2 (3) Audience Participation This item was covered on the video screen. (4) Consent Agenda a. CC Action regarding Minutes, June 21, 2016 b. CC Action regarding Area Metropolitan Ambulance Authority/MedStar Subsidy Summary: Each year the AMAA produces a schedule of price/subsidy options for each member city to consider and select its own transport price. Currently the City of Saginaw has an average transport bill of $1,448 with a per capita subsidy of $0.00. The AMAA is proposing no increase from the subsidies and fees. Therefore to continue with the $0.00 subsidy, the average bill will remain at $1,448. c. CC Action regarding Resolution No , supporting submission of grant application for the Forensic Evidence Identification and Collection Project Summary: Resolution No supports the submission of an application for a grant for the Forensic Evidence Identification and Collection Project to the Office of the Governor. The actual cost of the grant project is $56, There is no cost to the City. The entire grant is funded by the Governor s Office. d. CC Action regarding renewal of Agreement with Planet Kids for Saturday Night Youth Program Summary: Planet Kidz has offered a Saturday night youth program in the City since Their program includes activities, games, and music for children (2 nd grade through 7 th grade). The proposed agreement is the same as the current agreement. The term of the agreement is for a three year period with the option to renew for an additional three year period. The City will continue to receive $1.70 per paid child from Planet Kidz. e. CC Action regarding Resolution No , continued participation with Atmos Cities Steering Committee Summary: Resolution No approves the 2016 membership assessment to continue participation with the Atmos Cities Steering Committee. There are 168 member cities participating in this committee. Atmos Energy Corporation is a monopoly provider of natural gas and because of that, regulation of the rates that it charges its customers is the only way that cities can ensure that natural gas rates are fair. Many activities of the committee involve rate cases but the ACSC also represents the cities on other items pertaining to Atmos. The cost of the membership assessment is $ Funds for this expenditure are budgeted in the General Administrative Office Budget, Legal and Special Services and Audit Account Motion was made by Flippo with a second by Farr to approve the consent agenda as presented. 3 (5) CC Consideration and Action regarding award of bid for FM inch Waterline Project Director of Public Works White explained that bids for the FM inch waterline project were opened on June 14, The project consists of approximately 924 linear feet of 12-inch waterline along FM156 from Grand Central Parkway to the north property line of Highland Station Park. He stated that a total of seven bids were received. The bids were evaluated by Kimley-Horn and Associates and they determined the lowest responsive bidder to be Atkins Bros. Equipment Co., Inc. The amount of their bid is $170,636 including the deductive alternate of utilizing an open cut instead of a bore on 260 feet of the line. He explained that a total of $170,000 was budgeted for this project in the Water and Wastewater Budget. The remaining $636 will be covered with available fund balance. He added that the contract has a time period of sixty days once the notice to proceed is issued by the City. Motion was made by Farr with a second by Barngrover to award the bid for the FM inch waterline project to Atkins Bros. Equipment Co., Inc. in the amount of $170,636. Mayor Brinkley, Mayor Pro-Tem Flory, s Farr, Flippo, (6) CC Consideration and Action regarding award of bid for Bailey Boswell Road Phase 2 (Bus. 287 to West of High Country Trail) City Engineer James explained that bids for the Bailey Boswell Road Phase 2 Project were opened on July 12, This project includes the portion of Bailey Boswell Road from Business 287 (Saginaw Boulevard) to west of High Country Trail. He stated that a total of five bids were received. The bids were evaluated by Kimley-Horn and Associates and they determined the lowest responsive bidder to be JLB Contracting, LLC. The amount of their bid is $10,715, He stated that the contract has a time period of 480 days once the notice to proceed is issued by the City. Motion was made by Barngrover with a second by Mayor Pro-Tem Flory to award the bid for the Bailey Boswell Road Phase 2 Project to JLB Contracting, LLC in the amount of $10,715, Mayor Brinkley, Mayor Pro-Tem Flory, s Farr, Flippo, 3

4 (7) CC Public Hearing Consideration and Action regarding recommendation from Planning and Zoning Commission for approval of the 2016 Comprehensive Master Plan and Capital Improvements Plan (CIP) (Ordinance No ) Mayor Brinkley declared the public hearing for this item opened at 6:23 p.m. He explained that the comprehensive master plan and capital improvements plan provide guidance for future needs in the City. City Engineer James expressed his appreciation to the members of the City Council and Staff for their input in the process of preparing the plans. He briefly explained the review process. He stated that the proposed plans were presented to the Planning and Zoning Commission at their meeting on June 28, They reviewed the plans and voted unanimously to recommend approval to the City Council. City Engineer James gave an overview of the proposed comprehensive master plan and capital improvements plan. There was discussion regarding the zoning and land use of a strip of land on the south side of West McLeroy; prohibitive cost of extending Minton across the railroad tracks; and a new basketball court in Willow Creek Park. Farr expressed his concern that input from taxpayers was not gathered and used in the formulation of the plans. He pointed out that according the City Charter, that after the Planning and Zoning Commission makes a recommendation, the City Council has sixty days to take action. There was discussion of buffers between the railroad tracks and potential homes; the additional of a road next to the railroad; and the population and cost estimates used in the plans. City Attorney Meredith explained that the purpose of the comprehensive master plan and capital improvements plan is guidance. He stated that the City s zoning and subdivision ordinances are the tools used to address specific items. He stated that the plans are flexible and can be amended as needed. Mayor Brinkley called for any public comments. Mr. Matthew Spano of 805 Amber Drive addressed the Council. He stated that he understands the plans are for guidance but he agrees with Farr. Mayor Brinkley called for any other public comments. There were none. He declared the public hearing closed at 7:32 p.m. (Due to prior commitments, s Barngrover and Flippo left during this item.) Motion was made by Mayor Pro-Tem Flory with a second by Tankersley to accept the recommendation from the Planning and Zoning Commission and adopt Ordinance No , approving the 2016 Comprehensive Master Plan and Capital Improvements Plan. Motion carried Mayor Brinkley, Mayor Pro-Tem Flory, s Tankersley, and Nethery Farr s Flippo and Barngrover 4

The City Council may convene in executive session to conduct a private consultation with its attorney on any legally posted agenda item, when the City Council seeks the advice of its attorney about pending or contemplated litigation, a settlement offer, or on a matter in which the duty of the attorney to the governmental body under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with the provisions of Chapter 551, including the following items: a.
