Public Meeting to hear Minor Variance Applications Minor Variance A-22/13 (DEVELLIS) 206 Lodge Road To permit an increase of lot coverage to 10% (291.3 square metres / 3,136 square feet) a reduced interior side yard setback of 4 metres (13 feet) and a reduced rear yard setback of 4 metres (13 feet). He stated it is not out of character for lots in this area to have 10% lot coverage. Ms. Gunby read a letter of support from Bill Kemper. The applicant was present and hopes to get approval to commence the permit process.
2 COFA That the Committee of Adjustment approves Application A-22/13 for 206 Lodge Road, to permit the construction of a dwelling with an interior side yard setback of 4 metres (13 feet), a rear yard setback of 4 metres (13 feet) and a lot coverage increase to 10% (291.3 square metres / 3,136 square feet), subject to the following: 2. That the applicant enters into a Site Plan Agreement with the Township of Georgian Bay to preserve the existing vegetation on the property and enhance where possible. Minor Variance A-47/13 (TOIVIAINEN) 482 Island 290, Six Mile Lake To permit the construction of a dock with a side yard setback of 0 metres (0 feet). Ms. Gunby read a letter of support from Murray LeGris and a letter of opposition from Paul Volpe. The applicant was present and stated there was no other suitable location for the proposed dock and the neighbour who is most impacted is in favour. COFA /13 for 482 Island 290, Six Mile Lake, to permit the construction of a dock with a side yard set back of 0 metres / 0 feet, subject to the following: Minor Variance A-06/14 (BLACKWELL) Island 1685, Tomahawk Island To permit the construction of an addition to a non-complying dwelling being an addition size of square metres (597 square feet) in gross floor area and an increase in width of 4.1 metres (13.7 feet).
3 Ms. Gunby read three letters of support from Signey Farncomb and John Cowle, Jan and Joan Melchers and the President of the Tomahawk Club. The applicant was not present but the agent, Paul Gerow, was. COFA /14 for Island 1685, to permit the construction of an addition to a noncomplying dwelling with a gross floor area of square metres (597 square feet) and an increase in width of 4.1 metres (13.7 feet), subject to the following: Minor Variance A-07/14 (TROST) Island 1685, Tomahawk Island To permit the construction of an addition to a non-complying dwelling being an addition size of 64.5 square metres (695 square feet) in gross floor area and an increase in width of 10 metres (32.8 feet). Ms. Gunby read four letters of support from Signey Farncomb and John Cowle, Jan and Joan Melchers, the President of the Tomahawk Club and Patricia Hoolihan and Chris Fisherall. The applicant was not present but the agent, Paul Gerow, was. COFA /14 for Island 1685, to permit the construction of an addition to a noncomplying dwelling with a size of 64.5 square metres (695 square feet) and an increase in width of 10 metres (32.8 feet), subject to the following: Minor Variance A-08/14 (GARDEN) 491 Mohawk Road To permit the construction of a sleeping cabin with a maximum height of 5.6
4 metres (18.6 feet) and a maximum size of 56 square metres (603 square feet). No letters were received for the application. The applicant was not present but the agent, John Owen, was. He stated the bunkie is being proposed on top of the garage to minimize the structures on the property. COFA /14 for 491 Mohawk Road, to permit the construction of a sleeping cabin with a maximum height of 5.6 metres (18.6 feet) and a maximum size of 56 square metres (603 square feet), subject to the following: 2. The applicant enters into a Site Plan Agreement with the Township of Georgian Bay to preserve existing vegetation on the property and enhance where possible. Public Meeting to hear Consent Applications Consent B-01/14 (CRAMP) 131 Lily Pond Road To grant a lot addition from a residential property to a commercial property. Mr. Weatherell provided additional information regarding the property. The Planning Department has concerns with the application since there is no direct correlation with the commercial lot. Planning recommends, if the application is approved, the parcel being joined to the commercial lot be zoned Open Space or Commercial with a Holding to prevent building. Ms. Gunby read seven letters, not in support of the application, from, Ken Key, Tony Kafato, Alfredo and Eleonara Fiorini, Lisa Cavalieri, Silvana Tuzi, Roy Tuzi and Michael Facchini. The applicant was present and stated he had no issues with rezoning the parcel to prevent any building from taking place. Jurate Neumann was present and stated she submitted a letter, not in support, that was not read. She is not in favour of the application if it results in the access road and / or the new parcel being zoned Commercial.
5 Ken Key was present and stated he is not in favour of the application. He didn t disagree with the conditions but was of the impression that conditions equal a new application; Mr. Weatherell clarified that all consent applications have conditions and it is not a separate application when dealing with them. Member Bowden and Member Rivett expressed concern with the lack of justification for this application. The applicant withdrew the application. COFA BE IT RESOLVED that the Committee of Adjustment approves Application B- 01/14 for 131 Lily Pond Road, to grant a lot addition, subject to the following: 1. Deeds for the lot addition are submitted to the Secretary Treasurer, along with a registered copy of the survey plan. 2. A complete set of digital drawing files of the reference plans shall be provided to the Township. 3. The proposed lot addition be added to the respective abutting properties and that Section 50 (3) of the Planning Act is applied to all future transactions within the property. 4. The applicant applies to the Township of Georgian Bay to rezone the portion of lands that will be joined to the benefitting lands from the Shoreline Residential Type One Exception Ten (SR-1-10) zone to either the Open Space (OS) or Marine Commercial Type Three Exception Two Holding (CM-3-2(H)) zone to prohibit any structures being built behind the existing residential properties. APPLICATION WITHDRAWN BY THE APPLICANT NO VOTE / DECISION REQUIRED Approve Minutes of Previous Meeting COFA BE IT RESOLVED that the Committee of Adjustment adopts the minutes of the February 14, 2014, meeting as circulated. Adjournment COFA BE IT RESOLVED that the Committee of Adjustment does now adjourn at 10:26 a.m. until Thursday, April 17, 2014, at 9:00 a.m. or at the call of the Chair.
