen, and Jeremy Karlin, 8. Also present were City Clerk Kelli Bennewitz, City Manager Todd Thompson, and City Attorney John Hanlon. The Chairman declared quorum present. Council Member Dennis moved, seconded by Council Member Goad, to convene into executive session at 5:30 p.m. to discuss litigation and the approval of the November 7, 2011, and January 23, 2012, executive session minutes (5 ILCS 120/2(c)(1) and (21). Roll Call #2:.. During the Executive Session, Council Member Goad moved, seconded by Council Member Dennis, to adjourn to the regular meeting at 5:54 p.m. Roll Call #3:.. 2 Judy Guenseth, Galesburg Convention & Visitors Bureau Director, presented the CVB Annual Report. CONSENT AGENDA # All matters listed under the Consent Agenda are considered routine by the City Council and will be enacted by one motion Approve Resolution authorizing the submittal of a grant agreement to the Illinois Department of Transportation (IDOT) to fund the parking lot expansion at the Amtrak Station. Total cost of the project is $262,450 and is fully funded with Federal dollars Approve annual support renewal agreement from Enterasys in the amount of $12, Approve annual maintenance agreement from Granicus in the amount of $5, Approve annual agreement with Gallagher Bassett Services, Inc. in the amount of $30, Approve bills in the amount of $749, and advance checks in the amount of $197, Council Member Karlin moved, seconded by Council Member Allen, to approve Consent Agenda Roll Call #5: Chairman declared motion carried by omnibus vote. PASSAGE OF ORDINANCES AND RESOLUTIONS Council Member Karlin moved, seconded by Council Member Dennis, to approve Ordinance on final reading amending Section 3-64(c) of Chapter 3 of the Galesburg Municipal Code amending the number of Class C licenses issued from twenty-two to twenty-three. 3 Ordinance on first reading amending Appendix F of Chapter 28 of the Galesburg Municipal Code adding a yield sign on South Treadwell Drive at Lincoln Park Drive Ordinance on first reading amending Appendix D of Chapter 28 of the Galesburg Municipal Code removing stop signs on Saluda Road at Old Thirlwell Road. BIDS, PETITIONS, AND COMMUNICATIONS Bids received from R & R Services of IL (Argenta, IL) and Raney Forestry Recycling (Moline, IL) for the removal of wood waste. Council Member Andersen moved, seconded by Council Member Karlin, to approve the bid from Raney Forestry Recycling in the amount of $10,500 to remove the existing wood waste from the oversize brush drop off site located on Pickard Road. Roll Call #7: PUBLIC COMMENT CITY MANAGER S REPORT A. Yard waste will be collected this week, February 6 through 10, B. TAC Report received. C. Approved Special Events: a. Use of portion of Standish Park for handing out materials on October 19 and 20, MISCELLANEOUS BUSINESS (Agreements, Approvals, Etc.) Quotes received from Whitney and Associates (Peoria, IL), Shively (Peoria, IL), and Geotechnics/Klinger (Galesburg), for material testing, plant inspection and control work for bituminous/portland cement concrete plant inspection for the calendar year Council Member Goad moved, seconded by Council Member Dennis, to approve the quote from Whitney and Associates for most services, with the exception of approving Geotechnics/Klinger to perform two services exclusively (cylinder breaks and standard proctor testing) so that trip charges can be avoided. 4 Council Member Dennis recused himself from the meeting for all discussions on agenda item Council Member Karlin moved, seconded by Council Member Andersen, to approve the following recommendation action for the sale of City-owned properties with the exception of Tracts 12 and 13: ACCEPT SOLE BID: Tract 1: The Villas at Carl Sandburg, LLC for $1, and waive development plan bid requirement. Tract 2: Habitat for Humanity of Knox County, IL for $600. Tract 6: Galesburg CILA Homes Partnership for $650 conditioned upon ability to receive a building permit. Tract 16: Galesburg CILA Homes Partnership for $650 conditioned upon ability to receive a building permit. Tract 17: Swing Mobile Estate for $500. Tract 19: Galesburg CILA Homes Partnership for $650 conditioned upon ability to receive a building permit and a rear yard variance. Tract 24: Gregory DeWitt for $960. Tract 33: Tracts 40 & 43: Tract 51: ACCEPT HIGH BID: Shawn Shea for $3,125. (Note: This is a HUD $1 Home. Revenue from the sale of this property will be utilized to pursue foreclosure/delinquent tax sale purchases per the proposal submitted to HUD by the City). Galesburg CILA Homes Partnership for $325 for Tract 40 and $325 for Tract 43 conditioned upon ability to receive a building permit and purchasing both tracts. Galesburg CILA Homes Partnership for $325 conditioned upon ability to receive a building permit and purchasing a lot from an adjacent property owner. Tract 5: Brian Fishburn for $800 contingent upon Mr. Fishburn receiving title to 146 West North Street within the next six months. If not, then the property will be sold to Gregory DeWitt for $750. Tract 9: Elsie (Stanley) Smith for $650. Tract 20: Gregory DeWitt for $840. Tract 21: Peter Hauslein for $550. Tract 49: Galesburg CILA Homes Partnership for $650 conditioned upon ability to receive a building permit. February 6, 2012 Page 4 of 8
