1 Bend City Council Regular Meeting The regular meeting of the Bend City Council was called to order at 7:30 p.m. on Wednesday,, in the City Council Chambers at Bend City Hall, 710 NW Wall. Present upon roll call by City Recorder Robyn Christie were Bend City Councilors Nathan Boddie, Barb Campbell, Bill Moseley, Bruce Abernethy, Justin Livingston, Sally Russell and Mayor Casey Roats. 1. Roll Call 2. Pledge of Allegiance 3. Good of the Order A. Historic Preservation Month Proclamation Councilor Livingston moved to accept the Historic Preservation Month Proclamation. Councilor Moseley seconded the motion which passed unanimously, (7-0). Councilors Boddie, Campbell, Moseley, Abernethy, Livingston, Russell and Mayor Roats voted yes. Councilor Russell read a proclamation declaring May 2018 as Historic Preservation Month. Heidi Slaybaugh, Chair of the Historic Landmarks Commission, received the proclamation and reviewed upcoming events. 4. Visitor s Section 3 minutes per person; when invited to the podium, please state your name and whether you live inside the City of Bend. Dr. Mary Ellen Coulter spoke in support of a single-use plastic bag ban. She reviewed negative impacts from single-use plastic bags. Members of the Pacific Crest Green Team Margot Cummings, Willa Jensen, Hazel Sparks, Ryan Seaton, Avri Struhs, Iben Orton, Jesse Radzik, and Jillian Junker spoke in support of the Un-Bag Bend Movement. William Munzo, representing the business community, spoke in support of the plastic bag ban. He reviewed the financial benefit to his business if he did not buy plastic bags. He said he would be donating 2,000 reusable bags to his customers to encourage the disuse of plastic bags. Topher Laws spoke in support of the plastic bag ban. He reviewed some of the negative impacts that plastic bags have on our community. He also suggested banning the use of plastic straws and stir sticks. Bend City Council Regular Meeting Page 1 of 7
2 TeaFly Peterson, with Un-Bag Bend, spoke in support of banning single-use plastic bag use. She referenced a Bend Bulletin article which talked about the time and cost involved with cleaning up plastic bags. She noted that Un-Bag Bend is sewing fabric bags made out of t-shirts that will be free to the community. Nathan Goldberg, representing the Student Sustainability Initiative for OSU Cascades, spoke in support of a plastic bag ban. He noted that they are also doing an initiative at the campus to ban plastic straws. Angela Chisum spoke against gun violence. She said she started a Facebook group against gun violence. She said people are looking for answers and want to be a part of the solution. They are not anti-gun but supportive of sensible gun reform. She thanked Councilor Campbell for filing a petition against the 2 nd Amendment preservation measure. She thanked Mayor Roats and Councilor Boddie for attending the march. She asked Council to take a stance to protect our community against gun violence. Marika Green, a Bend resident and teacher at Highland Elementary School, spoke about the importance of safety and wellbeing of our community s children. She thanked Councilor Campbell for her opposition to the 2 nd Amendment preservation ordinance. She urged Council to do whatever they could to keep our community safe from gun violence. Matt Cowl spoke in support of students taking action against gun violence. He asked Council to be leaders in the conversation on this issue. Mark, a traveler who was born and raised in Central Oregon, said he has been excluded from parks and is really bummed about it. Michelle Porter, a Bend resident, said she is upset about dangerous traffic speed on NW Portland Ave. She requested police enforcement, the installation of 4-way stops at 11 th & Portland and Juniper & Portland and a crosswalk at Juniper. Steve Porter, a Bend resident, spoke about NW Portland Ave safety. He said traffic speed has reached dangerous levels. He asked for increased police enforcement on Portland Avenue, the installation of 4-way stops at 11 th & Portland and Juniper & Portland and the installation of a crosswalk at Juniper. Marlene Alexander, who has lived on NW Quincy for 45 years, also expressed concern with the intersection of Portland and 11 th. She noted the difficulty of seeing at the intersection of 11 th Street due to trees and bushes. She asked for the installation of a 4- way stop. At Mayor Roats request, Mr. King reviewed the process for citizen service requests and specifically for Portland Avenue. He said an entire corridor study will be done this summer for Portland Avenue. 