2 th LEGISLATURE REGULAR SESSION HB 1 - COMMITTEE ON CALENDARS RULE Pursuant to House Rule 3, Section 5(2), and House Rule 6, Section 16(f), Representative Woolley moved to adopt the following rule governing floor consideration for HB 1: Section 1. All original amendments that will be offered during second reading consideration of the bill must be filed with the chief clerk by 8 p.m. on Monday, March 26, Section 2. (a) During second reading and third reading consideration of the bill, any amendment that adds or increases an item of appropriation in ArticlesiI-X is not in order unless the amendment contains an equal or greater reduction in one or more other items of appropriation in one of those articles from the fund or funds against which the appropriation is to be certified. (b) The provisions of this section do not apply to an amendment that makes an adjustment in an item of appropriation solely to correct a technical clerical error. REMARKS REPRESENTATIVE EILAND: Ms. Woolley, he cleared it up, but I want to make very clear on the mic what this says, because that was not the way I read it. The amendment is not in order unless it contains an equal or greater reduction in one or more other items of appropriation. And so, what the intent is, in one or more of those articles REPRESENTATIVE WOOLLEY: It could be in one of those articles. EILAND: So for example WOOLLEY: That is the intent. EILAND: If I want to cut general government, for example, in that article, and move that money over to TYC in a different article, as long as the money is the same, that s okay? 3 Thursday, March 22, 2007 HOUSE JOURNAL 42nd Day 1115 MARTINEZ FISCHER: And so would the chair tell me that if a floor substitute to HB 1 was brought, if we adopt this calendar rule, what is the true effect on the entire bill as it relates to revenue neutrality? CHAIR: Mr. Fischer, the calendar rule will apply to the general appropriations bill and all amendments to the general appropriations bill. MARTINEZ FISCHER: I m sorry, could you clarify? I didn t hear you. CHAIR: The calendar rule will apply to the general appropriations bill and to all amendments that are to the general appropriations bill. MARTINEZ FISCHER: So, Mr. Speaker, to clarify, if there was a floor substitute that spent exactly the same amount of money as HB 1, that substitute would be in order? CHAIR: It would be in order. We would certainly have to review the house substitute to be sure that in fact it was within the same boundaries of the original house bill, but it would apply. MARTINEZ FISCHER: Mr. Speaker, how long would that review take? CHAIR: Not understanding in terms of hypotheticals, we would just have to see what was brought forward.
