CSHBi POINT OF ORDER Representative Stickland raised a point of order against further consideration of CSHBi2335 under Rulei4, Sectioni18(b) of the House Rules on the grounds that the committee minutes are incomplete. The speaker overruled the point of order and submitted the following statement: Amanda Herron came to the Capitol to testify on HBi2335. While physically present in the Capitol Complex, she certified under oath that she personally filled out a witness affirmation form. Under House Rules and adopted policies, and under normal conditions (the absence of a situation when the electronic witness affirmation system was unavailable), Ms. Herron s form complied with all house requirements, including being made while present in the Capitol Complex, appropriately using the Electronic Witness Affirmation Form, and personally affixing her digital signature to the required oath under the penalty of perjury.

15 Thursday, April 20, 2017 HOUSE JOURNAL 54th Day 1725 Like many Texans who fill out a computer form, Ms. Herron made an error. On the first card she submitted, she spelled her last name "Herrom." She also noted on that card that she did not intend to testify. For whatever reason, she submitted a second card that was an exact duplicate of the first card except that on the second card, she apparently correctly spelled her name "Herron," and noted her intent to testify on HBi2335. At some point after submitting the cards, Ms. Herron did, in fact, testify for the bill the same position noted on both her witness affirmation cards and correctly on the witness list under Rule 4, Sectioni18 of the House Rules. Representative Stickland raised a point of order against further consideration of HBi2335 pursuant to Rule 4, Section 18(b), of the House Rules on the grounds that the witness list is inaccurate. Specifically, he alleges that Ms. Herron s card (the first one) indicated that she did not intend to testify, when she in fact did. The notation on a form of the witness s initial intent to testify (or not testify) does not limit the courses of action open to a witness who has changed her mind (or of a chair to call up a witness who is at the back of a committee room who did not anticipate testifying). See 83 H.J. Reg (2013) (Walle point of order on CSHBi148) and 78 H.J. Reg (2003) (Y. Davis point of order on CSHBi262). Further, Representative Stickland argues that Ms. Herron s typographical error in the spelling of her own last name means that the witness list notation of both of the Amanda Herron cards (each of which carried the same unique identifying information) was in error, since only one Amanda Herron testified. In short, Representative Stickland contends that a person who has two witness cards, one with the last name spelled correctly and another with the typographical error, can only be reflected in the witness list one time. Representative Stickland expressed no opinion of how to resolve the other card. This argument is also incorrect. The purpose of Rule 4, Section 18(b), is to provide information to the public regarding the witnesses who submitted a sworn statement of a position on a bill but who were not recognized by the chair to address the committee. Here, both of Amanda Herron s entries are consistent in reflecting that she was in favor of the bill, thereby satisfying the purpose of Rule 4, Section 18(b). The duplicate entry into the Witness Affirmation Report did not deceive or mislead; instead, the entries accounted for each witness affirmation form submitted and in fact presented an accurate statement of the witness s testimony (typographical error and all). It should be noted that points of order are not sustained on mere typographical errors. See 78 H.J. Reg (2003) (Canales point of order on HBi3185); 78 H.J. Reg (2003) (Thompson point of order on CSSBi1370). Finally, Representative Stickland notes that "video of the proceeding also confirms that no witness named Amanda Herrom was ever recognized to testify on the bill." The chair continues to "follow precedents of the house in

16 th LEGISLATURE REGULAR SESSION consistently declining to use electronic recordings as a basis of a point of order, deferring instead to the printed records of the house. " See 84 H.J. Reg (2015) (Stickland point of order on CSHBi22 quoting 82 H.J. Reg (2011) (Y. Davis point of order on CSSBi18)). The point of order is respectfully overruled. Amendment No.i5 Representative Frank offered the following amendment to CSHBi2335: Amend CSHBi2335 (house committee printing) as follows: (1)iiOn page 5, line 2, after "employee" insert "who provides direct delivery of services to children and families". CSHB 89, A bill to be entitled An Act relating to state contracts with and investments in companies that boycott Israel. (Speaker in the chair) CSHB 89 - STATEMENT OF LEGISLATIVE INTENT REPRESENTATIVE WU: May we start with, on page 2, your definitions? And thank you for having very extensive definitions in this bill. On pagei2, linei5, what does the word "deal" how would you define that? It says, " Boycott Israel means refusing to deal with." REPRESENTATIVE P. KING: Well, I think it s expanded on in the rest of the statement: "to deal with, terminating business activities with, or otherwise taking any action that is intended to penalize, inflict economic harm on, or limit commercial relations specifically with Israel, or with a person or entity doing business in Israel." I think "deal" is the common terminology for a commercial transaction. WU: So based on your answer, is it fair to say that "deal" solely relates to economic relationships? P. KING: Absolutely. WU: Nothing outside purely economical relationships? P. KING: Purely economic commercial transactions. WU: On page 2, line 7, it says, "inflict economic harm." Could you elaborate more on what that terms means as a whole? P. KING: I guess you would just have to take it as the common Webster s dictionary definition of "inflict." And "economic harm" would be obviously to do damage to Israel in its economy. They re an interesting nation. They have no natural resources, so everything they have to use they have to buy and bring in. And that s why they export so much in technology again, because they have no natural resources of measure. They will tell you that they consider the economic warfare being waged by some around the world against Israel as large a threat to them as nuclear war again, because they are such a small economy. WU: Absolutely, I understand. And based on your answer, would it be fair to say that "economic harm" includes more than just money? P. KING: I think it includes anything that damages their ability to conduct business in world trade.