3 Lisa Lewis, who lives on Quincy Avenue, asked that traffic patterns be reviewed for the consideration of a 4-way stop at 11 th and Portland Avenue. Carol Elwood, the land use chair for Mountain View Neighborhood Association, commented on the notification system for land use issues. Keith Scott, a Bend resident, spoke about the need to update school safety regulations. He also spoke of the need for expansion of the Council Chambers and roundabout signage to remind drivers to signal when exiting. He suggested a public vote in regards to a plastic bag ban. 5. Consider a Motion to approve the Consent Agenda A. Approval of Minutes: April 4, 2018 work session April 4, 2018 regular meeting April 5, 2018 joint meeting with Deschutes County Commission B. OLCC Report C. Quarterly Investment Report D. Capital Improvement Program Monthly Report E. Authorize an agreement with Water Systems Consulting, Inc., in substantially the form presented to Council, for design of the Pump Station Decommissioning Project (1SPSD, 10 pump stations) in the amount not to exceed $460,501 F. Contract amendment with Orrick, Herrington & Sutcliffe LLP for legal bond counsel services, for a total contract amount not to exceed $294,000 G. Authorize a contract with Otak, Inc. for owner s representative and construction management services for the Empire Corridor Improvements Project Phase 1 in an amount not to exceed $318,579 End of Consent Agenda Councilor Russell moved to approve the Consent Agenda with the removal of item 5E. Councilor Abernethy seconded the motion which passed unanimously, (7-0). Councilors Boddie, Campbell, Moseley, Abernethy, Livingston, Russell and Mayor Roats voted yes. Purchasing Manager Gwen Chapman reviewed the changes made to the contract on item 5E. Bend City Council Regular Meeting Page 3 of 7
4 Councilor Campbell moved to authorize an agreement with Water Systems Consulting, Inc., in substantially the form presented to Council, for design of the Pump Station Decommissioning Project (1SPSD, 10 pump stations) in the amount not to exceed $460,501. Councilor Livingston seconded the motion which passed unanimously, (7-0). Councilors Boddie, Campbell, Moseley, Abernethy, Livingston, Russell and Mayor Roats voted yes. 6. Public hearing and first reading of text amendments to the Bend Development Code exempting Accessory Dwelling Units (ADUs) from sidewalk requirements The staff report was presented by Senior Planner Pauline Hardie. Jeff Payne, new Planning Commission Chair, introduced himself to the Council and reviewed how the Planning Commission arrived at their decision. Councilor Campbell provided some history on sidewalk requirements. She asked how the Planning Commission moved through their discussion. Mr. Payne reviewed the discussion that was held regarding the exemption of ADUs from sidewalk requirements. Mayor Roats opened the public hearing. Hearing no comments, Mayor Roats closed the public hearing. Councilor Moseley moved for the first reading of the ordinance amending Bend Development Code Chapter 4.2 Minimum Development Standards, Site Plan Review and Design Review. Councilor Boddie seconded the motion. Councilor Russell moved to amend the motion to return the 600 ft. requirement. There was no second. The original motion passed, (6-1), Councilors Boddie, Campbell, Moseley, Abernethy, Livingston and Mayor Roats voted yes. Councilor Russell opposed. 7. Public Hearing on the 2018 Community Development Block Grant (CDBG) Fund Awards The staff report was presented by Affordable Housing Manager Lynne McConnell. Councilor Abernethy asked how the decision was made to set up a fund for down payment assistance rather than first and last month rental assistance. How much are they looking for? Ms. McConnell said that the program details have not yet been determined. The committee will further review and make a decision. Mayor Roats opened the public hearing. 5 Councilor Campbell moved to approve the 2018 Community Development Block Grant Annual Action Plan and to authorize staff to take all actions necessary to fund the approved projects, including signing loan agreements and related documents, without further approval from Council. Councilor Russell seconded the motion which passed unanimously, (7-0). Councilors Boddie, Campbell, Moseley, Abernethy, Livingston, Russell and Mayor Roats voted yes. 8. First reading of an ordinance making text amendments to Chapter 1.20 of the Bend Municipal Code adding the Neighborhood Leadership Alliance Recommended motion: I move for a first reading of the ordinance to amend Bend Code Chapter 1.20 by adding Section Neighborhood Leadership Alliance. The staff report was presented by City Attorney Mary Winters. Councilor Russell moved for a first reading of the ordinance to amend Bend Code Chapter 1.20 by adding Section Neighborhood Leadership Alliance an advisory