MAJOR STATE CALENDAR SENATE BILLS SECOND READING The following bills were laid before the house and read second time: SB 23 ON SECOND READING (Kolkhorst, Moody, Carter, and P. King - House Sponsors) SB 23, A bill to be entitled An Act relating to the punishment for a capital felony committed by an individual younger than 18 years of age. (Gooden in the chair) Amendment No. 1 Representatives Schaefer, Carter, Hughes, Moody, and Toth offered the following amendment to SBi23: Amend SBi23 (house committee report) as follows: (1)iiOn page 1, strike lines and substitute the following: "imprisonment in the Texas Department of Criminal Justice [for]: (1)iifor life, if the individual committed the offense when younger than 17 years of age [individual s case was transferred to the court under Section 54.02, Family Code]; (2)ii_ for life or for life without parole, if the individual committed the offense when 17 years of age; or (3)iifor [(2)]iilife without parole, if the individual committed the offense when 18 years of age or older." 7 Friday, June 21, 2013 HOUSE JOURNAL 4th Day 1049 (2)iia sentence of either life imprisonment or life imprisonment without parole is mandatory on conviction of the capitol felony, if the individual committed the offense when 17 years of age; or" (3)iiOn page 2, line 6, strike "(2)" and substitute "(3) [(2)]".ii (4)iiStrike SECTION 2 of the bill (page 2, lines 9-15), substitute the following appropriately numbered SECTIONS, and renumber subsequent SECTIONS of the bill accordingly.: SECTIONi.iiSection 1, Article , Code of Criminal Procedure, is amended to read as follows: Sec.i1.ii(a) If a defendant is found guilty in a capital felony case in which the state does not seek the death penalty, the [judge shall sentence the] defendant shall be sentenced to imprisonment for life or for life [imprisonment] without parole as described by this section and by Section 12.31, Penal Code. (b)iithe judge shall impose a sentence of imprisonment in the Texas Department of Criminal Justice for life without parole with respect to a defendant who was 18 years of age or older at the time the capital felony was committed. (c)iithe judge shall impose a sentence of imprisonment in the Texas Department of Criminal Justice for life with respect to a defendant who was younger than 17 years of age at the time the capital felony was committed. (d)(1)iithe judge or jury shall impose a sentence of imprisonment in the Texas Department of Criminal Justice for life or for life without parole with respect to a defendant who was 17 years of age at the time the capital felony was committed. (2)iiIn determining the appropriate sentence under this subsection, the court shall consider any mitigating factors that may have contributed to the commission of the offense. (3)iiIf the punishment is to be assessed by the jury rather than the judge, the judge shall charge the jury in writing as follows: "Under the law applicable in this case, it is possible that any sentence of life imprisonment might be reduced by the award of parole. However, the defendant will not become eligible for parole until the actual time served equals 40 years, without consideration of good conduct time, and the eligibility for parole does not guarantee that parole will be granted. "It cannot accurately be predicted how the parole law might be applied to this defendant if the defendant is sentenced to life imprisonment, because the application of these laws will depend on decisions made by prison and parole authorities. "You may consider the existence of the parole law. However, you are not to consider the manner in which the parole law may be applied to this particular defendant." (4)iiSubdivision (3) does not permit the introduction of evidence on the operation of parole laws. SECTIONi.iiSection (b), Government Code, is amended to read as follows: (b)iian inmate serving a life sentence under Section 12.31(a)(1) or (2), Penal Code, for a capital felony is not eligible for release on parole until the actual calendar time the inmate has served, without consideration of good conduct time, equals 40 calendar years.