5 Tract 50: Michael Hensley for $12, (Note: This is a HUD $1 Home. Revenue from the sale of this property will be utilized to pursue foreclosure/delinquent tax sale purchases per the proposal submitted to HUD by the City). ACCEPT BEST BID: Tracts 12 & 13: Tract 52: Galesburg CILA Homes Partnership for $325 for Tract 12 and $325 for Tract 13 conditioned upon ability to receive a building permit and purchasing both tracts. Galesburg CILA Homes Partnership for $650 conditioned upon ability to receive a building permit. REJECT SOLE BID: Tract 8: Adrian Velazquez for $100. The bid was a development plan bid but the property is not adjacent to the city lot. The City Council has set a precedent for not accepting bids at this low of a bid price. REJECT ALL BIDS: Tract 39: Both of the bidders proposed to plant trees on a commercially zoned lot. Staff recommends holding onto the city lot to wait for a commercial project. Roll Call #9: Ayes: Council Members Goad, Fleming, Andersen, Schwartzman, Allen, Karlin, and Mayor Garza, 7. Absent: Council Member Dennis, 1. Council Member Andersen moved, seconded by Council Member Karlin, to approve the sale of Tract 12 and 13 to Edgreal and Oletha Wallace in the bid amount of $1,000 for Tract 12 and $ for Tract 13. Mike Kroll addressed the Council stating that the City does have a priority to return the properties to the tax rolls, but that CILA Homes Partnership does not pay property taxes. He stated that he agreed with Council Member Andersen that the tracts should be sold to the Wallaces. Bob Dillard, representing CILA Home Partnership, stated that the properties were being sought because they addressed the footprint needed for the buildings. Many of the other City sites were too small for the project. Seventeen other locations must be sought in Knox County to complete the project. Each building will cost approximately $325,000 to build and employ fifteen people. Total, the project will employ additional employees in our area. Discussion was held on if there were any other properties available. Community Development Director Parkin stated that some are in the initiation process now but likely would not be February 6, 2012 Page 5 of 8
6 available for at least six months. It is costly to advertise the properties and takes up much staff time, but there is nothing that prohibits the City from having more than one sale per year. Oletha Wallace addressed the Council and stated that she has lived in her home for forty years and maintained the property since the home was demolished. She believes that she deserves the consideration to purchase the properties. Council Member Karlin stated the issue with the property is that there are competing interests with the two bids. While the City wants to foster economic growth, which CILA will provide, there needs to be a fundamental fairness for our citizens. The Wallaces have been taking care of the property proving that they are good citizens and stewards. He noted that this is not a make or break decision for CILA from an economic development standpoint and would not have a big impact one or the other on the project. The group home will be located in the region, which would still benefit our community. The Wallaces have treated the property as if it was their own for some time now and feels it is only fair to vote in favor of allowing the Wallaces to purchase the properties. Roll Call #10: Ayes: Council Members Andersen, Schwartzman, and Karlin, 3. Nays: Council Members Goad, Fleming, Allen, and Mayor Garza, 4. Absent: Council Member Dennis, 1. Chairman declared motion failed. Council Member Goad moved, seconded by Council Member Allen, to approve the recommendation to approve the sale of Tract 12 and 13 to Galesburg CILA Homes Partnership in the bid amount of $325 for Tract 12 and $325 for Tract 13. Roll Call #11: Ayes: Council Members Goad, Fleming, Allen, and Mayor Garza, 4. Nays: Council Members Andersen, Schwartzman, and Karlin, 3. Absent: Council Member Dennis, 1. TOWN BUSINESS Council Member Allen moved, seconded by Council Member Fleming, that the City Council sit as the Town Board. The motion carried by voice vote Trustee Allen moved, seconded by Trustee Fleming, to approve Town bills and warrants be drawn in payment of same. Trustee Allen moved, seconded by Trustee Fleming, that the Town Board resume sitting as the City Council. The motion carried by voice vote. STATEMENTS BY COUNCIL OF GENERAL CONCERN Council Member Karlin reported that there would be another Galesburg Bicycle Advocacy Group meeting on Saturday, February 11, 2012, 1 p.m., in the lower level of the Bondi Building. Guests from the League of Illinois Bicyclists and Trails for Illinois will be present. The group has identified five action areas and with the help of Jim Cueno (City s GIS Analyst) has compiled maps with possible lanes and paths. Mayor Garza thanked Council Member Karlin for his efforts. Council Member Allen stated that he attended a meeting in Springfield hosted by the Illinois Chamber of Commerce. He provided Council Members with a handout that was presented at the meeting regarding the economic and revenue outlook for the State of Illinois. Council Member Schwartzman inquired on the properties that were not sold and if someone could make use of them for the year before another property sale was slated. Community Development Director Parkin stated that a possible one-year lease could be developed. Council Member Schwartzman reported that another free community dinner would be held Thursday, February 26, 2012, 5:30 7:00 p.m. at the Central Congregational Church. It is the goal to have two dinners per month for the rest of the year. He also stated that the Community Relations Commission would hold a forum at the Community Center on Tuesday, February 7, 2012, 6:00 7:30 p.m. He encouraged members of the public to attend and share ideas, concerns, etc. Council Member Dennis applauded Chief Christiansen and his canine officers Lane Mings and Torry Carnes for the recent drug tactics at the Amtrak Depot. Council Member Goad expressed his sympathy to the family and friends of Don Crose. Mayor Garza also expressed his sympathy and that his thoughts and prayers are with Crose s family. 8 Mayor Garza reported that the City, along with Carl Sandburg College, would be hosting a job fair on April 10, 2012, 10:30 a.m. 1:30 p.m. Employers from throughout several counties will be contacted to participate. The Mayor also reported that he is looking at the benefits and value of a multi-year budget. He stated that this would allow Council to focus on other initiatives instead of being bogged down by budgetary issues. He noted that there would have to be an added benefit to the process as well as being feasible for the City.
