1 WASHINGTON CITY COUNCIL MINUTES Regular Meeting June 5, Call to order by Mayor. Mayor Ryan Kern called the meeting to order at 6:30 p.m. 2. Roll Call. Citizens Comments. No comment. 4. Minutes. Motion to approve the minutes of the regular meeting held May 1, 2017 and special meeting minutes of May 26, 2017 by Schottel and seconded by Herrs. 5. Appropriations Ordinance Motion to approve appropriations ordinance by Schottel and seconded by Bryant. 6. Washington County Commissioners Request. Commissioner Tim Mueller was present to discuss the B Street project. Mueller stated he talked with his fellow commissioners and they have agreed to pay for 24 feet of road surface plus half the difference of remaining road surface on the B Street Project however they would only maintain 24 feet after initial completion. Mueller said the County planned to write a resolution about what costs it would be willing to pay to county cities for connecting link road upgrade and maintenance. Council Member said the City would have to crunch some numbers. The City had taken B Street improvements out of its budget two years ago and used those funds for other things. Page 1 of 5

2 Both Mueller and Council agreed to have CES Group, Marysville, update the engineering specifications for B Street to assist with budgeting the project. 7. Washington County Livestock Future. Rod Stewart, representing Sunflower Sales LLC, has entered into a contract to purchase Washington County Livestock. Rod Stewart, Ryan Stewart and Ethan Schuette were present to discuss the lease previously held by Washington County Livestock. The lease agreement terminates upon new ownership. Rod Stewart asked the Council if they would enter into a lease with Sunflower as previously held by Washington County Livestock. According to Schuette and the Stewarts, Sunflower, would like to utilize the facility to use for livestock, consignment and equipment sales and also explore other avenues to utilize the facility. The consensus of the Council was to have City Attorney Elizabeth Hiltgen draft a lease. The lease will be reviewed and considered at the July council meeting. 8. Voltage Conversion Agreement. Mike Schmaderer, Mid-States Energy Works, Inc., visited with the Council about the electric voltage conversion project. Schmaderer stated he wanted to walk the next two lines of the projects with the city and contractor. He stated he is working on the staking sheets and planned to have the contractor numbers and material estimates for the July council meeting. Schmaderer stated he would bid each line separately. City Administrator Carl Chalfant said City employees plan to put in some of the single phase poles to save cost. 9. Pool Employees. Motion to hire lifeguards Kylie Mintzmyer, $7.50; Scott Romeiser, $7.50; Katie Rundle, $7.50; Holly Delay, $7.65; Zachary Zarbynicky, $7.25; and Erin Holtmeier, $8.00 for the 2017 pool season by Herrs and seconded by Bryant. 10. Pool. Motion to allow the swimming pool to host free swim from 1-5 p.m. July 4, 2017 by Schottel and seconded by Imhoff. 11. Rabies Clinic. Dr. Phil Bentz, Animal Health Clinic, asked the Council to clarify its intent for rabies vaccinations offered at the annual clinic where pet registrations are also sold. City Clerk Denise Powell stated the city s pet registration has an annual renewal for license and tag. Bentz asked the Council to address the ordinance to reflect how it wanted the rabies clinic managed and whether a multi-year vaccination would be offered. Bentz said vaccinations at the annual clinic have declined do to two year vaccinations be given in some years. Bentz also asked if the Council would allow Animal Health to do the rabies clinic in Staff feels like the City should state the only vaccination to be given at the clinic is a one year so it remains fair to both local veterinarians. This would also allow residents to obtain the annual animal license which are only sold annually and not on a two year basis. If a two year vaccination Page 2 of 5

3 were allowed than the City needs to look at two years licenses and tags. Also discussed sitting down with a representative from both clinics to set pricing of vaccinations at the clinic. City Council Member stated that the City cannot restrict how either clinic does business but the City can regulate how the clinic is regulated. 12. Water Tower Drain Valve. Motion to approve the purchase and installation of a drain valve assembly in the bottom bowl of the Water Tower not to exceed $2, by Bryant and seconded by Imhoff. Vote: Ayes: Melanie Bryant 13. Power Plant Maintenance Plan. Motion to adopt and authorize the Mayor to sign the Power Plant Maintenance Plan as presented by Imhoff and seconded by Schottel. 14. Fair Board Request. Motion to approve the Loudspeaker/Sound Amplifier and Street Use permit for Washington County Fair board parade on July 21 & 22, 2017, by Bryant and seconded by Imhoff. Council took no action on a request for exemption of Special Purpose Vehicle Registration for all golf carts, ATV s and UTV s involved in the parade on July 21, 2017 and July 22, Bank Authorization. Motion to remove Colleen Hillyer, former city treasurer/utility billing clerk, on all City of Washington bank accounts by Schottel and seconded by Imhoff. 16. Executive Session. Motion to enter into executive session to discuss nonelected personnel for a period of 10 minutes at 7:24 p.m. to include the Mayor, Council, City Administrator, and EMS Director Leland Cook by Bryant and seconded by Imhoff. Motion to return to open session at 7:34 p.m. by Schottel and seconded by Bryant Page 3 of 5

