1 CITY COUNCIL CITY OF RICHMOND HEIGHTS MISSOURI REGULAR MEETING, July 5, 2016 A Regular Meeting of the City Council of the City of Richmond Heights, Missouri was held on Tuesday, July 5, 2016 at 7:30 p.m. in the City Hall Council Chambers at 1330 S. Big Bend Boulevard. The meeting was opened with The Pledge of Allegiance video by the Richmond Heights Imagination Station Summer Day Camp children. Present were Mayor Jim Thomson, Council Members Ed Notter, Joan Provaznik, Rick Vilcek, Matt Casey, Danny Hebenstreit, Reginald Finney, Dan Sebben and Megan Moylan.. Also present were Amy Hamilton, City Manager and Ken Heinz, City Attorney. ANNOUNCEMENTS Pledge of Allegiance Mayor Thomson thanked the Parks & Rec staff for assembling the Day Camp kids for their inspiring Pledge of Allegiance presentation. Proclamation Parks & Recreation Month Council Member Joan Provaznik read and presented a Proclamation to Parks and Recreation Director Teresa Proebsting honoring July as Parks and Recreation Month. District 2 Meeting July 9 Picnic meeting Mr. Vilcek stated District 2 will hold its next meeting on Saturday, July 9 at the A. B. Green pavilion at 10 a.m. Mr. Vilcek stated it will be their annual picnic BBQ. CITIZEN S COMMENTS NO.1 APPROVAL OF MINUTES None. Regular Meeting June 20, 2016 Mr. Vilcek moved, Mr. Finney seconded, a motion for the approval of the minutes of the Regular Meeting of June 20, Carried unanimously with Mr. Casey abstaining as he did not attend the meeting. 1

2 CITY MANAGER S REPORT Liquor License Painting with a Twist Ms. Hamilton asked the Council if they wished to grant a liquor license for the business Painting with a Twist at The Boulevard. Ms. Hamilton stated Staff recommends approval of the Class 1 License authorizing the sale of all types of intoxicating liquor by the drink at retail to be consumed on the premises. Currently we do not have a license that fits for Sunday sales as they requested, it is not a nonprofit, nor a restaurant. Ms. Hamilton stated this will allow them to sell their beer and wine every other day but Sunday and said she has communicated with the owner that Staff will work on drafting another class to fit their Sunday request. Ms. Hamilton stated their Sunday hours would be 11:00 a.m.-5 p.m. Mr. Vilcek moved, Mr. Finney seconded, a motion to approve Painting with a Twist Class 1 Liquor license. Carried unanimously. Changes to Criminal Code CITY ATTORNEY S REPORT Mr. Heinz stated he is continuing to work on the changes to the City s criminal Code, working with a draft outlined by the City of Creve Coeur whose Code is similar to Richmond Heights. Mr. Heinz stated he will be seeking input from Staff, including the Judge, Prosecutor, Police Chief, City Manager and Council. No Building Code changes are involved in these upcoming changes. BILLS PREVIOUSLY INTRODUCED Bill No. 5471; second reading Approves the final plat for lot consolidation combining several lots of contiguous property, part of Rannell s Subdivision of Home Farm in the City of Richmond Heights to allow construction of a single family home at 7925 & 7929 Hicks Avenue. Mr. Vilcek moved, Mr. Hebenstreit seconded, a motion for the second reading of Bill No Carried unanimously. Bill No 5471 was presented and read. AN ORDINANCE APPROVING THE FINAL PLAT FOR LOT CONSOLIDATION, THEREBY COMBINING SEVERAL LOTS OF CONTIGUOUS PROPERTY AS DESCRIBED HEREIN, BEING PART OF LOT 70 OF RANNELL S SUBDIVISION OF THE HOME FARM IN THE CITY OF RICHMOND HEIGHTS, MISSOURI, TO ALLOW CONSTRUCTION OF A 2

