1 CITY COUNCIL MEETING MINUTES TUESDAY, MARCH 25, 2014 CALL TO ORDER 7:00 P.M. Mayor Gámez called the Regular Scheduled City Council Meeting to order at 7:00 P.M. INVOCATION/PLEDGE OF ALLEGIANCE Invocation delivered by Attorney Ruby, and Pledge of Allegiance led by Council Member Espinoza. ROLL CALL Present: Mayor Gámez, Vice Mayor Laborin, Council Members Erives, Espinoza, Mendoza and Rodriguez. Absent: Council Member Farr. Present: City Manager Medrano Jr., Assistant City Manager Lopez, Fire Chief Good, City Clerk Hagen, Division Fire Chief Hansen, Chief Financial Officer Prins, Police Chief Rodriguez, and City Attorney Ruby. FINAL CALL TO SUBMIT SPEAKER REQUEST FORMS All citizens and interested parties wishing to speak before the Council shall fully complete a Speaker Request Form and, if possible, submit the form(s) to the City Clerk, or designee prior to the meeting being convened; but in any case submissions should be made no later than the Presiding Officer announcing the Final Call to Submit Speaker Request Forms. Sufficient Speaker Request Forms are located in the lobby of the Council Chambers. All speakers will be limited to 3 minutes unless otherwise noted by the Mayor. CALL TO THE PUBLIC (NON-AGENDA ITEMS) None. SCHEDULED PUBLIC APPEARANCES 1. Fire Department: Presentation of FIDO Mask.

2 Page 2 of 7 Chief Good and Division Chief Hansen presented Firefighter Jason Roosevelt from Phoenix (and Tonopah) Fire Department(s) who presented the "FIDO" Mask that is becoming part of the equipment on many fire apparatus' in the Valley. The mask is reusable for primarily cats and dogs that require rescuing from fires. Chief Hansen reviewed the benefits of the training cd/dvd and stated that Tolleson's firefighters will be trained by the end of the week. Tolleson's first FIDO Mask will be housed on the ladder truck. Additional units will be purchased for Tolleson's fire trucks. BUSINESS FROM THE FLOOR - PUBLIC HEARINGS AND ACTION 1. Proclamation declaring April 1, 2014 as 'National Service Recognition Day' by Mayors of the United States of America to encourage residents to recognize the positive impact of national service in our City, to thank those who serve; and to find ways to give back to their communities. Mayor Gámez so proclaimed, and City Attorney Ruby read by title. 2. Proclamation declaring April 2014 as 'Fair Housing M Mayor Gámez so proclaimed, and City Attorney Ruby read by title. 3. Public Hearing Soliciting comments from interested parties in reference to an application for a Temporary Use Permit as submitted by the Hispanic Leadership Forum de Oeste, 4509 West Orangewood, Glendale, Arizona for scholarship fundraising through beer and wine sales at the Whoopee Daze community event at Tolleson Veterans Park, 8601 West Van Buren Street, Tolleson, Arizona The event will be held on Friday, April 4th from 6:00 P.M. to 11:59 P.M., Saturday, April 5th from 12:00 P.M. to 11:59 P.M., and Sunday, April 6th from 12:00 P.M. to 10:00 P.M. Public Hearing opened at 7:14 P.M. and closed at 7:18 P.M. President Larry Rodriguez of the Hispanic Leadership Forum de Oeste presented a historical overview of the Forum's fifteen year history of fundraising for primarily local high school scholarships (Agua Fria, Buckeye and Tolleson). On occasion, they have been approached for elementary school scholarships. Year-to-date they have raised approximately $400, Main events are an annual dinner/dance and a golf tournament, in addition to hosting the beer/wine cooler booth(s) at the Whoopee Daze Festival and Luces de Navidad. Whoopee Daze and Luces are "City of Tolleson" sponsored community events.

3 Page 3 of 7 At this time there are twelve active members in the organization. 4. Public Hearing Soliciting comments on Arizona Department of Liquor Licenses and Control license application # as submitted by Hector Garcia for Carniceria El Charro, 810 North 91 st Avenue, Tolleson, Arizona Public Hearing opened at 7:18 and closed at 7:21 P.M. Mr. Garcia is requesting a license for beer at the market where they have a selection of fresh meats and vegetables, as well as outdoor grilling. In addition, they also sell Thrifty ice cream. Council Member Rodriguez has ordered ahead for several of his family dinners and stated that their meats are very good. CONSENT AGENDA ACTION ITEMS a. Approve Minutes: Regular Scheduled of March 11, b. Approve Claims and Bills (claims and bills submitted for approval are all claims and bills incurred no later than 24 hours prior to the Council Meeting and may be reviewed at City Hall during regular business hours). c. Approve Resolution No of the Mayor and Council of the City of Tolleson, Arizona, amending the City of Tolleson Personnel Handbook, Chapter 11, Employee Performance and Conduct; adopting a Conflict of Interest, Solicitation, and Political Activity Policy; adopting a Fraud Policy; and providing for the inclusion of such policies in the City of Tolleson Personnel Handbook. d. Approve Resolution No of the Mayor and Council of the City of Tolleson, Arizona, authorizing the renewal of the Cooperation Agreement with Maricopa County for Community Development Block Grant and HOME Programs for the three year period of fiscal years through e. Approve Resolution No of the Mayor and Council of the City of Tolleson, Arizona, approving the Transit Services Amendment for Fiscal Year 2015 between the Regional Public Transportation Authority and the City of Tolleson relating to transportation services in the City. f. Approve Purchase Order #63961 not to exceed the amount of $7,085, which amends original Purchase Order #63942 (approved on December 10, 2013 in the amount of $7,061,00.00 and amended on January 14, 2014 to the amount of $7,149,367.12) for the 'Downtown Redevelopment' Project (GMP #2) payable to