8 rd LEGISLATURE FIRST CALLED SESSION Amendment No. 2 Representative Moody offered the following amendment to Amendment No.i1: Amend Amendment No. 1 by Schaefer to SBi23 as follows: (1)iiOn page 1, line 18, strike "capitol felony" and substitute "capital felony". (2)iiOn page 2, immediately following the underlined period at the end of line 15, insert the following: Notwithstanding the exception language provided by Section 2(b), Article 37.07, the determination of who will assess punishment under this subsection is governed by Section 2(b), Article (3)iiOn page 2, strike lines and substitute the following: (2)iiEvidence may be offered by the state and the defendant as to any matter that the court considers relevant to the sentence, as governed by Section 3, Article 37.07, including evidence of the defendant s background or character and evidence of the circumstances of the offense. In determining the appropriate sentence, the judge or jury shall consider any relevant mitigating evidence, including the defendant s age. (4)iiOn page 2, strike lines 22 and 23 and substitute the following: "Under the law applicable in this case, a defendant sentenced to imprisonment for life without parole is ineligible for release on parole from the Texas Department of Criminal Justice. "It is possible that any other sentence of imprisonment for life might be reduced by the (5)iiOn page 2, line 31, strike "these laws" and substitute "this law". Amendment No. 2 was adopted. Amendment No. 1 - Point of Order Representative Dutton raised a point of order against further consideration of Amendment No.i1 under ArticleiIII, Sectioni40 of the Texas Constitution on the grounds that the subject is not designated in the proclamation by the governor. The chair overruled the point of order and submitted the following statement: Representative Dutton raised a point of order against further consideration of Amendment No.i1, as amended by Amendment No.i2, to SBi23 asserting that it violates ArticleiIII, Sectioni40 of the Texas Constitution because it is outside the scope of the governor s call. The point of order is respectfully overruled. The call adds "legislation relating to establishing a mandatory sentence of life with parole for a capital felony committed by a 17-year-old offender." Currently, Texas law provides that 17-year-olds who commit a capital felony may be sentenced to the death penalty or to life without parole. SBi23 provides that 17-year-olds who commit a capital felony will receive a sentence of life with the possibility of parole. The amendment at issue retains the existing sentence of life without parole as an option for punishing these offenders in addition to SBi23 s new option of life with parole. Because the amendment relates to establishing a mandatory sentence of life without parole for 17-year-olds who commit a capital felony, it does not violate ArticleiIII, Sectioni40 of the Texas Constitution. SB 23 - (consideration continued) Amendment No. 1, as amended, was adopted. Amendment No. 3 Representative Dutton offered the following amendment to SBi23: Amend SBi23 (house committee report) as follows: (1)iiAdd the following appropriately numbered SECTION to the bill and renumber subsequent SECTIONS of the bill accordingly: SECTIONi.iiSection 7.02, Penal Code, is amended by amending Subsection (b) and adding Subsection (c) to read as follows: (b)iiexcept as provided by Subsection (c), if [If,] in the attempt to carry out a conspiracy to commit one felony[,] another felony is committed by one of the conspirators, all conspirators are guilty of the felony actually committed, though having no intent to commit it, provided that [if] the offense was committed in furtherance of the unlawful purpose and was one that should have been anticipated as a result of the carrying out of the conspiracy. (c)iinotwithstanding any other law, an individual may not be charged with a capital felony under Subsection (b) if the individual is younger than 18 years of age at the time the capital felony is committed by one of the conspirators. (2)iiOn page 2, line 16, strike "The change" and substitute "(a) Except as provided by Subsection (b) of this section, the change". (3)iiOn page 2, between lines 22 and 23, insert the following: (b)iithe change in law made by this Act in amending Section 7.02, Penal Code, applies only to an offense committed on or after the effective date of this Act. An offense committed before the effective date of this Act is covered by the law in effect when the offense was committed, and the former law is continued in effect for that purpose. For purposes of this subsection, an offense was committed before the effective date of this Act if any element of the offense occurred before that date. Amendment No. 3 - Point of Order Representative Moody raised a point of order against further consideration of Amendment No. 3 under Rule 11, Section 2 of the House Rules on the grounds that the amendment is not germane to the bill. The chair overruled the point of order and submitted the following statement: Representative Moody raised a point of order against further consideration of Amendment No.i3 to SBi23 under Rulei11, Sectioni2 of the House Rules. The point of order is respectfully overruled. SBi23 provided for the option of a sentence of life with parole for offenders under the age of 18 who are convicted of a capital felony. Amendment No.i3 would have made SBi23 s sentencing provisions inapplicable to certain persons under 18 by prohibiting them from being charged with a capital felony if the

Because the amendment relates to the punishments applicable to juveniles who commit a capital felony, it was germane to SBi23. Representative Kolkhorst moved to table Amendment No. 3. The motion to table prevailed.
