HASTINGS COUNTY PLANNING ADVISORY/LAND DIVISION COMMITTEE County Administration Building Belleville, Ontario January 13, 1994 A meeting of the Hastings County Planning Advisory/Land Division Committee was held on the above date with the following members present: Jack Arthur, Morley Marquette, H. Allan Leal, Earl Hewison, Arnold Burkitt, Jack Vance, Warden Deline. Also in attendance were Niall Carney, Director of Planning, Jean Rixen, Senior Planner, Wm. Bouma, Clerk-Administrator and Gill Sparrow, Executive Secretary. Warden Deline was asked to conduct the public meeting, as Acting Chairman, and called the meeting to order. PUBLIC MEETING l(a) Village of Madoc: Concession 5, Part Lot 1 The purpose of the amendment is to redesignate the subject lands from "Rural" and "Industrial (with Special Policy") to "Industrial (with Special Policy)" to allow the establishment of a bus depot and used car sales business. Ms. Rixen explained that this parcel is in the west end of the Village in the vicinity of the developing municipal industrial park. Part of the land is currently designated "Rural" and part is "Industrial (with Special Policy)", the special policy referring to wetlands which exist within the industrial park but beyond the subject lot. A new "special policy" is required to allow used car sales in the "Industrial" designation along with the bus depot which the applicant wishes to establish for his tour business. The local Council has already proceeded with an implementing zoning by-law and considerable support for the proposed development has been offered, especially from the Madoc Village business community. Ms. Rixen indicated that the proposed uses would be appropriate in the subject location and recommended in favour of the proposed amendment. Moved by Jack Arthur Seconded by Morley Marquette That this application for amendment be approved and recommended to County Council.

2 2 January 13, 1994 (b) Village of Stirling: Concession 1, Part Lot 13; R.P. 39,. Lots 12 to 21 (south side Front Street); R.P. 149, Lots 12 to 21 (north side Weaver Street) / The purpose of the amendment is to redesignate the subject lands from "Industrial" to a new "Business Commercial" designation which would allow a wider range of land uses.. Ms. Rixen explained that the subject lands comprise the industrial park in the west end of the Village of Stirling. The amendment proposes a new designation which will recognize the changing character of businesses in this area. Few purely production-oriented activites are being established. Rather, uses which include a substantial retail component are typical but are not accommodated by the present Official Plan policies. It is expected that new uses, resembling the existing furniture manufacturing and sales showroom, building supply centre and carpet warehouse and sales outlet, will be those that require larger buildings or greater land area than is available in the downtown commercial core and, therefore, will be better accommodated in the subject area. Uses which will not be permitted, however, are those that would require high water usage such as car washes, hotels, full service restaurants and certain types of manufacturing. Mr. Brent Barnes of Ainley & Associates Ltd., represents the Village and explained that he is preparing an implementing zoning by-law and comprehensive development plan for the subject area. Mr. Roy Tucker asked what effect this new designation might have on his farmland, which is located within the subject area. It was felt that its effect would be no different from the current "Industrial" designation which has been in place for many years. amendment. (cl Township of Thurlow: Concession 5, Part Lot 22 The purpose of this amendment is to apply a "special policy" within the "Prime Agriculture" designation to allow the creation of a farm-related residential lot. /