4 Page 4 of 7 Valley Rain Construction Corporation, 1614 East Curry Road, Tempe, Arizona g. Approve Purchase Order #63962 payable to Salt River Project (SRP) for 'Downtown Redevelopment' in an amount not to exceed $64, This amount is for: - 92nd Drive 400 AMP 120/240V 1PH service $16, st Avenue to 96th Avenue ST/LT removal of $37, Street light conductor only and the new temporary service feed for the traffic signal at 94th Avenue and Van Buren AMP 120/240V 1 PH service for ST/LT $7, to feed City owned street lights AMP 120/240V 1PH service for ST/LTS $2, for the new feed to the new street light service The City of Tolleson contingency fund will be used for the above expenditures. h. Approve Resolution No of the Mayor and Council of the City of Tolleson, Arizona, approving a professional services agreement between the City of Tolleson and Total Events and More, L.L.C. related to security services for special events. Mayor Gámez has recently researched agendas of several other neighboring municipalities and has asked for clarifying language to be added at the start of the Consent Agenda from here on out. Motion made by Vice Mayor Laborin to approve Consent Agenda Items a. through h. and 2nd by Council Member Rodriguez. Council Member Erives requested that Consent Agenda Item c. be pulled for further clarification. Motion restated to approve Consent Agenda Items a. through h. excluding Consent Agenda Item c. by Vice Mayor Laborin and 2nd by Council Member Rodriguez. Motion carried 6-0. Consent Agenda Item c. discussion took place after approval of all other Consent Agenda Items. City Manager Medrano Jr. explained that Resolution No addresses the Personnel Handbook which is part of daily operations. The conflict of interest policy explains parameters that employees, as well as elected officials, must adhere to per Arizona Revised Statutes. It is also required for federal grants as well as some state and county applications. Chief Financial Officer Prins explained the importance of having a fraud policy as well and that it has been requested by Tolleson's auditors. The fraud hotline

5 Page 5 of 7 is being set up to further assist Tolleson employees to have a vehicle to report fraudulent activity and to ensure the highest quality of services for the citizens of the City. Motion made to approve Resolution No by Vice Mayor Laborin and 2nd by Council Member Rodriguez. Motion carried 6-0. REGULAR AGENDA ACTION ITEMS PROPOSED TO BE HEARD 1. Motion carried 6-0. Mayor and Council welcomed Mr. Garcia and his family to Tolleson. 3. Discuss, and if appropriate, ratify Ordinance 521 N.S. of the Council of the City of Tolleson, Arizona, amending the Tolleson City Code, Chapter 2, Administration, relating to vacancies in Council and the appointment and duties of city officers. After detailed discussion amongst Mayor, Council and City Attorney, motion was made to ratify Ordinance 521 N.S. by Vice Mayor Laborin and 2nd by Council Member Rodriguez. Motion carried 5-1. Council Member Erives voted nay. Council Member Erives would like a future work study scheduled to further discuss the details of Ordinance 521 N.S. CITY MANAGER S REPORT OF CURRENT EVENTS 1. Assistant City Manager: Current Events Update.

6 Page 6 of 7 Assistant Manager Lopez gave a summary of the events of the Whoopee Daze weekend, April 3-6, 2014 including entertainment and altered parade route due to the redevelopment of Van Buren Street. 2. City Manager: Dial A Ride (invoice). City Manager Medrano Jr. explained that the Dial A Ride annual invoice that Tolleson is billed for from City of Avondale came in at approximately twice as much as it has been in the past (this year was $40, and usually the invoice is between $17, and $21,000.00) due to the large serving area of the Tolleson zip code. A detailed invoice was requested by City Clerk Hagen and the 942 page report showed numerous Avondale and Phoenix requests for service. After several months of communications between Avondale, Phoenix, and Tolleson a new invoice has been submitted for payment. City Clerk Hagen stated that Marge Sydlowski volunteered to run the detail report and highlight all of the Avondale and Phoenix addresses that have an zip code. This saved Tolleson days of manually reviewing each page to identify requests for service that were not from Tolleson residents. Mayor and Council applauded Marge's efforts.