23 Thursday, April 20, 2017 HOUSE JOURNAL 54th Day 1733 WU: That s by itself a very, very broad statement. P. KING: We tried to use very specific terms. I think "inflict" is a well-defined term, and "economic harm" keeps it within that commercial idea. WU: On page 2, line 8, you also mention "limit commercial relations." Could you elaborate more on what that means, because there are many types of relationships some that involve money, some that don t involve money that businesses can conduct. Do you envision your bill solely talking about relationships that involve a monetary transaction? P. KING: The intent of the bill, speaking a little more broadly, is to prohibit someone trying to cause economic harm to the nation of Israel or to the Jews or anyone within the nation of Israel by boycotting, by not doing business with them, by punishing others who do business with them. Commercial transaction it is only about economic financial commercial transactions, not about anything else. WU: On page 2, lines 9 and 10, you state that all these people doing this stuff in relation to both Israel and "Israeli-controlled territory." Is that correct? P. KING: That s correct. WU: And in your definition and you added this, actually, probably, I think, for me, would that be fair? P. KING: Could be, maybe. No, I think it was already in there. WU: And in this bill the definition of "Israeli-controlled territory" means that the Israeli government has control of it? P. KING: Yes, it would be commonly called the West Bank or WU: And it s not anything in relation to whether or not Israel has a legal right to it? P. KING: No, and in fact, we have worked very hard to keep this from having anything to do with the two-state or one-state solution. We think that s a decision for others to make. This is simply about economic impact, and SodaStream is a great example. A good example is so many of these jobs have been lost in the Palestinian side, and frankly, the sad thing about all the economic boycotting is it really hurts the Palestinians so much more than it hurts the Jewish population, because they need the jobs the most. WU: And just to clarify I think I understand your answer but just to clarify if a territory is disputed and is not recognized by any other nation or not recognized by the United Nations as being legally belonging to Israel, that would still be included? P. KING: Yes, anything that is within what we would commonly call Israel today, and that includes the West Bank areas. WU: Including territories that Israel had previously promised not to go into those would still be included as well? I mean, that s the clear reading of the language.

24 th LEGISLATURE REGULAR SESSION P. KING: I would just say that anything that is under the leadership of Israel or control of Israel today. WU: On page 2, Subsection 2, in your definition of "company," does that include and I know from the plain language of it that it does not, but I just want to see in your legislative intent does this include the CEO of a company? P. KING: No, it doesn t prohibit any individual from taking any action. WU: And it does not include the board of directors? P. KING: No, it simply includes the corporate structure or the business entity itself. So if a board of director personally wanted to invest in companies that boycott Israel with their personal funds or if they wanted to boycott doing business, that s their First Amendment right in the United States. It simply applies to the corporate structure, the business entity itself. WU: And if I may move you to page 5, Subchapter B, starting on linei22. This legislation would actually create a blacklist of companies who have vocalized that they are boycotting Israel, is that correct? P. KING: That s correct. The comptroller would create it. Actually, they ll contract for that. There s some private companies that do that at a remarkably low price and that are already available today, much like we do for Sudan and for the Iran list. WU: This list is actually there is no provision for this list to ever expire. So this list goes on in perpetuity, correct? P. KING: Well, no, it s an annual. A new list is required annually. WU: Your legislation would require that a company would actually need to be removed from the list, correct? P. KING: Well, what would happen is, there s direct and indirect investments. Whether it is direct or indirect, if the company is on the list if it was whatever retirement system, ERS, let s say that then they are required to notify that company that you ve appeared on this list and to give them time to cure if it s a direct. If after that time to cure they do not, then the retirement fund is given a very substantial period of time I think it s six months to begin that divestment. WU: And if I understand your answer correctly P. KING: Let me finish this. Indirect investments, such as with an ETF or a mutual fund, those are not required to be divested. But the ETF or the mutual is required to be notified and asked to take action with regard to that investment. WU: And if I may sum up, your answer is, if a company wants to be removed from the list, they actually have to take a positive action to be removed from the list. P. KING: That s right, and then they are removed immediately. WU: And they actually have to make a statement that they are no longer