3 3 January 13, 1994 Ms. Rixen explainedthatthe subject lands, approximately 30 acres in area, are occupied by a house, barn and track where standardbred horses are bred and trained. A residential lot had been severed for family members involved in the business and an additional lot is now required for another family member. Since the policies of the "Prime Agriculture" designation do not permit more than one severance, the proposed special policy is required. The Ministry of Agriculture and Food has furnished the minimum distances from the two barns in the vicinity and has indicated that a new residence could be situated so as to comply. The Ministry therefore has no objection to the proposed amendment. Although the Township Council has not yet supplied a comment, the local Planning Advisory Committee had recommended approval. Because the proposal complies with the Foodland Guidelines and will benefit a viable agricultural activity, the Planning staff recommends in favour. Moved by Earl Hewison Seconded by Jack Arthur That the application for amendment be approved and recommended to County Council. (d) Township of Rawdon: Concession 1, Part Lots 8, 9 The purpose of this amendment is to redesignate the subject lands from "Prime Agriculture" to "Rural" to allow the establishment of a golf course. Ms. Rixen explained that consideration of this application had been deferred from a previous meeting to allow the applicant and his agent to discuss with the Ministry of Natural Resources and to allow the Ministry of Agriculture & Food to complete its review of the applicant's soil survey. The Ministry of Agriculture and Food is now satisfied that the subject lands are primarily comprised of soils of low productivity and organics. Mr. Charles Cleaver and his agent, Mr. Gary Dyke of Vanmeer Ltd., waited on the Committee to speak in favour of the application. Mr. Dyke stated that the golf course had been redesigned to take into consideration the concern of various agencies. It would now have only nine holes and a 15 meter setback adjacent to water courses would be implemented. Since the new design removes the development from the area of influence related to the Stirling Wetland, the Ministry of Natural Resources no longer requires an Environmental Impact Study.

4 4 January 13, 1994 Ms. Rixen recommended in favour of the proposal but sugested that a policy be included in the amendment requiring the use of a "holding zone" to ensure that drainage and grading plans satisfactory to the Ministry of Natural Resources, the Conservation - / Authority and the municipal Council are in place. The Warden warned that the Ministry of the Environment and Energy, which does not provide comments to the County on proposed amendments may be concerned about the effect of the golf course on the local ground and surface water resources, especially since an Environmental Impact Study is being conducted relative to the establishment of additional municipal wells for the Village of Stirling in the vicinity of the subject lands. He suggested that Mr. Cleaver discuss his proposal with the Ministry. Moved by Morley Marquette Seconded b,y Arnold Burkitt That this application for amendment be approved and recommended to County Council. ELECTION OF CHAIRMAN Mr. Bouma outlined the events of the meeting held on December 8, 1993, the Inaugural Session, which was called to elect the Chairman of the Planning Committee. At that meeting, proxy votes had been accepted. As this procedure is not recognized by the County of Hastings' rules of procedure, it was felt that a reelection should be held. After discussion, it was Moved by Jack Arthur Seconded by H. Allan Lea1 That the Planning Advisory/Land Division Committee recommend to County Council that any election of Chairman of Standing Committees be conducted by secret ballot. Moved by Jack Vance Moved by H. Allan Warden Deline then called for nominations for Chairman. That Jack Arthur be nominated. Lea1 That Earl Hewison be nominated.

5 Seconded by Jack Vance 5 January 13, 1994 That the call for nominations be closed. The Committee conducted a vote by secret ballot, electing the Warden and the Secretary as scrutineers. After the votes were counted, Warden Deline declared Reeve Earl Hewison the Chairman of the Planning Committee for ballots. The Warden then asked for a motion to destroy the Moved by Jack Vance Seconded by H. Allan Lea1 That the ballots for Chairman of the Planning Committee be destroyed. MINUTES The ballots were duly disposed of. Reeve Earl Hewison was then asked to assume the Chair. Ms. Rixen requested that the preamble on page 2 which reads "The applicant, therefore, has requested a deferral of this amendment" be amended to read "The Planning staff, therefore, has requested a deferral of this amendment". Seconded by Earl Hewison motion, That, being the original mover and seconder to this the minutes be amended as shown above. Seconded by Arnold Burkitt That the minutes of December 3, 1993 be adopted, as amended. MATTERS ARISING FROM THE MINUTES - None.