4 17. City Attorney Report. a) Unsafe Structures. Chapter 6. Section , Structures Damage by Fire, Explosion or Wind Storm. If there is loss of 75% of the face value of the policy covering the structure the insurance company sends the City 15% of the covered claim. 18. City Administrator Report. a) Code Violation Complaint. Property owner at 124 East College delivered proof of current vehicle registrations on May 1, 2017 to close out code violations at this address. Mowing notices were sent out the week of May 22, 2017, and follow up is in progress. b) FEMA Street Work. Staff has been working on laying rock on the identified roads for the 2015 FEMA Project extension. Staff stopped work on the project due to rain and to accommodate time for work at cemetery, street cleaning and patching, and ball field work. Work on the project will resume the first week in June. Staff also has some ditch work yet to complete as identified in the Project. c) LMI Survey Proposal. Staff recently heard from CES and they are working on the preliminary process of the LMI survey for the City of Washington. They have requested Staff to review a property owner spread sheet to assist with eliminating duplications. CES was informed that Staff will review as time allows. d) Building Codes. Staff has been working on the codes, trying to determine fee schedule to be added to each ordinance. Staff is working on a fee schedule for a permit process. Staff has not had time research this at this time. e) Leon Rumsey Issue. Leon Rumsey requested assistance from the City for a rock retaining wall along the east side of his residence. Rumsey stated that water coming across his yard from B Street caused it to fail. He stated his insurance does not cover that. Staff asked him to fill out a claim form and it would be sent to the City s Insurance for review. Rumsey has not returned the claim form. f) Water Wells, Boston s. Staff member Dennis Stigge reported that numerous bee hives and the start of a fence had been placed on the Water Well Property, which the City Leases from Robert and Marvel Boston. Marvin Heck was also in to voice his displeasure as the City subleased the hay to him. City Administrator has made several attempts to contact Mr. Boston by phone and has left messages, but has yet to make contact. Further action will have to be taken as per the City s lease of the 6 +/- acres surrounding the wells is to ensure that the area is kept and maintained per KDHE and EPA s water safety regulations surrounding public water supplies. Staff asked City Attorney Elizabeth Hiltgen to draft a letter to the Boston s. Council also discussed the purchase of the property. g) Water Tower Maintenance. Water tower maintenance is complete. Antennas and wiring have been removed. The brackets were left. 19. City Clerk Report. a) EMT. Caroline Scoville will begin employment as a fulltime EMT on June 27, Page 4 of 5

5 b) AT&T Phone Service. City Clerk Denise Powell received the bill June 5 th for turning the pool phone which was $ Powell contacted AT&T who suggested going to a mobile home phone solution account. The representative stated the adapter would be free and cost would be $20 per month. There would also be no charge for connecting and disconnecting the service in spring and fall. Consensus of the Council was at this time to go to mobile home phone solution account. c) Washington County Senior Citizens, Inc. Washington County Senior Citizens Services, Inc. income and expense report for April was given to the Council for review. d) Fire Minutes. June fire minutes were given to the Council for review. 20. Council Reports.. a) LKM Conference Public Service Awards. Imhoff reminded staff to contact the League of Kansas Municipalities in reference to the retirement of City Treasurer/Utility Billing Clerk Colleen Hillyer recognizing her for 40 years of service. Ryan Kern. a) BJ Smart. Kern stated BJ Smart, Rotary, told him they are still working on the design to install nonprofit organization signs near the Welcome to Washington signs. When complete it will be brought to the Council for approval.. a) Cemetery. Herrs said the cemetery looked very nice Memorial weekend. Motion to adjourn by Herrs and seconded by Bryant.
