1 TOWNSHIP OF GEORGIAN BAY Minutes of the Committee of Adjustment Friday November 8, :00 am 99 Lone Pine Road, Port Severn Ontario Members Present Chair Wiancko Member Bowden Member Ferguson Member Hill Member Rivett Staff Present Jessica Gunby, Deputy Clerk Jill Lewis, Director of Planning Todd Weatherell, Senior Planner Absent with Regrets Member Child Call to Order 9:00 a.m. Declaration of Pecuniary Interest Member Bowden declared pecuniary interest with Application B-24/13 as it is his Public Meeting to hear Minor Variance Applications Minor Variance A-39/13 (HENRY) 8462 Go Home Lake Shore To permit an addition to a non-complying dwelling of 84.2% (59.4 square metres / 640 square feet). The applicant was present and had nothing to add; no letters were received and no one from the public had comment.

2 COFA Rivett / Ferguson Application A for 8462 Go Home Lake Shore to permit the construction of an addition to a non-complying dwelling of 84.2% (59.4 square metres / 640 square feet), subject to the following: 2. The applicant enters into a Site Plan Agreement with the Township of Georgian Bay to preserve and enhance the existing vegetation on the property. Minor Variance A-40/13 (CLARK) Georgian Bay Shore To permit an increase of square metres (1,450 square feet) in gross floor area of the dwelling to 260 square metres (2,800 square feet). Ms. Gunby read nine letters of correspondence: Patsy Cross, James and Heather Trusler, Pixie Currie, Brye Bonner, John Stephens, Clair Balfour, Noel and Jill Bates, the Madawaska Club of Go Home Bay, and Ian MacDonald. They were all opposed to the application based on the visual impact, the possibility for two dwellings with the breezeway separating them, enlarging the cottage to double the size, and the development is inappropriate for the area and does not comply with the Community Plan. The applicant, Peter Clark, was present, and stated the breezeway is proposed to minimize the visual impact by pushing the addition behind existing vegetation. Patsy Cross inquired about roof height and total length; Mr. Weatherell stated the height was approximately 12 at midpoint and total length is 90. Noel Bates said he was of the opinion the request was not minor in nature and was concerned the Committee was stepping outside of its jurisdiction. Mr. Clark advised the Committee the proposal was not designed to

3 have two kitchens and will put something in writing stating as such. Discussion was had regarding total width; Mr. Weatherell advised the Committee that the request was strictly for gross floor area. Chair Wiancko asked for deferral to give the applicants the opportunity to come back to Committee with a proposal that does include the breezeway. COFA Ferguson / Rivett Application A-40/13 for Georgian Bay Shore to permit the increase of square metres (1,450 square feet) in gross floor area for a total of 260 square metres (2,800 square feet), subject to the following: 2. The applicant enters into a Site Plan Agreement with the Township to preserve and enhance the vegetation on the property. DEFERRED Minor Variance A-43/13 (VENTIN) 175 West Shore Road To permit the construction of a boathouse with a side yard setback of 2 metres (6.5 feet). He stated the applicant has an agreement with the abutting property owner that 50% of the structure will be on land. No letters were received for the Dave Robson, agent for the applicant, was present and stated there was a heavily treed buffer between the two neighbours. Mr. Staroba, abutting neighbour, stated the proposed location is acceptable. COFA Rivett / Ferguson Application A-43/13 for 175 West Shore Road to permit the construction of a boathouse with a side yard setback of 2 metres / 6.5 feet, subject to the following:

4 2. The applicant enter into a Site Plan Agreement with the Township of Georgian Bay to preserve and enhance the existing vegetation on the property, more specifically along the reduced side yard. Minor Variance A-44/13 (VERILLI) 33 Hansons Road To permit the construction of a dwelling with a front yard setback of 11.6 metres (38 feet) to the open deck and 15 metres (49.2 feet) to the dwelling wall. No letters were received and no one from the public had comment. The applicant was present and stated the dwelling may not need to encroach as much as they re asking for; they won t know the definite measurement until they dig. Member Bowden would prefer more detailed front elevation drawings and recommended deferral for this reason. Ms. Lewis suggested prohibiting a walk out if there were height concerns. Mr. Weatherell clarified the request was only for setback, not height. COFA Ferguson / Rivett Application A-44/13 for 33 Hansens Road to permit the construction of a dwelling with a front yard setback of 11.6 metres (38 feet) to an open deck and 15 metres (49.2 feet) to the main wall, subject to the following: 2. A complete set of digital drawing files of the reference plans shall be provided to the Township. 3. The applicant completes the purchase of the Shore Road Allowance DEFERRED until the Applicant has test holes dug to determine where the dwelling will be located and provides more accurate elevation drawings.

5 Public Meeting to hear Consent Applications Consent B-20/13 (FRENCH) 3220 Island 1810 To create one (1) new lot and a lot addition. Mr. Weatherell stated the applicant has agreed to a deferral. COFA Rivett / Ferguson BE IT RESOLVED that the Committee of Adjustment defers Application B-20/13 for 3220 Island 1810 to grant the creation of one new lot and one lot addition, to allow for the applicant to complete and Environmental Impact Study to confirm no development will occur within significant habitat for endangered or threatened species. Member Bowden left his seat and sat in the gallery for the next Consent B-24/13 (BOWDEN) Georgian Bay Shore To grant a lot addition. Ms. Gunby read seven letters: District of Muskoka. Ronald Webb, Scott Blair, Cognashene Cottager s Association, Ross Cooper, Peter Cooper and TJ Cooper, who were in favour of the The applicant was present but did not speak as he is a member of the Committee who declared. COFA Ferguson / Hill BE IT RESOLVED that the Committee of Adjustment approved Application B-24/13 for Georgian Bay Shore to grant a lot addition, subject to the following: 1. Deeds for the severed lot are submitted to the Secretary Treasurer along with a registered copy of the survey plan. 2. A complete set of digital drawing files of the reference plans shall be provided to the Township. 3. The applicant applies to the Township of Georgian Bay for a Zoning By-law Amendment to rezone and Georgian Bay Shore

6 to the Shoreline Residential Type Seven Exception Zone (SR-7-*) 4. The proposed lot additions be added to the respective abutting properties and that Section 50(3) of the Planning Act is applied to all future transactions within the property. 5. Provide confirmation that the resultant lot has been deemed not a lot on a plan of subdivision. Member Bowden returned to his seat. Applications not Subject to a Public Meeting Minor Variance A-28/13 (HORNE) 2696 Island 90, Six Mile Lake To permit the construction of a new dwelling with a front yard setback of 11.5 metres (37.7 feet) to the main wall. application and stated that Members Rivett and Ferguson would be unable to participate in the discussion and vote as they were not present at the meeting this matter was originally heard at. He stated the application was deferred at the last meeting so the applicants could put a cap on the maximum dwelling size but they were not willing to do that; the request today is the same as the original meeting. The applicant was present and stated they wanted to reserve their right to build within the by-law. COFA Hill / Bowden Applications A-28/13 for 2696 Island 90 to permit the construction of a new dwelling with a front yard setback of 11.5 metres (37.7 feet) to the main wall, subject to the following: 2. The applicant enter into a Site Plan Agreement with the Township of Georgian Bay to preserve and enhance the existing vegetation on the property.

COFA Ferguson / Hill BE IT RESOLVED That the Committee of Adjustment adopts the minutes of the October 11, 2013, meeting as amended, with Member Ferguson being listed as absent.