That the above-mentioned account vouchers be ratified for... -* CORRESPONDENCE (a) Nancy Rutherford, Planner Ministry of Municipal Affairs re: Partial Approval of Frankford Secondary Plan "'The approva? of-this amendment included 44 modifications which were submitted to the Ministry. A special order will be prepared for presentation to County Council to adopt one additional modification to change the location of the "Hazard" designation in Part Lots 3 and 4, Concession 6 (now in the Village of Frankford). Seconded by Morley Marquette same That the Committee approve this modification and recommend to County Council. w Hon. E. Philip, Minister of re: A New Approach to Land Municipal Affairs Use Planning The Mi.A.' istry has'forwarded to each municipality of copy of their document, "A New Approach to Land Use Planning". Mr. Carney asked every committee member to read through it carefully so that it can be discussed, in depth, at the February meeting.

7 7 January 13, Warden Deline pointed out several items of particular interest:. item 7 on page 9. item 3, page 13. item 5, page 14. item 4, page 16. item 8(a)-(d), page 17 Mr. Carney also advised that he is meeting with fellow County planners next week and will forward to committee members the outcome of that meeting and the Planning Department's review of this document, prior to the next Planning meeting. This item was for information purposes. (c) C. Robson, Clerk-Treasurer re: Reforms in Land Use Township of Rawdon Planning System This letter from the Township of Rawdon is dealing with basically the same topic as item 8(b) and it was suggested that all municipalities should be requested to send in their comments to be coordinated by the Planning Department and forwarded on to the Ministry. Seconded by Warden Deline That the Planning Department request, by fax, a response from the local municipalities by February 28, 1994 in order to coordinate a brief, on behalf of the County of Hastings, to be presented to the Ministry by its deadline of March 14, (d) Hon. E. Pilkey, Chair re: Duplication of Provincial Provincial/Municipal Task Force Legislation, Regulation, Policy This letter is part of the Social Contract Act and is asking for comments on duplication of services and other areas. Mr. Bouma informed the Committee that a copy is being sent to each Department Head to take to their respective committee. Mr. Carney would be looking for any suggestions relating to Planning/Land Division. It was agreed that a response would be prepared by the County Planner. (e) Hon. A. Eggleton, Minister re: Canada-Ontario Infraresponsible for Infrastructure structure Program and Hon. Frances Lankin, Minister of Economic Development & Trade

(f) Thurlow & Tyendinaga Township re: Gerald O'Neill Ltd. Rate Payers Thurlow:Con.3, Pt Lot 30 A copy of a letter written to Brian Ward, Ministry of Environment and Energy had been sent to the County, outlining seven reasons why the proposed quarry operation should not be allowed to expand. This matter has already been referred to the O.M.B. Moved by Jack Arthur Seconded by Morley Marquette That item 8(f) be received and filed. For Recommendation to County Council (a) R.G. Ferguson, Commissioner re: Metropolitan Toronto's of Works, Metro Toronto Willing Host Landfill Site Search Metropolitan Toronto is seeking any area which would be a willing host landfill site. Moved by Jack Arthur Seconded by Warden Deline That the resolution from Metropolitan Toronto be received and filed and that same be recommended to County Council. (b) K. Zammit, Deputy City Clerk re: Residential Property City of Brampton Statute Law Amendment Act, 1993 This resolution is dealing with accessory apartments in houses and speaks of a report prepared in As committee members believed that they did not have enough information to make any recommendation, it was

9 . Seconded by Warden Deline 9 January 13, 1994 That this resolution be deferred so that a request can be made for a copy of the City of Brampton's 1992 report. OTHER NOTICES OTHER BUSINESS None (a) Conferences 1994 County Council has set aside the sum of $2, for each Committee to send a delegate to a conference. The Committee should decide whether it will send one person or have the money divided amongst the membership. Mr. Carney informed the members that, at this time, he does not have any information on the upcoming conferences but believes it will be available for the February meeting. (b) This was for information purposes Budget Mrs. Smart attended before the committee to discuss the 1994 budget. She distributed copies of the Planning Department estimates stating that there have been no further changes. Moved by Morley Marquette Seconded by Arnold Burkitt That the draft 1994 budget for Planning be approved and forwarded to the Finance Committee. Warden Deline mentioned that it is his intent to ask County Council to finalize the budget, in principle, at the January 27th Session in order to send a strong message to the taxpayers and the school boards that the County is recognizing the current economic situation. (c) Downsizing Mr. Carney reported to the committee that there are two people in his department who are affected by early retirement: Edna Jacklin is eligible in January 1995 and Niall is eligible in January OMERS has a fund which will fund 100% for early retirement if the County has a plan in place. A by-law will be presented at the January Session.

