2 Page 1 Pursuant to NRS, the Licensing and Liquor Board met in regular session at 9:10 a.m. in the Bob Ruud Community Center, Pahrump, Nevada Butch Borasky, Chairman Peter Liakopoulos, Vice-Chairman Joni Eastley, Commissioner Midge Carver, Commissioner Gary Hollis, Commissioner Ron Kent, Deputy District Attorney Sandra "Sam" Merlino, Ex-Officio Clerk of the Board Ron Williams, County Manager Also present: Linda Uhl, Deputy Clerk; Johanna Cody, Assistant Sheriff; Michelle Jones, Deputy District Attorney; Pam Webster, Assistant County Manager Present in Tonopah: Assistant Sheriff Johanna Cody Absent: Sheriff DeMeo BOARD OF COUNTY COMMISSIONERS RESOLVEO TO THE LICENSING AND LIQUOR BOARD 1. APPROVAL OF THE LICENSING AND LIQUOR BOARD MINUTES FOR JULY 17, Commissioner Eastley made a motion to approve; seconded by Commissioner Liakopoulos; 5 yeas. 2. 3 Page 2 5. LICENSING SA. DISCUSSION. DELIBERATION. AND POSSIBLE DECISION TO ISSUE A RETAIL LIQUOR LICENSE FOR MARCO'S PIZZERIA AND PASTA LOCATED AT 1440 E. HIGHWAY 372, PAHRUMP. NEVADA. MARCO BALDIERI, Commissioner Liakopoulos disclosed that the applicant advertised on one of his 1V shows for one month about two or three months ago, but they were no longer advertising with him and he did not see a conflict and would be participating. Commissioner Eastley made a motion to approve this application contingent upon the receipt of the occupancy permit. Assistant Sheriff Johanna Cody stated that the occupancy permit was still pending. The motion was seconded by 5B. DISCUSSION. DELIBERATION. AND POSSIBLE DECISION TO ISSUE A PACKAGE LIQUOR LICENSE FOR DEYOE'S FOOD AND GAS LOCATED AT 212 MAIN STREET, TONOPAH. NEVADA. PRITPAL SINGH, Commissioner Eastley made a motion to approve; seconded by Commissioner Carver; 5 yeas. 6. LIQUOR 6A. DISCUSSION, DELIBERATION AND POSSIBLE DECISION TO APPROVE A 72 HOUR PERMIT FOR MARINE CORPS LEAGUE FOR THE PAHRUMP FALL FESTIVAL OCTOBER AT PETRACK PARK IN PAHRUMP. NEVADA. MR. VIC RODRIQUEZ. 6B. DISCUSSION, DELIBERATION AND POSSIBLE DECISION TO APPROVE A 72 HOUR PERMIT FOR MARINE CORPS LEAGUE FOR THE PAHRUMP FALL FESTIVAL OCTOBER 5 THROUGH THE 7, 2007 AT PETRACK PARK IN PAHRUMP. NEVADA. MR. VIC RODRIQUEZ. Commissioner Eastley; 5 yeas. Commissioner Eastley commented that Assistant Sheriff Cody had pointed out to her that there were two 72-hour permits for the Fall Festival that were not submitted on time. She commented on the number of beer vendors at one event.

VIC RODRIQUEZ, - Cont'd Bob Irving, Chairman of the Fall Festival, stated that the committee had adopted a different way of conducting business for the beer gardens at the Festival this year. He reviewed the matter. Assistant Sheriff Cody stated that a liquor license was not necessary to sell beer at the Harvest Festival. 6C. DISCUSSION, DELIBERATION, AND POSSIBLE DECISION TO APPROVE A 72 HOUR PERMIT FOR BETA SIGMA PHI FOR A FUNDRAISER COSTUME PARTY ON OCTOBER 27, 2007 AT THE TONOPAH CONVENTION CENTER, TONOPAH, NEVADA. JO MARIE EASON, Commissioner Hollis made a motion to approve; seconded by Commissioner Eastley; 5 yeas 60. PAHRUMP VALLEY MUSEUM, Assistant Sheriff Cody stated that the Chairman of the Pahrump Fall Festival had informed her that the item was withdrawn. Commissioner Eastley reviewed her support for the applicant to formally withdraw their request.

GENERAL PUBLIC COMMENT There was no general public comment. 3. CONSENT AGENDA ITEMS A. DISCUSSION OF ANY ITEM FROM THE CONSENT AGENDA ITEMS THAT NEEDS REVIEW BEFORE A DECISION IS MADE. Commissioner Eastley made a motion to approve consent agenda items 3A through E. Assistant Sheriff Cody stated item D needed to be pulled because there had been a fire and they wanted to table their request and rebuild. Commissioner Eastley amended her motion to approve consent agenda items 3A through C and E; seconded by Commissioner Liakopoulos. Commissioner Borasky asked about item 3C and their pending health certifi.cate. Ms. Cody stated they still needed the health certificate.