committee. Councilor Livingston seconded the motion. Councilor Moseley spoke of the importance of this motion. He said he probably would have assigned staff specifically via ordinance. Mr. King said he thought there would be opportunity to amend this Code language as the process moves further. Mayor Roats said he likes the language as it is now and would not want it to be any stronger at this point. The motion passed unanimously, (7-0). Councilors Boddie, Campbell, Moseley, Abernethy, Livingston, Russell and Mayor Roats voted yes. 9. Resolution Providing Direction on Urban Growth Boundary (UGB) Implementation Approach The staff report was presented by Long Range Planning Manager Brian Rankin. Councilor Livingston confirmed that the area planning process in the elbow would take about 17 months. Public Comment Steve Wilson, a part of the development community who has built many affordable homes in Bend, said it would be nice to do it again. He spoke of the affordability issues due to available homes and land. He said with development costs, it is really difficult to build houses that are affordable for citizens of Bend. He said the city has control over system development charges and the supply of land. He said when we are in a climate Bend City Council Regular Meeting Page 5 of 7
6 of rising interest rates, affordable housing goes down. He provided a handout to Council. Jody Ward congratulated Council for considering doing both the Empire and Murphy Road extensions. She said that they are very excited about the new schools being built in south Bend. Councilor Boddie moved to approve the resolution providing direction to staff and the community on the City s UGB implementation approach. Councilor Russell seconded the motion. Councilor Moseley moved to amend the resolution, Q page, 3, to replace implement with explore in the first sentence. Councilor Livingston seconded the motion. The Voice Vote for the amendment failed, (3-4). Councilors Moseley, Livingston and Mayor Roats voted yes. Councilors Boddie, Campbell, Abernethy and Russell voted no. The original motion passed unanimously, (7-0). Councilors Boddie, Campbell, Moseley, Abernethy, Livingston, Russell and Mayor Roats voted yes. Mr. King explained that staff was looking for more direction on the Murphy Road corridor. Mayor Roats declared an actual conflict of interest because he owns a water utility that is subject to the franchise fee. Mayor Pro Tem Russell took over in Mayor Roats absence. Councilor Moseley spoke to the huge infrastructure costs coming up. There was general agreement from Council on Option 2 to increase water/sewer franchise fees 1% and transportation SDC s to $6, Council Action and Reports A. Committee Reports Councilor Campbell reported on attending the Housing First meeting. Councilor Livingston reported on the Old Farm Neighborhood Association meetings where a brief update was provided on Septic to Sewer. Councilor Boddie said he was able to attend Washington DC for Mountain Pact. He also reported on the first meeting of the Climate Action Steering Committee (CASC). Councilor Abernethy also attend the CASC meeting. He noted that Housing First has hired a staff person. Bend City Council Regular Meeting Page 6 of 7
7 Councilor Moseley had nothing to report. Councilor Russell commented on the hotel being built in the medical district and said it serves a similar need as the Ronald McDonald House. She thanked everyone for putting up with the smoke from the controlled burn and noted that there would be more burning on Thursday and Friday. She said that Mr. King will be attending the regional city managers meeting on Monday at Eaglecrest. Mayor Roats said that he and Councilor Russell had a good meeting with the co-chairs of CTAC. Mayor Roats moved to recommended the Budget Committee appointment of Tom Schumacher, the reappointment of Kat Mastrangelo and the appointment of alternate Monica Rimai. Councilor Livingston seconded the motion which passed unanimously, (7-0). Councilors Boddie, Campbell, Moseley, Abernethy, Livingston, Russell and Mayor Roats voted yes. Councilor Russell said she would like to receive more detail on who we appoint to the Budget Committee since it is such an important committee to the city. 11. Receive City Manager's Report Mr. King noted that as part of HB 4079 for affordable housing, Council would see a resolution in June recommending the inclusion of a parcel on the east side of Bend which would include building 550 homes, including affordable housing. It is a very strong candidate. Mr. King said that the Simpson & 14 th Street roundabout is way ahead of schedule and should open within the next couple of weeks. He also noted that paving will be starting next week.