11 11 January 13, 1994 Mr. Carney presented this matter for information purposes. LAND DIVISION BUSINESS Mrs. Edna Jacklin and Mr. Paul Walsh waited on the Committee for the following Land Division matters. LAND DIVISION CORRESPONDENCE (a) Ontario Association of Committees of Adjustment & Consent Authorities: Newsletter (including comments on Final Report of Sewell Commission) Mrs. Jacklin referred the committee to a copy of the Association Newsletter. As there is only one copy available, any member wishing to review it should speak with her. (b) E.H. Lyons, Clerk Township of Sidney re: Application B198/93 (Ingram) Con. 4, Pt Lot 7 Mrs. Jacklin read out the letter that had been received from the Township of Sidney which stated that it objects to the granting of application B198/93; itwill not appeal the Committee's decision to the O.M.B.; and that its Council would notify the Land Division Committee and the applicants that the Township has not supported this application due to significant access deficiencies and therefore the Township of Sidney cannot anticipate granting entrance permits to satisfy condition (3) of the decision. Items (a) and (b) were presented for information. (c) Applications B1004/88 and B1005/88 (Lyts Begjin Inc.) Marmora Township:Con. 7, Pt Lot 19 O.M.B. Order to allow appeals Mrs. Jacklin reported that the appeal to the O.M.B. is allowed and these applications will not be granted. Seconded by Jack Arthur That the files on applications B1004/88 and B1005/88 be closed, that no further action be taken and that the fees be retained. (d) Hastings & Prince Edward Counties Health Unit - time limit for submission of comments Mrs. Jacklin told the committee that the Health Unit is very slow in responding to Land Division application letters and she has been requested to approach the committee for approval to write to them, giving a time frame in which to respond.

12 Seconded by Warden Deline 12 January 13, 1994 That Mrs. Jacklin send a letter to the Hastings & Prince Edward Counties Health Unit stating that, in the normal course of events, it is expected that a response should be received within sixty days. The letter will also state that if no response is received in that time, the application will be presented to committee for approval. LAND DIVISION BUSINESS Applications B223/93, B224/93, B225/93, March Properties Ltd. Township of Thurlow, B.F., Lot 27 Peter March, Owner, waited on the committee to speak in favour of these applications and Chris Schaefer, representing M.N.R. was present to speak to the Ministry's objections. The subject properties are located near a quarry operation but there was lengthy discussion regarding the distance of the required buffer. Mr. Schaefer agreed to provide further detailed information on the buffer area. As it was agreed that the committee lacked pertinent information, it was Seconded by Arnold Burkitt That the Ministry of Natural Resources provide detailed information on the required distances (whether from the boundary line or from the point referred to in the quarry licence) and how these distances relate to the subject properties. This information is to be available for the February 8, 1994 meeting when this application will be considered again. Mr. Walsh recommended that he, Mr. March and Mr. Schaefer meet to inspect the property. He also strongly suggested that the applicant obtain a single shot survey, prepared by a qualified surveyor with the proper equipment, measured horizontally from the aggregate zone boundary at a 300 metre distance. Moved by Morley Marquette Seconded by Arnold Burkitt That the applications for consent contained in Schedule 'B', (attached hereto and forming part of the minutes), be approved subject to the conditions noted on their files.
