The invocation was offered by Grady Dollar, Jr., pastor, Golden Bible Chapel, Golden, as follows: Our gracious Father God, creator of heaven and earth, we want to pause this Memorial Day to thank you for our beloved country. Thank you for all of those who have served and made great sacrifices. Many have lost their lives, others their health, but all were willing to serve so we could have the freedom and liberty we have today. Thank you for the great State of Texas, our governor, the Honorable Rick Perry, the senate, and the house of representatives. I pray that you would bless them and grant them wisdom from above, wisdom that is pure, peaceable, gentle, and full of mercy. Thank you for their willingness to give of their time and services that we may continue to enjoy our freedom as Americans.

2 th LEGISLATURE REGULAR SESSION Our Father, we know that no one is truly free until one comes to know your precious son, Jesus Christ, that one who died on Calvary s cross for our sins and gave his life that we might have life eternal. It is for all those who receive him as their lord and savior. We read in your Holy Word, "If the son therefore shall make you free, you shall be free indeed." How wonderful it is to be free from the guilt of sin, free from the penalty of sin, and free from the condemnation of sin! "For there is therefore now no condemnation to those who are in Christ Jesus." Thank you Father for that great sacrifice, that we may know redemption through his shed blood. In the most holy name, the name to whom every knee will bow, the king of kings and lord of lords, Jesus Christ. Amen. HB 7 - PRINTING RULE SUSPENDED Representative Hamric moved to suspend all necessary rules in order to not print the text of the conference committee report on HB 7 in the House Journal.

The following resolution was laid before the house: HR 2308, Honoring Steve Rice on being named Teacher of the Year for 2005 by the Eagle Academy of Tyler and the Tyler Rotary Club. HR 2308 was adopted. HCR ADOPTED (by Escobar) The following privileged resolution was laid before the house: HCR 230 WHEREAS, HB 3152 has been adopted by the house of representatives and the senate; and WHEREAS, HB 3152 contains technical errors that should be corrected; now, therefore, be it RESOLVED by the 79th Legislature of the State of Texas, That the enrolling clerk of the house of representatives be instructed to correct HB 3152 as follows: (1) In amended Subsection (g), Article 1.051, Code of Criminal Procedure, immediately before the colon, strike "proceedings" and substitute "the proceedings". (2) In amended Subsection (g), Article 1.051, Code of Criminal Procedure, in the third complete sentence of the blocked text, between "counsel" and "if", insert "appointed for me free of charge". HCRi230 was adopted. HCR ADOPTED (by Smithee) The following privileged resolution was laid before the house: HCR 234 WHEREAS, HB 2157 has been adopted by the house of representatives and the senate; and WHEREAS, HB 2157 contains a technical error that should be corrected; now, therefore, be it RESOLVED by the 79th Legislature of the State of Texas, That the enrolling clerk of the house of representatives be instructed to correct HB 2157, in added Subsection (g), Section 21A.301, Insurance Code, in the last sentence of that subsection, by striking "Subsection (j)" and substituting "Subsection (i)". The change in law made by this Act to Chapters 104 and 191, Health and Safety Code, applies only to the furnishing of data under Chapters 104 and 191, Health and Safety Code, or a rule adopted under those chapters that is originally required to be furnished on or after the effective date of this Act. The furnishing of data originally required to be furnished before the effective date of this Act is governed by the law as it existed immediately before that date, and that law is continued in effect for that purpose. (a) The department shall include in a draft or final environmental impact statement prepared as part of the environmental review of a Trans-Texas Corridor project information detailing: (1) the reasons for the immediate and future needs of the project; (2) the reasonableness of and necessity for the project; and (3) after a segment of the project has advanced: (A) the reasons for the immediate and future needs for each mode of transportation in that segment of the project; and (B) the reasonableness and necessity for each mode of transportation in that segment of the project. Last night at the Purple Party where blue and red come together I was considering this experience. In some ways it is like Cinderella: the coach turns into a pumpkin, the horses into mice. I also realize that these feelings are true for all of us; it is how everyone feels, not just me. I am going to miss this.

16 th LEGISLATURE REGULAR SESSION One of the things folks ask me is if I have a new perspective on session. I am going to let you in on a little secret, your spouses know how this works. I had a sense of the rhythm and the rhyme, the schedule and the stress. What I didn t realize is how many friends I would make how many of you I would enjoy so much despite differences in party or beliefs, differences in background and district. My coaches in the corner, Bob Griggs and John Smithee; my chairmen, Frank Corte and Jerry Madden. The wordsmith, Rob Eissler. My cheerleaders, Delwin Jones and Terri Hodge, and all the folks in the Tuesday prayer group, especially Bob Hunter who is everyone s selection for most cheerful; my resources and consultants, Pete Gallego, Lon Burnam, and Scott Hochberg. My caucus and study groups chairs, Jim Dunnam and Garnet Coleman. The snake killers, Carter and Fred, and fellow horsewoman Debbie. Most of all, my deskmate John Davis, a dear friend to my husband and now a dear friend to me. This morning on NPR there was a story about a soldier from the Korean War who has gone back four times to Korea trying to find the body of his friend lost in that engagement. Comrades who fight together are truly joined in a different kind of relationship. Earlier in the session, one of you Dan Gattis talked about dying on a hill for a belief. My husband is the sort that understands that, now more than ever. He was a warrior born, and he is living and working with comrades with whom he would take a stand on a hill. The thing that I didn t know is that I would feel that was about all of you when each of us gathers up the reins of our lives and returns to our homes, we are still comrades. Thank you to each and every one of you, for your coaching and patience and the service that you give to this great state and to your communities all across it. Section , Tax Code, is amended by adding Subsection (c-1) to read as follows: (c-1) A license holder may take a credit on a return for the period in which the purchase occurred, and a person who does not hold a license may file a refund claim with the comptroller, if the license holder or person paid tax on diesel fuel and the diesel fuel is used in this state: (1) as a feedstock or other component in the further manufacturing of tangible personal property for resale not as a motor fuel; or (2) in the original production of oil or gas or to increase the production of oil or gas. STATEMENT OF LEGISLATIVE INTENT This session there has been a lot of thought given to the topic of renewable energy. And while we were unable to finalize a bill before time expired, increased usage of wind, solar, and biomass energy is clearly supported by both chambers as well as the people of Texas. We encourage the Public Utility Commission of Texas, ERCOT, and other regional transmission organizations to use their existing authority to the fullest extent to enable increased usage of renewable energy in the state. The most immediate need is expansion of transmission to serve wind generation capacity that is existing or under construction in West Texas. Secondly, the PUC needs to develop a process to identify the areas across Texas that are most promising for additional renewable energy development competitive renewable energy zones and start long term planning for the transmission to support new power plants in those zones. One lesson we have learned from looking into the renewable energy issue is that we need better technical information to make the best policy decision for Texas. Before the 80th Legislature convenes, we need the appropriate state agencies and organizations to examine the cost and benefits of renewable energy and conduct the necessary studies to ensure that Texas will have enough power plants and transmission lines to meet the future needs of the state.
