PUBLIC COMMENT Lynn Murphy, Puget Sound Energy - Reported on the damage caused by the recent storm, the repairs needed, and the many power outages. B. CONSENT AGENDA: Approval of February 6, 2017 Council Minutes Authorization of February 3, 2017 Payroll Authorization of February 17, 2017 Payroll Approval of December 2016 Open Period Claims Run Approval of January 2017 Claims Run 2017 Contract/Rate Increase Councilmember Bersch moved, and Councilmember Watson seconded, to approve the consent agenda. Motion carried 6-1, Councilmember Olson opposed. C. PRESENTATION: Ferndale Heritage Society 2016 Report Ferndale Heritage Society members Serena Liebrant and Marie Andrews presented information about the various volunteer activities the Heritage Society organizes, and answered Councilmembers questions. D. CAPITAL PROJECTS UPDATE Public Works Project Manager Katy Radder presented an overview on the following capital projects: Completed in 2016: Library Crosswalk - completed in March Total cost: $141,491, which is $11,499 under budget. Washington Street Safe Routes to School completed in September TIB covered part of the additional funding needed due to unanticipated expenses. Central City Water Association Integration Project physically completed in November Funded through the Department of Commerce, via the Drinking Water State Revolving Fund. The original budget was $2,250,000, and the project was completed with $1,200,000 nearly $1,000,000 under budget. Half of the loan is forgivable upon completion. 3 Ongoing Projects: Pump Stations #2 & #3. Puget Sound Energy Street Light conversion to LED Upcoming Projects: Portal Way Pavement Preservation Project, Enterprise to Grandview Starting in May Third Avenue, Main Street to Alder Replace road, water line & sewer Starting late spring or early summer Gateway Storm Outfall Component of the LaBounty Roundabout Project permitting & right of way acquisition is underway - Fall 2017 construction goal. Washington Street, Main to Vista Summer 2016 construction anticipated. Thornton Road Sewer Malloy to Roundabouts Design is underway. E. PUBLIC WORKS/SNOW EVENT UPDATE Public Works Senior Foreman Bo Westford presented information about supplies and labor expenses due to the recent freeze/thaw and subsequent snow event, and answered Councilmembers questions. F. PUBLIC HEARING: Astound Broadband Franchise Agreement Ordinance Public Works Director Kevin Renz introduced Fred Miller of Astound Broadband to explain the details of the agreement for a dark fiber network within the City, which is utilized by the City and local businesses. Fred Miller, Astound Broadband Explained the history of Astound, which started as Black Rock Cable. In 2012, Wave Broadband bought Black Rock Cable. Wave offers voice, internet and other services as well as dark cable. Miller likened the telecommunications franchise agreement to a landlord/tenant relationship. Mayor Mutchler opened the public hearing at 6:57:00 No members of the public spoke. Mayor Mutchler closed the public hearing at. 6:57:43 Councilmember Bersch moved, and Councilmember Hansen seconded, to approve the agenda bill. Motion carried 7-0. G. PUBLIC HEARING: Developer Agreement Haven Communities, LLC Public Works Director Kevin Renz introduced the topic and explained the deficiencies that were discovered during construction which were not the developer s responsibility. This agreement addresses those items. Mayor Mutchler opened the public hearing at 7:00:00. No members of the public spoke. Mayor Mutchler closed the public hearing at 7:00:32. Councilmember Hansen moved, and Councilmember Goodrich seconded, to approve the agenda bill. Motion carried 7-0. H. ORDINANCE: Animal Control Amendments Code Enforcement Officer Jesse Ashbaugh spoke about the modifications to the existing animal control ordinance. 4 Peggy Holstine, Siddle Street, Ferndale Has backyard rabbits. She had a pen built to the specifications of several rabbit/animal welfare groups. She requested that Council send the item back to committee for more refinements. Laura Landrum, 1538 Main Street - Says it s not typical for chickens to fly over a fence, so she feels that a fenced back yard is a sufficient enclosure for chickens. She urged council to be in charge of the whole city, not a neighborhood. Carolyn Rose, 6006 Diamond Lane Questioned why ducks aren t allowed, and stated the language regarding enclosures is confusing to her. Keisha Hamilton, Deer Creek, Ferndale Lives just outside of City limits, and has livestock. She doesn t believe livestock should be limited to farms, because it s an important source of food. By general consensus, this item was referred back to committee. I. MAYOR REPORTS/COMMENTS Mayor Mutchler apologized for not following Robert s Rules of Order. He believed that each Consent Agenda item should have been voted on individually, as the Consent Agenda did not pass unanimously. J. COUNCIL REPORTS/COMMENTS Councilmember Bersch announced that she will be absent from two committee meetings and one council meeting in March. Councilmember Goodrich announced that he will be absent from the March 1 committee meetings. K. DEPARTMENT REPORTS L. COMMITTEE MINUTES INFORMATIONAL M. 9 ORDINANCE NO. AN ORDINANCE FIXING THE TIME AND PLACE OF THE FERNDALE ARTS COMMISSION MEETINGS BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FERNDALE: That that second Wednesday of every month is established as the time of meeting of the Ferndale Arts Commission. Effective Wednesday, March 8 th, following adoption of this Ordinance, the regular meetings will commence as follows: 1. Starting at the hour of 5:00 p.m. the Ferndale Arts Commission will meet in the Main City Hall Conference Room located at 2095 Main Street in Ferndale, Washington, All Arts Commission meetings are subject to the Washington State Open Public Meetings Act. Any meeting that is cancelled for any reason shall be posted on the City s website the day before said meeting. At any meeting hereafter that may fall on a legal holiday, the meeting shall be held the following day. All prior ordinances in conflict herewith are hereby amended to conform to the provisions of this ordinance.