3 SINGLE FAMILY HOME AT 7925 AND 7929 HICKS AVENUE IN THE CITY OF RICHMOND HEIGHTS, MISSOURI. Mayor Thomson asked for a vote of approval of Bill No AYES: Mr. Vilcek, Ms. Provaznik, Mr. Finney, Ms. Moylan, Mr. Notter, Mr. Casey, Mr. Sebben, Mr. Hebenstreit and Mayor Thomson. NAYS: None. Mayor Thomson declared Bill No. 5471, approved. INTRODUCTION OF NEW BILLS Bill No.5472; first reading Amends Ord. 4788, the Municipal Code, Chapter 310; Traffic Control Signs & Devices, hereby Amended by repealing Sec Violation of Public Safety at Intersections and the Automated Photo Enhancement of Traffic Control Signal Regulations in its entirety. Mr. Hebenstreit moved, Mr. Vilcek seconded, a motion for the first reading of Bill No Carried unanimously. Bill No was presented and read. ORDINANCE NO. 4788, THE MUNICIPAL CODE OF THE CITY OF RICHMOND HEIGHTS, MISSOURI, CHAPTER 310 TRAFFIC CONTROL SIGNS AND DEVICES IS HEREBY AMENDED BY REPEALING SECTION VIOLATION OF PUBLIC SAFETY AT INTERSECTIONS AND THE AUTOMATED PHOTO ENFORCEMENT OF TRAFFIC CONTROL SIGNAL REGULATIONS IN ITS ENTIRETY. Ms. Hamilton stated that after passage, signs at the intersections would be removed. Bill No was laid over to the next meeting. RESOLUTIONS Resolution No Reappoints Judie Streiff Lore to offices as a member of the Public Library Board of Trustees, to a term ending July 1, Mr. Vilcek moved, Mr. Finney seconded, a motion to read Resolution No Carried unanimously. Resolution No was represented and read. A RESOLUTION OF THE COUNCIL OF THE CITY OF RICHMOND HEIGHTS, MISSOURI, REAPPOINTING JUDIE STREIFF LORE, A RESIDENT CITIZEN, TO OFFICE AS A MEMBER OF THE PUBLIC LIBRARY BOARD OF TRUSTEES; TO A TERM ENDING JULY 1,

4 Mayor Thomson asked for a vote of approval of Resolution No Carried unanimously. Mayor Thomson declared Resolution No , approved. Resolution No Directs Mayor to terminate an agreement with Morgan Stanley Capital Services LLC with respect to the Certificate of Participation Series 2005 Debt Service Reserve Fund Services and authorize related actions by the City. Mr. Vilcek moved, Ms. Moylan seconded, a motion for the reading of Resolution No Carried unanimously. Resolution No was presented and read. A RESOLUTION OF THE COUNCIL OF THE CITY OF RICHMOND HEIGHTS, MISSOURI, AUTHORIZING AND DIRECTING THE MAYOR TO TERMINATE AN AGREEMENT WITH MORGAN STANLEY CAPITAL SERVICES, LLC (FORMERLY KNOWN AS MORGAN STANLEY CAPITAL SERVICES INC.) WITH RESPECT TO THE CERTIFICATE OF PARTICIPATION SERIES 2005 DEBT SERVICE RESERVE FUND SERVICES AND AUTHORIZING RELATED ACTIONS BY THE CITY MANAGER AND FINANCE DIRECTOR. Mayor Thomson asked for a vote of approval of Resolution No Carried unanimously. Mayor Thomson declared Resolution No , approved. Deputy Mayor Appointment MISCELLANEOUS BUSINESS Mayor Thomson stated the City Charter calls for the appointment of the Deputy City Mayor to be elected by the Council. Mayor Thomson stated he has selected Rick Vilcek to serve as Deputy Mayor and plans to alternate that position over the years. Mr. Hebenstreit moved, Mr. Finney seconded the motion that Council Member Rick Vilcek be appointed Deputy City Mayor. Carried unanimously. Richmond Heights Deer Population The Council briefly discussed the advocacy of further review of the reported deer sightings in various areas of Richmond Heights. Mayor Thomson noted the Council had received some information that was gathered from other cities with specific deer population control and information from the Department of Conservation, but noted 4

5 Richmond Heights has not asked for a study to enumerate the actual deer population and questioned if any action is warranted. Council stated they were hesitant to proclaim the deer as a hazard as yet without more information noting there has been only a very few incidents of auto/deer collisions in the past several years in Richmond Heights and deer nuisance eating of vegetation has just been a recent reported occurrence. Council noted that for now, since the City of Ladue was furthering their own control program Council stated they felt Richmond Heights should see if Ladue s control methods curb the population in Richmond Heights before taking any more action. Fire Department Staffing Study Mayor Thomson announced the Emergency Services Consulting International (ESCI) study presentation will be made to the Council at the next City Council meeting on July 18. Mayor Thomson stated the City Council will hear the presentation, ask questions regarding the study data and will spend further time reviewing the Study thru August. Substitute Court Staffing Mayor Thomson asked if the Council felt it necessary to appoint an additional substitute Municipal Judge as we currently have Judge Wahl who fills in if Judge O Brien is not available to serve. Council did not move forward with appointing additional staff and concluded the situation was adequately addressed as Judge O Brien is seldom unable to be on the Bench. CITIZEN S COMMENTS NO. 2 None. Adjournment With no further business to come before the meeting, at approximately 7:55 p.m., Mr. Vilcek moved, Mr. Finney seconded, a motion to adjourn. Carried unanimously.
